Professional and Legal Notice

Explanations about the website content and the legal service process.

The key points you should know about information, applications, acceptance of a matter and confidentiality.

Before using the content and applying

These explanations help you assess the process correctly when you use the information on the website and contact our firm.

Scope of the informational content

This website has been prepared to provide information about the practice areas and communication processes of the Güneş & Güneş Law Firm. Articles, guides, explanations and examples are general in nature and do not replace a legal opinion specific to your case.

Before taking any action or making a decision, the characteristics of the case, the documents, the applicable law and the current regulations should be assessed together. Please take the publication and update dates of the content into account; legislation or practice may have changed since.

Professional independence and expectations of outcome

Legal assessments are carried out in observance of the principles of professional independence, diligence, professional secrecy and avoidance of conflicts of interest. Describing practice areas or mentioning professional experience is not a guarantee about the outcome of a file.

Each file is assessed on its own facts and evidence. A decision or outcome in another file does not show that the same result will be reached in a dispute that looks similar.

Acceptance of a matter and the start of the service

Taking on a new matter at the Güneş & Güneş Law Firm requires the assessment of the application and the completion of all acceptance steps determined according to the nature of the matter. A preliminary consultation, the sending of information or documents, the creation of an appointment and the sharing of a fee quote do not, on their own, mean that a lawsuit, a procedure or the follow-up of a file has been taken on.

The scope of the application, the details of the parties and possible conflicts of interest are assessed. Matters that are not accepted are communicated to the applicant without delay.

Scope of service and agreement

First, the subject and scope of the legal assistance requested, the stages to be followed, the attorney’s fee, the payment plan and the expenses are determined. Once agreement is reached, an Attorney Engagement and Fee Agreement containing these terms is signed. An agreement made only for a preliminary review or consultation does not mean that the task of filing a lawsuit or following up a file has also been taken on, unless separately agreed.

Power of attorney and required documents

For matters that require authority of representation, the content of a power of attorney suited to the nature of the procedure and the necessary special authorities are determined and presented to the client. The client is asked to send our firm the executed power of attorney and the documents needed to carry out the matter. This step does not apply to consultation and review services that do not require a power of attorney.

That a power of attorney grants authority for more than one procedure does not mean that our firm has taken on all of those procedures. The scope of the service taken on is determined by the agreement and the explanations on acceptance of a matter; tasks separately accepted and statutory obligations remain reserved.

Starting conditions and written notification

To begin work, the basis is the receipt of the down payment, first installment or other starting payment provided for in the agreement, together with the necessary expense advance. Payment of the entire fee at the outset is required only if the agreement so provides.

Once the agreement, authorization, documents and starting conditions required for the nature of the matter are complete, our firm notifies the client in writing of the scope of the service taken on and the start of work. The start date set in the agreement and any separately accepted tasks remain reserved.

Notification of missing items

If a missing document, authorization or payment condition is identified that prevents work from starting or a particular procedure from being carried out, the items to be completed are communicated to the client. If there is a known time limit or urgency, its effect is explained separately.

Limits of communication before acceptance

Automatic acknowledgment messages, notices of document delivery, appointment confirmations or preliminary assessment correspondence are not, on their own, a notice of acceptance of a matter. For a time-limited or urgent procedure, whether our firm has taken on the task must be clarified separately.

Matters taken on specially

Where an urgent procedure or limited legal assistance is taken on separately, the scope and terms of the accepted task are specifically determined. These explanations show the firm’s standard acceptance procedure; they do not remove an attorney–client relationship already established, tasks actually taken on, the duty of professional secrecy or responsibilities arising from mandatory legislation.

In a matter already taken on, a payment delay does not mean that the engagement ends automatically. The conditions for withdrawing from the matter and the notification obligations are assessed separately.

New Application and Engagement Process

Urgent matters, time limits and notifications

A first response is given within 48 hours at the latest after your request. This period is not the time within which the matter is accepted, a legal opinion is completed or a procedure is carried out. If you need an urgent or special consultation time, please state this separately.

The web form and general communication channels do not replace the official notification (tebligat) channels conducted in due form. For files whose follow-up has been taken on, the communication method agreed and the instructions given prevail.

Consultation and fee information

If the appointment is confirmed, the consultation fee is communicated to you. The fee and any payment terms are clarified before the consultation begins. An appointment request is not a commitment to free legal consultation.

A payment made for a preliminary consultation, legal advice or document review does not cover filing a lawsuit or following up a file, unless separately agreed. The service to which each payment relates and its scope are stated in the quote or the agreement. The scope and fee of a service to be taken on separately after the consultation are also determined separately. The scope of litigation costs, translation, notary and similar expenses is explained according to the relevant service.

International and multilingual consultations

Online consultations can be held from within Türkiye and from abroad. The options of a Zoom or WhatsApp video call and an in-person meeting at the office are clarified when the appointment is made. You can state your preference for communication in Turkish, English, German and Russian in your application.

Please tell us the country you are in and your time zone. The appointment time is confirmed in Türkiye time together with the time at your location; local daylight saving time practices are taken into account.

That communication can be established from abroad does not mean that there is authority of representation under local law in the relevant country. Matters that require foreign law or local representation are assessed separately, within the framework of the rules of the relevant country and the need to work with authorized lawyers there. The service to be provided under Turkish law, any procedure to be carried out in a foreign country and the need for a local attorney are determined separately. The form, translation and certification requirements for a power of attorney are clarified according to the country where it will be used. If there is a difference in terminology or any ambiguity in translated texts, ask for clarification before the procedure.

Confidentiality and personal data

The information and documents you share are handled for the assessment of your application and legal matter and for carrying out the related service process, in observance of the principles of professional confidentiality and the protection of personal data. If a matter is not accepted, this does not mean that the information shared may be used freely.

In your first application, do not send unnecessary identity, health, bank or third-party information. For detailed document sharing, use the method our team directs you to. For the principles of data processing, review the KVKK Privacy Notice and the Privacy and Information Security page.

Frequently asked questions

I sent documents; does the follow-up of my file begin?

Sending documents does not, on its own, mean that the follow-up of a file has been taken on. Acceptance of the matter and the scope of the service must be clarified separately.

Can I take action based on a guide on the website?

Guides provide general information. The legal route that applies to your specific case should be determined by assessing your documents and the current regulations.

Can I join a consultation from abroad?

Yes. State your country, time zone and consultation language. The platform and appointment time are confirmed before the consultation.
