Our Approach to This Procedure
The content, date, manner of dissemination and evidence of the interference are preserved. With freedom of expression and grounds of lawfulness in view, the routes of prevention, cessation, declaration and compensation are assessed.
Protection of Personality and of the Name
The law of persons is not limited to civil registry records. A person’s rights over their name, image, voice, honor, reputation, private life and personal information are also under legal protection. This page covers the basic personality protection of natural persons under the law of persons; disputes with a press, internet, personal data or intellectual property dimension are handled together with the relevant independent practice areas.
In this context:
- Unlawful use of a name by another
- Prevention or cessation of interference with the right to a name
- Declaration of an attack on a personality right
- Cessation of a continuing attack
- Prevention of the risk of an attack
- Requests for correction, reply or publication of the decision
- Pecuniary and non-pecuniary compensation
- Surrender of the profit obtained from the unlawful interference
- Legal routes connected with content on the internet, in the press or on digital platforms
- Applications connected with the unlawful recording or sharing of personal data
may be assessed. Not every negative statement or use of personal data is automatically a violation of a personality right; the ground of lawfulness, freedom of expression and of the press, public interest, currency and proportionality are examined together.
Preparing for the Consultation and Scope of Services
Prepare the record you believe is wrong or inconsistent, the official documents on which that record is based and, if there is one, the rejection letter. Also state the dates of any notifications and procedures. Do not share unnecessary personal data before it has been assessed which documents the file actually requires.
The scope of the administrative application, lawsuit, appeal and post-decision procedures, as well as the attorney’s fee and other expenses, are agreed separately. The outcome and the end date are not guaranteed.
