Summary
A residence permit in Türkiye is not merely an application form or a card; it is a legal status that depends on the actual purpose of stay, personal circumstances and continuing obligations. Short-term, family, student, long-term, humanitarian and human trafficking victim residence permits are subject to different conditions; buying a home, renting a house or setting up a company does not, by itself, secure a permit. The timing of the application, the address, financial sufficiency, insurance, family ties and notifications must be examined together. Filing a lawsuit against a refusal decision does not in every case mean that the stay in Türkiye or a deportation measure is suspended; the time limits for the residence procedure, the entry ban and the deportation decision are assessed separately. [K1–K5]
A residence permit, a visa, a work permit and an address registration are not the same thing
A residence permit is an administrative permit that enables a foreign national to stay in Türkiye on a ground provided for by law. Under Law No. 6458 on Foreigners and International Protection, a foreign national who will stay longer than the period afforded by a visa or visa exemption, or longer than ninety days, needs a residence permit, subject to exemptions. The ninety-day figure does not give every nationality, on every entry, an unconditional right to stay for ninety days. Passport type, nationality, date of entry, the period of stay stated in the visa and earlier entries must be calculated together. [K1: Art. 19–22; K3–K4]
A visa concerns the regime of entry into the country and short stays; a residence permit concerns staying in the country for a specific reason; a work permit concerns authorization to work. There are cases in which a valid work permit or a work permit exemption takes the place of a residence permit. However, the work documents issued to international protection applicants, conditional refugees and persons under temporary protection have a different effect. An ordinary residence card does not, on its own, confer the right to work. [K1: Art. 27; K5]
A residence permit, an address registration certificate and the place of residence within the meaning of civil law are also different concepts. The fact that an address is registered at a dwelling does not prove that the person holds a valid residence permit. Conversely, the grant of a residence permit does not mean that the person may live anywhere without making a notification. Confusing the address document known as the “domicile certificate (ikametgâh belgesi)” with a foreign national’s residence permit can lead to significant errors in the application file. [K1; K4; K12]
The application form, the approved residence permit application certificate and the residence card are three separate documents. Generating the form does not show that a permit has been granted following the assessment. The temporary stay and travel possibilities afforded by the application certificate depend on the approval of the certificate, its validity period and the relevant conditions. [K3–K4]
What types of residence permits exist in Türkiye?
The Law provides for six basic types of residence permit. First application, extension and transition are not additional permit types; they are forms of the permit procedure. Tourism, ownership of immovable property, commercial connection or a Turkish language course are different grounds of application for a short-term residence permit. Spouses and children in the same family may stay under different types of permit. [K1: Art. 30–49; K2]
| Permit type | Basic grounds | Period and distinguishing feature |
|---|---|---|
| Short-term | Research, housing, trade, tourism, medical treatment and other purposes listed in the Law | In general, up to two years each time; different limits apply to special categories. |
| Family | A spouse and child relationship listed in the Law with an eligible sponsor | Up to three years each time; it cannot exceed the sponsor’s residence period. |
| Student | Education and student status covered by the Law | Determined by the education, the program and the student status. |
| Long-term | Uninterrupted residence and other conditions, or conditions set by the Ministry | Indefinite; it is not citizenship or an automatically indefinite work permit. |
| Humanitarian | The best interests of the child and other special humanitarian situations | Regulated within the periods set by the Ministry and the approval of the competent authority. |
| Human trafficking victim | Victimhood, or a strong suspicion that the person may be a victim | An initial period of thirty days; extensions of up to six months each, up to three years in total. |
The maximum periods in the table do not mean that the applicant will necessarily be granted a permit of that length. The validity of the passport, health coverage, the duration of the reason for stay, the sponsor’s situation and the documents submitted may affect the outcome. [K1–K2]
How are lawful stay and the correct status determined before applying?
