What does the rejection of a citizenship application mean?
A rejection is the competent administrative authority's refusal to grant a person's request to acquire Turkish citizenship. The fact that the file has been prepared, the interview held or the investigation completed does not mean that citizenship has been acquired. The statutory route under which the application was made, and whether the conditions required for that route are met, are assessed together. [1, Art. 10–20]
Does meeting the conditions make admission to citizenship mandatory?
Article 10 of Turkish Citizenship Law No. 5901 provides that satisfying the statutory conditions does not give a person an absolute right to be admitted to citizenship. However, the administration's discretion is not a freedom to decide without reasons or arbitrarily. The competence for the decision, the facts on which it rests, its legal ground and its purpose are open to judicial review. It matters not only that the applicant prepares a strong file but also that they show whether the ground for rejection is genuinely related to their own situation. [1, Art. 10] [3, Art. 2] [6, Art. 125]
Are removal from the docket and a preparatory act also treated as rejection?
Having the file completed because of missing documents, the commission's opinion, a decision not to process the application and a final rejection are not the same act. It is examined whether the act to be challenged is a final act that affects the person's legal situation and has to be enforced. Treating an interim letter as a final rejection, or treating a decision that closes the file as mere information, can lead to the wrong application. In the petition, the concrete consequence the document produces should be explained as well as its name. [2, Art. 18–21, 25–30] [3, Art. 14–15]
Article 73/3 of the Regulation separately provides that when an application is rejected the file at the Ministry is removed from the docket (işlemden kaldırma) and a new file is opened on reapplication. The expression "removal from the docket" therefore does not always mean that there is no rejection on the merits. The decision on which the closing letter is based should also be obtained. [2, Art. 73/3]
How does the type of application change the review of the rejection?
Citizenship application by the general route
Under the general route, the following conditions are examined: majority and capacity to discern, five years of uninterrupted residence before the application, the intention to settle in Türkiye, general health, good morals, adequate Turkish, income or a profession to ensure a livelihood, and national security and public order. Having stayed in Türkiye for five years alone does not satisfy the other conditions. Nor can the residence calculation be made simply by adding up the start and end dates of the cards. [1, Art. 11, 15]
The current Article 15 of the Law allows a total of up to 12 months to be spent abroad within the required residence period. The six-month limit seen in older texts cannot replace the current statutory provision. The type of residence, lawful stay, movements abroad and interruptions must be examined separately. If the rejection rests on this calculation, the entry-exit record is submitted together with the permit records. [1, Art. 15] [2, Art. 71]
The function of the commission and the interview
In a general application, the commission assesses elements such as Turkish, livelihood and social integration at the interview and writes its opinion clearly on the relevant form. A file in which it is concluded that the conditions are not met may not be sent to the Ministry, and the situation may be notified by the provincial directorate. For this reason, the preliminary review, the commission stage and the Ministry's final decision should be shown separately in the file chronology. Even a favourable opinion by the commission is not by itself a citizenship decision. [1, Art. 18–19] [2, Art. 19]
Citizenship application through marriage
Marrying a Turkish citizen does not directly confer citizenship. For an application, in addition to a marriage that has continued for at least three years, it is required that the spouses live in family unity, that no activity incompatible with the marital union is engaged in, and that there is no obstacle in terms of national security and public order. The statutory exception on the requirement of living in family unity where the Turkish spouse dies after the application is assessed separately. [1, Art. 16]
A separate address, living in different cities because of work, or a contradiction in an interview report should not automatically be turned into a conclusion of a sham marriage. The duration and cause of the separation, records showing the continuation of the shared life and the administration's findings to the contrary are examined together. Concrete findings showing that the marriage exists only on paper, on the other hand, strengthen the risk of rejection. [2, Art. 25–30] [12]
Investment and other exceptional routes
Obtaining a certificate of eligibility for the investment or satisfying other preconditions does not replace the citizenship decision. The legal basis of the exceptional acquisition, the eligibility review and the citizenship assessment should be kept separate. In the procedure in Article 12 of the Law, the Presidential decision is determinative; accordingly the competent judicial authority may also differ from that for an ordinary rejection issued by the Ministry. [1, Art. 12, 19] [4, Art. 24]
Depending on the type of investment, the records on payment, valuation, eligibility and the undertaking or annotation concerning retention of the investment are examined as a chain. Later unwinding of the investment is a different event from a deficiency at the time of application; it must be shown on what date which condition was broken. A rejection issued by the Ministry because of a national security or public order obstacle is not treated as a Presidential decision merely because the application was made by way of investment. [1, Art. 12/2] [2, Art. 20]
Other routes of acquisition
Routes such as reacquisition, adoption or the right of option have their own conditions. It is not correct to apply the five-year residence requirement of the general application to all applications. In the first review, the acquisition route on the application form, the provision of law on which the decision rests and the condition the administration applied should be on the same line. [1, Art. 13–14, 17, 21]
On what grounds can a citizenship application be rejected?
