What should be done first after a jet ski or parasailing accident?
The first priority is to bring the person to a safe area and to medical care. In an emergency, 112 should be called; if the location of the incident on the shore or at sea is known, that information, the craft and the number of injured should be stated. Depending on the area of responsibility, it is important that the Coast Guard or other competent law enforcement be informed of the incident and that an official record be created. Medical treatment should not be delayed to collect evidence, and no one should re-enter a dangerous water area.
- Identify the incident and the craft. Record the date, time, beach or pier, the name of the activity, the visible registration number of the jet ski or boat, the business name and the details of the personnel involved.
- Preserve the purchase link. Keep the reservation, the payment document, the hotel or agency messages, the promotional page, the ticket and a copy of the form you signed. The connection between the activity being sold at the hotel and its being run by another business should be investigated.
- Obtain images and witness details safely. Current images of the buoy line, the positions of the craft, the protective equipment, the parachute and connection gear, and the weather and sea conditions may be valuable. Witnesses' contact details should be identified before they are lost.
- Keep health and expense documents together. Collect the first examination, referral, imaging, treatment and follow-up records and the expense documents in the same incident file. Also document any continuing treatment abroad.
- Review payment, release and settlement texts. An advance payment of expenses, a release stating that all losses have been paid, and a criminal-law settlement may have different legal consequences. For a text in a language you do not understand, request an explanation and, where necessary, a translation. [1] [2] [13] [14]
An incident report prepared by the business is not, on its own, a conclusive report on fault. Likewise, the existence of a police or Coast Guard record does not mean that all the conditions of private-law compensation are met automatically. The first records of the incident are assessed together with the technical examination, medical findings, the contract and other evidence. [1] [3] [13]
Why does it matter who sold the activity and who ran it?
Although a single brand may be visible at the stand on the beach, the company that made the sale, the owner of the equipment, the person who operates the boat and the person who employs the staff may all be different. The hotel's logo appearing in the promotion, the price being posted to the hotel account, or the agency including the activity in its own program each carry a separate meaning. The first task is to establish the real contractual and operational connection of the service. For a tourist who buys the activity for a non-commercial and non-professional purpose, the provisions on consumer transactions may be considered; being a foreign national does not by itself remove this protection. [1] [2] [4] [11] [12]
| Person or business | Role and record to investigate |
|---|---|
| Water sports business | The person who undertook and managed the activity; operating license, area of operation, equipment, personnel, training and safety organization. |
| Owner/operator of the jet ski or towing boat | Actual and economic control over the craft, registration and usage documents, maintenance, policy and any rental relationship. |
| User, captain or attendant | The craft actually used, the duty assigned, instructions, speed and maneuvering, supervision and intervention conduct. |
| Hotel, agency or point of sale | On whose behalf the sale was made, collection, package content, the safety commitment given and participation in the actual organization of the activity. |
| Operator/user of another watercraft | The nature, movement and fault of the craft involved in the accident, and whether the special liability provisions of maritime commerce apply. |
Hotel liability in a water sports accident for an activity sold at the hotel
A hotel merely providing the contact details of an independent business is not the same legal relationship as the hotel selling the activity in its own name, collecting its fee or promising it as part of the accommodation service. Besides the invoice and the collection, the promotion, reception correspondence, the in-hotel sales arrangement and the contracts between the companies should be examined. Whether the hotel has its own breach of safety or information duties is also investigated separately. [1] [2] [4]
A contractual debtor having the activity performed by another business does not automatically end its liability for the conduct of an auxiliary person. The liability of the person who engages an employee under TBK Article 66 depends on different conditions from Article 116. That said, it cannot be said that the hotel is automatically liable for all damage in every accident on the beach; the concrete duty, the breach and the causal link must be established. [1] [2]
Is a short water sports activity a package tour?
A few minutes of jet ski use or a stand-alone parasailing activity is not a package tour merely because it is a paid tourist activity. Under Law No. 6502 Article 51 and the Regulation on Package Tour Contracts, the combination of services, the total price and the duration of more than 24 hours or an overnight stay conditions are assessed together. On the other hand, the activity may be a promised part of a package tour purchased earlier. In that case, all the contracts of the package and the sales statements are examined. [2] [9]
In a package tour, the liability of the organizer or intermediary may also be assessed for the acts of an independent service provider. A sub-business taking part in performance cannot be brought within the regulation's external third-party exception merely because it is a different company. In a day-trip-only service too, consumer and law of obligations protections may come into play; the absence of package character does not eliminate all rights. [1] [2] [9]
What conditions determine liability in jet ski accidents?
