You divorced abroad
Determining the administrative registration or court route for updating marital status in Türkiye.
Review divorce registrationRecognition secures acceptance in Türkiye of the res judicata or conclusive-evidence effect of a foreign court judgment; enforcement makes it possible to apply in Türkiye a ruling that requires execution. For certain foreign divorce judgments, an administrative registration (idarî tescil) route is also available. The type of the judgment and the result sought in Türkiye determine the route to follow.
Private international law is not limited to this. In family, inheritance, contract, commercial and property relationships with a foreign element, which law applies, which court has jurisdiction and where the judgment can be applied are considered together. The firm provides advice, contract and litigation services to applicants and to persons and companies against whom a claim is directed.

Review contract provisionsFinality, apostille, translation, service of documents and research into the content of foreign law.
Review document requirementsThat a judgment has been translated or bears an apostille does not mean it will be applied in Türkiye with all its effects. We determine the route of application by drawing the following distinctions.
On a narrow screen, you can scroll the table horizontally to see the other columns.
| Subject | Legal assessment | Application |
|---|---|---|
| Recognition | Acceptance of the res judicata or conclusive-evidence effect. | Divorce or status judgment; the effect of a foreign ruling in another case. On its own, it does not allow compulsory execution of a claim. |
| Enforcement | Application in Türkiye of a foreign ruling that requires execution. | Ruling on money, maintenance, damages or delivery. After an appropriate judgment, the Turkish execution procedure is followed separately. |
| Administrative registration | Entry of certain marital-status decisions listed in the law into the family register. | Divorce, nullity, annulment or a finding that the marriage does not exist. Financial and child-related rulings are handled separately. |
| Special treaty route | International instrument specific to the country and subject. | In matters such as child protection or maintenance, recognition, execution or authority assistance may differ from the general route under the Law on Private International Law and Procedure (MÖHUK). |
| Apostille and translation | Certification of the origin of a document and conveying its content in another language. | Verification of signature and seal does not replace recognition or enforcement; any document-specific exemption from certification is investigated. |
| Foreign arbitral award | An arbitration regime separate from court judgments. | MÖHUK Articles 60–63 and, where applicable, the New York Convention; details are addressed in the arbitration service. |
The date of the judgment, service, finality and enforceability are not the same thing. If a statement of claim has been served on you in Türkiye, or urgent protection is needed for a child or assets, state this in your first communication. A consultation request does not suspend statutory time limits.
The merits of the foreign case are not re-examined. However, the scope of the ruling and the enforcement conditions are verified against concrete documents. Reciprocity is not required for recognition; the different rules of special treaties are reserved.
Under Article 27/A of the Law, if one of the parties is deceased or a foreign national, the other party who is a Turkish citizen, or that party’s attorney, may apply alone. Where a joint application is required, the ninety-day period between separate applications is observed.
Administrative registration does not by itself make maintenance, custody, the matrimonial property regime or damages enforceable. These parts of the judgment and special treaty routes are assessed separately.
We do not treat a foreign judgment as merely a document to be translated. The real legal effect of the judgment, the law of the country, the service and defense records, and the result sought in Türkiye are examined together. The administrative procedure, recognition, enforcement, a new action and interim protection routes are separated at the start of the file.
In the same file, the effect of proceedings in two countries on each other matters. Where coordination is needed with a foreign legal expert, interpreter, notary and the competent authority, duties and responsibilities are determined. The step to be taken for the client, the documents needed, possible obstacles, cost and next step are explained in an understandable way.
The status of the parties, the dispute, the country in which the judgment was rendered, the Türkiye connection and any urgent date are recorded.
MÖHUK, special treaties, subject-matter and territorial jurisdiction, choice of law and representation requirements are assessed.
The full judgment, finality, service, payment and any related files in Türkiye are reviewed.
The scope of the claim or defense, the need for translation and certification, and fees and expenses are clarified.
After acceptance of the matter and authorization, pleadings, international service of documents and, where necessary, interim protection are followed.
Legal remedies, finality, civil registry or other registry procedure and execution are carried out separately, within the scope of the judgment.
By opening the relevant heading, you can review the detailed scope of the service. The work is planned by assessing the status of the parties, available documents, country connection and applicable law together.
The nationality of the parties, habitual residence, domicile, company seat, assets, and the places of contract, performance and harm are determined. The family, inheritance, contract, commercial, tort, property or company-status dimension of the dispute is classified under separate conflict-of-laws rules.
