From production to broadcast, from contract to the field

We address the value of content and the limits of the business relationship together.

Preparing a production, organizing an event or establishing a sports relationship brings together creative rights, commercial agreements and personal rights within the same project. Early on, it should be made clear who owns the content to be used, how revenue will be shared and what responsibilities each party will assume.

Güneş & Güneş Law Firm defines the scope of contract, advisory and dispute follow-up for producers, broadcasters, agencies, artists, organizers, sponsors, clubs and athletes according to the specific need. Based in Antalya and working on matters across Türkiye, we also assess, for projects with foreign links, the applicable law, jurisdiction and the need for local counsel.

Rights and contracts

Four key issues before signing.

Several permissions and responsibilities may arise within the same project. Attachments, earlier agreements and actual use matter as much as the title of the contract.

  1. Which right, which use?

Copyright, broadcasting rights, trademark permission and the right to use a person’s image are not interchangeable. In contracts on economic rights, written form and the separate identification of each right are observed. Live broadcast, repetition, short clips, advertising and archive use are each defined separately.

  2. Which fee, which approval?

The calculation of fixed fees, bonuses, commissions and revenue shares is set out; payment dates, reporting, audit and expenses are clarified. Who will approve the content, the number of corrections and the acceptance conditions for delivery are determined.

  3. Cancellation, postponement and termination

Postponing an event, changing a broadcast schedule and a party’s failure to perform its obligation do not lead to the same result. Notice, refund, rescheduling, compensation and content that will continue to be used are arranged according to the concrete conditions.

  4. Which law, which forum?

The country where the parties are located, the sports branch, the contract and the nature of the dispute are assessed together. Sporting management and disciplinary decisions are separated from contractual receivables; arbitration or an international route is not accepted automatically.

Ongoing legal advisory

Beyond a single contract, regular legal follow-up.

In recurring broadcast, production, event and sports activities, the consistency of contracts with one another is important. The scope of ongoing advisory is set in writing according to the organization’s scale, project calendar and frequency of transactions.

Contract and rights inventory

Current contracts, license terms, use limits and renewal dates are monitored together. In new projects, earlier commitments and exclusivity provisions are checked.

Pre-broadcast and pre-event review

Rights clearances, advertising statements, personal data processes and supply agreements are assessed against the timeline of the activity. Persons responsible for approvals are designated for last-minute changes.

Management and communication structure

The responsible lawyer, the organization’s contact person, document sharing and reporting frequency are settled when the engagement is accepted. New risks, upcoming deadlines and matters requiring a decision are reported within the agreed scope.

Our working method

We first clarify the rights and the timeline.

  1. Initial review

We identify the parties, the stage of the project and the upcoming dates. Where there is a dispute, the decision or notification date and the competent authority are examined first.

  2. Rights and document check

The contract and its annexes, permits, broadcast records, payment documents and correspondence are compared. Missing rights or documents and conflicting provisions are identified.

  3. Options and engagement

Legal options, risks, fees and expenses are explained. The work to be undertaken and the authorization required are clarified in writing.

  4. Implementation and follow-up

Contract, negotiation or application steps are carried out within the agreed scope. Deadlines and developments are shared through the agreed communication arrangement.

Preparing for a consultation

A short summary is enough for the first step.

You do not need to send the entire file with your first message. You can state your matter, the parties and the upcoming date, and list the documents you have.

  • Contracts, supplementary protocols and related offer or order documents.
  • Existing permissions for copyright, licensing, trademarks, and the use of image and voice.
  • Content links, broadcast dates, original files and delivery records.
  • Invoices, payment, revenue-share and settlement documents.
  • Formal notices (ihtar), decisions, notifications and important correspondence, with delivery or notification dates.
  • Language and method of consultation; if you are abroad, your country and time zone.

Frequently asked questions

Questions you may have before getting started.

Does paying for a piece of content give all rights?

Payment alone does not mean the content may be used for any purpose and indefinitely. The ownership of rights, the contract and the purpose of use are assessed together. In agreements on economic rights, written form and the separate identification of each right are important; the medium, term, territory and scope of reuse are also determined separately.

Must everyone publishing content online obtain an RTÜK license?

Not every social media account or content production falls within the same scope. The nature of the activity as radio, television or on-demand broadcasting, the broadcast order and the business model are examined. The need for a license or authorization is determined by this assessment; no conclusion is drawn from the name of the platform alone.

Is a contract alone enough for sponsored content?

No. A contract does not remove the need for the audience to understand that a post is advertising. Posts made in exchange for a product, service, invitation or another benefit, not only for a fee, are also assessed. The roles of the brand and agency, the visibility of the disclosure, content approval and the duration of use are arranged together.

Are fees always refunded when an event is cancelled?

A single result cannot be applied to all relationships. The reason for the cancellation, the nature of the relationship with the artist, venue, supplier and audience, as well as the contract and mandatory rules, are examined together. The consequences for refunds, postponement, expenses and compensation are assessed separately. A reference to force majeure alone does not remove all liability.

Can an athlete’s claim be brought directly before the Turkish Football Federation (TFF) or the Court of Arbitration for Sport (CAS)?

The forum is not determined automatically. The sports branch, the parties, the nature of the dispute, federation rules and the applicable arbitration arrangement are examined. Contractual receivables and sporting management and disciplinary disputes may be subject to different regimes. The competence of international bodies and their conditions of application are assessed separately.

Does a filming permit allow the image and voice to be used everywhere?

The text, purpose and scope of the permit should be examined. Filming, use in advertising, re-editing, transfer to another platform and the creation of new content with artificial intelligence are not the same use. The legal conditions on personality rights, copyright and the processing of personal data are assessed together.

What should be done first in case of unauthorized broadcast or content use?

Keep the link to the content, the broadcast date, the relevant account information and the original files you hold. The ownership of rights and the scope of use are determined; evidence preservation and any urgent protection need are examined. The notice, removal request, application or litigation route is chosen according to the nature of the incident; no outcome or removal time is guaranteed.

Can we work with producers, athletes or sponsors abroad?

Cross-border relationships may be assessed under Turkish law. The applicable law, jurisdiction or arbitration, the contract language and the country where a decision will be enforced are taken into account. If a review of foreign law is required, the need for legal support in that country is determined separately. Consultations may be conducted in Turkish, English, German or Russian.

Can ongoing advisory be retained instead of a single project?

Yes. For recurring production, broadcast, event or club activities, the scope of advice can be set up in writing. Contract reviews, rights and deadline monitoring, meetings and reporting arrangements are determined according to needs. Litigation, applications and work outside the ordinary scope are handled separately.

How are the process and fees determined after a consultation request?

We will respond to your request within 48 hours. This period does not mean that the legal opinion has been completed or the matter has been concluded. The scope of the consultation and, where applicable, its fee are communicated before your appointment is confirmed. The scope of the service, fees, expenses and authorization terms are agreed separately; an application alone does not create an attorney–client relationship.
