Summary

Lawyer, interpreter, release and consular rights for foreign detainees in Türkiye; a guide to applications and legal support for families abroad.

The pretrial detention of a foreign national in Türkiye often creates two uncertainties for relatives at once: what is in the criminal file and what steps the family can take. Pretrial detention is not a final conviction. A foreign person under a criminal accusation benefits from the guarantees of defense, legal assistance, an interpreter where necessary, judicial review of the detention and detention in conditions consistent with human dignity. The family’s first goal should be to reach the right file and not to delay applications that are subject to time limits.

This guide addresses foreigners placed in pretrial detention because of a criminal investigation or prosecution. Administrative detention in a removal center is a different legal regime. The execution of a final sentence is examined in the article Rights of foreign convicts in Türkiye.

How is the legal status of a foreign relative determined?

Police custody, pretrial detention and conviction must be distinguished

Being held by the law enforcement authorities does not always mean being placed in pretrial detention. Police custody (gözaltı) is a temporary measure applied within an investigation; pretrial detention is based on the decision of a judge or court. A first-instance court’s conviction likewise does not by itself show that the decision has become final. While an appeal (istinaf) or further appeal (temyiz) review is ongoing, the person’s status and the authority to which application is to be made must be determined separately.

The first information to be obtained from the family is the person’s name, date of birth, nationality, date of apprehension, the penal execution institution if known, the investigation or case number and the date of the latest decision. If some of this information is unknown, the first meeting should not be postponed; identifying the file with the available information should be considered. However, one should not assume that a lawyer has unlimited access to every file or that every record can be found by name alone.

A prison and a removal center are not the same

A foreign person for whom a release order has been issued in the criminal file may also be subject to a separate administrative detention decision. In that case, submitting a new release request to the criminal judge does not by itself end the administrative detention. The basis of the decision and the authority that issued it are identified, and the appropriate judicial route is used. This distinction is especially important for deportation and administrative detention after prison.

How does a foreign detainee benefit from the assistance of a lawyer and an interpreter?

Choice and appointment of defense counsel

Under the Code of Criminal Procedure, a suspect or defendant may benefit from the assistance of defense counsel. An appointment made at the request of a person who declares that he or she is unable to choose defense counsel and the situations in which the law provides for mandatory defense counsel are assessed separately. Foreign nationality alone is not a reason for automatic mandatory defense counsel in all proceedings. Referral for questioning with a request for pretrial detention and the other situations of mandatory defense counsel specified in the law are also taken into account. [1]

The family may establish first contact with a lawyer, pass on identity and file information and help organize the legal support. However, the owner of the defense is the person under the criminal accusation. The family’s payment of the fee does not give unlimited authority over that person’s defense choices; the passing of file information to the family is also arranged with regard to the detainee’s will and attorney-client privilege.

The defense of a person who does not know Turkish

CMK Article 202 guarantees that a defendant who does not know Turkish well enough to explain himself or herself can understand the essential points of the accusation and the defense through an interpreter; the relevant provisions also apply to procedures at the investigation stage. The need for an interpreter is not determined by nationality alone. What matters is whether the person actually understands the legal language being used.

If the translation is deficient even though an interpreter appears to have been appointed, it should be clearly entered in the record which question was not translated, that an answer was conveyed incorrectly or that the person could not understand the procedure. The general view that a written translation of every document in its entirety will be provided free of charge under all conditions is not correct. The request is formed by specifying the documents that are essential for the defense and the type of procedure.

Meetings with the lawyer and review of the file

The confidentiality of the meeting with the lawyer is one of the basic guarantees of the defense. Although the special and limited exceptions in the law are examined separately, the status of being a foreigner does not by itself remove the confidentiality of the meeting. As for reviewing the file, the stage of the investigation, the defense counsel relationship and any restriction order are important. The conclusion that “the file is entirely closed” should not be reached without seeing the scope of the restriction order.

What applications can be made against a pretrial detention order?

An objection and a release request are separate possibilities

An objection can be filed against a pretrial detention order within the statutory period. Unless there is a special provision, the general objection period under CMK Article 268 is two weeks from learning of the decision. The seven-day period that can be seen in older sources should not be used as the current general period. The records of learning and service, the nature of the decision and any special provisions that may apply should be examined on the file. [1]

A release request within the framework of CMK Article 104 may be made at every stage of the investigation and prosecution. That the objection period has passed does not mean that all possibilities of release have ended. Obtaining new evidence, the hearing of witnesses, a change in the state of health or the prolongation of the detention may be subject to a new assessment. However, instead of constantly repeating the same statements, an application that discusses the earlier reasoning should be prepared.

What documents can be used in the application?

  • The pretrial detention and continued detention decisions and the records of service or learning.
  • Documents showing residence, family, work and educational ties in Türkiye.
  • Records showing that summonses were complied with and that the person did not evade the investigation.
  • Documents on health condition and care responsibilities.
  • Explanations on the state of the collection of evidence and the concrete risk of tampering with evidence.
  • Address, contact and other information showing that judicial control can be applied.

