Summary

Graduation, enrollment freezes and school transfers for international students; the ten-day and six-month distinction, current university announcements and routes to court.

For an international student, graduating, freezing enrollment or transferring to another university does not produce the same result for residence. The expiry date on the student card is not sufficient on its own; the student's educational status, the administrative record and the new purpose of stay are examined together. The six-month application condition for a short-term permit after graduation likewise does not by itself give a right to stay for six months. Because the published regulation differs from some current university announcements, it is important to have one's own file confirmed in writing.[1, 2, 3, 4]

This article focuses on changes in the status of higher education students. First enrollment at a university, scholarships, student disciplinary proceedings, work permits and deportation decisions are distinct matters. The effect of a decision given in one of them on another process should be investigated; every consequence should not be drawn from a single sentence such as "student status has ended."

What is the legal basis of the student residence permit?

Articles 38–40 of Law No. 6458 on Foreigners and International Protection (Yabancılar ve Uluslararası Koruma Kanunu, "YUKK") govern the scope, conditions, and grounds for refusal or cancellation of the student residence permit. Associate, bachelor's, master's and doctoral studies in higher education fall within this framework. Documents showing enrollment, the absence of any obstacle to entry into Türkiye, and address information are important. The permit is tied to the purpose of study.[1]

The grounds set out in Article 40 are the absence or disappearance of the required conditions, the emergence of evidence that the studies cannot be continued, use of the permit for a purpose other than the one for which it was issued, and the existence of a valid deportation decision or entry ban. However, low grades, failing a single course or a reduced course load for one semester should not be read as a definitive end of studies without examining the circumstances.

The legal status of the university enrollment and the action of the migration authority must be determined separately. If student enrollment was deleted in error, an application directed at the university's action may be necessary; that application is not treated as an action filed against the residence decision. Similarly, a residence case does not by itself remove the university's deregistration decision.

Does the student residence card remain valid after graduation?

The rule in the published regulation

Article 37(2) of the YUKK Implementing Regulation (YUKK Uygulama Yönetmeliği) published by the Presidency of Migration Management (Göç İdaresi) provides that a graduating student's residence permit will be terminated as of the graduation date and that the ten-day transition period in Article 26(1) starts on that date. Under this provision, what matters is the official graduation date, not the diploma ceremony, the day the diploma is printed or the date the document is collected.[2]

The difference seen in current university announcements

An explanation of the Istanbul Technical University (İTÜ) Student Affairs office, accessed on October 14, 2026, states that deregistration results in cancellation, whereas in the case of an enrollment freeze, not taking courses and graduation the existing valid permit may be used until its expiry date. İstinye University, on the other hand, announces validity until the end of the card in the case of graduation but describes an enrollment freeze as a ground for cancellation. The announcements thus differ not only from the regulation but also from one another on enrollment freezes.[3, 4]

These two announcements do not prove that a nationwide regulatory change has been made for all students. The research could not confirm a current general rule showing the scope of the different explanation and its application in all provinces. On the other hand, the announcements should not be disregarded entirely and the discussion should not proceed as though the same practice in fact applied to every student. The legal text and institutional practice must be recorded separately.

The student should submit the graduation date, the card details and the university's announcement and ask the relevant provincial migration directorate in writing about the status of his or her own record and the application timetable that will apply. A person said to hold a valid card must also separately track the six-month graduation application condition. Postponing an application on the basis of a general internet announcement alone, without written personal confirmation, may lead to a loss of rights.

What does the six-month application condition for graduates mean?

YUKK Article 31(1)(i) provides that a short-term residence permit may be granted to those who complete their higher education in Türkiye and apply within six months from the graduation date. Under the fourth paragraph of the same article, this permit may be granted once only, for a maximum of one year. The six months is the window within which this special ground of application may be used; it is not the duration of the permit or a free right to stay.[1, 5]

In other words, three calendars are kept apart: when the existing right of residence actually ends, when the transition to the new purpose of stay will be made, and the six-month condition of the special short-term application based on graduation. Even for a person whose card is treated as valid for a while longer according to a university announcement, the lapse of six months may affect the special graduation-based application option.