The first check is not which permit would be easier to obtain, but which legal ground the person’s actual situation fits. The last entry record, the visa or exemption period, any existing residence or work permit, previous refusals and any restriction code, deportation or stay violation records must be examined together. A new passport, a new lease or a different application heading does not, by itself, erase past records. [K1; K3–K4]
Retirement income can explain financial sufficiency; however, there is no independent permit type called “retirement residence” that is granted to all retirees. A bank account and a lease are mostly documents of subsistence and housing, not of the reason for the application. Company shareholding, commercial preparation, investor status and actual work must be kept apart. Likewise, the existence of a lawsuit in Türkiye does not, by itself, create the relevant short-term category unless there is a request or decision of the competent authority that considers the stay necessary. [K1: Art. 31; K2; K5]
In terms of family, each person’s file must be built separately. A spouse’s title deed, a student’s admission document or a patient’s treatment record does not automatically grant a permit to all relatives. Which relationships, such as dependency, custody, consent, being a sponsor and co-ownership, give which right to which person is determined separately. If there are several actual reasons for staying, the main reason is chosen; the other ties are explained as supporting ones. [K1–K2]
The fourteen grounds of application for a short-term residence permit
A short-term residence permit is not a single-type tourist permit. Each of the grounds in Article 31 of the Law is assessed together with the general conditions in Article 32. The absence of a ground for the permit, its later disappearance, use of the permit outside its purpose or other statutory obstacles may lead to refusal, cancellation or non-extension. [K1: Art. 31–33; K2]
In a short-term application, the following are required: submission of information and documents supporting the purpose of stay, not falling within the grounds for refusal of entry into the country in Article 7 of the Law, housing conditions that comply with general health and safety standards, and notification of the address at which the person will stay in Türkiye. If requested, a criminal record certificate issued by the competent authority of the country of nationality or of lawful residence must also be submitted. These general conditions are assessed alongside, not in place of, the document specific to the category below. [K1: Art. 32; K2]
Scientific research
The subject of the specific research, the institution where it will be carried out, the field site and the duration must be explained. If the research is subject to permission, the permission of the competent institution matters; if not, an explanation showing the nature of the research and the relationship with the institution matter. A general invitation from a university or research organization does not in every case take the place of the required research permit. The visa on which the application is based, the research program, the funding and the requested period of stay must be prepared consistently with one another. [K2]
Home ownership in Türkiye
It is required that the immovable property be a dwelling and be used for that purpose. The title deed record, the independent unit, the share ownership and the actual use are assessed together. A contract concerning only a plot of land, a commercial workplace or a project to be delivered in the future is not the same as current home ownership. The stated reason for stay of a person who leases the dwelling to a third party and lives elsewhere must also be examined separately. The value, the date of acquisition, the address and the situation of family members are explained separately in the immovable property section below. [K1: Art. 31/1-b, 31/6; K2; K6]
Commercial connection or setting up a business
Genuine commercial meetings, business relationships and preparations for establishment must be documented. Where a permit of more than three months is requested, an invitation letter and similar documents from the persons or companies to be contacted may be requested. The company’s trade registry record, the agenda of the meetings, the business plan and the applicant’s role must corroborate one another. Establishing a company or becoming a shareholder in it does not take the place of the work permit or exemption needed to actually work in the company. [K2; K5]
In-service training
The letter of the institution providing the training, the content of the program, the start and end dates and the participant’s institutional relationship are important. The requested period must be consistent with the nature of the training. If actual work is carried out at a workplace under the name of training, the permit or exemption required by labor legislation is assessed separately. If the institution bears the costs, the scope of that undertaking is documented. [K2; K5]
International agreement or student exchange program
For those who come for education and similar purposes under agreements to which Türkiye is a party or under student exchange programs, the institutional letters, the program calendar and the funding documents are examined. An exchange program and enrollment in an independent higher education program in Türkiye are not the same category. As to health coverage, the applicable social security arrangement or program arrangement is investigated separately; the time limit for applying for general health insurance for students must also not be overlooked. [K2; K4]