The domestic rule of territorial jurisdiction, MÖHUK Article 40 and the special provisions on international jurisdiction are examined together. The jurisdiction of the Turkish court is distinguished from the applicable law and from the enforceability of the judgment in another country.
In obligations with a foreign element, whether the parties’ choice of a foreign court meets the conditions of MÖHUK Article 47 is assessed. Written form, a specific legal relationship, a field not subject to exclusive jurisdiction, the defendant’s objection and the possibility that the chosen court declines jurisdiction are examined.
Connecting factors such as the personal law, habitual residence, place of business, the most closely connected law, the location of the property or the place of the event are determined. In a file with a choice of law, the scope and validity of the choice and mandatory limits are addressed separately.
The Turkish judge applies foreign law ex officio and may use the parties’ assistance in establishing its content. Current statutes, secondary legislation, official statements, academic opinion and, where necessary, the opinion of a foreign legal expert are submitted to the file by an appropriate method; where the content cannot be established, the result under MÖHUK Article 2 is assessed.
It is examined whether the result of applying the foreign provision in the concrete case, not the provision itself, creates a manifest conflict with Turkish public policy. Overriding mandatory rules of Turkish law that are compulsory in view of their regulatory purpose and field of application are determined separately.
Dispute concepts and preliminary questions are assessed under the relevant conflict rules. Under MÖHUK Article 2/3, the renvoi of foreign law to another law is taken into account in disputes concerning the personal law and family law. This rule is not automatically extended to inheritance disputes; special provisions and applicable treaties are examined separately.
The issuing authority, type of judgment, parties, subject of the action, operative part, finality, service and need for execution are examined. It is determined which route is required: recognition, enforcement, administrative registration, a new action or another form of international cooperation.
A recognition request is prepared for acceptance in Türkiye of the res judicata or conclusive-evidence effect of a foreign judgment that does not require execution. The non-application to recognition of the reciprocity condition required for enforcement, and other MÖHUK obstacles, are addressed according to the concrete judgment.
An enforcement action is conducted for execution in Türkiye of a ruling on money, maintenance, damages, delivery or another performance. Reciprocity, public policy, exclusive jurisdiction, the objection of excessive jurisdiction and the right of defense are reviewed.

It is investigated at which stage the judgment became final under the law of the country where it was rendered, the ordinary legal remedy, the finality certificate and whether a separate enforceability document is required. It is checked that the document was not merely issued but belongs to the correct judgment and to all parts of the operative provisions.
In enforcement, it is investigated whether there is a bilateral or multilateral treaty between the state of the judgment and Türkiye, and whether there is reciprocity based on a statutory provision or on actual practice. The scope of the treaty in terms of subject, time and persons, and reservations and declarations, are verified.
It is examined whether the dispute falls within the exclusive jurisdiction of Turkish courts. The claim that the foreign court considered itself competent without a genuine connection to the case or the parties is assessed on the objection of the party against whom enforcement is sought and under the MÖHUK criteria.
The operative result of the foreign judgment is examined in terms of fundamental rights, safeguards of defense and the indispensable principles of the Turkish legal order. That foreign law differs from Turkish law is not by itself treated as a ground for rejection.
It is examined whether the person against whom the judgment was rendered was duly summoned to the foreign court and represented, and whether a judgment rendered in that person’s absence complies with the law of the country. Raising the objection within the time limit before the enforcement court, and service records, are important.
That a judgment was rendered in absence does not automatically lead to rejection. The statement of claim, notice of hearing, address, method of service, time to respond and notice of legal remedies are examined together, and the MÖHUK conditions are assessed.
Recognition or enforcement may be sought only for the necessary severable parts of the foreign judgment. Separate outcomes such as divorce, custody, maintenance, matrimonial property regime and damages are each handled according to their own legal nature.
If a foreign judgment is to be invoked in another Turkish case as res judicata or conclusive evidence, the conditions for examining recognition as a preliminary issue are assessed. Lis pendens, prior judgments and the risk of conflicting judgments are investigated through the chronology of the file.
The statement of claim, simplified procedure, proper composition of the parties, service abroad, evidence, the scope of the judgment, and the appeal and cassation stages are managed. Finality of the enforcement judgment and the execution process are followed on a separate timetable.