The tourist operating the craft and the business's safety duties
If a tourist had an accident while operating a jet ski, both the tourist's own movements and the way the business handed over the craft and managed the activity are investigated. The participant's experience, the explanations given, the hands-on demonstration, any pre-existing defect in the craft, the designated usage area and the attendants' supervision are important. A user's mistake and the business's organizational deficiency may both be effective in the same incident. The liability assessment cannot be reduced to the statement "a tourist was at the controls." [1] [2] [4] [5]
What was explained about throttle and steering control, stopping behavior, the function of the safety lanyard, the safe area and keeping distance from other people must be made concrete. Having the user sign does not by itself prove that these explanations were actually and comprehensibly given. The language of the document, the oral explanation, the attendants' supervision and any trial run must be examined together. [1] [2] [5]
Entering the swimming area and harm to third parties
Where a jet ski or other motorized watercraft is used in the same area as swimmers, the boundaries of the swimming area, the buoys, the entry-exit corridor, local port rules and the actual usage arrangement are investigated. The point at which the accident occurred, whether the tourist complied with instructions and the business's opportunity to prevent dangerous use are important. A single distance or speed limit should not be assumed for every coast; the rules in force at the place and on the date of the incident should be placed in the file. [1] [4] [5] [8]
The injured person may be a swimmer who did not buy the activity or a passenger on another boat. The absence of a contract between this person and the business does not automatically prevent a claim under tort or the applicable special liability provisions. On the other hand, rights based on a consumer contract and the independent damage claim of a third party are not assessed on the same legal basis. [1] [2] [3]
Life jacket, passenger capacity and the participant's suitability
Not only the presence of a life jacket but its suitability for the person and the activity, its use and its condition are investigated. The craft's passenger capacity, the manufacturer's limitations and the business documents must be assessed together. If the participant acted contrary to instructions or made a material statement about risk, its effect on the accident and on the increase of the damage should be shown by technical evidence. Not every deficiency automatically results in full fault. [1] [4] [5]
Participation of children and parental consent
For child participants, age, development, the fit of the equipment to the body, accompaniment, the conditions of the activity and applicable local restrictions are of particular importance. A parent signing a form does not remove the business's safety duty. It should not be assumed that the same age or driver's license requirement applies to all water sports; the review should be made on the basis of the specific craft, the commercial activity and the permit arrangement. [1] [2] [4] [5] [8]
What safety deficiencies are investigated in parasailing accidents?
Towing boat, parachute and connection equipment
Parasailing is an activity carried out with a parachute system towed by a boat; it should not be assumed to fall under the same technical and legal regime as paragliding. The parachute, the harness and connection points, the rope, the towing mechanism, the condition of the boat and staff coordination are examined together. The equipment's maintenance and usage history, the manufacturer's capacity and operating conditions, modifications made and earlier defect reports are important. [1] [4] [5]
Whether the accident occurred during takeoff, towing in the air, turning, landing or rescue changes the direction of the investigation. The participant's proper attachment, the weight and capacity assessment, communication between attendants, surrounding craft and the approach-to-shore arrangement must be made concrete. Looking only at the part that broke may leave deficiencies in other stages of the organization invisible. [1] [4] [5]
Weather and sea conditions and the decision to stop the activity
Wind, sudden changes in direction, waves, visibility and the weather forecast must be considered together with the equipment's operating limits and local authority decisions. Weather having worsened later does not, by itself, produce a force majeure result in every incident. The foreseeability of the danger, the decision to start or continue the activity and the measures that could have been taken are investigated. On the other hand, a claim of an unpreventable external event should not be rejected outright without examining the evidence. [1] [4] [5] [8] [9]
The landing or rescue plan, the competence of the personnel on duty, and access to communication and assistance equipment are also part of the review. Whether a delay in intervention increased the damage independently of the initial injury may require a medical and technical assessment. Being a licensed business is not, on its own, proof that all these duties were fulfilled in the specific incident. [1] [4] [5] [6]
Do the same rules apply to banana boats, ringos and other water sports?
