Summary

The 15-day period for vacating expropriated property, the enforcement complaint, the tenant’s claims and crop-harvest protection on sown land.

Vacating a property because of expropriation is subject to a procedure different from an ordinary rental eviction. For a property registered in the name of the administration under Article 20 of Law No. 2942, the enforcement officer serves a fifteen-day notice to vacate on those inside. The belief that an objection stops the eviction automatically, or that nothing can be done before the lease term ends, can lead to loss of rights.

Under what condition is vacating requested under Article 20?

Under the ordinary vacating scheme of the Law, it is required that the property be registered in the land registry in the name of the administration in whose favor the expropriation is carried out. The administration requests the vacating from the enforcement officer. For this reason, a project announcement, an oral statement by a field officer or a mark placed on the property is not, on its own, the same as the enforcement act under Article 20.

In the transaction file, the basis of the registration, the land registry record, the place requested to be vacated and the persons inside must be identified. In a partial expropriation, if the notice appears to cover the entire parcel, its legal basis is investigated. It cannot be assumed that the part outside the scope of the decision must also be vacated.

In urgent possession, is registration necessarily awaited as well?

Article 27, within the scope of urgent expropriation, is a separate regulation. Within the framework of the statutory conditions, the court’s possession order and the deposit of the compensation, use may come into question before registration is completed. For this reason, it is not correct to apply the ordinary conditions of Article 20 in the same way to every urgent possession file.

The basis of a document received should be read as much as its heading. The expropriation decision, the urgent possession order, the registration judgment and the enforcement notice (muhtıra) are different acts. Which application will be made against which decision is determined after this distinction. The existence of urgent possession does not give the administration the authority to use all areas outside the decision and the project.

How does the fifteen-day period work?

Article 20 provides that the enforcement officer notifies those inside to vacate the property within fifteen days. In calculating the period, the method, the addressee and the date of service are examined. A running period cannot be suspended on the ground of awaiting a reply to a general application made to the municipality or another administration.

If an irregular-service allegation exists, the date of learning and the route of application must be assessed with concrete documents. It should not be assumed that all irregularities can be raised at any time. It is risky to calculate a period only from a message screen, without adding the service envelope, the electronic notification record and the addressee’s details to the file.

Must notice be given to the tenant as well?

The Law is based on notice being given to those inside. It should not be accepted in advance that an expropriation letter sent earlier to the owner takes the place of all notices at the enforcement stage with respect to the tenant who actually uses the business premises. The tenant should document their use and the notice given to them.

If there are several independent business premises or users in the property, it is determined who is in which section. This determination is also important to prevent action against unrelated persons and the mixing up of belongings. Where a company is the tenant, whether a paper handed to one of the employees constitutes proper service is examined separately.

Does an objection or a complaint stop the eviction?

Article 20 provides that an objection and a complaint will not stop the vacating and that the court cannot issue an interim injunction. For this reason, writing “I object” in the enforcement file does not mean that the property will safely remain in use. This special limitation in the Law must be expressly taken into account in the application plan.

This provision does not mean that the lawfulness of the enforcement act can never be reviewed. Allegations such as action being taken against the wrong property, the absence of a basis decision or the unlawfulness of the notice may be raised before the appropriate authority. The examination of an application and the automatic suspensive effect of an application are different matters.

Is an enforcement complaint the same as an administrative annulment action?

A complaint concerning the unlawfulness of an enforcement act is, as a rule, assessed by the enforcement court. The general time-limit scheme in Article 16 of the Enforcement and Bankruptcy Law (İcra ve İflas Kanunu) and the exceptions according to the nature of the complaint are checked. Since a seven-day period from learning may come into play for an allegation of violation of the law, it is not safe to wait until the end of the fifteen-day vacating period.

The unlawfulness of the expropriation decision in terms of competence, form, reason, subject or purpose is a matter for the administrative courts. Whether an action was filed earlier, the special time limit and the scope of any stay of execution or annulment decision, if any, are examined. If an administrative court decision has been issued, it is submitted to the relevant enforcement and expropriation files. The protections available in different types of actions should not be used in place of one another.

How does the Court of Cassation treat the distinction between an enforcement order and a notice?

In the decision of the 12th Civil Chamber of the Court of Cassation (Yargıtay 12. Hukuk Dairesi) dated April 4, 2019, E.2018/6768, K.2019/5610, the request for delivery of the property by an enforcement order (icra emri) in proceedings initiated on the basis of an expropriation judgment was examined. The Chamber assessed the special vacating route in Article 20 and also the delivery request not awarded in the judgment. The file also included the re-enforcement of an attorney’s fee that had been paid earlier; the decision rendered, where the proceedings should have been annulled by accepting the complaint, was reversed. Full text of the decision.

The decision does not say that an expropriated property can never be vacated. The correction of an incorrect form of enforcement and the termination of the administration’s statutory vacating authority are different things. The possibility that a proper notice (muhtıra) may be issued after the annulment of the enforcement order must also be taken into account. The real outcome of the case should not be described by looking only at the headline “the proceedings were annulled.”

