Summary

How do the court and time limit change with the type of encümen decision? Distinctions in applications for demolition, fines, tenders and land readjustment.

The remedy against a decision of the municipal executive committee (encümen) is determined not by the name of the body that issued the decision but by the legal nature of the act. Demolition, land readjustment (parselasyon), tender, eviction and administrative fines are not subject to the same procedure. The first step is therefore to separate the law on which the decision rests and each of its provisions. Although the general time limit in administrative justice is sixty days, a thirty-day time limit may apply for tender acts, and for some administrative fines a fifteen-day time limit for applying to the criminal judgeship of peace (sulh ceza hâkimliği) may come into play.

Why does an encümen decision not signify a single type of case?

The municipal executive committee is the municipal body that performs the administrative and executive duties conferred by law. Some of its powers are in the Municipality Law No. 5393, and some are in zoning, tender and other special regulations. Special provisions on the composition and powers of the metropolitan municipality’s encümen are also taken into account.

A single decision may contain several outcomes: demolition of a structure, an administrative fine against a person, recovery of an expense, or suspension of an activity. Bringing them together under one decision number does not merge their legal natures. The basis, addressee, notification and judicial remedy of each provision must be examined separately.

Which documents should be obtained first?

In addition to the full text of the decision and its annexes, subject-specific documents are needed, such as the notification, the construction stoppage record or inspection report, the calculation schedule, the tender file or the distribution schedule. The list of those who attended the encümen meeting, the signatures, and the records of duty and proxy also allow review of procedure. The mere existence of a collection letter does not by itself prove that the earlier principal decision was never notified; all notification records of the file should be requested.

Court and time limit by type of decision

The distinction below is a starting map. For a specific act, the special law, related decisions and current case law on jurisdiction should be evaluated together.

Nature of the actGeneral assessmentPoint to note on the time limit
Demolition under zoning legislationAnnulment action before the administrative courtAs a rule sixty days; the notification is examined
Land readjustment (parselasyon)Administrative justice; place where the property is locatedAnnouncement, service and learning of the act are assessed separately
Tender actExpedited proceedings if within Article 20/A of the Administrative Procedure Law (İYUK)Thirty days; İYUK Article 11 does not apply
Administrative fineThe special provision and the link to the Misdemeanors Law are investigatedIn the criminal judgeship of peace route, as a rule fifteen days
Municipal tax and fee actThe jurisdiction of the tax court may come into playGeneral tax action time limit thirty days; special regimes reserved
Private-law claim arising from a contractJudicial courts may come into playThe contract and the nature of the claim are decisive

Where a zoning fine and demolition are combined

Article 27, paragraph 8 of the Misdemeanors Law No. 5326 regulates the situation where, within the act imposing an administrative sanction, there are also decisions concerning the same person that fall within the jurisdiction of administrative justice. The link between a fine and demolition or another administrative act may matter in determining jurisdiction. The approaches “every fine goes to the administrative court because the encümen issued it” or “the criminal judgeship of peace is always competent because it is a fine” are not safe.

Different addressees, acts resting on separate legal grounds, or the existence of a special jurisdiction provision can change the outcome. In the jurisdiction analysis, not just the date of the decision but all provisions of the decision must be read. It should not be assumed that applying to the wrong branch of the judiciary will in every case preserve the time limit; the rules on transfer and re-application have conditions.

Why must one act faster for tender decisions?

For tender acts within İYUK Article 20/A, the time limit for suing is thirty days and the application under İYUK Article 11 does not apply. A petition to the municipality saying “please reconsider your decision” does not stop this period. Decisions banning a person from tenders are excluded from the tender-acts regime in Article 20/A. The tender process should also not be confused with a private-law dispute after the contract has been signed.

This distinction is especially important because the municipal encümen both acts as a tender commission and exercises other municipal powers. In preparing the file, the stage at which the tender approval, the commission decision and the notification stand must be determined.

How is an administrative objection to an encümen decision assessed?

Under the general procedure of administrative justice, an application complying with the conditions of İYUK Article 11 may stop the running of the time limit for suing. If there is no superior authority, the application may be made to the authority that issued the act. Failure to respond within thirty days results in implied rejection (zımni ret); the remaining time limit for suing then continues to run. The days that passed earlier are not erased.

The application should clearly show the date and number of the decision, which provision is objected to, the unlawfulness and the result sought. The registry number and the delivery receipt should be kept. Requesting documents or talking to municipal officials is not the same as a proper application requesting removal of the decision.

Where a special law introduces a separate application system, the criminal judgeship of peace route is in question, or expedited proceedings apply, this general explanation cannot be used directly. Whether an administrative objection is mandatory and its effect on the time limit should be determined act by act.

Which unlawful aspects are examined in an encümen decision?