In towed inflatables, the boat's maneuvering, towing speed, number of people, grip and protective equipment; in motorized craft, the control and operating system; and in non-motorized activities, the area and environmental conditions carry different weight. Being offered under the name "water sports" does not bind all activities to the same technical standard or the same insurance cover. The liability and evidence method in this article must be adapted to the real characteristics of the activity in which the accident occurred. [1] [4] [5] [6]
How do the distinctions between watercraft, operator and passenger carriage affect compensation?
The legal nature of the craft used at sea may change the liability regime. Within the framework of TTK Articles 931–935, the craft's designated purpose, size, buoyancy and manner of use are examined. A product being called a "jet ski" in commercial promotion does not automatically resolve all legal classifications. Sporting or recreational use does not entirely exclude maritime commerce provisions; the special scope of Article 935 must be taken into account. [3]
The owner of the watercraft, the operator on its own behalf and account, the captain and the company that sells the activity may not be the same person. The shipowner is a capacity used in maritime law for the person who uses a ship, under certain conditions, for the purpose of gaining profit. TTK Articles 1061–1062 are assessed separately with regard to the concrete operating relationship and the acts of the persons on duty. A tourist's short-term use of the craft does not by itself show that the entire operator liability has passed to the tourist. [1] [3]
For watercraft that collide, the collision provisions may apply; in an incident that actually creates a carriage of passengers by sea, TTK Article 1247 et seq. may come into play. Not every water sports contract is automatically a contract of carriage of passengers by sea. The place in the contract of the stages of boarding the boat, the towed activity and handing over the craft for use must be determined. If the special maritime law regime applies, the basis of the claim, the time limits and any limitation of liability are examined separately. The special provision in Law No. 2634 Article 29 on the recreational, sporting and entertainment use of marine tourism vessels is also taken into account in this characterization. [3] [24]
The practical consequence of these distinctions is this: the insurance and time limit rules of a motor vehicle accident on the highway cannot be transferred directly to a jet ski accident. The fact that bodily harm is involved also does not render all maritime-law-specific provisions ineffective. The craft, the relationship and the capacity of the injured person must be determined first; then the appropriate legal route should be chosen. [1] [3] [4]
Why should a water sports business's permits and personnel documents be reviewed?
The operating license and craft documents for marine tourism vessels, the sporting activity qualification file, decisions on the area of activity and port rules serve different functions. The Marine Tourism Regulation, the 2023 Implementation Communiqué of the Marine Tourism Regulation, the Regulation on Sporting Activities for Tourism Purposes and the relevant local decisions must be assessed together. Preparing a current list of obligations on the basis of the repealed 2010 Communiqué may lead to an incomplete result. [4] [5] [6] [7] [8]
Craft registration and usage documents, the technical suitability required for the activity, authorized personnel, safety equipment and the contract/information given to the customer are examined together. A commercial water sports activity and a person's private use of a boat are not the same certification regime. For this reason, no general statement should be made that an "amateur seafarer certificate is sufficient" or that "no document is required." [4] [5] [6] [8]
If a different business runs the activity in front of the hotel, the contract in the sporting activity qualification file is particularly valuable. Article 12/1-g of the Regulation lists, under the relevant conditions, the contract between the facility operator and the activity operator among the application documents. This file may help reveal the real relationship between the hotel and the water sports business. The existence of a contract does not by itself mean that a particular party is liable for all damage. [6]
The scope of marine and inland water activities should also be distinguished. While the marine tourism certification regime may cover seas and inland waters, the scope of the Ports Regulation and its exception for inland water harbor masters are checked separately. A decision valid for a course on the Antalya coast cannot automatically be applied to an event in another province or on a lake. [4] [5] [8]
Is a risk acceptance form, an exclusion clause or parental consent valid?
