Summary

Death benefit in life insurance: the beneficiary, loan debt, rejection based on the health declaration, application time limits and an explanation of a Court of Cassation decision.

In life insurance, the person to be paid and the amount payable on death are determined by the policy’s coverage and the beneficiary record. The insured’s death does not mean that the loan debt will in every case be closed in full or that the entire benefit will be divided among the heirs. The policyholder, the insured, the beneficiary and the pledgee may not be the same person. [1]

Which information in the policy is examined first?

In the policy and its annexes, the following are checked: the insured, the start and end dates, the death coverage, exclusions, premium status, and the records of the beneficiary and the pledgee (dain-i mürtehin). Renewal documents are important: a previous year’s policy alone does not prove that coverage was still in force on the date of death. For insurance linked to a loan, the policy in the bank’s file is compared with the record held by the insurance company.

The coverage amount may be fixed or decreasing. That it appears to equal the loan balance does not guarantee that it will be equal on every date. Foreign currency, interest, delay and additional debt items are examined separately. Whether the cause of death falls within the scope of coverage should be assessed on the basis of the insurer’s specific reason for rejection.

The beneficiary’s right and the right as an heir

The Turkish Commercial Code (TTK) regulates the designation of the beneficiary in life insurance and the beneficiary’s rights. If a beneficiary has been named, the claim arising from the contract may belong directly to that person. If there is no beneficiary or the designation is ineffective, the relevant statutory and contractual provisions are examined. The shares in the certificate of inheritance do not automatically remove a valid beneficiary record. [1]

It should not be assumed that disclaimer of inheritance and the right arising from beneficiary status produce the same result. On the other hand, claims under inheritance law, such as the reserved portion, the nature of premium payments and abatement (tenkis), may also arise separately. The provision on benefits conferred through insurance in Article 567 of the Turkish Civil Code (TMK) should not be simplified to mean that the entire sum insured is in every case subject to abatement on the same calculation. [2]

The study by Orbay Ortaç and Çakır on the designation of beneficiaries examines the distinction between the party and the rights holder in life insurance in the context of the interpretive rule in TTK Article 1494. For this reason, the meaning of “heirs” or any other beneficiary expression used in a policy should not be determined by looking only at the table of inheritance shares. [3]

The company’s list of documents is obtained in writing. For a death abroad, the official death record, translation and the necessary certification are prepared. Health data is shared only through authorized channels. When a missing document is completed, the delivery date is recorded; a traceable application is preferred to a telephone call.

The insured, the policyholder and the beneficiary may not be the same person

In life insurance, whose life is covered, who concluded the contract and to whom the right to payment belongs must be determined separately. In a policy linked to a loan, the bank may be a party to the contract or to the security relationship; however, this does not mean that the entire sum insured belongs to the bank in all circumstances. The policy, the participation certificate, changes of beneficiary and the security records relating to the loan should be read together. [1]

If the beneficiary’s name has not been written, the resulting position is also determined by the statutory interpretation rules according to the type of contract. TTK Article 1494 contains rules on the failure to name a beneficiary in the death risk and on the shares of more than one beneficiary. The same article provides that disclaimer of inheritance or renunciation of inheritance does not affect the beneficiary’s right. This provision shows that a claim arising from beneficiary status and liability for the debts of the estate must be examined differently. [1]

How are the loan debt and the sum insured compared?

Scope of the bank’s security right

The remaining loan principal on the date of death, accrued interest, costs and the early-closure calculation are separated. Whether the insurance coverage is a fixed or decreasing amount and whether it corresponds exactly to the loan are investigated. If there is more than one loan, it is determined which debt the policy secures. A bank’s pledgee or similar record should not be regarded, without examining its content, as unlimited authority that takes precedence over all family claims.

Hypothetically, if the sum insured is 1 million Turkish lira (TL) and the amount valid under the coverage for closing the loan is 600 thousand lira, to whom the remaining 400 thousand lira will be paid is determined by the beneficiary and the policy arrangement. This example does not mean that the difference will necessarily be divided equally among the heirs. If the coverage amount is lower than the debt, the remaining loan debt is examined separately; the existence of insurance does not guarantee in every case that the loan will be closed in full. [1] [4]

The letters of the bank and the insurer should be obtained together

When the insurance company makes a payment, it is ascertained on what date and with which items the bank closed the debt. Where the bank continues to collect the loan, the insurance payment made and the offsetting (mahsup) records are compared. If amounts have been collected from the heirs for the same debt, a need for a refund or a correction of the account may arise. The file should not be regarded as finished until the insurer’s payment receipt (dekont) and the bank’s debt-closure letter are both available.

