Missing a signature once does not in every case automatically result in pretrial detention. On the other hand, there is no "right to miss the signature three times" that everyone can use in judicial control either. The standard of willful non-compliance in Article 112 of the Code of Criminal Procedure (CMK), and the excuse and notification provisions specific to judicial control in the Probation Services Regulation, apply together. 1, 2
What is the legal nature of the signature obligation?
CMK Article 109/3-b regulates regular reporting to places determined by the judge, within specified periods, as a judicial control obligation. Although in practice this is mostly called "signing at the police station", what matters is the place and the form of reporting indicated by the decision. The obligation is not a penalty or a conviction; it is a protective measure that serves the conduct of the proceedings.
That judicial control is lighter than pretrial detention does not mean that it can be applied in any file without reasons. The conditions of CMK Article 109 and the principle of proportionality must be observed. The frequency of reporting, the travel distance, the work schedule and the person's state of health determine the concrete weight of the measure. Going to a nearby unit once a week and making a long journey every day do not have the same effect.
These differences matter both when assessing the lawfulness of the initial decision and when examining the continuation of the measure. The person's regular compliance with the obligations in the file, a reduced likelihood of flight and developments in the investigation may be among the grounds for a request for removal or relaxation.
Is judicial control the same as probation in the execution of a sentence?
No. The execution of a final prison sentence under the probation measure is a different legal regime from the judicial control applied under the CMK. Obligations attached to the deferment of the pronouncement of judgment are also subject to their own provisions. That the probation directorate may take part in all of them does not mean that the rules on violations and reporting are the same.
This distinction becomes particularly important in explanations seen on the internet such as "three violations", "second warning" or "closing of the file". A rule that applies to an execution file cannot be transferred directly to a judicial control file. When examining the decision, it should be determined under which regulation the person falls, as a suspect, defendant or convict.
How are the signing day, time and place determined?
The decision and the notification of implementation should be read together. Article 57/1 of the Probation Services Regulation provides that the type of measure, how and when it is to be carried out, the rules to be observed and the consequences of non-compliance are notified. The notification also explains that the requirements of the obligation must be fulfilled immediately. 2
If the person holds only vague information such as "one signature a week", the day and the time range should be clarified with the implementing unit and, where necessary, with the authority that issued the decision. Uncertainty should not be interpreted to mean that the obligation can be fulfilled whenever the person wishes.
The fact that the decision was announced at a hearing or during questioning is also taken into account. A known obligation should not be neglected on the thought that a written notice will arrive later. On the other hand, in assessing a violation, which obligation was notified, when and how, and whether the person had the opportunity to know of it and to comply, should be examined concretely.
Does an official holiday, a weekend or a change of city alter the signing day?
The procedural rule that a deadline falling on a holiday is extended is not automatically applied to an established signing calendar. If the signing day falls on a weekend or an official holiday, it should be confirmed in advance to which unit and during which hours to report. The person should not choose the next business day on their own decision.
A change of address or workplace does not by itself change the place of signing either. If the person is moving to a new place, the change should be documented and the necessary application made. That another police station has registered the report does not guarantee that a step taken outside the designated place will be accepted as properly performed in every case.
What happens if the signature is missed or late?
CMK Article 112 provides that the competent judicial authority may issue a pretrial detention order against a suspect or defendant who willfully fails to comply with the provisions of judicial control, regardless of the length of the prison sentence that may be imposed. The wording of the law shows that detention is possible; it does not provide for mandatory detention upon every missing signature. 1
In the assessment, whether a violation has occurred, the content of the notification, the person's actual ability, the voluntary nature of the conduct and the excuse put forward are important. A violation report does not make it unnecessary for the person to give an explanation and submit documents. As regards detention, the concrete reasoning and the proportionality of the decision must also be reviewed.
A signature given outside the designated time range does not mean that the obligation for that day has been definitively fulfilled. On the other hand, the length and the reason for the delay may matter in the assessment of willful non-compliance. Reporting later does not of its own accord erase the earlier deficiency; it may help the incident to be recorded correctly and show that the obligation is continuing to be observed.