A participant's declaration that they know the nature of the activity and the safety instructions is a different matter from exempting the business in advance from its own fault. TBK Article 115(1) declares agreements that remove liability for gross negligence in advance absolutely void. If the conditions of a permit-based specialist service are met, Article 115(3) is also examined. In a consumer relationship, Law No. 6502 Article 5 and the unfair terms rules apply. [1] [2] [10]
A standard form stating that no claim can be made for death or injury does not mean that the clause is automatically valid. The annex to the Regulation on Unfair Terms specifically addresses terms that remove or limit liability for death, injury and material damage caused by the business's act or omission. In a genuine package tour, Article 18 of the Regulation on Package Tour Contracts is also assessed. [2] [9] [10]
The language of the form, whether an explanation the participant could understand was given, whether the text was individually negotiated and the specific safety warnings must be investigated. If there are allegations such as a tourist knowingly violating an instruction, being under the influence of alcohol or not using protective equipment, their effect on the accident or on the increase of the damage must be shown. Parental consent also does not remove the obligations relating to the child's physical safety. [1] [2] [10]
What evidence should be preserved after a water sports accident?
Because movements on the water are completed in a short time and equipment can be put back into use, identifying the evidence in time is important. Replacing the craft or the rope, deleting a camera recording, a witness returning to their country and the loss of digital records may later make technical assessment more difficult. Who holds the evidence and which concrete fact it will show should be determined from the start. [13]
| Evidence group | Subject to investigate |
|---|---|
| Sales and contract | The hotel's/agency's promise, the real seller, the payment recipient, whether the activity was included in the package, all pages of the risk form and its language. |
| Craft and equipment | Registration details of the jet ski or boat, maintenance/repair, parachute, rope, harness, connection part, life jacket and changes made after the accident. |
| Area and weather | The swimming area, buoys and corridor, the course decision, the position at the moment of the incident, official weather data, forecasts and warnings held by the business. |
| Training and personnel | The content and language of the instruction, the qualifications of the attendants, shift/duty records, participant list, equipment handover and contracts. |
| Digital and witness records | Shore/hotel/business cameras, any boat or action camera, the location data the device actually holds, original files and witness communications. |
| Official incident records | Coast Guard or competent law enforcement reports, the incident notification, first response, examination and technical reports in any investigation file. |
| Health and economic loss | First treatment, subsequent follow-ups, rehabilitation, income and work loss, care needs, necessary travel and expense documents. |
It should not be assumed that every jet ski or boat has the same recording device. AIS, GPS, camera or application data should be requested only if it is actually present on the relevant craft and meaningful for the incident. The original file of the images, the date information and the source from which they were obtained should be preserved; personal data and the rules on lawfully obtaining evidence must be observed. [13]
Sending the business a written request to preserve records may be useful; this request does not replace a court order. If there is a risk that the evidence will be lost or that its later submission will become considerably harder, preservation of evidence under HMK Articles 400–403 may be considered. Under the general regime, before the lawsuit the court that will hear the main case or the civil court of peace where the evidence is located comes into play; after the lawsuit is filed, the court hearing the case. However, if the event is a collision within the meaning of TTK Article 1286, the special jurisdiction and venue rule of Article 1292 applies to pre-suit preservation: the commercial court of first instance dealing with maritime commerce cases at the place of the collision is used; if there is none, the commercial court of first instance, and if there is none, the civil court of first instance dealing with commercial cases. Not every strike on a swimmer or equipment breakage is legally a collision. [3] [13]
In the expert examination, questions specific to the activity should be framed: Was the craft defect pre-existing; were the boundaries of the swimming area understandable; was the weather warning taken into account; were the parachute connection and capacity appropriate; could the training given have reduced the specific risk; did the delay in intervention enlarge the damage? The required expertise may differ among maritime, mechanical, activity technique and medical fields. The final assessment of legal liability belongs to the court. [1] [3] [13]
The importance of early preservation in a real case
In the ECtHR's Cavit Tınarlıoğlu v. Türkiye judgment (application no. 3648/04, February 2, 2016), an incident was examined in which a water sports business's speedboat struck a swimmer. Paragraph 12 of the judgment reports findings, in the examination carried out under the evidence preservation requested the day after the accident, that the marking arrangement in the boat corridor was set up after the accident. The example shows why the initial state of the scene must be preserved. The ECtHR not finding a violation as to the State's obligations does not mean a general compensation immunity for the operator or the hotel; nor can the old technical rules in the judgment be applied to all of today's coasts. [21]
What compensation can be claimed in case of injury or death?
