A person whose building registration certificate (yapı kayıt belgesi) has been cancelled may bring an action before the administrative court, asserting that the cancellation was unlawful. The general time limit for filing an action is 60 days, starting from the day following written notification. An administrative application under Article 11 of the Administrative Procedure Law (İYUK) may be made before filing the action; as a rule, however, it is not mandatory. Objecting to the administration or filing an action does not by itself stop the cancellation from being carried out. For urgent protection, a stay of execution must be requested separately. [1, Arts. 7, 8, 11, 27]
In these disputes, the decisive question is not merely “was a certificate obtained?” The following are assessed together: which structure and which works the certificate covers, when they were carried out, the ownership and protection status of the real property, whether there is a correctable error in the declaration, and what review the administration relied on in reaching its decision. Withdrawal of the certificate and the demolition, administrative fine, permit and land registry measures linked to it are likewise not the same legal act.
What rights does a building registration certificate provide?
The building registration certificate, regulated in provisional Article 16 of Zoning Law No. 3194, produces consequences for the existing use of the structure under certain conditions. It is not identical to a building permit or an occupancy permit. It does not alter the zoning plan; it does not grant unlimited authority to build a new floor, an additional building or a reconstruction. The scope of the certificate is determined by the information in the application and the physical condition that was recorded. [2, provisional Art. 16]
A valid certificate may, under the conditions set out in the law, serve as a basis for temporary utility subscriptions, for certain land registry transactions, and for the annulment of demolition decisions taken under Law No. 3194 and of administrative fines that cannot be collected. By contrast, protection regimes governed by special laws and the property rights of others are examined separately. The existence of a certificate does not mean that every sanction or private-law claim disappears. [2, provisional Art. 16; 3, Art. 6]
The certificate remains valid until the structure is rebuilt or an urban transformation project is carried out. On renewal, the zoning rules in force apply. For this reason, in a sale or investment review it is not enough to see a printout of the certificate: the status of the certificate in the system, its scope and its conformity with the existing structure must be investigated. [2, provisional Art. 16]
The certificate is not an assurance of earthquake resistance
By its decision of July 23, 2024, E.2023/74, K.2024/141, the Constitutional Court annulled the sentence in provisional Article 16 that left earthquake resistance to the responsibility of the owner. The Court held that the administration’s responsibility, which is linked to its duty of supervision and oversight, cannot be eliminated. An accessible secondary full text of the decision is listed in the sources. This decision does not turn a building registration certificate into a resistance report; nor does it annul all building registration certificates. [4]
Why is a building registration certificate cancelled?
The structure or the non-compliant work does not meet the date requirement
Provisional Article 16 was designed for structures built before December 31, 2017. The fact that a certificate was issued in 2018 or 2019 does not show that the structure was also built on that date. Likewise, the fact that the main building is old does not prove that a floor added later or a terrace later enclosed also falls within the scope. The review must be based on the specific work in dispute. [2, provisional Art. 16; 5]
The administration’s “new structure” assessment must be explained by reference to the date of the imagery, parcel matching, the building area, the number of floors and the nature of the change. A finding that confuses the application date of the certificate with the construction date, or that is based on construction on a neighboring parcel, gives rise to a challenge to the ground (sebep) element of the act.
Obstacles arising from ownership and protected areas
Special limitations apply to structures on privately owned property belonging to third parties and to structures on Treasury land allocated for social facilities. A finding that “this is Treasury real property” is not the same as a finding that “it has been allocated for the purpose of social facilities.” The title deed, the allocation act, the plan decision and the part of the real property that is actually used must be examined together. [2, provisional Art. 16; 3, Art. 8]
In special areas such as the Bosphorus, the historic peninsula and Gallipoli, the text of the applicable law, the relevant judicial decisions and the boundary coordinates are assessed together. A conclusion cannot be drawn merely from the name of the neighborhood. Under protected-site, coastal, forest or other protection statuses, whether a certificate can be issued and whether action can be taken under the special law must be distinguished separately.
Incorrect declaration and shortfall in the fee
An untrue construction date, incorrect real property information and an area error giving rise to a shortfall in the fee cannot be subject to the same legal assessment. Article 10 of the Communiqué provides for a correction to be made and the difference to be paid where the fee is insufficient. It should be examined whether the administration went directly to cancellation without operating this procedure. On the other hand, payment of the fee difference does not bring a new structure outside the scope within the zoning amnesty. [3, Art. 10]
How is the construction date proved?
