Summary

Lifting a bank e-attachment over tax debt: the administration that imposed it, a freeze exceeding the debt, salary and pension routes, and application and lawsuit routes; a lawsuit does not stop the e-attachment on its own.

Lifting a bank e-attachment imposed for tax debt first requires identifying the collection office that carried out the attachment, the debt being collected, the amount of the attachment and its legal basis. Payment of the debt, an attachment against the wrong person, an attachment exceeding the debt, or interference with income that cannot be attached each require different grounds. An application for lifting can be made to the tax office, but the filing period for a lawsuit must be protected separately. Filing a lawsuit against a collection action does not by itself stop the e-attachment. 1 2

This article examines the attachment applied to bank accounts for tax receivables. A bank’s contractual set-off, a judicial attachment and a collection by the social security institution (SGK) are subject to different legal regimes. A bank screen that merely says “blocked” is not enough to identify the correct route of application. For details, see the section on complaints against the actions of the enforcement directorate.

What is the difference between an e-attachment and a bank account freeze?

An e-attachment (electronic attachment, e-haciz) is an attachment for the collection of a public receivable, transmitted electronically. The bank applies it to the account. In practice the account holder may only see that the balance cannot be used, yet the cause may not be the bank’s own decision. Articles 62 and 79 of Law No. 6183 are particularly important for the attachment of the debtor’s rights and receivables held against third parties. 1

At the first stage, the attaching administration, the notice date and number, the attached amount and the relevant account movements are requested from the bank. The debt statement, the payment order and the service records are obtained from the tax collection office. If there is a freeze arising from more than one office or file, lifting one of them does not end the others.

Why should the frozen amount shown on the account be checked?

The amount stated in the attachment instruction and the amount the bank actually sets aside may differ. Without determining which amount is frozen, which amount has been transferred to the administration and on what date it entered the account, no legal consequence can be drawn from the total account balance alone. Nor can it be assumed that all money later deposited with the bank is attachable without limit; the scope of the notice and the time when the receivable arose are examined.

On what grounds can the lifting of an e-attachment be requested?

Payment, offsetting or write-off of the debt

If the debt has been fully extinguished, the basis of the continuing attachment is examined. The payment receipt is matched with the correct tax type and period, and it is checked whether any ancillary amounts (fer’i) remain beyond the principal. It should not be assumed that the bank will lift the freeze automatically and immediately after payment. The lifting decision of the collection office and its arrival at the bank should be followed up.

A request for offsetting is different from an offsetting decision. The administration may claim that the refund requested has not yet been verified or that it has been offset against another debt. For this reason, the acknowledgment of the application should be submitted together with the result of the offsetting and the account movements. A partial payment may not stop the attachment for the remaining debt, but it requires the scope to be updated. For details, see the article on refund of overpaid or undue tax.

Wrong person, wrong period or missing conditions of collection

Claims that the person owes nothing, that the conditions of liability for a company’s debt are not met, or that the required payment order was not properly served are explained with documents. In attachments based on shareholder and manager status, the company’s debt alone is not sufficient; a legal basis for personal liability must exist.

An ordinary attachment and a precautionary attachment (ihtiyati haciz) are not the same. For a precautionary attachment, the special conditions and litigation regime of Law No. 6183 apply. An objection based on the absence of a payment order cannot be assessed in the same way as an ordinary attachment if the measure is in fact a precautionary attachment.

Attachment exceeding the debt

Article 62 of Law No. 6183 is based on the principle that the attachment must be limited to an amount sufficient to cover the debt. The total of the actual freezes at several banks must be compared with the debt and its ancillary amounts. Sending notices to many banks for the same debt is not the same as actually holding money in each account that exceeds the debt.

For example, if 420,000 TL is in practice unavailable across two banks for a debt of 180,000 TL, the excess may be sought to be lifted by presenting dated bank records, a current debt statement and any collections made. This example does not mean that every multiple notice is unlawful in itself. The administration’s need to secure collection and the proportionality of the interference with property rights must be made concrete.

Can salary, pensions and social benefits be attached?

The fact that money is held in a bank account does not make its source irrelevant in every case. Wages, pensions, social assistance, commercial collections and money belonging to a third person may be subject to different rules. Calling an account a “salary account” alone may not be enough; the paying institution, the description and the regular transfer records matter.