Is a prior warning mandatory in judicial control?
Article 44/6 of the Regulation states that a person who violates the requirements of a judicial control measure without an excuse and intentionally is not warned, and that any excuse is assessed by the commission. Article 57/2 provides that the relevant file is sent to the competent judicial authority through the Office of the Chief Public Prosecutor without a warning. 2
Accordingly, it cannot be said that there is a general guarantee of three violations or two warnings in judicial control. The opposite is not true either: that the file has been notified does not show that the court will necessarily issue a detention order. The implementing unit's finding of a violation and the decision to be given by the judicial authority are different acts.
How is a valid excuse established?
Each excuse is assessed on its own conditions. Hospital admission, being in custody, an extraordinary situation that actually prevents travel, or another event that develops beyond the person's control may matter. However, it is necessary not only to show that the event existed but also to explain how it prevented reporting at the signing time.
| Situation asserted | Point to examine | Records that can be submitted |
|---|---|---|
| Health problem | Ability to move or travel at the time of reporting | Examination, admission, discharge and physician's assessment |
| Custody or other compulsory detention | Date and time at which liberty was restricted | Official record, entry and exit records |
| Interruption of transport or an extraordinary event | Whether it was possible to arrive by ordinary means | Official announcement, cancellation document, time-stamped transport record |
| Record problem although the person went to the unit on time | Place, time and the official's action at which the report was made | Report record, minutes and other verifiable records available |
| Continuing work or education conflict | Is it a one-off obstacle or a foreseeable continuing problem? | Shift schedule, letter from the workplace, class or exam calendar |
Submission of a hospital document does not mean that it will be accepted as sufficient in every case. For example, whether a short examination at a different hour prevented reporting throughout the whole signing range may be investigated. The date, the time and the connection of the document to the incident are therefore important.
Forgetting, being busy or ordinary daily difficulties are likewise not excuses that are accepted automatically. If these explanations are to be put forward, the incident should be described truthfully, and the person should ask for an assessment together with earlier compliance and conduct after the delay. Untrue documents or statements created afterwards should be avoided.
Where is the excuse petition submitted?
The probation directorate where the violation or excuse procedure is located, and the competent judicial authority according to the stage of the file, should be identified. The Regulation provides that the excuse is assessed by the commission. If notification has been made to the relevant judicial authority, it should be followed up that the explanation and documents also reach that file.
The petition should clearly state the file number, the obligation that could not be fulfilled, the relevant date and time, the beginning and end of the obstacle, the documents at hand and the assessment requested. The receipt or electronic record showing that the application was made should be kept. Giving information by telephone cannot safely replace a written record showing that the explanation has entered the file.
What steps should be followed when a signature has been missed?
- The decision and the signing calendar should be checked to determine which date or time was missed.
- The obstacle and the sequence of events should be recorded truthfully; the available documents should be obtained.
- The implementing unit should be informed without delay, and the excuse should be submitted by an application that is recorded.
- If the violation file has been sent to the judicial authority, it should be monitored that the explanations reach that file.
- A change of day, time or place, or a temporary exemption, should be requested separately for an ongoing problem.
- The existing obligations must be observed until a new decision is made.
These steps do not guarantee that a past violation will be excused. The aim is to prevent the incident from being assessed on the basis of an incomplete or wrong record and to reduce violations that may occur later. Documenting the excuse and changing the obligation for the future are separate requests; one does not take the place of the other.
Article 57/2 of the Regulation expressly provides that the execution of judicial control continues until a decision is received from the relevant judicial authority. The thought "my file has been sent to the court, so I will no longer sign" is therefore mistaken.
Can the signing day, frequency or place of reporting be changed?
CMK Articles 110/2 and 111 allow obligations to be removed or changed in whole or in part, and a temporary exemption from some of them to be granted. Reducing daily reporting to certain days of the week, changing the time range to suit the work schedule, or determining a suitable place of reporting because of a move can be requested within this framework. 1
The request should explain how the proposed arrangement would preserve the purpose of the measure. Instead of merely saying "signing is difficult for me", the current travel time, loss of work, shift conflict or state of health should be made concrete. Indicating an alternative day and time makes the request capable of being assessed.