In a dispute over the construction date, excessive weight should not be placed on a single document. An old electricity subscription may show the use of the main building; it may not show the date of an addition later made on the upper floor. A current inspection report, if it records only the condition on the day it was drawn up, may likewise fail to establish the past construction date on its own.
When preparing the defense, each document should be placed in the file together with a statement of which work and which date it proves. Problems of scale, shooting date, coordinates and visibility in maps and photographs should be explained; where necessary, different dates should be compared. The court’s power to investigate of its own motion does not remove the claimant’s need to submit the documents in its possession and to make the contradictions concrete. [1, Art. 20]
| Document or review | What it shows | Limit to keep in mind |
|---|---|---|
| Dated aerial and satellite imagery | The appearance of the structure on a given date | Roof covering, shadow and resolution may conceal the interior or a floor. |
| Municipal archive and earlier inspection report | The physical condition at the earlier inspection | A link to the same parcel and the same work must be established. |
| Subscription and street-numbering record | The history of the address and of its use | Does not by itself prove the date of a later-added section. |
| Dated photographs and technical report | The nature and stages of the work | The source, date and matching to the structure must be verifiable. |
| On-site examination and expert review | Assessment of technical contradictions | Questions should be prepared specifically for the work in dispute. |
Council of State decision: satellite imagery and the need for an on-site examination
In the decision of the Council of State (Danıştay) 6th Chamber dated May 3, 2023, E.2021/11103, K.2023/4385, the structures in Urla and the works added later were examined. The majority dismissed the action directed at the cancellation and updating acts on the basis of the imagery and documents in the file. The dissenting opinions argued that the date of some works should have been clarified by an on-site examination and expert review. [5]
The decision cannot be read as “satellite imagery is never sufficient” or “an on-site examination is always carried out in every dispute.” The probative force of the imagery in the specific file and the technical doubts are what matter. The dissenting opinion contributes to the discussion of incomplete review in the defense without replacing the majority’s ruling.
Can the certificate be updated without being cancelled entirely?
Updating means bringing the existing record into line with the real and legally protectable situation. It is not a method of retroactively conferring rights on a structure that does not meet the application conditions. Where the old main structure and the later works can be separated, the scope of the certificate that can be preserved must be shown technically.
In the 2023 Council of State decision above, the 15-day period given by the administration for updating the certificate in respect of the earlier works, leaving out the third floor added later to the old structure, was also in dispute. This period is an element of the act in that file; it is not a general time limit for filing an action that applies to all update applications. In the decision, the full cancellation of the certificates of some other structures and the updating of the existing structure were assessed separately. [5]
Hypothetical example: Suppose a third floor was added in 2019 to a two-story building that existed in 2015, and the whole was shown in the application. Submitting a 2015 invoice for the building alone is not enough to protect the third floor. The scope of the old part, the status of the new part, technical separability and the steps the administration requires for updating must be determined. Deleting the new floor from the record does not mean that a non-compliance left in place in fact has been remedied.
When an update application is made, the time limit for an action against the cancellation must be protected separately. The fact that the heading of the application says “update” does not mean that it automatically suspends the time limit under İYUK Article 11; the content, addressee and timing of the request are examined. [1, Art. 11]
What unlawfulness is examined in a cancellation act?
In an annulment action, the act is reviewed as to competence, form, ground, subject matter and purpose. Rather than basing the petition only on the claim “I had a certificate, it cannot be cancelled,” it should show which finding of the administration is wrong and why. [1, Art. 2]
• Competence: Which authority took the act and the basis for the signature and delegation are examined. The general assertion that a provincial directorate never has authority to cancel is not sufficient. In its 2023 decision, the Council of State assessed the Ministry’s delegation letters and did not accept the objection of lack of competence. [5]
• Ground and review: The underlying imagery, technical report, title deed and plan data are requested. An error as to the parcel, date or square meters is made concrete.
• Subject matter and proportionality: A correctable deficiency is distinguished from a situation that was an obstacle to issuing the certificate from the outset. The reasoning for an act directed at the whole certificate is questioned.
• Procedure and notification: The date, number, scope and manner of service of the act are determined. A service problem is not confused with unlawfulness going to the merits of the act.
Council of State decision: determining the Bosphorus boundary
In the decision of the Council of State 4th Chamber dated May 6, 2025, E.2025/708, K.2025/2909, it was discussed whether the real property was in the Bosphorus view zone. The regional administrative court assessed the location on the basis of the map and sketch obtained from the administration; the Council of State affirmed the decision, preserving the dismissal of the action. [6]
The contribution of this decision to practice is that the character of the zone is determined by technical documents. It cannot be said that the same result automatically applies to other parcels or that all protected sites are subject to a single rule. It is important to attach to the application a verifiable study showing the location of the real property within the boundaries.