A rejection based on the health declaration is not automatically valid

Under the duty of declaration in TTK Article 1435 and the articles that follow, it is examined which information was asked, what the policyholder knew, how clear the question was, and the answer given. If the insurer refuses payment saying “there was a prior illness,” it must be shown when the illness was known, whether the unreported matter was material, and its connection with the death. Circumstances known to the insurer when the contract was concluded are also separately important. [1]

TTK Article 1439, in the sanction applicable after the risk has occurred, distinguishes between negligence, intent and the connection. A negligent breach may, under certain conditions, have the effect of a reduction, while intent and a connection with the risk may have the effect of extinguishing the payment obligation. Even where there is no connection, an assessment relating to the premium rate comes into question. For this reason, no categorical generalization can be made that all claims will be rejected on the basis of a single old hospital record, or that there will be no problem if the cause of death is different.

For an heir or a beneficiary, the evidence plan includes the proposal and health questionnaire, signature or electronic approval, the policy, the dates of diagnosis of the illness, treatment records and the cause of death. Health records should be shared only to the extent required by the dispute. The legal and contractual ground relied on by the insurer is asked for in writing; the vagueness of a general rejection letter is remedied by a specific request for documents.

The payment period, the due date and the statute of limitations must be tracked separately

TTK Article 1427 regulates when a claim becomes due in connection with the necessary documents and the investigation process; for personal insurance it deals together with the special fifteen-day period, the case of delay not attributable to the insurer, and default. This period cannot be read as a guarantee of unconditional payment after every death notification made without documents. Notices, delivery of documents and notifications of deficiency should be kept in date order. [1]

TTK Article 1420 provides a two-year period running from the due date for claims arising from an insurance contract and, with respect to the sum insured, a six-year outer limit linked to the occurrence of the risk; the special provisions that are reserved are assessed separately. Merely saying “two years in insurance” is not sufficient without examining the starting point and the grounds of interruption according to the nature of the application. Sending an e-mail to the company is not in every case an act that interrupts the statute of limitations.

Choosing between arbitration and a lawsuit

Whether an application can be made to the Insurance Arbitration Commission (Sigorta Tahkim Komisyonu) should be verified on the basis of the company’s participation in the system, the scope of the dispute and the preliminary application conditions. Alternatively, a lawsuit before the court with subject-matter jurisdiction is considered; the consumer nature of the relationship, the conditions of suit and the amount claimed matter. A particular legal remedy or finality outcome should not be stated without seeing the current monetary threshold.

The claim should be formulated clearly as to the sum insured, any late-payment interest and the correction of the account. If the bank’s loan claim and the insurer’s payment obligation are to be addressed in the same action, the position of the parties and the relationship between the claims are determined. The contribution of the academic study on beneficiaries also emerges here: the meaning of the word “heir” in the contract and the system of inheritance shares in inheritance law are not in every case the same. [3]

After payment or the decision, the lifting of the bank’s security, the loan closure record, the payment of the remaining amount to the rights holder and the account of costs are checked. Even if the insurance payment has been made, a loan record that remains open may lead to later collection and credit-record problems.

A real Court of Cassation decision: What review does a rejection based on a health declaration require?

The facts and two separate legal issues

In the decision of the 4th Civil Chamber of the Court of Cassation (Yargıtay 4. Hukuk Dairesi) dated September 21, 2023, E. 2022/12923, K. 2023/9602, death coverage was claimed under a life insurance policy linked to a loan. In the action, the bank’s status as pledgee under the policy and its consent to the action were first discussed; after an earlier quashing, the review of the merits was reached. The lower court rejected the claim on account of the answers given to the health questions and the illness information in the death certificate. The Court of Cassation did not find it correct that a decision of rejection was given without an examination by a specialist physician as court-appointed expert on the cause of death, the onset of the illness and the connection between the unreported illness and the death, and quashed the judgment.

The quashing does not mean that payment of the sum insured was definitively ordered. The outcome must be determined according to the medical review and the distinction between fault and connection in the statute. Neither the plaintiff’s merely presenting the death certificate nor the insurer’s merely showing a past illness record resolves the entire dispute on its own. The text of the decision was verified from a private database; the link may require an account.

Specific questions to put to the expert

The date on which an illness was diagnosed and the date on which the insured learned of the illness may not be the same. What information was requested in the health questionnaire, the answers to the questions and how the cause of death was medically determined should be clarified. The existence of mere suspicion or testing before the policy should not be treated as automatically equivalent to a definitive diagnosis and knowing concealment. Conversely, the concealment of a clearly known serious illness cannot be trivialized with the statement “the death was sudden.”