A missing statutory condition or missing proof
The rejection may rest on an incorrect calculation of the residence period, on a failure to show sufficiently the livelihood or the intention to settle, on the marriage conditions, or on another statutory condition. A condition that is really absent and an existing condition that cannot be understood because of missing documents are different problems. In the first, the condition may arise later and a new application may come up; in the second, the documents proving the situation on the date of application become important. [1, Art. 11–19]
Assessment of national security, public order and good morals
These headings leave the administration an area of assessment. However, it should be investigated to which event, which date and which application condition the ground for rejection relates. If there is a similarity of names, an outdated record, an incomplete investigation or an assessment that is not individualised, the objection should be made concrete. A clean criminal record does not of itself remove every security assessment; nor can an abstract negative assessment be regarded as sufficient in every file. [2, Art. 72] [7, §§39–45]
Inconsistency between documents and statements
Names transliterated from different alphabets, differences in birth records, marital status documents or addresses are sometimes explainable record problems. These should not be put in the same category as a deliberate false statement. The source of the error and the correcting document should be submitted; no fact affecting the application should be concealed. A document or statement contrary to the truth requires a separate review that may produce not only rejection but also other administrative and criminal consequences. [1, Art. 31, 38–40] [2, Art. 64–69]
How is the rejection notice read, and when does the time limit for filing suit start?
The decision, the notice document and the date of notification
The notice of the citizenship decision, rejection, given to the applicant is an important record announcing the outcome of the act. The decision date, decision number, authority, statutory basis, date of notification and routes of recourse in the document should be read together. The provincial directorate that delivers the document and the authority that issued the decision may not be the same. It should not be assumed that the entire reasoning in the file is visible from the notice sheet alone.
Under the general rule, the 60-day time limit for filing suit starts on the day following the day on which written notification is made. The date written on the decision and the date on which it was notified to the person may differ. For this reason, the acknowledgment-of-receipt copy, the notification envelope or the electronic notification record should be kept. A failure to indicate the routes of recourse fully or an allegation of irregular notification may be assessed separately; delaying the application in reliance on them carries a risk of loss of rights. [3, Art. 7–8] [5, Art. 32] [6, Art. 40]
Are electronic notification and an online query the same thing?
Electronic notification under Law No. 7201 is deemed made at the end of the fifth day following the date on which it reaches the electronic address. If the status shown on the application query screen is an ordinary e-mail or SMS, it is not in itself the same legal mechanism. The date cannot be calculated without examining by which system and by which procedure the specific notification was made. [5, Art. 7/a]
For which acts is the special announcement procedure important?
Under Article 41 of Law No. 5901, decisions to deprive a person of citizenship made under Article 29 are deemed notified on the date they are published in the Official Gazette. This special rule does not apply of its own accord to the rejection of an initial application or to the cancellation of citizenship under Article 31. The date of notification should not be calculated before the type of act is determined. [1, Art. 29, 41]
The main time limits
| Step | General time limit or starting point | Important distinction |
|---|---|---|
| Annulment action | 60 days starting from the day following written notification | Any special provision, the type of act and the notification are examined separately. |
| Administrative objection under İYUK Art. 11 | Within the time limit for filing suit | A timely application of the appropriate kind suspends the running period. |
| No response to the objection | 30 days | After an implied rejection, the time limit for suit remaining before the application runs. |
| Appeal on the merits (istinaf) | As a rule 30 days from notification of the decision | It is checked whether the decision is open to appeal. |
| Appeal on points of law (temyiz) | For a decision open to appeal on points of law, 30 days from notification | İYUK Art. 46 and the 2026 transitional provision are applied together. |
| Implementation of a judicial decision by the administration | Without delay after notification; general upper limit 30 days | The act required by the judgment and its reasoning is carried out; automatic citizenship cannot be inferred. |
The basis of these time limits is Articles 7, 8, 11, 28, 45 and 46 of the Administrative Procedure Law (İYUK). Whether the last day falls on a public holiday and the provisions on judicial recess are taken into account according to the file. The time limit should be derived from the actual notification and application records, not from a habitual calendar template. [3] [13]
How is an administrative objection to the rejection decision made?
Is an objection mandatory, and where is it filed?