Treatment, working capacity and economic losses
In bodily harm, treatment expenses, loss of earnings, losses arising from the reduction or loss of working capacity and the impairment of economic future are assessed within the framework of TBK Article 54. For necessary care, rehabilitation, transport, additional accommodation or return-home expenses, necessity, appropriateness and a link to the accident must be shown. The nature of insurance and social security payments is also taken into account. With respect to social security payments that cannot be recovered in whole or in part, and payments not made for the purpose of performance, the prohibition on deduction in TBK Article 55 is reserved. [1] [3]
The tourist's income and working conditions in their own country may matter. Wage, tax and employer documents should be submitted consistently with the health records. If permanent effects cannot yet be determined, medical follow-up and the applicable reporting arrangement are considered. A reliable compensation amount cannot be determined from the first examination record or an accident photograph alone. [1] [13] [16]
Death, loss of support and non-pecuniary damages
In case of death, under TBK Article 53, funeral expenses, if death did not occur immediately the related treatment and work-loss claims, and loss of support claims may come into play. The right to support is not identical to heirship; the actual or expected support relationship is investigated. The injured person's non-pecuniary damages, and relatives' non-pecuniary damages claims in case of serious bodily harm or death, are assessed separately under TBK Article 56. [1]
If maritime passenger carriage or other special maritime law provisions apply, the scope of the claim and the limits of liability must be examined together with that regime. The limit in an insurance policy and the total legal liability of the person who caused the damage are not the same concept. Where there are several liable persons, the basis of liability of each should be established; joint and several liability and the conditions of apportionment in the internal relationship should be assessed separately. [1] [3] [4]
Activity fee and unusable vacation
A service not having the safety features promised or required may, depending on the conditions, also bring the defective service provisions in Law No. 6502 Articles 13–16 into play. A compensation claim under the TBK may be possible together with the appropriate optional rights; the injured person's claim cannot be reduced to a refund of the activity fee alone. If a genuine package tour is involved, appropriate compensation for wasted vacation time is assessed separately. [1] [2] [9]
Which insurance pays for a jet ski and parasailing accident?
The name of an insurance is not sufficient by itself. The insured person, craft, activity, period, type of damage, limit and exclusions must be read together. The business's general liability policy, the policy of a specific boat, the participant's personal accident insurance and the tourist's travel health insurance cover different risks. A cover for the boat's or jet ski's own damage does not give the injured person an automatic right to compensation. [3] [4] [5] [6] [22] [23]
| Policy or guarantee | Core question to ask in the review |
|---|---|
| Activity and business liability | Are the real operator, the type of water sport and the place of the incident covered by the policy; on what conditions are third-party and participant damages subject? |
| Watercraft liability | Does the policy match the registration details of the boat/jet ski in the accident; what are the compulsory insurance and risks required by law? |
| Personal accident | Are the insured person and the activity defined; what are the death, permanent disability or treatment cover and payment conditions? |
| Travel health and assistance | Is there a water sports/parasailing exclusion, or a special condition or additional cover for rescue, treatment, transfer and return home? |
| Package tour insurance | Is it cover for the risk of the package not being provided at all or properly; was health/accident cover also purchased separately? |
[3] [4] [5] [6] [11] [22] [23]
The operator's insurance obligation and the capacity distinction
Marine Tourism Regulation Article 51/2 provides an insurance obligation for businesses holding a certificate, for damage the craft listed in their certificates may cause to crew and third parties. The accident and financial liability policies under the sporting activity legislation must also be examined separately. For marine tourism vessels whose passenger capacity in the seaworthiness certificate is more than twelve, Law No. 2634 Article 29 and Regulation Article 51 additionally refer to the insurance requirements of TTK Article 1259. This threshold does not mean that there is no insurance obligation at all for smaller craft. [3] [4] [5] [6] [22] [24]
A policy limit does not end all of the injured person's claims. For damage outside the cover or exceeding the limit, the claims that can be directed to the operator and other liable parties are examined together with the substantive law conditions of liability and any special limits. Cover for non-pecuniary damage should also be assessed on the basis of the policy and the applicable rules; an exclusion relating to compulsory motor liability insurance cannot automatically be carried over to a marine policy. [1] [3] [4] [23]
The agency's insurance under Law No. 1618 Article 12(a) for the organizer of a package tour should be distinguished from the accident, illness, treatment and return insurance about which information is required in item (b) of the same article. The existence of package tour insurance does not mean that all the consequences of every water sports injury will be paid without limit. [11]
Application to the insurer and the Insurance Arbitration Commission
The policies should be requested; the incident, the damage and the documents should be communicated to the insurer in a traceable way. In liability insurances under TTK Article 1478, the injured person may have the possibility of a direct claim against the insurer within the sum insured and the relevant time limits. For a foreign insurer's personal travel policy, the law applicable to the contract and the application system are checked separately. [3] [16] [23]
In an application to the Insurance Arbitration Commission (Sigorta Tahkim Komisyonu), whether the dispute falls within its scope, prior application to the insurer, the 15 business days condition in case of a final negative answer or no answer, and the other admissibility requirements are assessed. The application system of road traffic insurance is not applied as is to a marine accident. The relationship among the court, arbitration and consumer arbitration committee routes for the same dispute should also be determined before applying. [17]
Which authority and court should be approached?
