Summary

When does a customs violation become the offense of smuggling? Intent, commercial purpose, evidence, effective repentance and defense options under Law No. 5607.

The miscalculation of customs duty, incorrect information in a declaration or the failure to deliver goods does not, on its own, show that the offense of smuggling has been committed. For criminal liability, the act alleged must correspond to the definition of the offense in the statute, the required mental element must be present, and these must be established with lawfully obtained evidence.

Short answer: An administrative customs violation and an offense under Law No. 5607 are separate. The starting point of the defense is to determine which paragraph of which article is being applied. The tax difference, commercial purpose, deceptive conduct and the element of knowledge are not required in the same way for every type of offense; the approach that “once the penalty is paid the file is closed” is also incorrect. [1, 2, 3]

Why must an administrative penalty be distinguished from a smuggling investigation?

The customs administration may issue a decision on duties and an administrative fine on account of the value, tariff classification, origin or regime conditions of the goods. The prosecutor’s office, in turn, may investigate whether the same event constitutes an offense. The administration’s issuing an additional assessment does not automatically lead the criminal court to a conviction. Conversely, the continuation of a tax dispute does not by itself stop the statements in the criminal file or the time limits for legal remedies. [1, 3]

When more than one sanction comes into question for the same act, Article 231 of Law No. 4458, Article 15 of the Misdemeanors Law and the relevant special provisions are examined together. Neither of the two generalizations, “both an administrative and a judicial penalty always apply” or “if there is a criminal case, all administrative acts fall away,” is safe. Whether the acts are the same, the nature of the sanction and the outcome of the decisions are decisive. The tax debt and the question of punishment must also be kept separate. [3, 4]

Which acts does Law No. 5607 regulate as different offenses?

Article 3 of the Law contains many types of offense. Import, transit, temporary import, export, fuel and tobacco products are not assessed under the same conditions. The table below shows the distinctions frequently encountered in customs files; it is not a list of all the offenses or of the penalty ranges. [1]

Conduct allegedPrincipal legal issue
Bringing goods into the country without subjecting them to customs proceduresThe manner of entry and the evasion of procedures; Art. 3/1
Non-payment of duties through deceptive acts or conductDeceptive conduct in addition to the tax difference; Art. 3/2
Leaving transit goods in Türkiye contrary to the regimeTransit records and actual delivery; Art. 3/3
Fraudulently showing temporary import or inward processing goods as exportedThe regime, the exit record and the actual situation; Art. 3/4
Engaging in commercial transactions with smuggled goods without taking part in the earlier actsKnowledge of the nature of the goods and commercial purpose; Art. 3/5

For example, a technical difference of opinion on tariff classification is not the same as concealing the duty by preparing a false document. However, the explanation that “the transaction was carried out by the broker” also does not remove liability on its own. The information the person provided, his or her instructions, contribution to the document and participation in the process are investigated.

How are intent and personal liability assessed?

Under Article 20 of the Turkish Penal Code (TCK), criminal liability is personal. The capacity of company manager, importer, carrier, customs broker or warehouse employee does not by itself prove that the offense was committed. The provisions on intent in TCK Art. 21 and, where applicable, on mistake in Art. 30 are assessed on the facts of the case. [2]

An employee’s carrying a sealed package does not in every case show that he or she knew the goods carried were smuggled. Conversely, an unusual transport fee, an arrangement for concealment, contradictory shipping documents, earlier warnings and correspondence may support the claim of knowledge. The defense should answer this evidence; it should not rely only on the job title or on the explanation “it was not my goods.”

For a person acting on behalf of a foreign company, the contract and the relationship of representation are important. An invoice from a foreign country may show the acquisition of the goods; it does not on its own prove that the entry procedures into Türkiye were lawfully completed. Likewise, the import conditions in Türkiye for a product freely sold abroad may be different. The conditions of a claim of mistake in a transaction carried out without knowing this difference are examined separately.

How are personal use and commercial purpose distinguished?

Commercial purpose must be proved with respect to the type of offense for which the statute requires it. This element is important in particular for Art. 3/5 and for some product offenses. However, it cannot be said that commercial purpose is necessarily required in all smuggling offenses. For goods accompanying a passenger, Art. 6/4 and the relevant customs regulations are also considered together. [1]

The quantity of the goods, their variety, how many units of the same product there are, the packaging, the frequency of travel, sale listings, customer correspondence and money movements are assessed together. The consistency of the personal-use defense is important; but concluding a commercial purpose merely from the carrying of a single high-priced item may also be insufficient.

In its decision of 30.04.2024, E. 2023/10347, K. 2024/4557, the 7th Criminal Chamber of the Court of Cassation (Yargıtay) assessed the features of the event with respect to the telephone, cigarettes and tea found with a passenger; accepting that there was no commercial purpose in light of the personal-use and gift defense, it quashed the conviction. This decision does not mean that the quantities mentioned in it may be brought in duty-free or without limit today. [5]

In a decision of the same Chamber of 20.11.2024, E. 2024/2024, K. 2024/10115, by contrast, the personal-use explanation was not considered sufficient in light of the 74 cartons of cigarettes seized at a bus terminal and the circumstances of the event; the acquittal judgments were quashed. Reading the two decisions together shows that the type and number of goods should not be detached from the event and turned into a universal “offense threshold.” [6]

Which evidence and technical reports should be examined in the defense?

First, it is determined whether the goods are in fact the same goods and whether the examination was carried out on the correct product. The product description in the record, the sample, brand, serial number and photographs are compared with the report. What data the GTİP (tariff code), origin, value or laboratory report is based on should be explainable.

