Summary

Municipal decision, the parcelling requirement, filing deadline, technical documents and remedies, with Council of State decisions, when a subdivision or consolidation application is rejected.

The rejection of a subdivision or consolidation application is not an outcome left solely to the municipality’s discretion. A rejection decision must comply with the zoning plan, Zoning Law No. 3194 and the applicable regulation. On the other hand, being the registered owner in the land registry does not secure approval of every division or merger requested. The correct route is determined by examining together whether the property is a zoning parcel, whether parcelling is required, the plan conditions and the grounds of the rejection act.

Subdivision (ifraz) is the division of a property into more than one parcel; consolidation (tevhit) is the merging of parcels. The dispute often arises during a sale, a family division or the preparation of a building permit. Setting out why the application was rejected with technical documents is a more effective legal starting point than merely saying “my property right has been obstructed.”

How do subdivision and consolidation differ from parcelling?

The procedures under Articles 15 and 16 of Law No. 3194 are not the same as the land and plot readjustment carried out under Article 18. Parcelling (parselasyon) may rebuild the pattern of ownership in a particular readjustment area in accordance with the zoning plan; a readjustment partnership share and allocations of new parcels may come into play. Subdivision or consolidation, by contrast, is the alteration of parcel boundaries under its own conditions.

This distinction matters: a municipality cannot transform an area requiring comprehensive parcelling merely through individual applications. Nor can an owner use a subdivision request as a guaranteed way of avoiding all the consequences of an Article 18 implementation. Before applying, the title deed parcel, the cadastral map sheet, the implementation zoning plan and, if there is one, the registered parcelling plan should be compared.

Is subdivision or consolidation possible without parcelling?

Article 15 of the Law is based on parcelling being carried out first in areas that have a zoning plan. As a rule, the procedures are carried out in areas with a registered parcelling plan. However, cases listed in the Law, such as public investments by administrations under the central government and areas in public ownership, as well as certain built-up areas where parcelling is not possible and other statutory exceptions, are assessed separately.

The existence of an exception does not remove the plan and regulation conditions. Instead of merely saying “there is construction in the vicinity,” the application should explain which exception is relied on and how it is verified by a map, the construction status or an ownership document.

On what grounds may the municipality reject the application?

The minimum size of the parcel, its frontage, depth, connection to a road and building conditions are the main subjects of review. Consolidating parcels with different land-use designations, or creating parcels unsuitable for construction as a result of the division, may cause problems. Where there is a protected-site, coastal, agricultural-land or special-protection law, additional restrictions come into play.

A technical deficiency must be distinguished from a legal obstacle

A missing coordinate, an incorrect staking-out, or a document deficiency that can be remedied cannot be treated on the same ground as an operation the plan expressly prohibits. The administration is expected to explain in an understandable way which document is missing and which rule it relies on. If the application can be completed, the technical correction that will achieve this should be identified.

On the other hand, correcting the project does not by itself stop the filing deadline running against a final rejection decision that has already been served. Abandoning the monitoring of the time limit on the ground that “the surveyor is preparing a new drawing” may lead to a loss of rights. The application file and the litigation calendar must be managed together.

Is approval on a neighboring parcel enough on its own?

For a claim of equality, the legal and technical conditions of the parcels being compared must be similar. Different plan notes, frontage, road connection or date of the act may change the result. Moreover, an earlier unlawful act does not give a right to demand repetition of the same unlawfulness. If a precedent act is to be submitted, not only the outcome of the executive committee (encümen) decision but also the plan and parcel characteristics on which it was based should be obtained.

To whom is the application made, and when must a decision be given?

Article 16 of Law No. 3194 provides for the approval of the municipal executive committee (encümen) for procedures within the municipal and adjacent-area boundaries, and of the relevant provincial administrative board (il idare kurulu) for those outside them. Because of the metropolitan system and specially authorized areas, the administration responsible for the specific property must be determined separately.

The same article provides that the approval procedure be concluded within 30 days at the latest from the application; that notification be given to the land registry within 15 days for registration or deletion; and that the land registry authority conclude the procedure within one month. These are not time limits of the same nature, and the municipality’s silence does not mean automatic approval. The time limit for carrying out the procedure and the time limit for applying to the court are calculated separately.

Ownership and representation documents, the technical file, a copy of the relevant plan and a clear statement of the request should be attached to the application. The incoming document registration number and the date of submission should be kept. Oral discussions do not replace a written application and a written rejection decision.

Objection to the rejection decision and the filing deadline

An annulment action is generally filed in the administrative court against a final and enforceable rejection act. Unless a special period is provided, the general 60-day period in Article 7 of the İYUK (Administrative Procedure Law No. 2577) applies. At the start of the period, service of notice and the facts of learning of the act in the specific file are important; the safe approach is to build the calendar on the earliest date that can be documented.