Emergency aid, law enforcement investigation, administrative inspection, insurance application and compensation lawsuit serve different functions. The Coast Guard's or competent law enforcement's incident record; the inspection by the harbor master and the tourism administration; and the prosecutor's criminal investigation may complement each other. An administrative complaint does not by itself create a compensation award in favor of the injured person. The duty of the persons concerned under the Ports Regulation to notify immediately and submit a written report within 24 hours at the latest should likewise not be read as a time limit for the tourist to file suit. [4] [6] [8] [14]
Consumer transaction versus maritime commerce dispute
The relationship of a person who obtains a service from a professional business for a personal vacation may have the nature of a consumer transaction. However, the tort claim of a swimmer who did not take part in the activity at all, a direct claim against the insurer, a loss of support claim and a dispute relating to carriage by sea are not subject to the same jurisdiction assessment. The jurisdiction assessment must be made separately for each claim and each party. A marine accident does not automatically make the commercial court competent; the injured person being a tourist does not automatically make the consumer court competent. [1] [2] [3]
Law No. 6502 Articles 73 and 83(2) and TTK Articles 4–5 should be considered together; where necessary, the specialized court assigned to maritime commerce and marine insurance matters should be identified. The capacities of the defendants, the basis of the claim directed at each, and subject-matter and territorial jurisdiction are assessed separately. The existence of several persons or policies in the same incident does not mean that all claims will necessarily be joined in the same court. [2] [3] [13]
Consumer arbitration committee and mediation as a condition precedent to litigation
For consumer disputes valued below TL 186,000 in 2026, the consumer arbitration committee limit applies; disputes equal to or above it are outside this monetary limit. First, the nature of the relationship as a consumer dispute and the scope of the claim must be determined. This amount is not an automatic filing address or compensation ceiling for every water sports accident; it changes annually. [2] [18]
For cases to be heard in the consumer court, mediation as a condition precedent to litigation is assessed taking into account the exceptions in Law No. 6502 Article 73/A, and, for commercial monetary and compensation claims, the scope in TTK Article 5/A. Not every tort lawsuit automatically falls within this scope. The effect of applying to mediation on time limits and which damage items the settlement covers must be determined carefully. [2] [3] [19]
Statute of limitations in water sports accidents and the 2026 amendments
Applying a single period to all jet ski, parasailing or boat accidents is not correct. The legal relationship, the nature of the craft, the basis of the claim, the position of the injured person, and the incident and filing dates must be examined together. The table below is a starting map; in the specific file, special provisions, grounds for suspension/interruption and international rules are investigated separately. [1] [2] [3] [16] [19]
| Legal nature of the claim | Main time limit regime |
|---|---|
| General tort | TBK Art. 72: two years from learning of the damage and the person liable, ten years from the act in any case; a longer criminal limitation period if its conditions are met. |
| Breach of contract | Unless there is another special period, the general ten years under TBK Articles 146 and 149 and the start of maturity. |
| Defective service | Law No. 6502 Art. 16: as a rule two years from performance of the service; concealment through gross negligence/fraud and longer-period provisions are examined separately. |
| If the maritime passenger carriage provisions apply | TTK Art. 1270: ten years for claims arising from death or bodily harm; two years for the other passenger carriage claims regulated in the same article. Starting conditions are determined separately. |
| Collision within the meaning of the TTK | TTK Art. 1297: as a rule two years from the incident for compensation claims arising from a collision; special recourse and other provisions are assessed separately. |
The period for a claim directed at the insurer should be checked separately. Sending an email to the business, complaining to the administration or conducting negotiations does not automatically stop all limitation periods. In mediation as a condition precedent to litigation, the special rule in Law No. 6325 Article 18/A is taken into account for the period between the application and the final minutes. [1] [3] [19]
Why should the incident date and the filing date be recorded separately?