The Notification Law, bilateral agreements, the 1954 Hague Civil Procedure Convention, the 1965 Hague Service Convention and country declarations are examined. In files requiring a document or witness procedure through a foreign authority, the applicable letters rogatory and evidence convention route is determined.
The status of the state in which the document was issued and the state in which it will be used as a party, the type of document, exceptions, the competent apostille authority and the chain of certification are examined. It is explained that an apostille does not verify the content of the document or the enforcement conditions; translation and notarial procedures are planned separately.
A recognition action is conducted so that a divorce, separation, nullity or annulment judgment rendered by a foreign court produces personal-status effects in Türkiye. The marital, inheritance and civil-registry consequences after the date of the judgment are examined case by case.

Under Article 27/A of Law No. 5490 and the relevant Regulation, an application to the competent diplomatic mission or the population directorate (nüfus müdürlüğü) is assessed for a final foreign judgment that falls within the scope. Where one of the parties is deceased or a foreign national, the other party who is a Turkish citizen, or that party’s attorney, may apply alone. The other conditions and the capacity of the applicant are still examined.
Where a joint application is required, being present at the same time is not mandatory; the interval between separate applications must not exceed ninety days. This period is different from the ninety-day period granted for completing a missing document. Special power of attorney, finality, certification and translation are checked according to the file.
The commission’s grounds for rejection are examined from the standpoints of missing documents, public policy, a pending case, a prior rejection or a scope problem. If the conditions are met, recourse is made to the courts with a recognition or enforcement request before the competent family court.
For a foreign custody, personal contact (access) or child-protection judgment, any applicable international convention is investigated first. In relationships to which the 1996 Hague Child Protection Convention applies, the recognition and execution regime may differ from the general MÖHUK route. The best interests of the child, habitual residence, jurisdiction and the need for interim measures are assessed together.
An allegation of wrongful removal or retention of a child under the 1980 Hague Convention and Law No. 5717 is examined. The central authority, habitual residence, actual exercise of custody rights, exceptions to return and urgent measures are conducted as a special process distinct from recognition and enforcement.

The scope, periods, currency, interest and amendment decisions of the child or spousal maintenance judgment are examined. A maintenance convention applicable between the states concerned, central authority assistance and special execution conditions are investigated. The general finality and reciprocity conditions of MÖHUK are not applied in the same way to all files without examining the special convention regime.
Whether the matrimonial property regime, compensation, costs or money ruling in a foreign divorce judgment can be separated from the divorce status is assessed. Taking into account that administrative registration does not make these claims enforceable, the need for enforcement or a new action in Türkiye is determined.
The effect in Turkish law of foreign judgments on parentage, paternity, adoption, name and surname, and personal status is examined. Public policy, the interests of the child, civil registration and the provisions of special international conventions are separated out.
The effect of a foreign certificate of inheritance, court judgment or estate procedure on movable and immovable property in Türkiye is assessed. The law applicable to rights in rem in immovable property, the jurisdiction of Turkish courts and land registry practice are examined separately.

Recognition or enforcement of judgments on companies, shareholders, sales, distribution, services, licenses and commercial claims is conducted. The competent commercial court, reciprocity, a jurisdiction agreement, interest, costs and the enforceability of the operative part are examined.
Principal, type and start date of interest, litigation costs, attorney fees and currency are separated out from the operative part. The form of proceedings in Turkish execution law, exchange rate and payment objections are planned for the stage after the enforcement judgment.
The effect of a judgment on the formation, capacity, organ authority, shareholding or dissolution of a foreign company on its branch, shareholding and assets in Türkiye is examined. Registry procedure, recognition, enforcement and the applicable company law are distinguished from one another.
The effect of a foreign bankruptcy, a composition-type (konkordato) process or a restructuring judgment on the debtor and assets in Türkiye is assessed. Universality, territoriality, the Turkish execution and bankruptcy order, public policy and whether a special recognition mechanism exists are examined.
It is investigated whether a foreign judgment that is not yet final or is provisional in nature is a judgment within the meaning of MÖHUK Article 50. The conditions for an independent precautionary attachment or interim injunction against assets in Türkiye are assessed separately from the main action and the enforcement process.
The scope of the parties’ express or unambiguous choice of law, its application to the whole contract or a part of it, and later changes are examined. Protective or mandatory provisions, such as those for consumers, employment, insurance and immovable property, are also taken into account.
