Summary

The conditions for precautionary attachment for tax debt, the 15-day time limit for an action, lifting by security and the documents needed for a stay of execution.

Precautionary attachment (ihtiyati haciz) for a tax debt is a temporary protective measure applied to property, rights or receivables in order to secure collection of a public receivable. That the ordinary stage of compulsory collection has not yet been reached does not, by itself, make the measure unlawful. Conversely, the existence of a tax audit is not in every case sufficient for precautionary attachment. The statutory ground, the competent authority, the date of the act and the scope of the values attached must be examined together.

Article 15 of Law No. 6183 provides a special 15-day period against precautionary attachment. For a precautionary attachment relating to a tax receivable, an annulment action must be filed in the tax court and, if the necessary conditions exist, a stay of execution must be requested. Filing a petition for lifting with the tax office should not be treated as a substitute for protecting the time limit for filing an action.

What is the difference between precautionary attachment and ordinary tax attachment?

Ordinary attachment is aimed at the compulsory collection of an unpaid public debt. Precautionary attachment, on the other hand, serves to prevent the loss of the possibility of collection. For this reason, the fact that the payment order stage required in ordinary enforcement has not been completed is not, by itself, a ground for annulment as regards precautionary attachment. The article on which the act is based is as decisive as the name of the act applied.

The type of attachment may not be clearly understood from a block on a bank account or an entry in the vehicle registry. The decision, the attachment report, the supporting letter, the debt breakdown and the notices of implementation should be obtained from the tax office. Precautionary assessment (ihtiyati tahakkuk) is assessed separately as well: this institution in Articles 17–20 of Law No. 6183, although it may be connected with precautionary attachment, is not the same act. If both acts need to be made the subject of an action, the claims must be set out clearly.

This table concerns tax receivables. For the public receivables of other institutions, the competent judicial forum may differ because of special provisions. Precautionary attachment decisions issued under the Enforcement and Bankruptcy Law for private-law receivables are also subject to a different procedure.

On what grounds can the tax administration apply precautionary attachment?

Article 13 of Law No. 6183 provides several grounds. These include cases requiring a request for security, the debtor's having no fixed domicile, the likelihood of flight or of removing assets, failure to provide the security requested, and breach of obligations relating to the asset declaration. The article also regulates the filing of a public action on account of an act requiring a fine and cases requiring the annulment of certain dispositions.

These grounds do not raise the same problem of proof. For example, in an allegation that no address could be found, address records and the inquiries carried out matter; in an allegation of removing assets, concrete transactions and dates matter. The transfer of a real property does not, by itself, produce the same result in all files. The timing of the transfer, its price, its economic justification and its connection with the public receivable should be assessed.

How should the ground for requesting security be shown in the file?

In practices connected with Article 9 of the Law, the first calculation of the person authorized to conduct the audit, the amount to be secured and the tax or penalty to which the act relates should be visible in the file. The calculation's not yet being final may follow from the nature of the protective measure; even so, fixing an amount without reasons or inconsistently is not beyond review.

The existence of a situation requiring security and the failure to provide the requested security within the time limit are different grounds. Without determining which of them the administration relies on, one should not be content with the defense "I was not given time first." The link between the reasoning and the statutory sub-paragraph must be established.

Can precautionary attachment be imposed after the tax audit has ended?

There is no single answer to this question for all grounds of precautionary attachment. The explanation added to the Collection General Communiqué by Communiqué Series A No. 16 of 13 August 2024 separately addresses, in practice under Article 13(1), the stage after the audit is completed and the report reaches the tax office. It has been explained that a precautionary attachment decision cannot be taken on this ground, and that if there is another ground in Article 13, that ground may be assessed.

For this reason, the approach "the audit is complete, there can be no precautionary attachment in any way" is too broad. The dates on which the audit report was completed and reached the tax office should be compared with the date of the security request and of the precautionary attachment decision. Where the administration later relies on a different ground, it is discussed whether the material facts existing on the date of the act really support that ground.

How is the time limit for an action against precautionary attachment calculated?

Law No. 6183 Article 15 takes as its basis the implementation of the attachment and, for an attachment made in the person's absence, the notification of the attachment. The 15-day period should not be confused with the general period in an ordinary tax action. Matters such as not counting the starting day, the last day falling on a holiday and the legal date of electronic notification are determined from the concrete notification document.