In the investigation the criminal judge of peace (sulh ceza hâkimi) is the reference point, and at the prosecution stage the competent court with jurisdiction. That the implementing unit runs the file does not mean that it may, in its own discretion, remove an obligation contained in the judicial decision in every case. For requests that change the essential content set out in the decision, the necessary judicial decision should be followed.
When might a temporary exemption be more suitable?
For a short-term operation, necessary travel, an exam or another obstacle on particular dates, a temporary exemption may be requested instead of permanent removal. The start and end of the exemption, which signing days it covers and how matters will continue afterwards should be clear.
If foreign travel is involved, it should also be checked whether there is a travel ban. An exemption from signing does not lift a travel ban, and permission to travel abroad does not create an exemption from signing. If there is judicial control in more than one file, action is taken according to the decision in each file.
What application is made if there is an error in the signature record?
Objecting to the content of the obligation is different from claiming that the implementation record was kept incorrectly. If the person says that they reported at the specified time but their signature was not recorded, they should request correction and review with the date, time, unit and, if available, minutes information. A request to preserve existing camera or electronic records may be assessed according to the particulars of the specific case.
Article 48 of the Regulation provides for the route of objection to the directorate or complaint to the enforcement judgeship against the directorate's acts and actions. For a complaint to the judgeship, periods of fifteen days from learning of the act and in any case thirty days from the act are provided. This route is different from an objection under CMK Articles 111 and 268 against the court decision imposing judicial control. 2
The act against which the complaint or objection is directed should be clearly identified. Making only an objection to the administrative record in order to have the court decision changed, or explaining the record error only in a general petition for removal, may make it harder for the necessary examination to be carried out in time.
How are the time limit and grounds determined for an objection to the signature obligation?
Decisions on judicial control may be objected to under CMK Article 111/2. The current general period is two weeks from learning of the decision; this rule applies to decisions given on or after June 1, 2024. The five-day decision rule in a request for removal is not an objection period.
Even if the period for objecting to the initial decision has passed, removal or change of the continuing measure may be requested. In an objection, the unlawfulness at the date the decision was made; in a new request, the current necessity, changed conditions and proportionality should be explained. Records showing regular compliance with earlier obligations are important, but on their own they do not produce a mandatory removal.
An objection or an application for removal does not of its own accord suspend the obligation. Unless there is a deferral decision under CMK Article 269 or an express exemption, the existing calendar must be observed. Detailed explanations of the authority and period are given in the series article "Objection to a Judicial Control Decision and Request for Removal".
How long does the signature obligation last, and is it deducted from the sentence?
Under CMK Article 110/4, the need for continuation is reviewed at intervals of at most four months. This does not mean that the measure will end by itself after four months. The basic periods, the conditions for a reasoned extension and the maximum limits in Article 110/A apply separately; for children, the periods are halved.
The basic period is two years in matters not within the jurisdiction of the High Criminal Court (Ağır Ceza Mahkemesi) and three years in High Criminal Court matters. The extension is at most one year in the first group; in the second group, as a rule three years in total, and four years for certain offenses specified in the law. That the longest limit has not yet been reached does not prevent a request for removal or relaxation earlier. 1
The time spent under the signature obligation is not deducted from a prison sentence merely because the person went to sign. The set-off exceptions in CMK Article 109/6 relate to other obligations. The calculation rules for house arrest should therefore not be carried over to the signature obligation.
Did the İbrahim Aydoğan decision deem every signature obligation lawful?
No. In the İbrahim Aydoğan decision of the Second Section of the Constitutional Court (AYM) dated January 19, 2022, application no. 2019/36711, the concrete intensity of an obligation to report two days a week between 08:00 and 21:00 was examined. The Court did not assess this practice as a deprivation of liberty within the meaning of Article 19 of the Constitution and found the relevant complaint inadmissible for lack of jurisdiction ratione materiae (§§37–42). 3
This result does not mean that all signature decisions are lawful or that a request for removal cannot be made. The scope of the right examined and the conformity of the measure with the law and with proportionality are not the same question. If a serious effect on the person's social, family or professional life is alleged, it must be made concrete separately.