Article 71 of Law No. 6183 provides a partial attachment regime for wages and similar income. There is a further limitation where monthly income is at or below the level of the minimum wage. For pensions, the scope of Article 93 of Law No. 5510, special exceptions such as maintenance and institutional receivables, and the valid consent (muvafakat) are examined separately. An identical result cannot be explained for every pension payment. 1 3

A claim of non-attachability should be supported by the pension award or wage document, bank movements, the source of the money and, where necessary, family living expenses. In a mixed account, the amount corresponding to the protected income must be shown. If the administration argues that the account is also used for commercial purposes, this can be answered by presenting the income movements separately.

How is an application for lifting submitted to the tax office?

The application is addressed to the collection office that carried out the attachment. The petition contains the identity or tax number, the particulars of the attachment notice, the bank and account, the amount sought to be lifted, the legal reason and the annexes. The request for full lifting is separated from the request to release the portion exceeding the debt.

  • The bank’s attachment or freeze letter and dated account movements.
  • The current debt statement, payment order and service record.
  • The payment, offsetting, write-off or court decision document.
  • Official records showing the source of the protected income.
  • Where there are several attachments, a comparison table by bank and amount.

The acknowledgment of the application is kept. A petition left only at a branch may not suffice on the assumption that the bank has authority to lift the attachment. Where there is an implementation error on the bank’s side, both a notice to the bank and the need to correct the administrative act are assessed. The application is not accepted as stopping the lawsuit period by itself.

Which court and within how many days is a lawsuit filed against an e-attachment?

In an ordinary attachment on a tax receivable, the court with subject-matter jurisdiction is in principle the tax court (vergi mahkemesi); the general period for filing an action is 30 days. The effect of service, or of learning about the act, on that period is assessed in light of the concrete facts and the service arrangements. Learning of the attachment from the bank does not in every case nullify an earlier legally valid notice. 2 4

The 15-day period for a payment order should not be confused with the 30-day period for attachment. The specific 15-day period under Article 15 of Law No. 6183 applies to a precautionary attachment. A seven-day objection to the attachment notice sent to a third party under Article 79 differs from the debtor’s action for annulment of the e-attachment. Where no objection is made within the time limit for the third party, the separate route of a negative declaratory action is also assessed. 1

Stay of execution and enforcement of the decision

An action for annulment of an e-attachment does not automatically stop collection. The conditions of Article 27 of the Administrative Procedure Law No. 2577 (İYUK), namely manifest unlawfulness and damage that is difficult or impossible to repair, must be shown together. Inability to pay wages, failure to cover health expenses, or the complete unavailability of cash necessary for the activity may be explained with the relevant documents. The statement “my commercial life is being harmed” alone is not a sufficient ground. 2

When a court decision is obtained, the scope of the decision, its notification to the administration, the lifting instruction and the actual result at the bank are followed. The obligation to implement a decision under Article 28 of the same law does not give the administration the right to wait for 30 days without reason. If there is another attachment from a different file, the decision does not automatically remove that file. Recovery of money transferred from the bank to the collection office is a claim separate from lifting the freeze. For details, see the article on enforcement of a tax court decision.

Conclusion

In an e-attachment file, the correct starting point is to document the reason for the freeze and the money actually held. Extinguishment of the debt, disproportionate attachment and non-attachability cannot be resolved with the same petition. The administrative application, the filing period and stay of execution should be planned together; after a lifting decision, the implementation at the bank should be verified.

Frequently Asked Questions

If I pay the tax debt, will the e-attachment be lifted the same day?

No definite same-day lifting result can be stated. The debt record, the lifting notice and the bank’s processing are followed. See the section “Payment, offsetting or write-off of the debt.” Back to the related explanation

Can a freeze exceed the debt?

An attachment should be limited to an amount sufficient for the debt. The actual freezes and the total debt are compared on the basis of documents. Details are in the section “Attachment exceeding the debt.” Back to the related explanation

Can a tax e-attachment be imposed on a pension payment?

The special regime applying to the pension and its exceptions are examined; no single answer can be given for all account balances. See the section “Can salary, pensions and social benefits be attached?” Back to the related explanation

Does an application to the tax office stop the lawsuit period?

This result should not be assumed. The period is protected separately through the attachment act and the service records. Details are in the section “Which court and within how many days is a lawsuit filed against an e-attachment?” Back to the related explanation

Does an installment arrangement lift all attachments?

Every deferral or installment application does not have that result. The conditions of the approved arrangement and the status of existing attachments are examined, and an express act is requested from the administration. See the section on applying for lifting. Back to the related explanation
