The sale of real estate attached for a tax debt is a separate act from the payment order and the attachment decision. Annulment (fesih) of a real estate auction carried out by the tax office under Law No. 6183 is sought by way of a complaint to the enforcement court where the real estate is located. Article 99 of the Law provides that service of the auction on the person concerned is the starting point of the seven-day application period. This special rule must not be confused with the general accounts of time limits used for all enforcement auctions.
The owner of the real estate must first determine which act is being targeted: the debt itself, personal liability, the attachment, the valuation, sale preparations and a completed auction are different legal issues. A request for annulment of the auction does not by itself restart time limits for cases that have been missed against earlier acts. By contrast, material unlawfulness in the enforcement and sale file should be examined within the correct remedy.
How is a tax attachment distinguished from annulment of a real estate auction?
An attachment imposed to collect a tax receivable is a compulsory enforcement act that prepares the way for the sale of the property. The unlawfulness of the attachment and the unlawfulness of the auction held by the sales commission are not the same claim. The existence of a case filed in the tax court against the attachment does not by itself eliminate an auction held later.
Which judicial path to take is determined by the real nature of the act. An application in the administrative courts against the tax office’s collection act and a complaint for annulment brought before the enforcement court under Article 99 of Law No. 6183 cannot be used in place of one another. It is also not sufficient for the heading of the petition to say “cancellation of the sale”; the result sought and the decision targeted must be stated clearly.
| Act examined | Basic examination | Point of attention for the application |
|---|---|---|
| Payment order | Debt, service of notice and liability | Has its own special time limit for a case |
| Tax attachment | Basis and scope of the attachment | Tax jurisdiction and interim protection are assessed separately |
| Sale preparations | Value, announcement, specification and notification | It is examined whether the act is an independent subject of a case |
| Completed real estate auction | Lawfulness of the auction | Special annulment route under Article 99 of Law No. 6183 |
Is the same court applied to in a sale by the SGK?
The main subject of this article is a real estate sale carried out by the tax office. In enforcement proceedings under Law No. 6183 conducted by the SGK, however, the special jurisdiction provision of Article 88 of Law No. 5510 is important. In Section 21.10 of the SGK’s Circular No. 2024/12, the labor court is indicated for annulment cases concerning the Institution’s real estate auctions. A court should not be chosen without seeing which institution carried out the auction. A sale by a special enforcement office is also not identical to a tax office sale.
How is the seven-day period for annulment of the auction calculated?
The express provision of Article 99 of Law No. 6183 is based on service of the auction on the persons concerned. The date of the auction, the drawing up of the auction decision, the announcement and the service on the person concerned are separate records. The auction decision and the service document should be obtained first; to whom, at which address and by which procedure notice was given should be determined. In electronic service, the dates of reaching the system, being read and being legally deemed served must not be confused.
In calculating the period, the starting day, the last day falling on a holiday and the procedural provisions that apply are examined together. If an allegation of defective service is made, how the person learned of the auction must be documented; the possibility that the service may be deemed valid must not be ignored. Waiting on the idea that “the service is defective, so the period never starts” is not safe. The file should be prepared at the moment the auction decision becomes known.
Submitting a petition to the tax office for the sale to be lifted does not replace an application to the enforcement court. Talks with the administration, payment negotiations or waiting for documents do not by themselves extend the special seven-day period. When the application is made, the file information should also be notified to the sales unit, so that the fact that the court has been applied to is taken into account at the registration stage.
Which unlawful acts are examined in the annulment of an auction?
A request for annulment should not rest solely on the claim that “my property was sold cheaply.” It must be explained which mandatory rule the sale was conducted in breach of, and what effect that had on participation, competition, the price or the rights of the person concerned. Not every formal deficiency carries the same weight; the applicant’s capacity, legal interest and claim of concrete harm are also assessed.