The doctrine likewise emphasizes that judicial control may interfere with different fundamental rights. In assessing rights, not only the name "signature" but the actual conditions of the measure should be taken into account. 4
What distinctions should be kept in mind for children?
For children, the periods in CMK Article 110/A are applied at half the rate. In addition, education, family relations, travel safety and developmental needs should be addressed specifically when preparing an application. Article 44/6 of the Regulation provides that, when a violation notification is made, information about the guidance and rehabilitation work carried out with the child is also to be submitted.
Article 57/7 of the Regulation separately provides that failure to take part in guidance work under the Child Protection Law does not, under certain conditions, lead to a warning and violation procedure. This special provision is not identical to a child's failure to comply with a signature obligation determined by the judge. Failing to take part in a guidance program and violating a judicial obligation should not be confused. 2
Conclusion
The right approach to the signature obligation is to clarify the content of the decision from the outset, to keep to the calendar and to submit any obstacle that arises, with documents, without delay. Having a past deficiency assessed as an excuse and changing the future day, time or place are separate procedures.
There is no automatic violation quota in judicial control; nor does every deficiency mean mandatory detention. The specific incident, the standard of willful non-compliance and a valid excuse are assessed together. It should be borne in mind that the obligation continues until the application is concluded.
Frequently Asked Questions
If I do not go to sign once, will I certainly be detained?
No. CMK Article 112 allows the possibility of detention; it does not provide for an automatic consequence. The conditions of the violation, willful non-compliance and the excuse are assessed. That said, a single violation should not be assumed to be unimportant either.
Do I have a right to violate the signature three times?
No. The Regulation provisions specific to judicial control provide that, in a violation without excuse and with intent, notification is made without a prior warning. It should not be confused with other probation regimes in the execution of sentences.
If I submit a hospital report, will my excuse certainly be accepted?
No. The date and time of the document and how it prevented going to sign are examined. The connection between the admission or treatment record and the incident must be clearly established.
Is it enough to say that I forgot to sign?
Forgetting is not an excuse that is accepted automatically. The incident should be described truthfully, and the available explanations and documents should be submitted. Compliance with later obligations should be maintained.
Is it useful to go to the police station after missing the signing time?
It is important to report the situation without delay and to have it recorded. However, a late report does not of itself eliminate the earlier deficiency. Submission of the excuse to the file is also separately required.
If the signing day falls on an official holiday, can I go the next day?
You should not change the day on your own decision. The signing calendar and the unit's working schedule should be clarified in advance. The rule extending procedural periods does not apply automatically to the signing day.
Can I change the signing day because of work?
A change can be requested. A suitable day, time or frequency should be proposed with documentation of the shift or work schedule. Until the request is accepted, the existing decision is taken into account.
If I move to another city, can I sign at a police station there?
The place of reporting does not change automatically. The change of address should be notified and the necessary implementation and decision procedures followed. It should not be assumed that signing at any unit is sufficient.
Do I continue to sign when the violation file is sent to the court?
Yes, the obligation continues unless a new decision is made. Article 57/2 of the Regulation provides that execution continues until a decision is received from the relevant judicial authority.
Is an exemption from signing enough to travel abroad?
It must also be examined whether there is a travel ban or another obligation that prevents travel. The scope of the decision is assessed separately for each obligation.
What should I do if I think the signature record was kept incorrectly?
Correction and review should be requested with the date, time and place of the report and the available records. The route of application against a directorate's act differs from an objection to the court's judicial control decision; the periods must be followed separately.
Is time spent under the signature obligation deducted from the sentence?
The mere fact that a signature obligation was applied does not create a right to set-off. The exceptions in CMK Article 109/6 relate to different obligations. The set-off rule for house arrest does not apply to signing.
