Correcting a tax error is a special application procedure that removes a clear mistake in calculation or taxation. If the time limit for filing an action has passed, a taxpayer who meets the conditions first requests a correction from the relevant tax office; after a rejection, the taxpayer follows the complaint route. This route does not make every allegation of unlawfulness open to a new lawsuit. The scope of the application, the nature of the error and the calculation of the time limit must be assessed together. 1
A tax being high, a loss from a commercial transaction or another taxpayer winning a similar case does not by itself give rise to a right to correction. First it must be determined which transaction is wrong, for what reason and in what amount. In particular, if the time limit for filing a lawsuit has not yet expired, it should not be left unchecked on the assumption that a correction application will be made. For details, see the article how a tax lawsuit is filed.
What is a tax error, and which errors can be corrected?
Articles 116–118 of Tax Procedure Law No. 213 (VUK) distinguish calculation errors from taxation errors. The subject of a correction is the unjustified demand or collection of too much or too little tax because of a calculation or taxation error relating to tax. A correction therefore does not simply mean a decision in the taxpayer's favour; the administration may also identify the error within the conditions set by law. 1
Calculation errors: tax base, amount and double taxation
In a calculation error, the mistake lies more in records or in the numerical result of the transaction than in an evaluation. Transferring the tax base incorrectly, calculating the tax wrongly on a correct tax base, and requesting the same tax again for the same period may be examples. However, different tax types arising from the same economic event are not, by themselves, double taxation.
For example, if it is alleged that the same assessment was paid twice, two bank receipts may not be sufficient. It should also be seen from the account movements that the receipts were posted to the same debt, and that one payment was not cancelled or offset against another period. The application file should include a short explanation that matches the payment with the record at the tax office.
Taxation errors: person, subject and period
Requesting tax from the wrong person, imposing taxpayer status on a person who is clearly not subject to tax, collecting tax on a transaction clearly outside the subject of the tax, or applying the wrong period may be assessed in this group. Clarity here matters. If determining the scope of an exemption provision requires a long legal interpretation, it is also examined whether the dispute goes beyond the limits of correction. 1 2
How is a tax error separated from a legal dispute?
The main question in a correction file is whether the error falls into one of the error types in the law. If the true nature of a contract, whether a transaction is a supply of goods or a service, the scope of an exemption, or the connection of an expense with income is disputed, using only the expression "tax error" does not bring the application within this scope.
The Tax Litigation Chambers Board of the Council of State (Danıştay Vergi Dava Daireleri Kurulu), in its decision of 2 October 2024, E.2023/112, K.2024/880, did not treat the matter as a clear tax error, because the scope of the stamp duty exemption relating to urban transformation work required interpretation. The Board rejected the appellant's request for review on points of law. The dissenting opinion in that decision favours reversal; a dissenting opinion cannot be presented as the outcome accepted by the majority. 2
This decision does not mean that all exemption claims fall outside correction. The application must establish the connection between the statutory provision and the concrete document, and explain why the administration did not need to make a separate legal classification. Conversely, if the dispute turns on interpretation, using the direct lawsuit route within its time limit may be decisive.
How is a correction application prepared?
Under Article 122 of VUK, a correction is requested in writing from the relevant tax office. The application should not be framed simply as "my debt should be deleted"; the transaction, period, amount and reason for the error must be stated clearly. The administrative record number and proof of submission must be kept. For electronic applications, it should also be checked separately that the attachments were actually uploaded and the procedure was completed. 1
- Tax type, tax period, and the number of the tax accrual (tahakkuk) or notice of assessment (ihbarname).
- Comparison of the erroneous amount with the amount claimed to be correct.
- The reason the error is assessed under Article 117 or Article 118 of VUK.
- Tax return (beyanname), accrual slip, payment document, account statement and other relevant documents.
- Separate explanation of the requests for correction, cancellation (terkin), refund and, where applicable, interest.
How is a claim matched with documents in the petition?
Stating in one sentence what each attachment proves makes the application reviewable. Instead of saying "attachments are submitted", it should be explained that the first assessment and the second assessment concern the same tax and the same period, and where the difference between them arises. If a representative acts, the power of attorney must be in the file; for companies, the authorization document showing the authority to act must also be in the file.
If a refund is requested, the amount actually paid must first be separated from the amount merely assessed. Cancelling an unpaid debt and refund of tax already collected are different outcomes. In a file where interest is requested, the dates of collection, of the application and of the correction receipt should be recorded separately.
How long is the limitation period for correction?
Article 126 of VUK refers, for correction, to the limitation period in Article 114. The general framework is five years, starting from the beginning of the year following the calendar year in which the tax claim arose. In addition, the suspension of limitation, special provisions and the minimum one-year periods in Article 126 are assessed separately. It is not correct to say that in every file only five years from the date of payment of the tax count. 1
In which situations does the one-year minimum period matter?