Time limits for objecting to the administration and filing an action
The sixty-day period and service
The general time limit against an individual cancellation act is 60 days from the day following written notification. For electronic service, the date on which service is legally deemed to have occurred must be determined separately. When the certificate is seen as inactive in e-Devlet, a copy of the act should be requested immediately; one should not wait on the assumption that “the time limit never starts unless an official letter arrives.” Disputes about learning of the act and about service are assessed according to the characteristics of the file. [1, Arts. 7, 8]
What consequence does an İYUK Article 11 application have?
Within the time limit for filing an action, the removal, withdrawal or amendment of the act may be requested from the superior authority; if there is no superior authority, from the authority that took the act. A properly made application suspends the running of the time limit for filing an action. If no reply is given within thirty days, the request is deemed rejected. After an express or implied rejection, the remaining period, taking into account the time that passed before the application, continues to run. It should not be assumed that a new 60-day period begins. [1, Art. 11]
For example, if 20 days of the time limit for filing an action had passed before the application, the balance to be used after rejection is 40 days. In the concrete calculation of the last day, the provisions on service, holidays and judicial recess are applied separately. A request for information and an application for the withdrawal of the act are not the same; one should not rely on a petition submitted to the wrong authority or after the time limit for filing an action has expired.
| Act or application | General time limit | Legal effect |
|---|---|---|
| Action against an individual cancellation act | 60 days from the day following written notification | Filing an action does not by itself stop implementation. |
| İYUK Article 11 application | Within the time limit for filing an action | Suspends the time limit for filing an action, if the conditions are met. |
| No reply to an Article 11 application | 30 days | Implied rejection arises; the remaining time limit for filing an action continues to run. |
| Objection to a stay-of-execution decision | 7 days from the day following service | The authority specified in the law may be applied to once. |
| Appeal (istinaf) against a first-instance decision | As a rule 30 days from service | Finality and the provisions on legal remedies are checked separately. |
The time-limit table is the general framework for an individual building registration certificate cancellation act. The time limits are calculated afresh where a regulatory act is separately challenged, where a third party applies against the certificate, or for a claim for compensation. [1, Arts. 7, 10, 11, 12, 27, 45]
In which court, and against whom, is the annulment action filed?
In a dispute over the cancellation of an individual building registration certificate, the competent judicial forum is the administrative judiciary; under the rule of jurisdiction relating to real property, the application is as a rule made to the administrative court of the place where the real property is located. Where a regulatory act applied nationwide is also challenged, the first-instance jurisdiction of the Council of State may additionally come into play. These two claim structures should not be confused. [1, Art. 34; 5]
The defendant is determined according to the administrative body that took the act under challenge. If the cancellation decision was taken within the governorship, naming only the municipality as defendant may not be correct; a demolition or permit act separately taken by the municipality is different. The court’s ability to correct the defendant does not justify leaving the petition unclear as to the act and the request. [1, Art. 15]
For the claimant, the current, personal and legitimate interest is explained. The certificate holder, the new owner and other right holders may not be in the same position. In an application on behalf of a company, authority of representation, and in the case of inheritance, documents proving entitlement, must be prepared. There is no general mandatory mediation stage for an administrative annulment action.
How should the request be framed in the petition?
The certificate number and the date and number of the cancellation act are stated clearly. In addition to annulment, a stay of execution, the obtaining of the act file, and an on-site examination and expert review are requested where necessary. In a request for technical review, the question to be resolved is written out. If annulment of a demolition or fine is also sought, those acts, their time limits and the conditions for suing jointly are assessed separately. [1, Arts. 3, 5, 20, 27]
Application and decision fees, postage costs, where necessary the on-site examination and expert advance, and the risk of the opposing party’s attorney fee are taken into account. A fixed total litigation cost cannot be given without relying on current tariffs. Whether security may be required for a stay of execution and whether, where the conditions are met, a decision may be given without security are likewise assessed in light of the file. [1, Arts. 6, 27]
How is a stay of execution requested?
