Obstruction of Access to a Business or Property by Road and Sidewalk Works: Annulment and Compensation Routes

Summary

Where road, sidewalk, barrier or retaining wall works seriously restrict the use of an immovable, annulment of the administrative act, an appropriate access arrangement and a claim for compensation for documented damage may come into question. Not every traffic change gives rise to compensation. The nature of the loss of access, the public interest, the adequacy of alternatives and the concrete damage are assessed together.

What is the difference between an access obstruction and a traffic arrangement?

Making the road in front of a shop one-way, customers having to use a longer route and the building being left with no safe entrance are not the same situation. The administration may make arrangements for transport safety, pedestrian movement and infrastructure needs. The owner of an immovable has no right to demand that the existing traffic flow be preserved forever. On the other hand, if the arrangement unnecessarily or disproportionately obstructs the lawful use of the immovable, it may become the subject of judicial review.

In the first review, pedestrian, disabled, vehicle, loading and emergency access should be addressed separately. The nature of the business also matters: closing the only vehicle entrance of a licensed garage does not have the same effect as it does for an office with pedestrian access. However, not every opening that is actually used is legally a permitted vehicle connection. The permit, the approved project and the permissions relating to the road connection must be examined together.

Which act or practice can be made the subject of an action?

The dispute sometimes arises from a decision of UKOME (the Transportation Coordination Center) or a traffic commission, sometimes from the municipality’s road project, and sometimes from an implementation error on site. For an annulment action, a final and enforceable administrative act must be identified. Rather than relying on the oral explanation of personnel working at the construction site, the date and number of the decision, the attached project and the scope of the works should be requested.

Where the decision is lawful but the implementation is faulty

Closing with a high curb an entrance that appears open in the project, or failing to provide a temporary pedestrian crossing, may constitute an implementation problem different from the content of the decision. In that case, a request to correct the implementation and the full remedy route based on damage from the action gain importance. Seeking annulment of the entire project alone, without connecting the faulty implementation to the underlying decision, may obscure the real problem in the file.

Where a temporary construction-site obstruction turns into permanent damage

The duration of the works, deviation from the planned schedule, whether the business was notified and whether a safe temporary passage was provided are investigated. The short-term inconvenience of ordinary infrastructure works is not subject to the same assessment as a complete closure that continues for months without explanation. In both cases, the connection of the damage with the public service and the applicant’s own measures should be made concrete.

Which administration should the application be made to?

That the works are within municipal boundaries does not by itself determine the responsible administration. The division of duties between metropolitan and district municipalities, and whether the excavation belongs to the water administration, the road belongs to the General Directorate of Highways (Karayolları) or the infrastructure belongs to another institution, should be checked. A construction-site sign provides starting information; authority and responsibility are verified through correspondence. If more than one public administration has contributed, their acts should be shown separately.

The application states the block and parcel of the immovable, the business license, the start of the obstruction, photographs and the solution requested. Instead of a request to “restore the road to its former condition,” the application should explain why a lawful and safe entrance cannot be provided. The administration may be asked for a passage plan, a work schedule and the technical justification. Requesting project information does not in every case stop the annulment or compensation time limits.

The annulment action and stay of execution

In an annulment action, unlawfulness may be asserted in terms of authority, form, cause, subject and purpose. The actual usability of an alternative route matters as much as its existence. Access for disabled persons, emergency evacuation and pedestrian safety must also be assessed under Law No. 5378 and the relevant accessibility regulations. The administration’s explanation of public interest should be supported by concrete technical needs.

For a stay of execution, manifest unlawfulness and the conditions of damage that is difficult or impossible to remedy must be shown together. Complete closure of the entrance, the business ceasing operations or emergency intervention becoming impossible can be explained with photographs and technical documents. Filing an action does not automatically stop the works. The court does not draw a particular road project in place of the administration; it reviews the unlawful act.

What losses must be proved for compensation?

Temporary loss of activity, necessary transport costs, necessary expenses incurred to re-establish access and permanent loss of value of the immovable may come into question. For each item, the injured person, the period and the calculation method must be determined. The owner may claim the loss of value of the immovable, and a tenant may claim its own commercial loss; the same loss should not be claimed again by two different persons.