The legal value of these documents varies from case to case. Just as the existence of a family tie is not an automatic ground for release, carrying a foreign passport alone does not justify the automatic acceptance of a flight risk. The conditions of pretrial detention, the concrete evidence showing strong suspicion of an offense, the grounds for detention and proportionality must be examined together.

For what purpose is judicial control requested?

Under CMK Article 109, judicial control may constitute an alternative to pretrial detention. A ban on leaving the country, reporting to certain places or other obligations suited to the specific situation may be discussed. The request should not consist merely of the statement “judicial control is sufficient”; it should explain which measure would reduce the risk identified by the court and how. Being released does not mean that a ban on leaving the country is also lifted.

A real Constitutional Court decision: a connection with a foreign country does not take the place of a concrete examination

In its decision Constitutional Court (AYM), Akerke Abdykalykova Onat, Application No. 2019/42674, February 26, 2025, the Court required the risk of flight and of tampering with evidence to be explained by concrete facts. The applicant argued that she was also a citizen of Kazakhstan, that she had gone abroad and returned although she was aware of the investigation, and that she had made no attempt to flee. The Court found that these explanations had not been taken into account and that sufficient grounds had not been shown for the legitimate aim of the detention, and it held that the right to personal liberty and security had been violated. [2]

The decision does not mean that pretrial detention can never be applied to foreign persons. It shows that an application should ask for an assessment of the person’s conduct and of the concrete ties that reduce the flight risk. It does not produce an automatic release in another file.

How are consular notification and communication with the family ensured?

Under CMK Articles 95 and 107, there are provisions on consular notification upon the apprehension, police custody or pretrial detention of a foreign person; the statutory provisions on the person’s written objection are taken into account. Consular assistance and the lawyer’s task of defense are not the same. A consulate cannot issue a release decision in place of a Turkish court. [1]

Family visits, telephone calls and other means of communication are subject to the legislation and record procedures applied by the institution. A passport, a document of kinship, a visitor record and, where necessary, a translation can be prepared. If there is a refusal or an obstacle to communication, the reason and the date of the action should be obtained in writing. Families can avoid unnecessary costs by confirming the visit permission and the institution’s current schedule before buying travel.

An application plan for the family: from first information to legal follow-up

Describing the problem correctly in the first meeting

Instead of merely conveying the name of the offense to the lawyer, the family should describe the last known step: Is the person with the law enforcement authorities, was he or she referred for a pretrial detention hearing, was he or she placed in pretrial detention, is there a hearing, or is a legal remedy against a conviction awaited? Each stage requires different preparation. The request “we want help” can be turned into a concrete service need such as review of the file, urgent assistance by defense counsel, a release application or family communication.

At the initial stage, instead of each family member sending separate and conflicting information, it is useful to designate a contact person whom the detainee considers suitable. This person’s task is not to direct the defense but to organize the flow of papers and news. Which information can be shared with whom should be clarified from the outset. Attorney-client privilege is protected with respect to private information that the detainee does not want passed to the family.

Keeping the application trackable

NeedInformation or documents to prepareLegal assessment
Objection to pretrial detentionDecision, record of learning, documents of personal tiesReasoning, time limit and the competent objection authority
Lack of an interpreterRecord of the procedure, language used, the part conveyed incorrectlyEffect on the defense and an appropriate remedy request
Obstacle to communication with the familyApplication date, institution’s reply, kinship recordThe institution’s action and the application route
Travel after releaseRelease and judicial control decisionsBan on leaving the country and separate administrative procedures

After a petition is filed, the application registration number and the date of the reply should be monitored. When a new decision arrives, it should not be assumed that the earlier petition is now sufficient. A decision to continue the detention may contain new reasoning; additional documents may need to be submitted or a new assessment of the legal remedy may be required.

Actions the family should avoid

Family members’ contacting witnesses to get them to change their statements, deleting digital records or publicly disseminating unverified statements about the file can harm the defense. The purpose of legal assistance is the proper presentation of evidence and the protection of the person’s right of defense. Messages, travel records and other documents should be preserved in their original form; no editing that would change their context should be done.

Obtaining the opinion of defense counsel before making any statement about the criminal accusation can prevent families from unknowingly creating contradictory accounts. In the case of payment or document requests said to come from an official authority, the addressee should be verified; the claims of third persons who promise release should not be confused with the legal process.

Conclusion

The effective exercise of a foreign detainee’s rights depends on determining the correct legal status, reviewing the file and applying to the right authority with concrete reasons. The family’s most valuable contribution is to pass on the correct information and documents in time and to make it easier for the detainee to receive legal assistance.

Frequently Asked Questions

Can the family contact a lawyer without coming to Türkiye?

Yes. The first meeting can be held remotely. The documents required for establishing representation and for certain procedures are determined separately.

Does being a foreigner prevent release?

Not by itself. The grounds for pretrial detention, including the risk of flight, are assessed on the circumstances of the specific case.

Does applying to the consulate stop the objection period?

It does not take the place of the statutory application in the criminal file and does not stop the period by itself. The judicial application must be made separately.

Can the person return to his or her country immediately upon a release decision?

This conclusion cannot be reached without examining the ban on leaving the country, passport procedures and separate migration decisions.