It cannot be said that all types of residence are closed to a person who lets the six-month window pass; however, any other application must rest on a genuine and documented reason for stay. A tourism, family, work or new study ground cannot be constructed contrary to the facts merely to get around the time problem. The consequences of an earlier residence violation are also assessed separately from the new application.

How do enrollment freezes, deregistration and school transfers differ?

SituationLegal and administrative checkExplanation needed in the file
GraduationRegulation Art. 37(2) and the current procedure applied to the personal recordOfficial graduation date, written reply on the status of the card and the new purpose of stay.
Enrollment freezeRegulation Art. 35(13) and the scope of the differing university announcementsThe freeze decision, its duration, its reason and the provincial migration directorate's assessment of the file.
Deregistration or severance of ties with the universityEnd of the ground for study and YUKK Art. 40Date and notification of the decision, and any objection to the deregistration decision or stay of execution.
School or department change in the same provinceNo interruption of studies and notification within the time limitOld and new enrollment documents; a calendar showing that studies continued without interruption.
Continuing studies in another provinceResidence procedure and address update in the new provinceNew university acceptance, enrollment and address documents.

Article 35(12) of the Regulation provides that, in a faculty or department change within the same institution and in an institution change within the same province, the existing permit keeps its validity on the conditions that studies are not interrupted and notification is given in time. In the case of continuation in a different province, the basic rule is that the governorship of the new province terminates the existing permit and issues a permit according to the new period of study. Students and educational institutions are obliged to notify the provincial directorate of changes in student status and enrollment within twenty days. This period is not the same as the university's timetable for uploading cards to its own portal.[2]

Article 35(13) of the Regulation provides for the permit to be terminated from the date of the enrollment freeze. Because of the difference in current announcements noted above, the personal effect on the permit should be confirmed before a freeze decision is made. Health or family necessity may explain the reason for interrupting studies, but it cannot be presented as a general exception that protects the permit in every case.

How should the move to a new study program or a work permit be planned?

In a move from a bachelor's to a master's degree or from a master's to a doctorate, the acceptance letter and final enrollment are different documents. The start of the new program, the prior graduation, the status of the existing permit and the basis for stay during the interim period are assessed together. An application made only for the coming semester does not automatically turn the interim period into student residence.

A student residence permit does not by itself confer authorization to work. A work permit must be obtained as required under YUKK Article 41 and Article 19 of Law No. 6735. For associate and bachelor's students, there is a framework of completion of the first year and part-time work; different rules apply to graduate students. Receiving a job offer after graduation also does not mean that a work permit has been granted.[1, 6]

Article 19(5) of Law No. 6735 on International Labor Force (Uluslararası İşgücü Kanunu) provides that a work permit application made within one year of graduation by a foreign national who has completed higher education in Türkiye is assessed according to the relevant policy principles. This one-year application provision is different from the six-month short-term permit condition in the YUKK and from the existing right to stay. A new period of stay cannot be created by adding these three periods together.[6]

The passport validity, health coverage, address record and education document must be kept up to date for the new application. Submitting documents to the university is not the same as completing the e-İkamet application. Which document was submitted to which institution on which date should be shown by the application number and the submission record.

What remedy is available against refusal or cancellation of student residence?

Refusal of a residence request made from within Türkiye, non-extension of the permit or its cancellation is carried out by the governorship and notified to the person concerned, his or her legal representative or attorney. Under YUKK Article 25, matters such as family ties, length of residence, the situation in the country of origin and the best interests of the child are taken into account in the assessment. The specific document and legal ground on which the decision rests should be examined.[1]

Unless a special period applies, an annulment action against a residence decision is generally filed before the competent administrative court within sixty days of written notification. Jurisdiction is determined by reference to the authority that took the action. Filing the action does not automatically suspend execution. If studies would be interrupted, enrollment lost or other serious consequences would follow, the conditions of Article 27 of the Administrative Procedure Law (İYUK) must be explained with supporting documents in a request for a stay of execution.[7]

Merely stating "I objected" is not sufficient for an application to the administration. Whether the application falls within Article 11 of the İYUK, whether it was made in time and its effect on the time limit for filing suit are examined. It should not be assumed that a general request for information suspends the limitation period for the action. The notification record, electronic notice and application records should be preserved.