Is a fall in turnover enough on its own?

A decline in sales is important data, but it does not by itself show that the entire loss stems from the road works. Previous periods, the same season, general changes in the area, sales channels and expenses are compared. In calculating compensation, the main subject of discussion is the provable net loss of earnings rather than gross sales. Tax returns, accounting records, cancelled orders and delivery records are assessed together.

How is the loss of value of an immovable determined?

A valuation expert compares the situation with and without the access restriction. Comparable properties in the same area, the nature of use and the suitability of the alternative passage are taken into account. For a problem that can be remedied by repair, accepting a permanent and full loss of value may not be correct. If it is argued that the administration is not at fault, the existence of a special and extraordinary burden can also be legally discussed; this type of liability does not apply to every commercial contraction.

Litigation time limits and the distinction regarding prior application

Unless there is a special provision, the period for a general annulment action against a final administrative act is sixty days before the administrative court. The start is determined by proper notification and the characteristics of the event. In a timely İYUK 11 application, the remaining litigation period continues to run after the thirty-day non-response period. Filing a new petition does not by itself create a new right of action against an old act whose time limit has lapsed.

For damage arising from an administrative action, under İYUK 13 an application for compensation to the relevant administration is required within one year from learning of it and in any case within five years from the action. After a refusal or the thirty-day non-response period, the general litigation period comes into play. The scope of learning and later-arising damage are assessed according to the particular file. For damage arising from an act, the options in İYUK 12 apply separately. Therefore, instead of writing a single period for the entire file, the dates of the decision, the action and the damage should be recorded separately.

A real decision: access and loss of value due to a retaining wall

In the decision of the 10th Chamber of the Council of State (Danıştay 10. Daire) dated April 28, 2021, E.2016/3110, K.2021/2157, the effect on an immovable of a retaining wall built by the General Directorate of Highways as part of road works was examined. The expert report found that easy access to the road was obstructed and that the value of the immovable was adversely affected. The Chamber upheld the part of the decision granting pecuniary compensation, which the administration had appealed.

This decision does not concern a municipal sidewalk; it is an example of proving through technical examination the effect of a road service on access and value. Moreover, the scope of the Council of State’s review is the granted part that the administration appealed. It would not be correct to read the decision as meaning that compensation or non-pecuniary damage arises in every access change. The full-text link in the sources may require a database account.

What documents should be collected when preparing the file?

The title deed or lease agreement, the business license, the approved entrance and parking project, the municipal or UKOME decision, old and new photographs and the work schedule are the basic documents. The point at which access is cut off can be shown on a sketch. A sketch does not replace a technical measurement; it helps direct the review to the right place. Accounting documents should be submitted while protecting personal and commercial secrets.

Reasonable alternative arrangements made by the business to continue operating should also be recorded. If a temporary delivery point or a transport service was used, their necessity and cost are explained. After the action is filed, asking the expert to answer not only “is there damage” but how much damage arose in which period and for what reason increases the verifiability of the file.

Conclusion

In access disputes, the aim is not to unconditionally preserve the former traffic advantage of an immovable but to protect its lawful use from unnecessary and disproportionate obstacles. Separating the decision from the implementation, assessing the usable alternatives and documenting the net loss form the basis of annulment and compensation claims.

Frequently Asked Questions

Is being unable to park a vehicle in front of the shop a ground for compensation?

Not on its own. The legally protected access, the nature of the use, the alternatives and the concrete damage are examined.

Can a tenant also sue the municipality?

A tenant whose own interest or personal right is affected may bring an action depending on the type of claim. The tenant cannot automatically claim all the losses belonging to the owner.

If there is pedestrian access, is closing the garage entrance unimportant?

No. For lawful garage use, vehicle access is assessed separately. The approved project and the connection permit matter.

Does the right to sue end when the construction site is finished?

Even if the temporary obstruction is lifted, documented past damage can be argued. The time limits must have been preserved and the claim properly framed.