The report should explain the effect of the unreported matter on the risk and the medical connection. The legal nature of the fault and the sanction to be applied are assessed by the court. Basing a judgment on general internet health information instead of an expert report does not comply with the standard of review emphasized by the decision.

The way the beneficiary record is written changes the payment shares

TTK Article 1494 provides for equal entitlement where more than one person is designated as beneficiary without shares being stated. Therefore, if the spouse and two children are named as beneficiaries in the policy without shares, it cannot be said that the inheritance shares under civil law apply directly. If no beneficiary has been specified at all, the statutory rule of acceptance in favor of the heirs comes into play; the beneficiary’s failure to acquire the right is assessed separately within the framework of Article 1495. Turkish Commercial Code Articles 1493–1495

The correct distinction for a person who has disclaimed the inheritance

The statute contains a provision that the beneficiary’s right is not affected by the disclaimer of inheritance. However, the independent right of a beneficiary named by name and reliance solely on heir status under a policy that names no beneficiary are not the same thing. A general conclusion such as “everyone who disclaims the inheritance receives payment from all policies” cannot be drawn. First, the form of the designation, the text of the policy and the capacity in which the right is asserted must be determined. That one person in the same family is both an heir and a beneficiary does not show that the other family members have the same right.

In a reserved-portion claim, is the entire sum insured taken as the basis?

TMK Article 567 provides for abatement, for benefits conferred through a life insurance made or transferred in favor of a third party payable on the decedent’s death, on the basis of the surrender value at the time of death. This calculation does not mean that the entire death coverage written in the policy is in every case added to the estate. The type of policy, the source of the premiums, entitlement and the surrender value must be documented. A risk insurance and a product containing savings should not be hypothetically valued by the same method. Turkish Civil Code Article 567

A numerical check example for the loan account

Suppose that in a hypothetical file the coverage valid on the date of death is 1,000,000 TL and the bank’s claim, which has priority within the scope of the policy, is 620,000 TL. If the coverage and the bank’s right are verified, whether the remaining 380,000 TL belongs to the rights holder is examined according to the beneficiary arrangement. This example is not a legal guarantee presuming that the policy will necessarily pay the full amount; it only shows why the debt and the coverage are calculated separately.

If the heirs have paid installments after the death, the bank’s current debt may decrease. The same debt cannot be collected a second time both from the sum insured and from payments by the heirs. On the other hand, for which payment a refund will be requested is determined by investigating the payment date, the scope of the insurance, the bank’s collection and when the insurer’s debt became due. It cannot be accepted automatically that interest and enforcement costs are entirely within the scope of the policy.

How is the file completed in the case of a death abroad?

If the foreign death certificate shows only the fact of death and not its cause, additional medical documents may be required. A request for documents should be relevant to the examination of the risk and proportionate. Instead of sharing the entire health history without any limit, the records for which a reason is given should be sent through an authorized and secure channel. The date of death, the end date of the policy and the date format in the foreign document should be checked together.

The missing documents, the article relied on for rejection and the calculation method should be clear in the letter to be obtained from the company. The need for a Turkish translation, an apostille or consular certification is assessed according to the country and the type of document. The attorney-in-fact’s authorities for the insurance application, file review, arbitration or lawsuit, and collection are kept distinct from one another. Representing all of the heirs with a single attorney-in-fact should also not be chosen automatically on the assumption that there is no conflict of interest.

How does a policy exceeding five years affect the declaration objection?

TTK Article 1498 contains a special provision limiting withdrawal on the ground of a breach of the declaration at the time of formation once five years have passed since the contract was made, including renewals. Exceptions for intent and the technical limits stated in the statute are reserved; premium difference and proportional payment issues are assessed separately. Therefore, looking only at the date of the last renewal is not sufficient. The original contract, the uninterrupted renewals and all versions of the health declarations should be requested. The passing of five years does not lead to the result that “no defense of rejection can be raised.” TTK Article 1498

Conclusion

Resolving a life insurance file requires reading the policy, the beneficiary and the loan relationship together. A proper application ensures not only proof of the death but also clarification of the coverage and the payment calculation.

Frequently Asked Questions

Is the loan definitely closed in the event of death?

No. The coverage, the policy term, exclusions and whether the sum insured is sufficient for the debt are examined.

Can a person who has disclaimed the inheritance receive money as a beneficiary?

The legal nature of the beneficiary’s right must be assessed separately from heirship; the disclaimer alone does not explain all insurance rights.

Can the bank keep the entire sum insured?

The scope of the bank’s rights and claim is determined; to whom the remaining amount belongs is examined separately.

Is the company’s rejection letter the final decision?

No. Under appropriate conditions the dispute may be examined through arbitration or the court.