Is cancellation of residence automatically deportation and an entry ban?

No. A residence action, a deportation decision and an entry ban into Türkiye are actions that produce different legal consequences. Cancellation of a residence permit or a violation of the period of stay may lead to a deportation assessment; however, the decision concerning the person, the notification and the safeguards under YUKK Articles 4 and 55 must be examined separately. Student status does not by itself provide a right not to be deported.[1]

If a separate deportation decision has been notified, the seven-day filing period under YUKK Article 53 applies. A deportation challenge should not be delayed while waiting for the sixty-day period of the residence case. If administrative detention has been applied, review of the deprivation of liberty before the criminal judgeship of peace (sulh ceza hâkimliği) proceeds separately. For the general process, see the guide on deportation decisions.

In what order should a student file be prepared?

First, the chronology of events should be established: the first permit, the last permit, the graduation or deregistration decision, the date notice was given and notification of the adverse action. Documents on the current status are then added. An error of information at the university and an error of information in the migration record should not be crammed into the same application.

  • Current and past student certificates, transcript, and the official graduation or deregistration decision.
  • Enrollment freeze, internal transfer or new program acceptance and enrollment documents.
  • Passport, residence card, address and health coverage documents.
  • e-İkamet application number, proof of document submission and correspondence with institutions.
  • Refusal, cancellation, deportation or restriction actions, with separate records of notification.
  • A dated copy of the university announcement and a written reply on whether it applies to the personal record.

Take, as a hypothetical, a student who graduates in September and whose card states the following March. That student should not wait until March on the strength of an explanation on a university web page. The student should first learn the validity of his or her own record and whether a transition is required, and should also track the six-month condition of the graduation-based short-term permit. Treating the card as valid and preserving the condition for applying for a particular type of permit are not the same result.

Conclusion

An international student's plan to stay depends on the status of the educational record and the administrative action applied to the personal file as much as on the date on the card. It is plain that on graduation, enrollment freezes and school transfers, the published rule and current institutional announcements can differ. The transition timetable should therefore be confirmed in writing, and the six-month graduation application condition, the work permit and possible filing periods should be tracked separately.

Frequently Asked Questions

Can I stay freely for six months after graduation?

No. Six months is the condition for the special short-term permit application under YUKK Article 31(1)(i). An existing right of stay must separately be present. Submitting an application does not by itself mean a favorable decision.

Is it enough if my student card shows a later date?

It is not sufficient on its own. The status of the record is examined in light of graduation and enrollment changes. Because some universities have published explanations about validity, whether such an explanation applies to your file should be confirmed in writing by the relevant provincial migration directorate.

When enrollment is frozen, is the permit treated the same way everywhere?

The published regulation provides for termination of the permit; the university announcements that have been accessed contain different information. One should not act as though a general exception existed before a nationwide provision to the contrary has been confirmed.

Is a new permit always required when I change universities in the same province?

The Regulation provides that, on the conditions that studies are not interrupted and notification is given in time, the existing permit may keep its validity in an institution change within the same province. The new enrollment and notification documents should be submitted to the file.

For how many years can a short-term permit be granted to graduates?

Under YUKK Article 31(1)(i), a permit may be granted once only, for a maximum of one year. Granting the full year, or acceptance of the application, is not automatic.

Does finding a job turn student residence into a work permit?

No. A job offer or an employment contract is not a work permit. The appropriate application must be made and the required permit obtained; the existing status of stay is also tracked separately while the application is being assessed.

If I file a residence case, is a deportation case also filed?

No. Cancellation of residence and a deportation decision are separate actions. In the case of a deportation decision, the special seven-day period running from notification must be protected separately.

Which documents matter if my university enrollment was deleted in error?

A copy of the deregistration decision, its notification, objection and correction records, and documents showing that studies are continuing are important. Correction of the university's action or its judicial suspension should be submitted to the migration authority; the application concerning the residence action is assessed separately.