A text message sent by the bank may show that the implementation was learned of; but in each file it is not the same as a properly effected notification. Waiting in reliance on it is also not correct. Because the effect of actual learning on the time limit may give rise to a dispute, the date of first learning should be recorded and the act documents requested immediately. The action period must not be allowed to pass while awaiting the outcome of the document request.

In an action concerning precautionary attachment relating to a tax receivable, the competent court is the tax court. Venue is determined under İYUK Article 37 and by reference to the tax office that made the act or conducts the enforcement. The petition must clearly state the date and number of the act, the date of learning or notification and the scope whose annulment is sought. If there is more than one act for the same debt, the legal nature of each must be separated.

Does filing an action against precautionary attachment stop the act of its own accord?

That an annulment action has been filed does not mean the precautionary attachment has actually been lifted. A stay of execution must be requested separately under İYUK Article 27. The conditions of obvious unlawfulness and of loss that would be difficult or impossible to remedy if the act were implemented are explained together. Rather than the statement "my business is suffering," how this result arises should be documented.

The unavailability of the business's only collection account, approaching salary payments, an interruption in the purchase of raw materials or the unavailability of an essential means of production can be made concrete. In addition, the allegation of unlawfulness must also be built: the wrong person, a risk whose basis is not explained, an erroneous amount or a ground that does not match the date of the act may serve as examples. The magnitude of the loss alone does not secure the suspension of a lawful act.

Whether security is required and its type are assessed in the court's decision. The objection route in İYUK Article 27 against the decision on a request for a stay of execution and the seven-day period from notification are followed separately. This period is different from the 15-day period of the action to be filed for annulment of the precautionary attachment.

Can precautionary attachment be lifted by providing security?

Law No. 6183 Article 16 provides for the lifting of precautionary attachment when appropriate security prescribed by law is provided. The exception that the article introduces for movable property within Article 10(5) must not be overlooked. For this reason, it cannot be said that the attachment will necessarily be lifted by declaring some movable asset. The type, value and conditions of acceptance of the security must be clearly determined.

For options such as cash or a letter of guarantee compliant with the legislation, the whole of the amount secured and the validity conditions of the security are examined. The security document, a copy of the decision and a list of the attachments whose lifting is sought should be attached to the application. The administrative lifting of the attachment should not be framed as a waiver of all objections to the merits of the tax; the scope of the application must be written carefully.

Article 14 of the Law also regulates leaving attached property in the person's hands with certain guarantees. Leaving the property with the debtor and lifting the attachment are not the same result. This option, which can be used to continue the business's activity, may not of its own accord end the restriction in the registry.

Which documents are needed for the action and the lifting application?

DocumentPoint to examine
Decision and attachment reportAuthority, ground, amount, date
Notification and electronic delivery recordsStart of the time limit
Audit and security lettersThe link between Article 9 and Article 13
Land registry, vehicle and bank recordsScope of the attachment as to persons and property
Cash flow and mandatory payment documentsLoss for the stay of execution
Payment, cancellation or security recordsWhether the measure needs to continue

By way of example, in a business where a decision was taken solely on the ground of Article 13(1) after the audit report reached the tax office, the decision date and the date the report was transmitted are the key evidence. However, if there is also an allegation of removing assets in the file, the review cannot be confined to that. This example shows not an action whose outcome is determined in advance, but which documents need to be read together.

There must be a proportionate relationship between the administration's need to protect its receivable and the scope of the interference with the debtor's assets. The combined effect of entries placed on several assets, earlier pledges and the real sale values of the property are assessed together. A simple total of market values is not always equal to the collectible amount.

Conclusion

For the lifting of precautionary attachment for tax debt, the statutory ground on which the act is based must first be determined. Protecting the 15-day action period, examining the conditions of the security route and, if necessary, requesting a stay of execution with concrete evidence must be pursued together. A general objection prepared without establishing the relationship between the audit process, the decision date and the asset records may leave out the decisive issues in the file.

Frequently Asked Questions

Must a payment order be sent first for precautionary attachment?

The payment order sequence in ordinary compulsory collection does not apply as it is to precautionary attachment. The protective measure's own conditions are examined. Is the time limit against precautionary attachment seven days or fifteen days?

The period in Article 15 for annulment of a tax precautionary attachment is 15 days. The periods of other acts, such as an objection to a stay of execution decision, are different. If I file a petition with the tax office, do I still need to file an action?

An administrative application for lifting does not replace the route of an action. Applying to the court should not be postponed without separately assessing the effect of the application on the time limit.