As a general rule there is no obligation to file an administrative objection before bringing an action against the rejection of a citizenship application. Under Article 11 of İYUK, the withdrawal, reversal or amendment of the act, or the making of a new act, may be requested within the time limit for suit from the superior authority or, if there is no superior authority, from the authority that issued the act. Identifying the authority that issued the decision therefore comes before the heading of the petition. [3, Art. 11]
The authority for applying cannot be determined in the same way for a Ministry act and a Presidential decision. One should not be content with telling the directorate that issued the notice only to "review the result again"; which decision the request is directed at and how it reached the competent authority should be documented. The registry number, date of application and acknowledgment of receipt are kept.
What should the objection petition contain?
The petition should show the route of application, the rejection act, the date of notification, the alleged unlawfulness and the express request. For example, an incorrectly calculated residence period is explained with records, criminal information belonging to the wrong person with identity matching, and an incomplete family-unity assessment with concrete documents of shared life. If the ground is not known, the relevant documents of the decision and act file are requested; this request should not be relied upon on the assumption that the time limit stops of its own accord. [3, Art. 11, 20]
Does a new 60 days start after the objection?
No. An application made in time and falling within İYUK Art. 11 suspends the time limit for suit. On notification of an express rejection answer, or at the end of 30 days without an answer, the remaining period resumes running, taking into account the days that passed before the application. The time consumed up to the date of the objection is not erased. [3, Art. 11]
Hypothetical example on the remaining period
Assume that a proper administrative objection is made after 20 days of the time limit for suit have passed. When a rejection answer is given to the application, or when an implied rejection arises through 30 days without a reply, 40 days as a rule remain. This example illustrates a calculation that includes no holiday, notification dispute or special period; the actual last day is determined separately. [3, Art. 8, 11]
Do CİMER, a request for information and a repeat petition protect the time limit?
The name of the application or the portal to which it is sent is not decisive on its own. What matters is the content of the request, its timing, the authority it reached and whether it genuinely asks for the act to be reconsidered. Merely asking about the status of the file, requesting documents, or repeating the same petition after the period has expired is not regarded as a method that reliably protects the time limit for suit. While awaiting a reply, precautions should be taken on the basis of the earliest possible last day. [3, Art. 11]
The first request under İYUK Art. 10, where there is not yet any decision, should not be confused with an application under Art. 11 against an existing rejection decision. The provisions on a non-definitive answer, waiting and a late answer in the first request cannot be carried over unchanged to an Art. 11 objection. [3, Art. 10–11]
If an action is also being considered against a regulatory provision, its time limit is calculated separately. In the decision of the 10th Chamber of the Council of State (Danıştay Onuncu Dairesi), E.2025/838, K.2025/1275, a later action against a provision of the regulation was dismissed on grounds of time. This decision is not a judgment on the merits that the applicant should be granted citizenship; it shows that the time limits for suit against an individual act and a regulatory act must be tracked separately. [19]
Annulment action against the rejection of a citizenship application
What does the court review?
In an annulment action the rejection act is reviewed in terms of competence, form, ground, subject matter and purpose. The court does not take the administration's place and set citizenship policy; it reviews the lawfulness of the specific act. For this reason, the statement "I meet the conditions" should be completed by showing which ground for rejection is refuted by which document. [3, Art. 2]
The act being established by an incompetent authority, the application of the wrong provision of law, the person in the file being confused with someone else, the disregard of essential evidence or a failure to relate the reasoning to the specific case may each constitute different grounds for annulment. The breadth of the administration's discretion is taken into account; the claimant's aim is to show where the limits of discretion were exceeded. [1, Art. 10] [6, Art. 125] [7]
The petition and the filing channel
The petition clearly states the parties, the act, the date of notification, the sequence of events, the legal grounds, the evidence and the relief sought. The rejection letter and the notification documents are attached. The petition may be submitted to the competent court or to the receiving authorities listed in Article 4 of İYUK. If filing through UYAP, the account used must have the authority to file suit and the electronic-signature requirements must be completed; ordinary e-mail does not replace filing an action with the court. [3, Art. 3–4]
What does a stay of execution achieve?
Filing an action does not by itself stay the rejection act. For a stay of execution, a manifest unlawfulness and, if the act is implemented, damage that would be difficult or impossible to remedy are required together. The request must explain what the damage is, by which document it is shown and why waiting for the end of the case would be inadequate. [3, Art. 27]
Because the refusal of a citizenship request is a negative act, the effect of interim protection is assessed on the specific act. Even the granting of such a decision does not in itself mean that a Turkish identity card, passport, residence or work permit is issued. If there is a separate residence, work permit or deportation act, legal protection relating to it should be addressed separately. [3, Art. 2, 27] [14] [21, Art. 6, 12]
Under the general procedure, there is a once-only route of objection, within seven days from the day following notification, against decisions on a stay of execution. The reviewing authority varies according to the court that gave the decision. This seven-day period is separate from the 60-day period for the main action against a citizenship rejection act. [3, Art. 27/7]
In which court, and against whom, is the action filed?
