The documentation threshold that applies to a commercial transaction cannot be applied as is to the payment of rent. General collection and payment rules and the rules specific to rent payments should be kept separate; the contract, the invoice and the financial institution record should be linked to the same transaction.

Documentation of Collections and Payments through Financial Institutions: The 30,000 Turkish Lira Threshold, Installments and Exceptions

Collections and payments exceeding the applicable 30,000 Turkish lira (TL) must be documented through a bank, an authorized payment institution or PTT. This rule does not concern companies alone; an end consumer who buys from a business subject to it may also face the obligation. However, passing the payment through a bank does not remove the duty to issue an invoice, receipt or other transaction document. [1]

Documentation (tevsik) means recording a collection or payment through financial institution records accepted by law. Issuing an invoice does not show that the separate obligation on the payment method has been fulfilled.

Persons obliged to document collections and payments through financial institutions

First-class and second-class merchants (birinci ve ikinci sınıf tüccar), self-employed professionals, taxpayers under the simplified regime (basit usul), farmers keeping books, tradesmen (esnaf) exempt from tax, and non-taxpayers carrying out transactions within scope are considered. The general rules contain an exception for transactions between non-taxpayers themselves. However, this exception does not apply to a high-value purchase made by a consumer from a business.

The threshold is assessed on the transaction amount inclusive of value added tax (KDV). Besides the price of goods and services, advances, deposits, earnest money (pey akçesi), loans exchanged with partners and similar collections and payments may also fall within scope. Therefore, scanning only the sales invoices is not sufficient.

Applying the documentation threshold to the total transaction value in installment payments

A service with a total price of 120,000 TL, paid in six installments of 20,000 TL, does not create a cash payment option on the ground that each installment is below the threshold. Because the underlying transaction total exceeds the threshold, each installment must be made through a financial institution. Issuing a separate electronic receipt for self-employed professionals (e-SMM) or a separate invoice for each installment does not change this result.

However, where there are independent transactions with the same person or entity on the same day, documentation is required from the transaction that causes the daily total to exceed the threshold. For example, with purchases of 12,000, 16,000 and 5,000 TL during the day, the total with the third transaction is 33,000 TL; the rule applies to the transaction that exceeds the threshold and to subsequent transactions. This situation differs from splitting a single contract into installments.

How can a person without a bank account pay?

The absence of the payer's own account or credit card does not remove the obligation. Payment may be made directly at a bank branch into the payee's account, with identity details and an explanation of the transaction, and a receipt obtained. By contrast, handing the money to the seller in cash and having the seller deposit it later into their own account does not achieve the same result; the initial cash collection does not become compliant with the prescribed procedure.

The receipt must clearly show the parties, the amount, the date and the debt to which the payment relates. Using the account of an unrelated third party instead of the business's own account is assessed separately; appearing to comply with the documentation rule does not eliminate all violations of account use.

Partner, staff and special payment regimes

Payments within scope made to or from partners are also examined independently of the sale of commercial goods. Where the net monthly payments to staff in respect of wages, advances, bonuses and similar items exceed the threshold, documentation is required. More specific obligations under labor and social security legislation on paying wages through a bank may also apply; the threshold in this article does not remove them.

For motor land vehicle rental services within scope, there is a documentation rule independent of the amount. Residential and business premises rent is documented through a bank or PTT under its own specific regulation. The general 30,000 TL threshold cannot be applied to rent to conclude that a lower rent may be paid in cash.

Case-by-case assessment of the exceptions to the requirement to pay through financial institutions

Specific exclusions apply to the transactions within scope of central government administrations and certain revolving fund (döner sermaye) transactions, capital market intermediary institutions, authorized foreign exchange bureaus, land registry and notary transactions, specified public tender guarantees, and the market for precious metals. The exception does not extend without limit to all activities of the institution or person; the transaction the regulation points to is assessed.

Certain conditions and time limits for farmers not under the actual regime (gerçek usul) in sales of specific goods or products registered on a commodity exchange are important. In transactions within scope with foreigners or non-resident individuals, an exception may arise under special conditions, such as writing the passport number on the invoice. Repealed former conditions, such as attaching a copy of the passport or depositing the collection in the bank the following day, should not be repeated as current obligations.

A transaction falling under this general documentation exception does not remove secure payment or mandatory bank use required by other laws. In particular for notary and land registry transactions, the current special payment regime for the relevant transaction type is separately checked.

Penalty, voluntary disclosure and application

In case of a violation, a special irregularity penalty may arise for each party, for each transaction, at 10% of the transaction amount, but not less than the relevant statutory minimum amount. The minimum amount varies according to the taxpayer group and the year of the violation. The amounts of 20,000, 10,000 and 5,000 TL in the 2024 guide cannot be used as 2026 penalties; the 2026 monetary limits (hadler) under Law No. 213 on Tax Procedure (Vergi Usul Kanunu, VUK) apply. An annual aggregate upper limit also applies separately.

If the person who made a non-compliant payment voluntarily notifies the administration within five business days after the payment, a penalty may not be imposed on that person for the payment, under the conditions in the law. This does not mean that the collecting party is automatically protected too. The timing, voluntary nature and content of the notification must be documented.

In a penalty notice, the act, amount, status of the party, year and the applicable statutory minimum are checked. Where the conditions are met, the reduction under Article 376, a settlement appropriate to the amount, or a lawsuit is assessed. A penalty reduction and the transaction being lawful from the outset are not the same thing; first it should be examined whether the violation actually occurred.