What happens to the tenant’s lease term and compensation claims?

Vacating for expropriation is not an ordinary process in which the landlord relies on one of the eviction grounds of lease law. Institutions such as two justified warnings, need or expiry of the lease term do not apply automatically as conditions of an Article 20 act. The lease contract still matters with respect to the consequences between its own parties for rights and obligations.

Article 20 also provides that the property owner and the administration cannot be held liable for compensation because of the vacating of the property. For this reason, no guarantee of payment can be given to every tenant, in the amount of moving costs, loss of customers or the profit for the remainder of the lease term, merely on the basis of having to move. Nor is it correct to add all of the business’s losses into the expropriation compensation.

Do independent contractual claims disappear entirely?

The examination may differ for prepaid rent, a security deposit, movable equipment or a separate debt expressly assumed in the contract. These should not be labeled in a way that circumvents the Law’s limitation on compensation for vacating; they should be assessed on their own legal grounds. Payment periods, the actual delivery date and the contract provisions are decisive.

In a dispute arising from the lease relationship between the tenant and the landlord, the court with jurisdiction and mediation as a condition precedent to litigation are examined separately. This process is not the same as a complaint to the enforcement office against the expropriation vacating. Filing another claim action does not by itself stop the vacating file.

What happens to the structures and installations built by the tenant?

Buildings, trees, fixed installations and removable items must be separated. Under the last paragraph of Article 19, a claim for the value of improvements (muhdesat) or a contract-based claim for expenses may come into play; but a leasehold right alone does not give a share of the land value. Ownership, valuation and the conditions of legal interest must be made concrete.

Before vacating, it is important to photograph the installations, prepare an inventory and determine which elements can be removed. Removing and taking away an integral part of the property without permission is not the same as taking possession of the tenant’s movable belongings. The legal and technical scope should be clarified before any physical action.

Is the harvest awaited on sown land?

Article 20 provides that the vacating of sown land be left until the end of the harvest. Where the harvest cannot be awaited, the administration may request vacating on condition of paying the crop value to be determined by the court. If the crop value has already been taken into account in the expropriation valuation, there is no need to determine and pay the same amount again.

A person who wishes to benefit from this protection must document the existence, type and growth stage of the crop and their own right over the crop. The landowner and the tenant or sharecropper who grew the crop may be different persons. Without clarifying to whom the crop value belongs, the assessment should not be made solely in the name of the owner.

If the harvest cannot be awaited, which documents are needed?

Agricultural records, sowing dates, current photographs, production costs and the expected harvest time are submitted to the file. The administration’s ground of urgency must also be seen in writing. An oral statement such as “the construction site will start” does not explain by which legal act and on what payment condition vacating is requested.

The calculation of crop damage and the value of a multi-year tree may differ. It is checked which items were assessed in the earlier expert report. The same crop should not be counted twice, both in the land income and again in the crop value; nor should a genuine and separate loss be left out.

How should records be kept before vacating and during handover?

StageRecord to be checked
Receipt of the noticeNotice, date of service, addressee and basis of the act
Identification of the propertyLand registry record, expropriation map and registration decision
Separation of rightsOwner, tenant, crop and improvements owner
Preparation of belongingsPhotographs, inventory and removal plan
HandoverRecord, keys, meters and damage records
Subsequent claimsDeposit, prepaid rent and independent loss documents

Showing the physical condition clearly in the handover record is important for damage claims that may arise later. The release or waiver-of-all-rights wording in the record should not be signed on the assumption that only the handing over of keys is taking place. What declaration the signature relates to should be read.

If it is alleged that belongings were damaged during vacating, the damage and the person who carried out the act are documented separately. The Law’s limitation on compensation purely because of vacating does not make it unnecessary to investigate the consequences of every unlawful act. On the other hand, it cannot be said that every damage claim will be raised in the same court and within the same period.

Conclusion

In a vacating because of expropriation, the first task is to determine the type of the document received and of the underlying decision. The fifteen-day vacating period, the enforcement complaint period and the period for an action against the expropriation act must be tracked separately. In assessing the tenant’s contractual claims, the improvements value and the right to the sown crop, the special limitations in Article 20 must be taken into account; it should not be assumed that an objection is automatically suspensive.

Frequently Asked Questions

Can I be removed because of expropriation before my lease ends?

If the conditions of Article 20 are met, the special vacating procedure may be applied. The continuation of the lease term does not by itself prevent the act.

If I object to the enforcement file, does the fifteen-day period stop?

The Law provides that an objection and a complaint will not stop the vacating. Applications and protective options must be assessed separately.

Does the annulment of the enforcement order let me stay in the property permanently?

No. The annulment of an incorrect act may not prevent a new vacating act from being carried out properly, if the conditions are met.

Can the land be taken before the sown crop is harvested?

It is possible under the statutory conditions. The inability to await the harvest and the special provision on crop value are examined together.

Is a relocation compensation paid to the tenant automatically?

No. Article 20 contains a limitation on compensation because of vacating. Independent contractual claims may be examined separately.