Ministry acts
Where there is no special provision on subject-matter or territorial jurisdiction, the administrative court at the seat of the administrative authority that issued the act is the court with general territorial jurisdiction in an annulment action. For rejection acts issued by the Ministry of the Interior at headquarters, this rule brings the Ankara administrative courts into question. The fact that the applicant lives in Antalya, Istanbul or another province does not in itself change the competent court. [3, Art. 32]
Presidential decisions
Under Article 24 of Council of State Law No. 2575, the Council of State (Danıştay) hears annulment actions against Presidential decisions as a court of first instance. This distinction is especially important for exceptional citizenship and for certain decisions that affect citizenship status. It cannot be assumed in every investment file that the letter notified is directly a Presidential decision; the final act that is the subject of the case must be identified. [1, Art. 12] [4, Art. 24]
Identifying the defendant administration
The defendant is the administration that owns the act sought to be annulled. That the provincial civil registry directorate is named on the document does not necessarily show that that directorate issued the final rejection decision. The full copy of the decision that is the subject of the case, the cover letter and the chain of authority are assessed together. The existence of a procedural provision allowing the court to correct a wrongly named defendant does not justify not examining the act and the jurisdiction from the outset. [3, Art. 15/1-c]
Which documents should be prepared for the objection and the case?
A file is not strengthened merely by collecting many documents. Each document must answer a specific ground for rejection. First a chronology of events from the application to the notification is prepared; then the condition the administration did not accept is matched with the record showing that condition. If there are explanations that give different meanings to the same document, the contradiction is removed expressly.
| Subject of review | Relevant documents | What should be explained? |
|---|---|---|
| The act and the time limit | Application record, rejection decision, notice document, acknowledgment-of-receipt or electronic notification record, objection receipt | Which act, which authority and which starting date? |
| Residence and settlement | Residence/work permit records, entry-exit record, address and settled-life documents | The statutory period and the periods of stay that can count toward it |
| Livelihood and profession | Employment, income, profession and, where necessary, tax/social security records | The livelihood of the applicant and of their dependants |
| Marriage and family unity | Marriage record, documents of shared life, records showing the reason and duration of any separate living | The actual continuation of the marriage and contradictions in the reports |
| Criminal or security information | Reasoned decisions, finality information, investigation outcome, record-correction documents | Identity matching, the nature and date of the event and the current legal situation |
| Investment or another special route | Certificate of eligibility, records of the relevant institutions and documents of the special acquisition route | Separating the fulfilment of the precondition from the citizenship decision |
This list does not mean that all documents are mandatory in every file. For documents from foreign countries, translation, certification, apostille or an exemption arising from a treaty is assessed according to the country in which the document was issued and the purpose of use. Private family, health or criminal documents should be shared only to the extent needed for the dispute and through the appropriate channel. [1, Art. 37–39] [2, Art. 64–69]
Access to the act file and the court's investigation
In administrative justice the court has the power to investigate of its own motion. The claimant may request that the administration be asked for the commission report, investigation letter or other grounds that have not been given to them. The confidentiality exception in İYUK Art. 20 and the effect on the judgment of a defence based on documents that were not provided should be assessed together. It cannot be said that every security document will be opened to the applicant without limit; how effective judicial review is secured is discussed in the specific file. [3, Art. 20]
Lawyer, litigation costs and legal aid
A person may pursue the case themselves; if pursuit through a representative is preferred, a duly executed proof of authority is required. Court fees, postage and other expenses and the lawyer's fee agreement are separate items. The outcome of the case may give rise to liability for the opposing party's attorney's fee and expenses. Legal aid is assessed in terms of difficulty in paying and whether the claim is not manifestly unfounded; reciprocity and applicable exceptions are also examined for foreign nationals. Lawyer assistance from the bar association and a court's legal aid decision on costs are not the same procedure. A fixed total cost or a promise of free proceedings cannot be given without seeing the current tariff and the scope of the file. [3, Art. 31] [16, Art. 334–339] [17, Art. 35, 163–164, 176–178]
How are the security investigation, the criminal record and HAGB assessed?
Is a negative security assessment a definitive obstacle?
The conditions of national security and public order are an important part of the citizenship review. However, the mere notification of a "negative" result may not explain which fact was checked. The applicant can discuss the accuracy of the information about them, the personal connection of the event and its currency, and can ask the court to obtain the grounds of the act. The administration's security interests that need protection and the person's concrete objections are assessed together. [1, Art. 11–12, 16] [3, Art. 20]
Does deferment of the pronouncement of judgment prevent citizenship?