Law No. 7589, published in the Official Gazette of July 31, 2026, introduced amendments to TBK Article 55 and to the calculation of bodily harm and loss of support, and, through HMK Articles 107 and 109, to the arrangement for filing suit and increasing claims. Under the new TBK Article 55 arrangement, for loss of working capacity and loss of support compensation, statutory interest from the incident date for the known income period and from the date of judgment for the unknown income period, and the proportional deduction arrangement for payments made for the purpose of performance before the investigation, are important. [20]
The same Law repealed HMK Article 107 and added to Article 109 a provision under which, in a partial lawsuit, a one-time increase of the claim until the end of the investigation is permitted and the limitation period for the increased portion is interrupted on the filing date. The transitional rules take the incident date as the basis in the TBK amendment, and the filing date of the lawsuit in the application of old Article 107. For this reason, an old internet petition, type of lawsuit or interest template should not be transferred directly to a specific file. [20]
Effect of the criminal investigation and settlement on compensation
If injury or death has occurred through negligent conduct, criminal liability under TCK Article 89 or 85 may come into play. The duty area, conduct, fault and link to the result of the attendant, captain, instructor and management officer are investigated personally. The private-law liability of the operator or the hotel and the criminal liability of natural persons are not the same assessment. [1] [3] [15]
In cases dependent on complaint, the six-month period in TCK Article 73 and the exceptions in Article 89 should be examined. Although the images, witnesses and technical examinations in the criminal file are important for the civil lawsuit, waiting for the criminal process to conclude does not protect all compensation time limits. A settlement under CMK Article 253(19) may affect the compensation claim; the exception for damages that could not be determined at the time of the settlement or that emerge later must be assessed separately. A private release document and a criminal-law settlement should also be distinguished from each other. [1] [14] [15]
How does a foreign tourist pursue their rights after returning to their country?
A foreign tourist leaving Türkiye does not automatically end their seeking of rights for a damage that arose here. By establishing a suitable power of attorney and communication arrangement, collecting evidence, making applications and following up the lawsuit may be possible. However, the need for identity verification, where necessary a personal statement, an examination, an expert examination or attendance at a hearing varies with the file; it cannot be said that all procedures will certainly be completed remotely. [13] [16]
Treatment, income and work-loss documents from a foreign country should be prepared in connection with the accident; the Turkish translation, certification and, where necessary, authentication requirements are determined under HMK Articles 223–224 and the applicable treaties. The same apostille procedure is not required for every foreign document. A risk form that is not understood in Turkish does not, by itself, prove that the tourist understood all the safety instructions. [1] [2] [13] [16]
The consumer contract rules in MÖHUK Article 26 and the tort rules in Article 34, the jurisdiction provisions and any international conventions are assessed together. The exceptions of Article 26 relating to carriage and to services that must necessarily be provided in another country, and the distinction from a package tour, are important. Foreign citizenship does not automatically mean that foreign law or the international regime of carriage of passengers by sea applies. [16]

Conclusion
An effective legal assessment in jet ski, parasailing and other water sports accidents must establish, with concrete evidence, who undertook the service, how the activity was run, which safety conduct was lacking and its link to the damage. The bases of liability must be established separately for the hotel, the agency, the water sports operator, the person concerned with the craft, the personnel and the insurer. Early evidence preservation, a correct policy review, the appropriate filing route and a time limit calculation based on the incident date allow the claims of the tourist and their relatives to be prepared soundly. Frequently Asked Questions
I was operating the jet ski. Can I claim compensation from the operator?
