Tourism-Purpose and Short-Term Leases

In Türkiye, leasing residences for tourism purposes for a single period of one hundred days or less is subject to a special permit and inspection regime. Obtaining a permit document, the requirements for the building and the independent unit, advertising activity, the plaque, identity notifications and administrative sanctions must be reviewed under the current legislation.

In Antalya and the tourism regions, when villas, residences, apart units and homes are rented by the day or by the season, lease law, condominium ownership, tourism legislation, tax and the administrative sanction regime are addressed together. Carrying out short-term leasing for tourism purposes in practice under the appearance of a long-term residential lease may create legal and administrative risk, whatever the contract is called.

Lease Transactions for Foreign Tenants and Landlords

In lease relationships with foreign parties, in addition to the mandatory provisions of Turkish law, the contract language, the address for service, the power of attorney, bank payment, restrictions on contracts in foreign currency, use of the address in a residence permit application, and service on a party located in a foreign country are examined together.

It is important that a contract prepared in a foreign language does not conflict with the Turkish text and that it is clearly stated which text prevails. Güneş & Güneş Law Firm provides legal communication and contract support in Turkish, English, German and Russian.

Leases of Land, Agricultural Land and Produce

In the lease of land, agricultural land, a business, facilities, vehicles, machinery and a revenue-generating right, the type of lease, the obligations of use and operation, the sharing of produce or revenue, and the provisions on maintenance, return and termination are examined. It is borne in mind that the protective provisions specific to leases of residences and roofed commercial premises do not apply to these contracts automatically.

The name of the contract alone is not decisive

Granting only a right of use, and leaving the right to operate and to obtain produce or revenue together with it, may lead to different provisions. The obligations of handover, yield, maintenance, operation and return are determined according to the actual contract; not every protection in residential leases carries over to these relationships.

The limits of a contract with a foreign party

Being a foreign national does not by itself guarantee that the rent can be set in foreign currency or that a residence permit will be obtained. The parties’ residency status, the property, the purpose of use and the relevant exceptions are examined. Representation in Türkiye and service and local-law procedures in another country are planned separately.

How We Work on This Topic

First we determine the legal type of the lease and the relevant special rules. We separate the foreign elements connected to Türkiye and the need for representation and documents; we plan the permit, contract and dispute processes according to the scope of services.
