Summary

Review the deadline to sue against tax and penalty assessment notices, electronic notification, grounds for annulment, evidence and the effect of a settlement on the right to sue.

The main judicial remedy against a tax or penalty assessment notice is to file an annulment action before the tax court within the general 30-day period that starts on the day after notification. Each tax, period and penalty in dispute should be identified separately. Each petition filed with the tax office does not stop the time limit. Where settlement is requested for a penalty, the principal tax outside the settlement still requires separate deadline tracking. 1 2

When a notice arrives, looking only at the total debt is not enough. The same examination may lead to several tax types, several periods and different penalties. Setting up the file correctly, keeping the notification records and identifying the proper route for each step prevents loss of rights. This article addresses the tax and penalties stated in an assessment notice. Payment orders and attachments are separate steps of the collection stage.

What is the difference between a tax assessment notice and a payment order?

A tax assessment notice (ihbarname) informs the taxpayer of the tax or tax difference calculated by the administration. A penalty notice (ihbarname) sets out the type, amount and legal basis of the sanction. Appearing on the same document does not mean that the tax and the penalty have identical legal consequences. The provisions of the Tax Procedure Law No. 213 (VUK) on the content of the notice and on the notification of penalties are read together. 1

A payment order aims at the forced collection of a public receivable alleged to be unpaid when due. The material and legal basis of the tax assessment may be disputed against the notice, but the grounds and time limits differ for a payment order. Raising objections to the calculation of the tax by waiting for a payment order may lead to the loss of the right to sue against the assessment.

How should the notified document be classified?

The content of the document matters as much as its heading. The issuing authority, transaction number, debt period and legal basis are all relevant. A tax inspection report, an invitation to provide explanations (izaha davet) letter, a request to produce books and an assessment notice are not the same transaction. A report is usually the preparatory basis of the assessment, and receiving a report does not in every case replace the notification of the notice. Conversely, an act with an independent legal effect cannot be treated as outside judicial review merely because it is titled "report" or "letter."

At the initial review, record for each document its issue date, notification date, legal consequence and filing deadline on a separate line. This keeps the administrative review stage from being confused with the stage of filing a lawsuit.

How is the deadline to sue calculated?

Under Article 7 of the Administrative Procedure Law No. 2577 (İYUK), the deadline in tax cases without a special provision is 30 days. The day of notification is not counted; the following day is day one. The provisions of İYUK Article 8 on a last day that falls on a holiday and on the suspension of work during the recess apply separately. "One month" and "30 days" are not the same period. Where the period falls within the fiscal recess, the provision of Law No. 5604 that suspends the running of action time limits, and its exceptions, are examined separately. Fiscal recess and the suspension of work are not the same regulation. 2 4

Which date governs electronic notification?

Electronic notification under VUK Article 107/A is deemed made at the end of the fifth day following the date on which the document reaches the electronic address. The date on which the message is actually opened may differ from the legal notification date. Instead of relying on an SMS or email alert, keep the electronic notification envelope and the system's delivery records. For documents delivered through another electronic notification system, that system's own legislation is examined. 1

A claim of irregular notification must be substantiated. Who was the addressee, to which address the document was sent, what the electronic notification obligation was, and how delivery took place must all be investigated. The statement "I had no knowledge" is not sufficient on its own. The defect in the notification record must be shown to be legally invalid.

Does an objection to the tax office stop the time limit?

An application for revocation, withdrawal or amendment made within the lawsuit period, under the conditions of İYUK Article 11, stops the running of the period. After an express rejection, or at the end of the 30-day period of non-response under the current regulation, the remaining lawsuit period resumes; the days elapsed before the application are counted. The former provision that excluded tax transactions from this article entirely is no longer in force. Nevertheless, the VUK correction and complaint route, time-limited proceedings and petitions that merely request information are not the same. It should not be assumed that the period has stopped before the content and legal nature of the petition are determined. 2

VUK Article 116 and the following provisions, the correction route, are aimed at removing calculation or taxation errors. Not every dispute that requires extensive legal interpretation is a taxation error. Being able to apply through correction and complaint after the lawsuit period has passed does not mean that all objections to the original assessment will be reviewed again, without limit.

On what grounds can a notice be annulled?

The taxable event and an incorrect determination of the tax base

It may be argued that the taxable event did not occur, that income or a transaction was attributed to the wrong person, that exemption conditions were disregarded, or that the tax base was calculated incorrectly. The defense should not be limited to showing that an invoice exists. The contract, bank movement, delivery record, inventory, service output and accounting entries should explain one another.

For example, against the treatment of every amount that enters a bank account as sales revenue, a loan agreement, a capital payment or a refund transaction may be documented. However, merely writing "loan" in the description field does not fix the economic nature of a transaction. The relationship with the sender, the repayment and the commercial records are assessed together. The approach to the actual nature of a transaction and to proof under VUK Article 3 matters for the claims of both parties. 1

The condition for an ex officio assessment and the tax base calculation must be examined separately

The existence of a deficiency that permits an ex officio assessment does not by itself make the whole base chosen by the administration correct. Against a claim of failure to present books or of irregular records, first determine whether that ground actually occurred, and then whether the discretionary or examination-based calculation was built on concrete data.