HAGB (deferment of the pronouncement of the judgment) is not the same legal situation as an acquittal or a final conviction. However, Article 72/5 of the Citizenship Regulation provides a special assessment, including HAGB, for certain sentences and decisions other than negligent offences. The conclusion that "HAGB does not appear on the criminal record, so it can have no effect" is therefore not safe. The nature of the offence, the length of the sentence, the date of the decision and later decisions must be examined separately. [2, Art. 72/5]
The outcome of the criminal file and the administrative assessment
Outcomes such as a decision not to prosecute, acquittal, dismissal or deletion of a record should be submitted to the citizenship file. However, attaching only the outcome document without explaining why the decision was given may not be sufficient. It is examined, in terms of the presumption of innocence, the personal situation and the relevant statutory condition, whether the administrative act rests on an imputation of guilt or on other concrete facts. The effect of res judicata or the consequences of a particular decision cannot be generalised without seeing the file. [6, Art. 38] [3, Art. 20] [18]
The contribution of academic debate to practice
In the doctrine, the discretion on whether to grant citizenship and the concrete and objective investigation of the statutory conditions are assessed separately. Tüysüz focuses on the statutory limits of discretion and on the objective determination of conditions in marriage applications. Eroğlu discusses the foreseeability of the national security and public order assessment in the marriage route. These views enrich the questions to be asked in a file; they do not replace a binding rule or a guarantee of outcome. [11, p. 1990, 2004] [12, p. 54, 61]
Rejection of an application, cancellation of citizenship and withdrawal are different
Rejection of an application
In a rejection, citizenship has not yet been acquired. The dispute concerns whether the conditions of the relevant acquisition route existed on the date of application and during the assessment process, and the lawfulness of the rejection act. What is sought from the court is the annulment of the rejection act. [1, Art. 10–19] [3, Art. 2]
Cancellation of citizenship already acquired
Article 31 of Law No. 5901 regulates the case where citizenship was acquired as a result of the person's false statement or concealment of material matters underlying the acquisition. Here there is a separate act that removes the existing citizenship status. The timing of the cancellation decision, the derivative acquisition and the effect on family members are addressed separately. Article 24 of the Law lists the ways of loss in general; the specific basis for cancellation because of a false statement is Art. 31. [1, Art. 24, 31–32]
Withdrawal of the decision and correction of a material error
Article 40 of the Law regulates withdrawal where it is later understood that a decision on the acquisition or loss of citizenship was given before the legal conditions existed or was given in duplicate. Correction of a material error is a separate institution in Art. 39. An event that emerges later, a deficiency present on the date of acquisition and a false statement at the outset cannot be explained by the same legal ground. If the basis of the act has been wrongly chosen, this distinction may become the centre of judicial review. [1, Art. 39–40] [9]
In investment files in particular, the eligibility process, the acquisition decision and a later act of cancellation or withdrawal should be examined with separate documents. For a detailed explanation, see the guide on cancellation and withdrawal of citizenship acquired by investment.
What do the judicial decisions show?
Constitutional Court A.S. decision: concrete reasoning and the effect on private life
In the A.S. application (App. No: 2018/31431, 3 March 2022), the Constitutional Court (Anayasa Mahkemesi, AYM) assessed a citizenship rejection act based on the good-morals condition from the standpoint of the right to respect for private life. The Court addressed the point that the fact that the rejection had not produced residence or deportation consequences does not on its own exclude a private-life review, and that the reasoning must be explained with person-specific concrete data. It decided that the right to respect for private life had been violated and ordered a retrial. [7, §§39–48]
This decision does not mean that every rejection act is a violation of a fundamental right or that the Constitutional Court directly grants citizenship. Its contribution in practice is to make concrete the effect of the ground for rejection on the applicant's life and how the judicial bodies addressed the substantive claims.
