Summary

Overpayment in a joint title, usage fee, superior benefit and dissolution of co-ownership; separate routes of action connected with property division.

In a jointly titled home, each spouse has an ownership share. Even so, the title share, the financing contribution, benefiting from the home and ending the co-ownership are separate matters. Resolving one does not automatically resolve all the others.

The Position of the Spouse Who Overpaid

If one spouse also financed the other’s share, the nature of the payment as a gift, a loan or a property regime contribution is investigated. The price of one’s own share is not entered a second time as a claim. Just as a half-and-half title does not prevent every additional claim, an overpayment does not by itself change the title ratio. [1]

If Only One Spouse Uses the Home

The usage agreement, an interim court decision, the status of the family residence and the other spouse’s request to benefit should be examined. As to the usage fee, the condition of prevention of use (intifadan men) and its exceptions matter according to the specific case. It cannot be accepted that the spouse living in the joint home incurs rent as a debt automatically every month. The period requested and the benefit deprived of should be explained.

How Is the Co-Ownership Ended?

A sale by agreement or a transfer of shares is possible; if no agreement can be reached, the route of dissolution of co-ownership may be considered. In disputes concerning the division of movables and immovables and the dissolution of co-ownership, the regulation on mediation as a condition precedent to litigation is also taken into account separately. This condition does not mean that the same requirement exists in every action for a property regime claim. [3]

Can One Spouse Request the Whole Home?

Under Article 226 of the Turkish Civil Code, superior benefit and payment of the price of the other share may be asserted; in the event of death, different provisions on allocation (özgüleme) may be investigated. A child living in the home or a spouse wanting the home does not by itself fulfill all the conditions. The legal basis of the request and the price calculation must be clear.

How Are Multiple Actions Assessed Together?

The participation claim, the usage fee and the dissolution of co-ownership may proceed in separate files. If the result of one file affects the other, the conditions for joinder or for a preliminary issue are examined. A joint calculation table should be kept so that the sale price, the title share and contribution payments do not provide the same economic value twice.

How Are Claims Concerning Co-Ownership in Shares, a Joint Account and Compensation for Unjust Occupation (Ecrimisil) Separated?

If the spouses are co-owners in the land registry, the provisions on co-ownership in shares and the liquidation of the property regime are assessed together but as separate layers. The allocation of co-owned property to one spouse depends on the superior benefit and price conditions in Article 226/2 of the Turkish Civil Code. Dissolution of co-ownership, compensation for unjust occupation (ecrimisil), money withdrawn from a joint account and the liquidation claim are not the same request; the relationship among subject-matter jurisdiction, territorial jurisdiction, the statute of limitations and the preliminary issue may vary.

Frequently Asked Questions

How Are the Title Share and the Property Regime Claim Separated in an Immovable Property Owned Jointly by the Spouses?

The share in the land registry shows ownership; a participation or contribution claim is a separate assessment of the source from which the share was financed. A half-and-half title record does not mean that all financing disputes are resolved. However, collecting the same economic contribution twice, both as an ownership share and as a claim, is not permitted. The calculation should be set up on each spouse’s share and the source of payment.

If Only My Spouse Uses the Joint Home, Can I Request a Usage Fee?

One spouse’s use of co-owned property does not give rise to a usage fee in every case. The obstruction of the other spouse’s use, the request to benefit, an earlier agreement and an interim usage decision given for the family residence are examined. Where necessary, the condition of prevention of use (intifadan men) and its exceptions are assessed. The usage fee is not an automatically calculated part of the participation claim; an independent claim and period are needed.

If I Also Financed My Spouse’s Share in a Jointly Titled Home, Might I Have a Separate Claim?

That you financed the other spouse’s title share may require a review of an additional claim. However, the nature of the payment as a gift, a joint living expense, a loan or a contribution without consideration must be determined. Being a half-share owner does not turn the payment made for your own share into a claim again. The acquisition value of each share, the source of payment and earlier agreements are calculated separately.

Does a Request for Allocation Concerning the Family Residence Affect the Action for Dissolution of Co-Ownership?

The award of co-owned property to one spouse because of superior benefit, or the allocation of the family residence to the surviving spouse after death, may affect the result of the dissolution of co-ownership. The legal basis of the request and the court with subject-matter jurisdiction are determined; if necessary, the relevant file is made a preliminary issue. Merely saying that the home is the family residence does not stop all division procedures indefinitely; the specific request and conditions must be shown.