Decision before the transaction and file to prepare

Determine whether the parties fall within scope, the total price of the single transaction and any special payment regime. Do not overlook the transaction total by looking only at installment amounts; record in the bank document clearly which party the payment is from and which debt it relates to.

Payment of Rent through a Bank or Postal Administration: Cash Payment, Co-owned Property and Penalties

For residential and business rent, collection and payment must be made by bank or PTT documentation regardless of the amount. The 500 TL threshold for old residential leases is no longer current. The landlord filing a rental income tax return does not remove the tenant's obligation to document the rent payment properly. Rental income tax and the documentation penalty are different legal matters. [4]

Declaring rental income and documenting the rent payment through the proper payment channel are separate obligations. Payment of the tax does not by itself remove a documentation violation that may arise from cash payment.

Who does the rule cover and which leases does it include?

The landlord and the tenant are each separately obliged for a residence or business premises. The fact that a party is not an income tax taxpayer does not by itself exclude them from scope. Short-term residential rentals on a daily, weekly or similar basis are also included. The 30,000 TL threshold in the general collection rules does not apply to rent payments.

The scope of the previous regulation was changed by Serial No. 328 General Communiqué (Tebliğ) under the Income Tax Law (GVK), dated October 17, 2024. When reviewing a past violation, the payment date is important; today's scope and penalty amount cannot be applied directly to the earlier date. For a 2026 transaction, the old 500 TL threshold cannot be relied upon.

Bank and postal administration records accepted for documenting rent payment

Receipts or account notifications issued against instruments such as bank transfers, EFT, deposits through a bank, cheques and cards may be used for documentation. Internet banking is also within scope. A tenant without an account may pay the landlord's account directly at a bank branch, with identity details and a rent description.

A receipt that states the rented premises, the rent period and the relationship between the parties makes proof easier. However, writing an incorrect description and making no payment through the bank at all are different events; documents showing the real transaction are assessed together. A landlord depositing cash received by hand into their own account later does not make the tenant's first payment one made through a bank.

Payment to a single account for co-owned property

Where the full rent of co-owned property is paid through a bank or PTT to one of the landlords, the documentation obligation may be considered fulfilled. However, this convenience does not change the distribution of ownership shares for income tax purposes. Rent arriving in one person's account does not mean the whole income belongs only to that person.

The lease agreement should clearly state the authority to collect, the partners' shares and the payment account. Shares are separately allocated in the rent declaration. In different situations, such as payment into the account of an agent or property manager, the chain of authority and collection is examined with concrete documents; a payment exception for payment to one of the partners is not extended without limit to any third-party account.

Court, enforcement and in-kind payment exception

Rent collections through court or enforcement proceedings and in-kind payments (ayni ödemeler) are specifically excluded from the documentation regulation. This exception does not mean that rental income is exempt from tax. The valuation of in-kind rent and its income nature are determined under their own provisions.

Actions such as the tenant carrying out repairs, offsetting a debt or treating a deposit as rent cannot be automatically resolved under the label of "in-kind payment". The contract, the intention to offset, the arising of the debt and the real transaction are examined. A special agreement between the parties cannot by itself remove the legal documentation obligation.

Partly by bank, partly in cash

Paying only part of the rent through a bank does not satisfy the obligation for the remaining cash portion. For example, if 25,000 TL of a 40,000 TL rent is paid through a bank and 15,000 TL in cash, the cash portion may constitute a separate violation. Showing a low rent amount in the contract, moreover, may create additional problems regarding real income and documents alongside documentation.

In cash payments covering several months, the date and amount of each transaction are investigated. It should not be assumed that the 10% rate applied once to the total cash amount will lead to a penalty for the whole file; the number of transactions and the application of the minimum penalty may change the result. The taxpayer groups of the landlord and the tenant may also lead to different statutory minimum amounts.

Penalty calculation: year and taxpayer group

Under Article 355 (mükerrer), for each party, 10% of the transaction amount is assessed, but not lower than the relevant statutory minimum penalty. For 2026, the amounts that matter are 35,000 TL for the first-class merchant and self-employed professional group; 17,000 TL for the second-class merchant, book-keeping farmer and simplified regime group; and 8,700 TL for the other group. The personal or professional nature of the transaction must also be correctly classified. The annual aggregate upper limit also applies. [3]

Hypothetically, if a non-taxpayer tenant and a homeowner in the same group pay and receive 20,000 TL rent in cash in a single transaction in 2026, the 10% calculation is 2,000 TL. Since this amount is below the 8,700 TL statutory minimum, on the assumption that no other special circumstance exists, a separate minimum penalty comes into question for each of the two parties. The 5,000 TL amount from the 2024 example of the old guide cannot be used here.

The payer's five-business-day notice and routes to challenge

If the person who made a non-compliant payment voluntarily notifies the administration within five business days after the payment, a penalty may not be imposed on that person under the conditions of the law. This opportunity does not automatically protect the landlord either. The notice should be made concrete with payment and party information, and a receipt of the notice should be kept.

If a penalty has been imposed, the date of notification (tebligat), the act, amount, year and taxpayer status are examined. For 2026, whether the applicable irregularity penalty exceeds 40,000 TL is important for settlement and for the reduction of the increased penalty (artırımlı ceza indirimi). Lawsuit, reduction and settlement have different preferences and consequences. A dispute about payment of rent through a bank may also be pursued separately from the private law dispute arising from the lease agreement.

Decision before the transaction and file to prepare

Match the party and property information in the lease agreement with the explanation in the bank receipt. For co-owned property, state that the payment relates to the full rent and to the relevant owners; do not treat cash, in-kind or court-mediated payments as subject to the same rule.