Deficiencies in the announcement, service of notice and specification
In the sale announcement, the nature, location, legal status or auction conditions of the real estate may have been shown incorrectly. Differences between the specification and the announcement may cause participants to bid on the basis of different information. The scope of the announcement, the method of publication and its statutory timing should be examined together with the notifications that had to be made to the persons concerned.
For these claims, a copy of the announcement, publication records, the version of the specification on the auction date, the title deed record and service documents are needed. A web page that was changed afterwards may not by itself prove the announcement on the day of the auction. Against the administration’s defense that “the necessary announcement was made,” it must be made concrete which obligation was not met.
Valuation and the real characteristics of the real estate
The zoning status of the real estate, the building permit, the actual area of use, the co-ownership structure, the encumbrances and the market conditions on the valuation date are assessed together. That the subject of the sale as announced and the property that was valued are different, or that the wrong surface area or comparables were chosen, may be placed at the center of the examination.
However, the asking price in a current real estate listing is not conclusive proof of a market value as of an earlier date. A technical objection should be prepared on the basis of the method in the valuation report and the date and similarity of comparable sales (emsal). Earlier notifications and opportunities to apply concerning the valuation should also be shown in the file; it should not be assumed that every valuation objection will be heard without limit after the auction.
Prohibition on participating in the auction and distortion of competition
Law No. 6183 contains rules on persons who cannot participate in the auction and on the conduct of the auction. Claims of direct or indirect participation by a prohibited person, of conduct preventing participants, and that the bidding process did not reflect reality must rest on concrete documents. The auction record, the list of participants, security deposit records and, if any, electronic records obtained lawfully are examined.
Closeness or acquaintance alone does not prove fraud. By contrast, payment records that support one another, documents showing concerted action and contradictions in the record may be significant. Filing a criminal complaint does not replace an application for annulment of the auction and does not preserve the short complaint period.
How are the sale or title registration stopped?
If protection is sought before the auction, interim protection should be considered in the judicial path suited to the nature of the existing attachment or sale act. After the auction has taken place, the registration regime in Article 99 becomes important: the notification for registration with the land registry must not be made before the complaint period has expired and, if a complaint has been filed, without regard to its outcome.
This protection does not mean “I applied, so all acts were deleted automatically.” The date and scope of the application and the court decisions should be shared with the collection office, and the status of the land registry records should be monitored. If there is a separate stay of execution or injunction decision, the act to which the decision relates must be stated clearly.
Which documents should be in the application file?
The auction decision and the service document come first. To these are added the payment order, attachment records, the sale decision, the valuation report, the specification, the announcement, the bidding records and the encumbrance information on the title deed. Documents showing the applicant’s capacity as owner, co-owner, rightholder or other interested person are also submitted.
The petition should not be content with merely requesting that the whole file be brought in. Each claim should, as far as possible, be linked to a specific record. For a document held by the Institution, a request for production is made by showing its name, its date and which unlawfulness it will explain. The prayer for relief should be stated clearly as to annulment of the auction, the necessary interim protection and costs.
Does a decision annulling the auction also eliminate the debt?
No. A decision of annulment concerns the outcome of the auction act; it does not mean that the tax debt and the attachment disappear in every case. A new sale, correction of earlier preparatory acts, refund of the price paid by the buyer and remedying the registration status are followed according to the scope of the decision.
If the application is rejected, the remedy against the decision must be determined by examining together the date of the decision, the special and general procedural provisions that apply, transitional arrangements and monetary limits. Statements on remedies and monetary limits in old consolidations of the statute should not be used without investigating the current regime. A claim by the auction buyer for a refund of the price or for loss of value of the money also requires an assessment separate from the debtor’s request for annulment.
Conclusion
In the sale of real estate attached for a tax debt, effective legal protection depends on targeting the right act in the right court and within its own time limit. The special seven-day period tied to service of the auction on the person concerned should be examined together with the notification records in the sale file; the grounds for annulment should be based on concrete documents. The attachment case, the auction complaint and the title registration stages should be tracked separately.