Being the user does not remove all of the business's liability. The craft's maintenance, the training given to you, the arrangement of the area, supervision and safety equipment are examined. The contribution of your own conduct to the damage is also assessed. The outcome depends on the legal regime that applies and on the evidence showing the link of each conduct to the accident. [1] [2] [3]
If parasailing took place on the hotel's beach, is the hotel necessarily liable?
The activity taking place on the hotel beach does not by itself create definite liability. The hotel's role in sales, collection, commitment, organization and safety, its contract with the independent operator and its own breaches are investigated. Having the activity performed by another company also does not automatically remove all of the hotel's obligations. [1] [2] [4] [6]
I signed the risk form. Can I no longer claim my rights?
Risk disclosure is different from validly being released from liability. Gross negligence, a specialist activity requiring a permit, unfair terms presented to the consumer and any special maritime carriage provisions are examined. The language of the form, how it was explained and its content are important; a signature does not mean waiving all claims under every condition. [1] [2] [3] [10]
Does being given a life jacket release the operator from liability?
The presence of the jacket is not sufficient by itself. Its suitability for the activity and the person, its size, its fastenings, the usage instructions and its actual use are examined. Craft safety, supervision, the arrangement of the area, weather conditions and the rescue organization are also assessed separately. The link between the deficiency and the damage must be shown. [1] [3] [5] [6]
A jet ski hit me in the swimming area. Does it matter that I did not buy the service?
Not being a party to the service contract does not prevent you from seeking your rights under tort and, if their conditions are met, special maritime law provisions. The liability of the driver, the person concerned with the craft and the business is investigated. The swimming boundary, the entry-exit corridor, speed, visibility, warnings and the location of the incident are key evidence. [1] [3] [6] [8]
Does bad weather always make the accident force majeure?
No. The foreseeability of the weather, meteorological warnings, the decision to start or continue the activity, the equipment's operating limits and the necessary precautions are examined together. Not every wind or wave event is an automatic ground of release. Whether there was a truly unavoidable event requires a technical and legal assessment. [1] [3] [6] [8]
Does travel insurance necessarily pay for jet ski and parasailing accidents?
Cover depends on the policy. The water sports or motorized activity exclusion, additional cover, limits, and the conditions for rescue, treatment and return home must be examined. The business's liability insurance and the tourist's personal travel policy are different. For a foreign insurer, the applicable law and the application method are determined separately. [3] [4] [16] [23]
Is there no insurance obligation on a boat with fewer than twelve people?
This conclusion cannot be drawn. A passenger capacity of more than twelve is tied separately to the TTK Article 1259 insurance requirements for certain marine tourism vessels. The Marine Tourism Regulation, sporting activity rules and other policy obligations arising from the characteristics of the craft are also examined separately for smaller craft. [3] [4] [5] [6] [24]
How can camera and equipment records be preserved before they are deleted?
A preservation request can be made by identifying the record holders and the requested period; this request does not replace a court order. If there is a risk of loss, judicial preservation of evidence is considered. In a collision within the meaning of the TTK, the special rule of Article 1292 applies; in other incidents, the conditions of HMK Articles 400–403 are important. [3] [13]
Is a lawsuit always filed within two years for a water sports accident?
No. Different periods may apply to tort, contract, defective service, insurance, maritime passenger carriage and collision. For example, a death/bodily harm claim under TTK Article 1270 is not the same as a collision claim under Article 1297. The incident, the date of learning, the maturity of the claim and the filing dates must be examined together. [1] [2] [3]
Can I file a lawsuit in Türkiye after returning to my country?
Leaving the country does not automatically end the possibility of seeking your rights. Applications can be continued with suitable representation and a document arrangement. Foreign health and income documents should be submitted with translation and certification requirements. Whether an examination or personal attendance is required varies with the file; assurance cannot be given that all procedures can be completed remotely. [13] [16]
Does a payment made by the operator or a criminal settlement end all claims?
Whether the payment is an advance, performance for a specific damage item or within the scope of a release is investigated. The effect of a criminal settlement on compensation is assessed under CMK Article 253(19), with the exception for damages not determined at that time or emerging later. The scope and validity of the document are important. [1] [14] [20]