How does reapplying to the administration affect the time limit?

An application for removal, withdrawal or amendment made within the filing period and meeting the conditions of Article 11 of the İYUK may stop the running period. Under the current provision, failure to respond within 30 days is deemed a rejection; after that, the remaining period runs, with the earlier days also taken into account. Each new petition does not provide a new 60 days.

If no act has yet been issued, the application for an act to be performed under Article 10 of the İYUK and the implied-rejection regime come into play. The 30-day response period of that regime should not be confused with an objection against an existing rejection decision. The nature of the application is assessed by its content, not by the heading of the petition.

How are the defendant and the competent court determined?

The action is directed against the administration that issued the rejection act; the members of the executive committee are not personal defendants. In zoning disputes concerning real property, the rule in Article 34 of the İYUK on the court at the place where the property is located is taken into account. The presence of a private-law co-ownership problem in the same file requires the review of the administrative rejection decision to be separated from the dispute over rights in the land registry.

Which documents and illegalities does the court examine?

In an annulment action, lawfulness is reviewed in terms of competence, form, reason, subject and purpose. In files requiring technical assessment, a site inspection and expert examination may be carried out. The expert is expected not to give a legal ruling but to answer specialist questions on the plan and parcel conditions.

Rejection and executive committee decisionWhich act was rejected, and on what grounds?
Title deed and survey planAre the owner, shares and boundaries correct?
Plan, plan notes and parcellingWhat is the applicable legal basis of the application?
Subdivision or consolidation projectDo the resulting parcels comply with the rules?
Notification and application recordHow will the filing deadline be calculated?
Technical opinion and measurementsDoes the obstacle cited by the administration actually exist?

For example, if the municipality says “there is no frontage on a road,” the mere de facto use of an existing road may not be sufficient. The road designation in the zoning plan, the title deed and the implementation status must be examined together. Conversely, a rejection reached through an erroneous overlay of map sheets can be refuted by technical examination.

A real Council of State decision on ex officio consolidation

The decision of the Plenary Assembly of the Administrative Litigation Chambers of the Council of State (Danıştay İdari Dava Daireleri Kurulu) dated 07.11.2022, E.2022/1231, K.2022/3119 concerns the provision of the Regulation on Zoning in Planned Areas (Planlı Alanlar İmar Yönetmeliği) on the consolidation of parcels unsuitable for construction. The Plenary Assembly affirmed the decision dismissing the action against the provision. In the review, the statutory basis added to Article 15 of Law No. 3194 was also assessed.

The importance of the decision in practice is that it rules out the idea that the administration can never intervene, under any condition, in zoning parcels unsuitable for detached construction. However, this result does not mean that every parcel can be consolidated without notifying the owners. The notification requirement in the Law, the three-month opportunity to reach agreement and the specific technical conditions are separately reviewed. A decision on a regulatory act does not make every individual consolidation act lawful in advance. Full text of the decision.

Does a stay of execution take the place of approval?

Filing an action does not by itself render the rejection decision ineffective. For a stay of execution, a manifest unlawfulness and damage that would be difficult or impossible to remedy if the act is implemented must be shown together. An approaching investment or sale date may not be sufficient on its own; the damage must be explained with concrete documents.

A stay of execution of the rejection act does not mean that the court has approved the technical project or directly created a new parcel in the land registry. The administration must act in accordance with the reasoning of the decision. After a final annulment as well, the application is to be reassessed taking into account all of its statutory conditions.

Conclusion

Success in a subdivision and consolidation dispute depends on examining together the technical feasibility of the request and the legal validity of the grounds of rejection. The first step is to gather the written decision, the current plan, the land registry records and the technical project in the same file. The time limit must be monitored without delay, and the parcelling requirement and obstacles under special legislation must be clearly assessed.

Frequently Asked Questions

If the municipality does not respond within 30 days, is the subdivision approved?

No. Exceeding the procedural time limit in the Law does not create automatic approval. The implied-rejection and litigation provisions of the İYUK are assessed separately.

If I hold a title deed, can I create a parcel of any size I wish?

No. The conditions in the plan, the regulation, parcelling and, where applicable, special protection legislation apply.

Are a subdivision rejection and an Article 18 implementation the subject of the same lawsuit?

Not always. The dates, content and connection of the acts are examined. Separate acts may have separate time limits.

Can a consolidation be made without my neighbor’s consent?

A consensual transaction must be distinguished from an ex officio act whose conditions are set out in the Law. Co-ownership and representation requirements are examined separately.

Does the land registry change immediately once an annulment decision is issued?

Annulment removes the legal effect of the rejection act; it does not mean that technical approval and land registry procedures are completed automatically.