The administration may show deficiencies that undermine the reliability of the records. The taxpayer may explain that the comparison was made on the wrong period, product or business, or that costs and returns were excluded. An alternative calculation table in the file is more useful than merely stating that "the base is excessive."

Limitation and procedural defects

The general limitation period for assessment under VUK Article 114 is five years, counted from the beginning of the year following the year in which the tax claim arose. Statutory suspension and special period provisions are examined separately. Preparing the transaction within the period alone is not the same as lawful notification of the tax. The limitation period for penalties is also to be assessed separately under VUK Article 374. 1

The mandatory content of the notice, its reasoning and the accessibility of the reports it relies on matter for the right of defense. However, it cannot be said that every formal defect automatically results in annulment. The concrete effect of the defect on understanding the act, on determining which debt is claimed, or on an effective defense should be explained. This heading is also addressed in the article on what to do if the tax technique report is not notified.

Does filing a lawsuit stop collection?

Filing an action in the tax court for a tax dispute stops, within the framework of İYUK Article 27(4), the collection of the tax, duty, fee or similar financial obligation subject to the action, together with its surcharges and penalties. The same result cannot be assumed for the part that is not challenged. In statutory exceptions, such as actions brought on a declaration made with protest (ihtirazi kayıt) and collection measures, a stay of execution is evaluated separately. 2

Check whether the tax office records show that the action has been registered. A payment order or attachment received later may itself be subject to a time limit; the existence of the first action does not automatically cancel every new step. Filing an appeal after a first-instance decision does not automatically stop the decision from being enforced.

How is the petition and evidence file prepared?

The petition clearly states the competent court (by subject matter and by territory), the parties, the transaction details, the notification date, the amount in dispute, the legal grounds and the result requested. The general rule of territorial jurisdiction under Article 37 of İYUK, under which the tax court in the place of the office that assessed the tax or imposed the penalty is competent, is important. Whether a single petition can cover several transactions is evaluated under the connection conditions of İYUK Article 5. 2

  • A complete copy of each notice and its notification record.
  • The examination report, the committee decision and any additional calculations.
  • A table showing, by tax type and period, the administration's calculation against the taxpayer's counter-calculation.
  • Evidence linking the invoice, contract, payment, dispatch and performance of the service.
  • Earlier applications, replies and any settlement minutes.

The court's power of ex officio investigation does not justify a party leaving its claim without documents. A report or administrative record that is not in hand may be requested by clearly identifying it. The reason why a document submitted later could not have been presented earlier should also be explained.

Example: one report, different subjects of action

Assume a hypothetical business is subject to corporate tax, VAT and a tax loss penalty (vergi ziyaı cezası), all based on the same report. The cost dispute in corporate tax and the conditions for the VAT deduction are not the same. If the petition states only that the report is generally wrong, the distinction required for each period, base and penalty is lost. For each transaction, the report finding, the counter-evidence, the effect on the calculation and a separate annulment request should be set out.

What should be considered when choosing a settlement or a reduction?

Under the regime amended by Law No. 7524, the principal tax has been removed from the settlement scope. When a settlement meeting is requested for the penalty, the lawsuit schedule for the principal tax should be kept independent. Transitional provisions for earlier applications are checked separately. There are legal limits on filing a new action regarding a penalty that has been settled and on applying another reduction. 1 3

The reduction under VUK Article 376 depends on specific application, payment and not-filing-a-lawsuit conditions. Making a single reduction application for all notices, without first determining which transaction will be contested, may later complicate the defense strategy. The principal tax, the penalty and the interest should be evaluated separately before a decision is made. 1

Conclusion

An effective application against a notice rests on choosing the correct procedure, calculating the period from notification and matching each claim about the base with evidence. The first step is not to wait for every detail of the report to be completed, but to secure the timetable for the lawsuit and for the administrative applications. The examination, settlement, reduction and collection stages may meet in the same file, but each has its own legal effect.

Frequently Asked Questions

What is the deadline to object to a tax assessment notice?

In tax cases without a special provision, the general period is 30 days. The day of notification is not counted; electronic notification and holiday rules are also taken into account separately. The distinctions explained in "How is the deadline to sue calculated?" should be applied. Return to the related explanation

Does filing a petition with the tax office replace a lawsuit?

No. A petition submitted to the administration is not a lawsuit filed in court. The special time-limit regime explained in "Does an objection to the tax office stop the time limit?" should be checked. Return to the related explanation

Can an action be brought against the penalty alone?

The claim may be limited to the penalty. However, the effect of this on the finality of the principal tax and on the grounds for the penalty should be evaluated. The scope of the action explained in "Does filing a lawsuit stop collection?" is important. Return to the related explanation

Is it sufficient to request annulment of the examination report?

Generally, the tax or penalty act that has legal consequences is made the subject of the action, rather than the report that prepares the assessment. The distinction between documents explained in "How should the notified document be classified?" should be followed. Return to the related explanation

Does a settlement request also extend the time limit for the principal tax?

Since the principal tax is outside settlement under the new regime, this result should not be relied on. As explained in "What should be considered when choosing a settlement or a reduction?", the calendar for the principal tax should be kept separate. Return to the related explanation