Choice of court, arbitration, mediation, applicable law, address for service and enforcement of judgments are drafted as complementary clauses. Provisions that conflict with one another or are difficult to apply in practice are eliminated before the contract is signed.
Choice of law and court is assessed in international sales, agency, distributorship, franchise, license, transport and service relationships. The applicability of uniform law texts such as the CISG and matters outside their scope are determined separately.
The place of damage, place of the act, common habitual residence, the more closely connected law and the injured party’s option are examined under the relevant MÖHUK provisions. The competent court, applicable law, insurance and enforcement of the foreign judgment are handled in the same strategy.
Special conflict and international-jurisdiction provisions protecting the weaker party are assessed. To what extent a choice of foreign law or court can affect the mandatory protection of the employee, the consumer or the insured is determined according to the concrete relationship.
The application of a final recognition or enforcement judgment at the civil registry, land registry, trade registry, bank, enforcement office or other relevant institution is followed. No registration or collection request beyond the scope of the foreign judgment is made; the judgment, the enforcement judgment and the finality records are submitted together.

Original or certified copy, exemption from certification, apostille, special power of attorney and Turkish translation.
The timetable for response and legal remedies, the statute of limitations, and interim protection for a child or assets.
Execution after enforcement, prior payments, registration and, if necessary, separate proceedings in the foreign country.

The country and authority that issued the judgment, your capacity as a party, the procedure requested in Türkiye and a current contact address.
The full judgment, supplementary decisions, finality or enforceability documents, and information on legal remedies.

Do not send identity documents, passports, children’s information, bank records or the whole foreign case file in your first message. Taking into account jurisdiction, representation and the conditions of the file, the firm can provide services in the 81 provinces of Türkiye in private international law advice, recognition, enforcement, litigation, legal remedies and the application of judgments. Processes connected with Türkiye of persons and companies outside Türkiye can be assessed through online meetings, secure document sharing and communication in Turkish, English, German and Russian. Where a review of foreign law or local representation is needed, the scope, responsibility and fee of coordination with an attorney authorized in the relevant country are determined separately.
Before acceptance of a matter, conflict of interest and authority to represent are checked. The responsible attorney or team is determined in the engagement; significant developments, decisions that are needed and upcoming dates are communicated to the client in an understandable way. You can review the professional backgrounds of our attorneys.
Which of recognition, enforcement, administrative registration, defense, legal remedies and post-judgment execution are included in the engagement is explained at the outset. The country, the number of parties and documents, international service of documents, translation, foreign-law review and the need for urgent action affect cost.
The attorney’s fee is explained in writing, taking into account the Attorneys’ Minimum Fee Tariff in force (Avukatlık Asgari Ücret Tarifesi) and the professional rules. Court fees, expert, translation, notary and necessary technical service expenses are shown separately. The scope and responsibility of local representation in a foreign country, the opinion of a foreign legal expert and translation services are also determined separately. The matter is not presumed to have been undertaken until the engagement and the necessary authorization are confirmed.
The res judicata, conclusive-evidence or execution effect of a foreign judgment in Türkiye depends, as a rule, on the conditions for recognition or enforcement. For certain foreign family-law judgments, the administrative registration route under Law No. 5490 may also be assessed.
Recognition secures acceptance of the res judicata or conclusive-evidence effect of a foreign judgment. Enforcement gives a performance ruling compulsory execution force in Türkiye.
Yes. For the execution in Türkiye of an enforced ruling, the legal effect of the foreign judgment is also accepted. However, recognition alone is not enough for the collection of a claim that requires execution.
Under MÖHUK Article 51, the opposing party’s domicile in Türkiye is the basis, failing that the place where the party resides; if there is neither, the courts of Ankara, Istanbul or Izmir come into question. That our firm is located in Antalya does not by itself give an Antalya court jurisdiction. The court with subject-matter jurisdiction is also determined by the subject of the judgment.
As a rule, the family court; where there is no family court, the civil court of first instance acting in that capacity comes into question. If the conditions for administrative registration are met, that route may also be examined before filing an action.
Yes; however, the statement of claim and the notice of hearing must be sent by the applicable international service procedure. The country, treaty, translation and the time for service affect the litigation timetable.
The defendant’s acceptance or failure to object may narrow the scope of the dispute; however, the court’s duty to examine the MÖHUK conditions and the document order continues. Proper composition of the parties is still required.
A judgment rendered in absence is not by itself a ground for rejection. Proper summons, representation, the opportunity to defend and compliance with the law of the state of judgment are examined.