Dismissal after HAGB: the importance of the application date
In the decision of the 10th Chamber of the Council of State (Danıştay Onuncu Dairesi) of 15 October 2025, E.2023/5620, K.2025/4552, a request for annulment of the relevant provision of Regulation Art. 72/5 was rejected, while the individual citizenship rejection act was annulled. The distinguishing fact is that the completion of the HAGB supervision period and the dismissal of the criminal case occurred before the citizenship application and the rejection act. The regulation's remaining in force did not of itself make the rejection act in the specific case lawful. [18]
The Chamber also stated that the annulment does not directly confer citizenship and that a new act may be made within the framework of the other conditions and discretion. The decision was given as open to appeal on points of law. The same result cannot be drawn from this for every HAGB file; the date of the dismissal decision, its finality and its relationship to the citizenship act must be documented. [18, Legal Assessment and Outcome of the Decision]
Plenary Assembly of Administrative Litigation Chambers decision: majority reasoning versus the dissenting opinion
The decision of the Plenary Assembly of Administrative Litigation Chambers (İdari Dava Daireleri Kurulu, İDDK) of the Council of State of 14 February 2022, E.2021/3322, K.2022/438, concerns, unlike the rejection of an initial application, the cancellation of citizenship previously acquired. The majority upheld the dismissal of the action with respect to one of the claimants, and reversed the part concerning the annulment of the act with respect to the other claimant. The different assessment that intelligence information cannot be treated as the same as the concealment of material matters appears in the dissenting opinion. [8, Legal Assessment, Outcome of the Decision and Dissenting Opinion X]
A dissenting opinion cannot be presented as the majority's reasoning for annulment. This example shows that taking only a sentence that appears favourable may mislead litigation strategy, and that the type of decision, the event and the outcome of the judgment must be read together.
The importance of the acquisition date in a withdrawal dispute
In its decision of 4 February 2026, E.2024/3835, K.2026/324, the 10th Chamber of the Council of State annulled an act of withdrawal of citizenship. It was assessed that there was no concrete basis in the file showing that the legal conditions did not exist on the date of acquisition, and that events alleged to have occurred later cannot be carried to Art. 40 without establishing their connection with the earlier period. The decision was given as open to appeal on points of law. It cannot be said that the same ground suffices for rejection of an application, cancellation because of a false statement and withdrawal. [9, Legal Assessment and Outcome of the Decision]
Not every citizenship dispute can be taken to the Constitutional Court under the same heading of right
In the Abduljabar Ulus application (App. No: 2023/28512, 18 November 2025), the Constitutional Court found a citizenship dispute raised only under the right to a fair trial inadmissible for lack of jurisdiction ratione materiae. The decision also notes that there was no allegation concerning private or family life. This outcome does not mean that the rejection act was found lawful on the merits in every case. In an individual application, the scope of protection of the right invoked and the concrete effect must be established separately. [10, §§6–10]
Which routes are followed after the court decision?
Does an annulment decision automatically confer citizenship?
The annulment of a rejection act is not the same as the person being directly given a Turkish identity card or passport. The administration is obliged to act in accordance with the operative part and reasoning of the judicial decision. The new act must answer the unlawfulness the court identified; the decision cannot be rendered ineffective by repeating the same reasoning without any change. The general rule is that the decision is complied with without delay after its notification to the administration and in any case within 30 days. [3, Art. 2, 28]
The file may need to be re-evaluated, an incomplete investigation completed, or a different act made according to the reasoning of the decision. If the judicial decision is not implemented or a new rejection is issued, the notification of the new act, the subject of the case and the conditions of possible compensation are examined separately. Even if the case is won, later notifications should not be left unmonitored. [3, Art. 12, 28]
Appeal on the merits (istinaf) and appeal on points of law (temyiz)
An appeal on the merits (istinaf) may as a rule be filed against an administrative court decision within 30 days from notification. An appeal on points of law (temyiz) is not automatically open for every regional administrative court decision. The types of decision, exceptions and transitional provisions in İYUK Art. 46 must be examined. Decisions given by the Council of State as a court of first instance are subject to a different system of appeal. [3, Art. 45–46] [4]
Why does the 2026 amendment matter?
Law No. 7589 introduced an additional right of appeal on points of law for certain disputes in which a regional administrative court overturns the first-instance decision and decides anew. In terms of the entry-into-force and transitional provision of the regulation, the date of a regional administrative court decision given on or after 31 July 2026 matters. The exception in the new Art. 46/2 concerning disputes under Law No. 6458 cannot be carried to a citizenship case based on Law No. 5901 merely because the claimant is a foreign national. Other exceptions and the nature of the specific decision are again checked. [3, Art. 46/2] [13, provisional Art. 1/3, Art. 26]
Individual application and compensation
After the ordinary routes of recourse, an individual application to the Constitutional Court may be considered if its conditions are met. This route is not a general appellate body in which the citizenship request is reviewed on the merits for a third time. It must be explained which fundamental right was violated and for what concrete reason. Compensation is likewise not an automatic result of the annulment of a rejection decision; damage, causation and the relevant procedural conditions must be shown. [3, Art. 12–13, 28] [7] [10]
In an individual application, learning of the final decision on exhausting the routes of recourse and the 30-day period in Article 47/5 of Law No. 6216 must be assessed separately. The requirement of exhausting the ordinary routes of recourse and this special period are separate from the time limit for the first action against the citizenship rejection act. [20, Art. 45/2, 47/5]
Can a person whose citizenship application was rejected reapply?
