Summary

The validity of electronic notification in tax matters, the fifth-day calculation, SMS notices, the wrong addressee, and objections based on technical records.

The validity of electronic notification in tax matters depends on the notice being made to the correct addressee, through the statutory system and with verifiable records, not on whether an SMS was received. Under VUK Article 107/A, a notification is deemed made at the end of the fifth day following the date on which the document reached the electronic system. Opening the document late does not extend the period on its own. A wrong addressee, the legal status of the account, or a gap in the delivery record, however, must be examined concretely. 1 2

Electronic notification is not only a technology matter. Whether a tax or a penalty can be challenged in court, the period for objecting to a payment order, the duty to produce documents, and some limitation period debates all depend on the notification date. For this reason, a single date shown on screen should not be treated as sufficient. The creation of the document, its arrival in the system, its being read, and its being deemed notified under the law should each be recorded separately.

Are the tax office's e-notification and UETS the same system?

The electronic notification system of the Revenue Administration (GİB) and the National Electronic Notification System operated by PTT are not the same legal and technical record system. A notice made by the tax administration under the VUK is separate from a notice made by a court under the Notification Law. The use of an electronic method in both does not mean that the records of one system can replace those of the other. 1 2 3

The fact that a lawyer sees a tax court decision in the UETS account does not cancel a tax notice previously sent to the client's GİB account. Likewise, regular monitoring of the client's tax account does not replace the control of notices served on the lawyer by the court. Within an organization, it should be set out in writing which person monitors which account and how often. The article on appeals and cassation in tax cases examines this issue under a separate heading.

An ordinary e-mail, a WhatsApp message, or a screenshot forwarded by an accountant is not, on its own, a legal electronic notification document. Such material may be important for learning of a document and for communication, but the legal assessment is made on the record in the authorized system.

Why should Communiqué No. 596 be taken into account?

The Tax Procedure Law General Communiqué No. 596, published in the Official Gazette No. 33397 dated October 11, 2026, is the new regulation on the application of VUK Article 107/A, as amended by Law No. 7587. The Communiqué regulates the scope of electronic notification, application, use, informing the notifiable person, and exit from the system, and it provides for the repeal of the earlier Communiqué No. 456. For this reason, actions should not be taken solely on the basis of older guides regarding scope and application details. 2 4 For details, see the article what to do when a tax notification arrives.

The transitional provision of the new regulation governs the continued use of existing user codes and passwords by those who joined the system before July 1, 2026. However, the validity of a past notification is assessed under the provisions in force on the date of notification. The existence of the new regulation does not invalidate earlier notices in bulk, nor does it cure a past defect on its own. 2

How is the obligation to use electronic notification determined?

The notifiable groups under Article 5 of the Communiqué and the exceptions are checked, with particular attention to corporate tax payers and income tax payers taxed under the actual method on commercial, agricultural or professional earnings. General partnerships and limited partnerships, as well as certain first acquisition and registration transactions, are also part of the scope assessment under the new text. It cannot be said that every natural person is compulsorily included in the GİB system merely because they are a citizen. 2

A company, its partners and its legal representative are separate addressees. A document sent to the company's account and a payment order concerning the manager's personal liability should not be treated as the same. The document should be examined together with the person in whose name it was issued, the tax number or identity information with which it was matched, and the account to which the notification was made.

How is the fifth-day rule applied?

The days following the day of arrival in the system are counted, and the notification takes effect at the end of the fifth day. The period for an action or application is then calculated according to the provision that applies to it. Reading the electronic document on the first day and the statutory completion of notification at the end of the fifth day are different things. The deadline record should not be reduced to the reading date. 1 2

The five-day section is not a period for an application calculated on a business-day basis. It is not extended automatically because a weekend falls within it. On the other hand, the last day of the period for bringing a lawsuit and the tax recess and other different rules are assessed separately. The formula "five days plus thirty days" also cannot be applied to every transaction; the special lawsuit period in a payment order is a clear example of this.

Does failure to receive an SMS invalidate the notification?