The special provision of the article sets separate starting points for tax assessed and notified in the last year of the limitation period; for tax notified by publication, the notification of the payment order; and for the attachment date where both the notice of assessment and the payment order are notified by publication. In these cases, the correction period must not be less than one year from the relevant date. This exception cannot be applied as an additional one year from the payment date for all debts. 1
For example, the special protection of Article 126 may come into play for an assessment notified at the end of the year in which the general five-year period expires. However, for this the assessment and notification dates, valid notification and other effects on the period must be examined. The example does not replace the calculation that determines the last filing day of a specific file. This point is also addressed in the article on electronic notification in tax matters.
The difference between an application within the lawsuit period and the complaint route
The time limit for filing a direct action before the tax court is, as a rule, thirty days; special provisions are reserved. An application made within this period is examined to determine whether it has the nature of a request for removal, withdrawal or amendment of the act under Article 11 of Administrative Procedure Law No. 2577 (İYUK). An application that meets the conditions of that article may suspend the time limit for filing an action; after the rejection, the remaining period resumes. Not every petition has the same effect. 3
The former provision of Article 11 of the Administrative Procedure Law, which entirely excluded tax disputes, is no longer in force. On the other hand, the VUK correction–complaint route is a route with special conditions. The name of the application, the date it was made, the content of the request and the subject of the lawsuit must be assessed together; the conclusion that "the time limit definitively stopped" must not be drawn without this.
If the direct lawsuit period has passed, what order is followed?
If the correction request is rejected after the lawsuit period has passed, the complaint stage under Article 124 of VUK is followed. For files relating to the central tax administration, the complaint is addressed to the competent authority for the Ministry of Treasury and Finance / Revenue Administration Presidency (Gelir İdaresi Başkanlığı). For municipal and provincial special administration taxes, the different authorities provided by law are taken into account. 1
After a complaint is rejected, expressly or by implication, a lawsuit before the tax court comes into question. For implied rejection, the thirty-day response period in the current Article 10 of Administrative Procedure Law No. 2577 and the lawsuit period that follows are calculated together. A non-final response, a later response and the completion of the application chain are also important. The sixty-day implied-rejection period in older publications should not be used directly. 3
What is examined in a lawsuit against a rejection decision?
A lawsuit petition must not only explain why the original tax is unjustified. The correction and complaint applications, registration dates, responses, notifications and the type of error must be presented together. The relief sought should include, in the form the facts require, annulment of the rejection of the complaint, and refund and interest claims linked to remedying the error.
The administration may argue that the dispute requires legal interpretation, that the time limit has passed, or that the payment belongs to another debt. Against each defense, the counter-document in the file must be presented. It should not be assumed that repeating the same application without a new fact will continuously restart a missed lawsuit period.
Can the same route be used for a payment order or attachment?
A payment order and an attachment are separate acts at the collection stage. Objections to their annulment cannot be converted into the VUK correction–complaint route merely because they concern a tax debt. The collection act keeps its own lawsuit period and grounds. Moreover, submitting a correction petition does not by itself stop collection; the necessary judicial protection is assessed separately. 3
It must also be examined whether there is a final court decision. Article 125 of VUK accepts a correction for acts that have already been reviewed by the courts, under specific conditions; however, whether a court has ruled on the same error is decisive in this assessment. A correction is not a general means of re-examination to override res judicata. 1
Conclusion
Success in correcting a tax error depends less on the name of the application than on demonstrating the clear error and the correct procedure. The nature of the transaction, the type of error, the limitation period and the direct lawsuit period must be examined together. In a file where the lawsuit period has passed, the correction and complaint stages must be completed; the rejection decision and the refund and interest claims must be made concrete with documents.
Frequently Asked Questions
Can every unlawful tax be removed through correction?
No. As explained in the section on how a tax error is separated from a legal dispute, not every dispute requiring interpretation falls into this special route. Return to the related explanation
Must five years from the payment date always be counted for a correction?
No. The general starting point and the Article 126 exceptions must be examined together, as explained in the section on how long the limitation period for correction is. Return to the related explanation
Can a lawsuit be filed immediately after the tax office's rejection?
The timing of the application matters. As explained in the section on the difference between an application within the lawsuit period and the complaint route, once the direct lawsuit period has passed, the special complaint stage must be completed. Return to the related explanation
Does a correction request automatically lift a bank attachment?
No. Under the distinction explained in the section on whether the same route can be used for a payment order or attachment, the collection act and the necessary request for a stay of execution are assessed separately. Return to the related explanation