When a new application is meaningful
A previous rejection is not in every case a lifelong ban on applying. If the conditions of the relevant acquisition route arise later or a deficiency that was noted is remedied, a reapplication may be considered. However, there is no single waiting period valid for everyone, nor a rule that acceptance is mandatory after a certain time. The ground for the rejection and the statutory conditions of the new application should be examined together. [1, Art. 10–19] [15]
For example, a deficiency in the residence period and a negative security assessment are not remedied by the same method. The first may require a new calculation of time; in the second, the source, accuracy and currency of the information and the earlier judicial assessment become important. Resubmitting the same file without explanation does not indicate that a different result will be obtained.
Does reapplying revive the old time limit for suit?
A new citizenship application does not of itself restore a time limit for suit that was missed against the earlier rejection decision. Seeking annulment of the earlier act and seeking a new decision on new facts are different legal aims. Whether to pursue a timely action and a reapplication together or separately, avoiding contradiction between the requests, and keeping track of the dates of each file should be assessed. [3, Art. 7, 10–11]
What changes if the court has dismissed the case?
The reasoning of a final judicial decision matters. Repeating the same request on the same facts and a new application based on later changed conditions are not the same. It must be clearly shown whether a new document is evidence explaining the earlier situation or a genuinely new fact. A rejection under one route of application does not mean that the conditions of another route of acquisition are also met or can never be met. [1, Art. 10–19] [3]
Does the rejection decision affect residence, work and family members?
The rejection of a citizenship application, the rejection of a residence permit, the end of a work permit, an entry ban and a deportation decision are separate acts. A citizenship application, or a case brought against this rejection act, does not of itself give the person a right of lawful stay or work. The validity of existing permits and whether a separate migration act exists should be monitored. [1] [14] [21, Art. 6, 12]
Can the same fact be used in different files?
The same security record or criminal event may be assessed in different administrative processes. Even so, the statutory basis, notification, time limit for application and court of each act may be different. The filing of a citizenship case does not mean that the application obligations in the other files have been met. Each decision should be kept on a separate line in the timetable. [3] [14]
The situation of the spouse and children
The rejection of one person's initial citizenship request does not automatically conclude all independent applications of their spouse or child. The acquisition route and conditions of each person are examined. By contrast, Art. 32 on derivative acquisition in the cancellation of citizenship previously acquired, and the provisions on family members in Art. 20 in the acquisition of citizenship, are separately important. A family file can be examined together, but each person's act and right of application must be shown separately. [1, Art. 20, 32]

Conclusion
Effective legal preparation after the rejection of a citizenship application begins with obtaining the whole decision and the notification. The route under which the application was made, the fact on which the ground for rejection rests and the authority that owns the act are identified. The time limit for suit is calculated; if an administrative objection is preferred, the remaining period is tracked separately. The evidence is arranged so as to answer the ground for rejection.
Just as the administration has discretion, judicial review has limits. A strong application consists not of stock phrases that guarantee an outcome but of the right act, the right authority, a protected time limit and concrete evidence. Distinguishing the rejection of an application from the cancellation of citizenship already acquired, and following the steps after the decision, are decisive at every stage of the process.
Frequently Asked Questions
What should be done first if a citizenship application is rejected?
A copy of the rejection decision and the notification should be obtained, and the date of notification, the ground for rejection, the acquisition route and the authority that issued the decision should be identified. The time limit for suit should be tracked immediately, together with the process of searching for documents and consultation. [3, Art. 7–8]
What is the time limit for filing suit against a citizenship rejection?
The general period is 60 days and starts on the day following written notification. The type of act, any special notification provision or an allegation of irregular notification are assessed separately. [3, Art. 7–8] [1, Art. 41]
Can an action be filed without an administrative objection?
Yes. As a general rule an administrative objection is not first required in the rejection of a citizenship application. An annulment action can be filed directly within the time limit. [3, Art. 11]
When can an action be filed if there is no reply to the objection?
If no reply is given to an application under İYUK Art. 11 within 30 days, an implied rejection arises. After that, the remaining time limit for suit runs, less the days consumed before the application. [3, Art. 11]
Is a fresh 60 days gained by objecting?
No. The objection does not restart the period but, if its conditions are met, suspends it. For example, if 20 days have been consumed, 40 days remain on the general calculation. [3, Art. 11]
Does writing to CİMER stop the time limit for suit?
Not every CİMER application does. The content of the application, its reaching the competent authority, its timing and whether it falls within İYUK Art. 11 are examined. It should not be assumed that the time limit is protected by a message that merely asks for information. [3, Art. 11]
Is the rejection date on the e-Devlet query screen the date of notification?