For a stay of execution, the act must be clearly unlawful and its implementation must cause damage that is difficult or impossible to remedy; both conditions must be present together. Rather than a statement that “I will suffer,” both the concrete error in the ground for annulment and the imminent and serious consequence of implementation must be shown. [1, Art. 27]
For example, a cancellation act based on an image of the wrong parcel can be explained in terms of unlawfulness; a notified demolition date, the closure of a business or the loss of housing can be explained in terms of damage. The lease agreement, activity documents, the administration’s implementation letter and the technical report may assist this assessment. A claim of economic loss must likewise be made concrete as to its nature and whether it can be remedied.
For acts whose effect would be exhausted by their implementation, a provisional decision may be given under the conditions in the law without obtaining the defense. However, this does not mean that the request will be granted or that a decision will be issued the same day. The seven-day period for objecting to a decision on a request for a stay of execution must be monitored separately. [1, Art. 27]
The fact that an action has been filed against the cancellation of the certificate does not preserve the time limit for an action against the municipality’s separate demolition decision. It must be clear against which act or acts the request for interim protection is directed. When the court’s decision is issued, it must also be delivered to the relevant administrations, and it must be monitored whether actual implementation has been halted.
Effect of cancellation on demolition, fines and the business license
Cancellation of the certificate affects the basis of the protection it provided. Nevertheless, the conclusion “it was cancelled, therefore all acts are automatically valid” cannot be drawn. In a demolition decision, competence, the report, the scope of the non-compliance and procedure are examined; in an administrative fine, liability and calculation elements are examined separately. The withdrawal of an earlier sanction and the imposition of a new sanction are also separate legal situations. [2, Arts. 32, 42 and provisional Art. 16]
New acts taken while the action against the cancellation is pending should be notified to the file. If the certificate covers only a particular independent unit, it should not be assumed to provide protection for a non-compliance in another unit. Refund of a fine that has been collected is likewise not identical to the provision in provisional Article 16 concerning fines that cannot be collected.
Council of State decision: cancellation of the certificate may affect the business license
In the decision of the Council of State 4th Chamber dated May 7, 2025, E.2023/13186, K.2025/2915, the subject of the action was the business opening and operating license issued to a store. Because the building registration certificate for the structure, issued for business use, had been annulled by a court decision, the condition of conformity with zoning legislation was assessed; the regional administrative court decision, which had preserved the dismissal of the action against the license, was reversed. [7]
This is not a decision given directly in an action for the cancellation of a building registration certificate. It shows that the effect on a dependent license is examined in a separate action. It cannot be said that all businesses will automatically close without investigating the other bases of the specific license, the type of use and the conditions of condominium ownership.
The position of a person who later buys the real property
The fact that the buyer did not make the original application does not mean that the structure meets the conditions in the legislation. Good faith does not by itself make work outside the scope lawful. On the other hand, the new owner’s interest, when they learned of the cancellation, to whom service was made and the earlier proceedings must be assessed separately. It should not be assumed that a sale in every case starts a new time limit for filing an action. [1, Arts. 2, 7, 11]
In a review before purchase, the certificate number, the application declaration, the payment record, the update history, the existing structure and the municipal archive should be seen together. The seller’s undertakings in the contract and whether the seller disclosed a known cancellation or inspection process should be recorded. Administrative applications and private-law claims that may be directed against the seller are different legal relationships; jurisdiction, time limits and, where applicable, conditions for bringing the action are investigated separately.
The cancellation of the certificate should not be interpreted as a decision that automatically erases all entries in the land registry. Even where the basis of a condominium ownership or change-of-category transaction has been affected, how the register is to be corrected and the rights of third parties are examined separately. In the application file, personal data and records belonging to third parties should be used only to the extent relevant to the dispute.
Can the building registration certificate fee be recovered?
The reason for the refund must first be determined: is there an overpayment arising from the area or fee calculation, or is the total fee paid for the cancelled certificate being claimed? Article 10/2-b of the Communiqué provides for a separate correction procedure for refund of the overpaid portion. This possibility does not mean that the total fee will be refunded to everyone whose certificate is cancelled. [3, Art. 10]
The 2025 appeal outcome of a 2024 decision
By its decision of March 5, 2024, E.2021/10207, K.2024/1541, the Council of State 6th Chamber annulled, in the relevant part, the provision that the fee will not be refunded and the rejection acts in the dispute. However, the decision of the Plenary Assembly of Administrative Chambers of the Council of State (İDDK) dated February 27, 2025, E.2024/1884, K.2025/462, reversed that annulment part by majority vote and affirmed the part dismissing the action concerning cancellation of the certificate and withdrawal of rights. The majority assessed the provision as consistent with statutory authority. The dissenting opinion argued that the annulment part of the Chamber’s decision should be preserved. [8]
This course of events shows that a definite right to a refund cannot be advertised on the basis of the 2024 decision. The decisions were assessed from an accessible secondary report of the decisions; the direct link may require a login. The new judgment after the reversal is not presented here as a final outcome. Overpayment, an incorrect collection and lawful withdrawal of the certificate are different grounds for a refund.