The competent body and the formation of the decision

A decision that the law leaves to the municipal council being taken by the encümen, the absence of the approval of the relevant authority, or a breach of the statutory composition of the encümen may give rise to a problem of competence. The number of members, the quorum for the meeting and for the decision, the casting of votes and the prohibitions on participating in the meeting must be examined. A person holding two different capacities is not automatically given two votes.

In the decision of the Council of State (Danıştay) 6th Chamber dated 02.05.2023, E.2021/9222, K.2023/4306, the casting of two votes by the same person in the encümen, in the capacities of chair and member, was assessed. The result on annulment of the administrative fine was upheld on a different reasoning. Although the file also contained a demolition provision, the appeal review was limited to the part concerning the fine. The decision therefore cannot be reported as one that also annulled the demolition. [1]

Findings, reasoning and calculation

The facts on which the act rests must be correct and verifiable. The location and extent of the violation in the structure, the area occupied, the period of use, the addressee’s relationship to the act, or the breach of the tender condition must be made concrete. Adding to the calculation schedule afterwards a violation that is not in the record, imposing a sanction on the wrong person, or failing to explain the amount may be grounds for suit.

In technical disputes, photographs, measurements and comparison with the project are important. The legal question of competence is not left to the expert alone. An expert can explain the technical fact; which body is competent or which court has jurisdiction is a legal assessment.

Stay of execution and interim protection

An annulment action does not, in general, stop the implementation of the encümen decision automatically. In administrative justice, for a stay of execution, manifest unlawfulness and damage that is difficult or impossible to compensate must be shown together. In situations such as an imminent demolition, eviction or transfer of ownership, documents on the date of implementation show the urgency of the request.

Damage that is difficult to compensate is not accepted automatically in every dispute over a payment of money. Features such as a concrete financial effect that could lead to the closure of a business must be documented. There are special provisions in tax cases on the suspension of collection; this result cannot be generalized to all municipal monetary claims.

For a sanction subject to the criminal judgeship of peace route, the rules on stay of execution in administrative justice are not applied as they are. The effects of the application and of enforcement are assessed under the relevant law. A request for interim protection must be consistent with the judicial route chosen.

How should the petition and evidence file be built?

The petition should make clear which part of which decision of the municipal encümen is sought to be annulled. Suing on several acts in a single petition should be examined in terms of the connection conditions in İYUK Article 5 and the jurisdiction rules. Combining decisions that are independent of one another merely because they come from the same municipality may create a procedural problem.

In the chronology of the file, the dates of the finding, decision, service, objection and implementation should be shown separately. The defendant administration is the municipality concerned; an annulment action directed personally at encümen members is not the appropriate approach. In property disputes, territorial jurisdiction must be checked separately.

Evidence requests should be kept concrete: for example the meeting minutes, signature list, measurement sketch, permit and project, service record or tender evaluation documents. The court may be asked to obtain documents held by the municipality. On the other hand, waiting for all documents to arrive before filing the suit should not cause loss of time.

Does an annulment decision prevent a new act from being made?

The administration must comply with the binding reasoning of the court decision. However, if the reason for annulment was only an incomplete finding or a procedural defect, a new act may be made to the extent that the statutory conditions continue. Repeating the result found unlawful on the merits while appearing to change the reasoning is a different problem.

In files where fine, demolition and collection acts exist together, it must be read carefully which part was annulled. Following annulment of the principal decision, an additional application or suit may be needed for the refund of an amount already collected, for interest, or for damage arising from the act carried out. An annulment decision does not automatically award all heads of compensation.

Conclusion

The right remedy against an encümen decision is possible by distinguishing the legal nature of the decision. The competent court, the time limit and the effect of the objection should be determined in the first stage; the formation of the decision, the findings and the calculation should then be examined. Especially in decisions containing more than one sanction, it should not be overlooked that each provision has a separate outcome.

Frequently Asked Questions

Is a suit always filed within sixty days against an encümen decision?

No. Although the general administrative time limit for suing is sixty days, tender acts, tax disputes and applications to the criminal judgeship of peace may be subject to different time limits.

Does demolition stop when a petition is submitted to the municipality?

Submitting a petition does not by itself stop the demolition. The municipality must suspend implementation, or a suitable interim protection order must be obtained from the court.

If the fine and demolition are in the same decision, is a single suit sufficient?

The connection between the acts, their addressee and the jurisdiction rules must be examined. A single decision number does not automatically determine a single judicial route.

Can I request the encümen’s meeting minutes?

The relevant documents may be requested by application; their production by the court may also be requested in the proceedings. The time limit for suing must be protected separately while waiting for documents.

Does annulment of an encümen decision also secure compensation?

Annulment and compensation are different claims. The damage, causation and the appropriate remedy are assessed separately.