A query result and a properly executed notification are not the same. The legal nature of the notice and its records should be examined. The fifth-day rule for electronic notification is not automatically applied to an ordinary query screen. [5, Art. 7/a]
Is a citizenship rejection case always filed in Ankara?
No. For the Ministry's headquarters acts, general jurisdiction brings the Ankara administrative courts into question; for Presidential decisions the Council of State has first-instance jurisdiction. The owner of the final act and any special provisions are decisive. [3, Art. 32] [4, Art. 24]
Is the provincial civil registry directorate always the defendant?
No. The directorate that notifies the decision and the authority that issued the act may differ. The defendant is determined on the basis of the owner of the final act that is the subject of the case. [3, Art. 3, 15]
Is living in Türkiye for five years enough for citizenship?
No. Under the general route, other conditions are required in addition to the statutory residence condition; satisfying the conditions does not give an absolute right to citizenship. Not every period of stay counts toward the residence calculation in the same way. [1, Art. 10–11, 15]
Is the limit on staying abroad in a general application six months?
The current Article 15 of Law No. 5901 allows a total of up to 12 months abroad within the required residence period. Calculations should not be made with the old six-month wording. [1, Art. 15]
Does marriage to a Turkish citizen automatically provide citizenship?
No. A marriage that has continued for at least three years and the other statutory conditions are examined. Marriage on its own does not replace an acquisition decision. [1, Art. 16]
Is rejection possible if there is an investment eligibility certificate?
An eligibility certificate is not the same as a citizenship decision. The other conditions of exceptional acquisition and the competent authority's assessment continue. [1, Art. 12, 19] [2, Art. 20]
Does a clean criminal record remove the security investigation?
No. The criminal record and the national security and public order investigation are not of the same scope. On the other hand, the connection of a negative assessment with the person, its accuracy and its grounds may be the subject of judicial review. [2, Art. 72] [3, Art. 20]
Is the application of everyone with HAGB definitely rejected?
Such a generalisation cannot be made without seeing the file. Regulation Art. 72/5 contains special provisions on the type of offence and the length of sentence; the date and nature of the decision and later developments are examined together. [2, Art. 72/5]
Can an action not be filed if the ground for rejection is not explained?
The right to sue does not depend only on the detailed notification of the ground. The time limit can be protected on the basis of the rejection and the notification; a request can be made for the supporting documents to be obtained from the administration. [3, Art. 7, 20]
Does the commission's opinion replace the Ministry's decision?
The commission's assessment is a stage of the application process. The authority for the final decision is determined according to the relevant acquisition route. Whether the commission's opinion or an interim letter is a final act should be examined separately. [1, Art. 18–19] [2]
Does filing a case stay the rejection decision?
No. A stay of execution is requested separately and depends on statutory conditions. Filing a case alone does not confer citizenship, residence or work rights. [3, Art. 27] [14] [21, Art. 6, 12]
If I win the case, can I immediately get a Turkish identity card?
The annulment decision removes the unlawful rejection act. The administration acts in accordance with the operative part and reasoning; a court decision does not mean automatic citizenship or an identity document in every file. [3, Art. 2, 28]
Can a rejected application be made again?
If the conditions are met, a reapplication is possible. The earlier ground for rejection, the changed conditions and the new evidence should be explained. There is no single waiting period valid for everyone. [1, Art. 10–19] [15]
Does reapplying extend the time limit for suit against the old rejection decision?
No. A new request and seeking annulment of the earlier act are separate legal routes. An act whose period has passed does not become open to suit again of its own accord by repeating the same petition. [3, Art. 7, 10–11]
Does a citizenship rejection mean deportation?
No. Deportation and residence acts depend on separate statutory grounds. However, because the same fact may be assessed in separate files, the other permits and notifications should be monitored separately. [14]
Are cancellation of citizenship and rejection the same subject of a case?
No. An initial rejection concerns citizenship not yet acquired. Cancellation under Art. 31 and withdrawal under Art. 40 of Law No. 5901 are different acts affecting the existing status; their grounds and consequences are examined separately. [1]
How long does a citizenship case take, and can the outcome be guaranteed?
The duration varies according to the file, the investigation and the stages of appeal. A fixed end date or a guarantee of winning cannot be given for every dispute. The 30-day implied-rejection period in an administrative objection is not the period within which the case will end. [3, Art. 11, 20, 45–46]
Is it mandatory to hire a lawyer in a citizenship case?
As a rule a person may pursue the case themselves. However, the competent authority, the time-limit calculation, security records and routes of appeal may require a file-specific assessment. If representation is chosen, a valid power of attorney and its scope are arranged separately. [3, Art. 3, 31] [16]