If a refund is sought, the payment receipt, the payer, the certificate number, the ground for cancellation, the amount claimed and the claim for interest must be set out clearly. Rejection of the application, annulment and full remedy claims and the time limits for the action are assessed together. A request to regain the certificate and a request to recover the fee do not replace each other. [1, Arts. 10, 12]
If the action is won, does the certificate become valid again?
The requirements of the court’s decision of annulment or stay of execution must be carried out by the administration without delay; the general upper limit in İYUK Article 28 is 30 days from service of the decision on the administration. Correction of the system record in line with the result of the decision and notification to the relevant institutions are requested. Thirty days is not a period that gives the administration authority to wait in every case. [1, Art. 28]
A new zoning amnesty application must be distinguished here from the remedying of the consequences of an unlawful cancellation act. The court does not step into the administration’s place and issue unlimited new certificates. An annulment based on a procedural or competence error may not mean that the substantive conditions were necessarily met; the administration may take a new act consistent with the reasoning of the decision. Exactly which act the decision affects, and on what grounds, must be read.
Appeals (istinaf) and cassation appeals (temyiz) likewise do not by themselves stop the implementation of the decision; it is monitored whether a separate stay has been ordered at the appellate level. Whether an appeal on points of law is available depends on the current conditions in İYUK Article 46. If the decision is not implemented, a written application and the necessary legal remedies are assessed together with the concrete damage that has arisen. [1, Arts. 28, 45, 46, 52]
Conclusion
An effective application against the cancellation of a building registration certificate must test the ground for cancellation against concrete records. The construction date, the scope of the certificate, the ownership and protection status and the possibility of updating are examined together. While the time limits for the administrative objection and the action are protected, a stay of execution is requested separately if there is a risk of urgent damage.
Cancellation of the certificate, a demolition decision, an administrative fine, a business license and a refund of the fee may affect one another; but each must be tracked separately as to the act, the request and the time limit. The first thing to do is to obtain the cancellation decision and the service record, and to compare the underlying technical review with the actual scope of the certificate.
Frequently Asked Questions
What is the time limit for an action against cancellation of a building registration certificate?
The general time limit against an individual act is 60 days from the day following written notification. The nature of the service, the administrative application and the holiday provisions are taken into account in the concrete calculation. [1]
Is it mandatory to object to the administration first?
As a rule, no. An annulment action may be filed directly. If an İYUK Article 11 application is preferred, it must be made to the competent authority and within the time limit for filing an action. [1]
If the objection is rejected, do I get 60 days again?
In an application under İYUK Article 11, as a rule only the remaining period runs. The days that passed before the application are taken into account. This should not be confused with the Article 10 regime for a request for a new act. [1]
Does filing an action automatically stop the demolition?
No. A request for a stay of execution is required. If there is a separate demolition decision, the time limit for an action against it and the need for interim protection must be assessed separately. [1]
Does an old electricity bill prove the construction date?
It may help; however, a link to the floor or addition in dispute must be established. A subscription for the old main building does not by itself show that the new addition is also old.
Can the certificate be cancelled immediately because of a shortfall in the fee?
The Communiqué contains a procedure for correction and for making up the shortfall in the fee. Whether it was applied is examined. Making up the shortfall does not remedy a situation that was an obstacle to obtaining the certificate from the outset. [3]
Does a floor added later affect the whole certificate?
It may; however, the scope of the old and new works and the possibility of updating must be investigated. Neither automatic partial protection nor automatic full cancellation can be concluded for every file. [5]
If the certificate is cancelled, will I necessarily get back the money I paid?
No. A refund of an overpayment is different from a refund of the total fee of a cancelled certificate. The 2025 Plenary Assembly decision reversing the 2024 decision on refunds must also be taken into account. [3; 8]
Is a person who buys later liable for a false declaration?
Mere purchase does not turn a false declaration in an earlier application into the buyer’s own act. Who made the declaration, representation and personal conduct are examined. An administrative cancellation or a criminal complaint is not by itself a criminal conviction. [5]
Does winning the annulment action give the right to build anew?
No. The effect of the decision is limited to its scope as to the certificate and the cancellation act. New construction, reconstruction and additions are subject to the zoning legislation in force. [2]