There is no single fixed period. Service abroad, objections, completion of documents, appeal and cassation, and the court’s workload affect the duration. The stages and dependencies are explained in the preliminary review of the file.
No. Participation in the Apostille Convention, the type of document, a bilateral treaty, an exemption from certification and the authority where it will be used must be examined. If the apostille is not applied, another certification procedure may be required.
No. An apostille serves to certify the origin of a document; it does not mean that it replaces the conditions for recognition or enforcement.
A certified Turkish translation is required for the judgment and related documents in a foreign language submitted to the court and to the population commission. The method of translation and certification is determined according to the country of the document and the authority to which it will be submitted.
MÖHUK Article 50 requires that a foreign judgment be final under the law of the state in which it was rendered. The date in the text of the judgment may not by itself show finality; a separate official document may be required.
If the conditions in Article 27/A of Law No. 5490 and the Regulation are met, administrative registration may be possible through the competent diplomatic mission or the provincial directorate commission.
Where a joint application is required, being present at the same time is not necessary; the interval between separate applications cannot exceed ninety days. If one of the parties is deceased or a foreign national, the possibility of a sole application by the other party who is a Turkish citizen, or that party’s attorney, is examined separately.
Article 27/A of Law No. 5490 allows the other party who is a Turkish citizen, or that party’s attorney, to apply alone in these cases. The competent authority, finality, public policy and document conditions are still required. The applications of other interested persons and divorces based on a unilateral declaration of intent are assessed under special provisions.
No. The commission’s registration decision concerns the divorce or the relevant marital-status result; a recognition or enforcement action may be necessary for the provisions on custody, personal contact, maintenance, matrimonial property regime and damages.
After the grounds for rejection and the status of the documents are reviewed, a recognition or enforcement action may be filed under MÖHUK before the competent family court. If documents are missing, the completion procedure in the Regulation is assessed separately.
First the judgment is enforced; then, on the basis of the final enforcement judgment, proceedings in accordance with Turkish execution law come into question. Interest, currency, payment and partial collection records are examined together with the judgment.
Under MÖHUK Article 58, the reciprocity condition specific to enforcement does not apply to recognition. Other obstacles to recognition and the finality and document conditions are examined.
The manifest conflict of the result of the foreign judgment with the indispensable fundamental values of the Turkish legal order is examined. That foreign law differs from Turkish law is not by itself an obstacle of public policy.
As a rule, the recognition and enforcement judge does not re-review the foreign court’s factual and legal assessment as a higher court would. The judge examines the conditions in MÖHUK and in any applicable treaty.
If the parts of the operative provisions can be separated from one another, partial recognition or enforcement may be possible. The outcome sought and the part whose execution is requested must be clearly specified.
No. Recognition and enforcement of foreign arbitral awards are assessed under MÖHUK Articles 60–63 and, if applicable, the 1958 New York Convention. Details are addressed on the Arbitration Law page.
Depending on the nature of the file and a valid power of attorney, many procedures can be carried out through an attorney. Procedures requiring personal attendance or special authority are determined separately. The content, certification and translation of a power of attorney executed before a consulate or a foreign notary should be checked in advance.
Which part of the ruling has been satisfied should be shown with proof of payment, release or partial collection. An objection of satisfaction or of a ground preventing satisfaction may be assessed under MÖHUK Article 55. The time to respond to case papers in Türkiye is followed separately.
Security may come into question for foreign natural and legal persons under MÖHUK Article 48. Reciprocity or an exemption under an applicable international treaty is examined. It is not presumed that every foreign applicant will deposit the same amount.
That a judgment was rendered in Europe is not enough by itself. The country, the type of judgment, the treaty in force and the appropriate route in Turkish law are investigated. The European Union rules on the circulation of judgments do not create an automatic recognition or execution mechanism for Türkiye.
MÖHUK Article 50/2 allows enforcement to be sought for the provisions on personal rights contained in a criminal judgment. This possibility does not mean that a prison sentence or criminal fine is applied through private-law enforcement. The type of ruling and other conditions are examined.
The fee is determined in writing according to the scope and stage of the work. Court fees, international service of documents, translation, notary, certification and, if needed, the expenses of a foreign legal expert are explained separately. A definite total cost or completion time is not promised without knowing the country and the number of documents.
Content preparation and source check: . Legislation and the application timetable should be checked again on the date of the transaction.