The notification of information must be separated from the notification itself. Stating only that an SMS or e-mail information message was not received does not suffice to show that the actual electronic delivery record is invalid. The technical records should be examined to determine whether the notice actually reached the addressee's account, and the regulation in force at the relevant time should be applied. 2 3

In its decision of October 14, 2024, numbered E.2022/3337, K.2024/4146, the 7th Chamber of the Council of State (Danıştay) stated that an information e-mail should not be confused with the actual electronic notification address in the context of an electronic system used in a customs dispute. This decision shows that the conclusion that "a wrong information e-mail is in every case a notification to the wrong addressee" is not accurate. It should be applied with regard to the special context of the customs dispute and the legislation on the date of the event. 5

On what grounds can an electronic notification be objected to?

An objection should be based on a concrete deficiency, not on a general statement that the system could not be accessed. That the account belongs to another person, that the notified document does not match the transaction under dispute, that delivery cannot be verified in the event record, or that the legal addressee was wrongly identified are different problems. Matching the document number, period and amount, not just the file name, is necessary.

When a technical outage is alleged, the time, duration and function affected by the outage should be stated. Being unable to reach a document is not the same event as forgetting a password. The institution's technical records, the application number, the error screen, the help request and the responses should be preserved. A personal internet connection problem should not be put forward in place of a failure of the central system.

Does ceasing activity automatically close the electronic account?

The end of a taxpayer status does not mean that the account is closed on the same day in every case. The conditions for exit from the system differ for natural persons, legal entities, death, declared absence, deletion from the register, or voluntary use. The current Article 11 of the Communiqué and, for past notices, the regulation in force on the date of the event should be examined. Failing to monitor documents arriving on the assumption that an account is not being used may cause loss of rights. 2

In companies, a change of manager or accountant must also be managed. As much as removing the access of a person whose authority has ended, it is important that the new responsible person actually takes over the account and checks the documents that arrived earlier. An internal transfer of duties not having been carried out does not render the administration's notification act void on its own.

Which records are requested in a notification dispute?

  • The complete electronically signed copy of the document notified and its annexes.
  • The records of the addressee's account, identity, and inclusion in the system.
  • Records of sending, arrival in the system, reading, and the statutory notification event.
  • Records of technical outage, access request, support application and response documents.
  • Documents concerning representation, death, deletion from the register or exit from the system.
  • Correspondence and application records showing the date of actual knowledge.

The lawsuit petition should explain which aspect of the notification is disputed, and the records requested from the administration should be listed one by one. Where event records that are not in the addressee's possession are needed, the court may be asked to obtain them. When raising a notification objection, legal defects in the substance of the transaction should also be raised within the time limit; relying solely on a procedural objection may needlessly narrow the defense. For a detailed assessment, the article how to file a tax lawsuit may be consulted.

Conclusion

In electronic notification, the safe approach is to monitor the account regularly and calculate the legal period on the basis of system records. The information message, the actual delivery, the reading, and the statutory notification must be kept apart. In an objection, the wrong addressee or the technical deficiency should be shown with concrete evidence, and new regulations should not be applied automatically to past events.

Frequently Asked Questions

Are the GİB account and the lawyer's UETS account the same?

No. As explained in the section "Are the tax office's e-notification and UETS the same system?", administrative notification and judicial notification must be tracked separately. Return to the relevant explanation

Does reading an e-notification late grant additional time?

Not on its own. The statutory notification calculation and the special period of the action in question, as described in "How is the fifth-day rule applied?", apply. Return to the relevant explanation

If my telephone number is wrong, is the notification disregarded?

An incorrect information number alone does not automatically produce invalidity. The distinction between actual delivery and the information message, as discussed in "Does failure to receive an SMS invalidate the notification?", is examined. Return to the relevant explanation

If my tax liability has ended, should I check my account?

It should be verified whether exit from the system has legally taken place. The conditions set out in "Does ceasing activity automatically close the electronic account?" are taken into account. Return to the relevant explanation