The customs-cleared value and the invoice amount are not the same concept. An error in the value used and in the duty calculation may affect the assessment of the penalty or the amount of effective repentance. On the other hand, an expert’s finding of a tax difference does not by itself resolve the existence of intent. The technical assessment and the legal assessment to be made by the court are separate. [1, 2]

The following documents can be compared in the defense file:

• The declaration, invoice, payment record, certificate of origin and transport documents.

• Orders, contracts, return correspondence and delivery records.

• The basis for the search order or special inspection, the seizure record and the judge’s approval.

• Sampling records, seal information, laboratory and valuation reports.

• The job description, power of attorney and correspondence connected with the event showing the person’s role.

Digital records should be preserved without alteration; instead of screenshots detached from their context, verifiable original records should be assessed. For documents containing trade secrets or personal data, only the part relevant to the file should be submitted and, where necessary, procedures protecting confidentiality should be requested.

Why do the search and the lawfulness of the evidence matter?

Whether evidence obtained unlawfully may be used as the basis of a judgment is examined separately under CMK Arts. 206 and 217. However, a customs inspection, a preventive search and a judicial search are not the same act. No single result can be established for all searches without taking into account the special powers in Art. 9 of Law No. 5607. [1, 7]

The objection must be concrete: the authority on which the search was based, the scope of the order, the time and place limits, the reason for delay, the record and the chain of custody of the evidence should be stated. A report does not become “unlawful evidence” because its result is disliked; an error of method or content and unlawfulness in obtaining it are different objections.

Under what conditions does effective repentance come into play?

Article 5 of Law No. 5607 separately contains the provision relating to giving information and contributing to the uncovering of the offense, and the provision on a reduction conditional on payment. In the payment-based Art. 5/2, for offenses within its scope, payment to the State Treasury of twice the customs-cleared value of the goods is provided for. Payment until the end of the investigation is linked to a reduction of one half; payment until judgment is given in the prosecution phase, to a reduction of one third. Art. 3/7, concerning goods whose import is prohibited by law, is outside this provision. For repeat offenders and for offenses committed within the scope of organized activity, the bar in Art. 5/3 is also taken into account separately. [1]

The Law provides for a warning by the prosecutor in the investigation and, if none was given, by the judge in the prosecution. In its decision of 24.01.2024, E. 2023/2174, K. 2024/843, the 7th Criminal Chamber of the Court of Cassation dealt with the failure to give a proper warning in the investigation and the investigation of the payment position. The decision shows that a person should not be misled with a wrong reduction rate. It cannot be generalized to mean that every payment made in the prosecution phase will automatically secure a one-half reduction. [8]

Before a decision to pay is made, the elements of the allegation, the amount calculated, the content of the warning, the stage and the exceptions should be examined. Effective repentance does not in every case produce acquittal, closure of the file, erasure of the tax debt or return of the goods. Article 13/2 of the Law also separately provides that not imposing a penalty because of effective repentance, or the dropping of the case, may not prevent confiscation of the goods that are the subject of the offense. [1]

How should the statement and application process be prepared?

The allegation, the date of the event and the paragraph sought to be applied should be learned. The rights to the assistance of counsel, to remain silent and to request the collection of evidence in one’s favor are assessed under the CMK. The need for an interpreter of a person who does not know Turkish should be notified. Instead of signing a ready-made defense without knowing the event, an explanation based on documents should be prepared. [7]

Alongside the criminal file, the separate dates of the administrative penalty, the vehicle measure and the liquidation proceedings should be kept. In past events, the provision in force on the date of the offense must be compared with a more favorable provision that entered into force later. Applying the current penalty range directly to an old event is not correct. The calculation of the application and of the legal remedy is also made according to the type of the relevant decision and the transitional provisions. [2, 7]

Conclusion

A smuggling defense is broader than the question whether a customs violation exists. The correct type of offense, the person’s contribution to the act, intent, commercial purpose if any, and the lawfulness of the evidence must be examined together. The tax and administrative sanction processes must be followed separately, and effective repentance must be assessed by verifying its calculation and conditions.

Frequently Asked Questions

Is every customs penalty the offense of smuggling?

No. The conditions of an administrative sanction and of criminal liability are different. All the elements of the offense must be assessed with concrete evidence.

If there is an invoice, does the smuggling accusation fall away?

An invoice can show the acquisition and the price; it does not in every case prove that the import was lawfully completed. It is examined together with the declaration and payment records.

Are goods brought in for personal use always free?

No. Personal use does not remove every import prohibition or declaration obligation. The offense that requires a commercial purpose and the customs exemption are assessed separately.

Is being a company manager sufficient for a conviction?

No. The personal act, knowledge and intent are investigated. The capacity of manager does not take the place of evidence; if there is real participation, liability may arise separately.

What happens if the carrier does not know the goods are smuggled?

The knowledge and intent requirements of the paragraph alleged are examined. Transport documents, instructions and the circumstances of the event are important for the defense.

How many units of a product count as commercial purpose?

There is no single number that applies to every item. Quantity, the nature of the product, and evidence of travel and sale are assessed together; the exemption limits are checked separately.

Is paying only the tax difference sufficient for effective repentance?

For the payment-based Art. 5/2, the statutory measure is twice the customs-cleared value of the goods within its scope. It should not be confused with payment of the tax difference or of an administrative fine.

Is effective repentance possible in the prosecution phase?

Subject to the scope and exceptions in the Law, there is a provision for payment until judgment is given. Whether the earlier warning was given should also be examined.

Does effective repentance necessarily secure the return of the vehicle?

No. Reduction of the penalty, the vehicle measure and confiscation are separate matters. For the vehicle, the conditions of ownership and special confiscation are assessed.

Does filing a tax action stop the criminal investigation?

It does not stop it automatically. The relationship between the files and, if any, the need for a preliminary question (bekletici mesele) are assessed by the competent authority; the time limits are followed separately.