Stay for tourism purposes
The purpose of the trip, where the person will stay and on which dates, and the transportation, accommodation and financing plan must be explained. A request for a long stay based only on a statement such as “I love Türkiye” or on a lease may not sufficiently explain the genuine tourist purpose. The program must be consistent with the person’s age, health, budget and life plan. Examples of seasonal trips and the importance of genuine reservations are addressed in the separate tourism section. [K2; K4]
Stay for medical treatment
On condition that the person does not carry one of the diseases classified as a threat to public health, the hospital’s admission and treatment documents matter for persons who will receive treatment in Türkiye. The duration of the treatment, how the costs will be paid and, if any, a continuation report should be prepared. Where documentation shows that all treatment costs are covered, a special arrangement regarding health insurance may come into play. The status of a companion is determined separately; the patient’s document does not automatically grant a permit to all relatives. The special insurance arrangement for up to two companions of those who come under Supplementary Article 14 of Law No. 3359 cannot be generalized to all treatment files. [K2; K4]
Request or decision of a judicial or administrative authority
The competent authority must consider it necessary for the person to remain in Türkiye because of a procedure. Filing a lawsuit concerning immovable property, having a tax dispute or consulting an attorney does not, by itself, constitute this ground. The reason for and the duration of the required stay must be clear in the authority’s letter. Which procedure is being pursued, why the person must be present in person and the alternative means of representation are assessed according to the file. [K1: Art. 31/1-g; K2]
Transition from a family residence permit to a short-term permit
There is a possibility of transition for those who have stayed in Türkiye with a family residence permit for at least three years and have reached the age of eighteen. In the divorce of a foreign national married to a Turkish citizen as well, the condition of at least three years of family residence comes into play; if victimhood of domestic violence is established by a decision of the relevant court, this period is not required. In the event of the sponsor’s death, a transition may be considered without the period requirement for those staying under the family residence dependent on the sponsor. The duration of the marriage and the time spent under a family residence permit are not the same. [K1: Art. 34/5–7; K2]
Turkish language course
Registration with an institution authorized to teach Turkish and the continuation of the course are documented. A permit based on this ground may be granted at most twice; in a program shorter than one year, the permit period cannot exceed the length of the course. An independent Turkish course, preparatory education attached to a university and registration in the main higher education program are not in the same legal position. Which program the statement “I registered with TÖMER” refers to must be determined from the admission document. [K1: Art. 31/1-h, 31/3; K2; K4]
Education, research, internship or course through a public institution
The basis of a program carried out through a public institution, the applicant’s admission and the program calendar must be shown. In this scope, the permit may be issued for a period of up to one year. Where housing, food or health expenses are borne by the relevant institution, it is explained which expenses are actually covered; it cannot be concluded from a single institutional letter that all document and insurance requirements have fallen away. [K1: Art. 31/1-ı, 31/4; K2; K4]
Graduation from higher education in Türkiye
For those who have completed their higher education in Türkiye, if they apply within six months of graduation, a short-term residence permit of up to one year may be granted once. These six months do not mean that the student permit automatically remains valid for six months after graduation. According to the statement of the Presidency of Migration Management (Göç İdaresi), student residence ends on the graduation date and an application suited to the new purpose of stay must be made within ten days. The six-month window for applying to the category and this ten-day procedural obligation concerning the preservation of the existing stay cannot be used in place of one another. [K1: Art. 31/1-i, 31/5; K2; K4]
Investors specified in the Law and their family members
Persons who do not work in Türkiye but will make an investment within the scope and amount to be determined by the President, their foreign spouses, and the minor or dependent foreign children of themselves and their spouses may be assessed in a special category. The permit may be issued for periods of up to five years each. Not every bank balance, every company shareholding or every purchase of immovable property satisfies this special investment requirement. The investment conditions for citizenship and a residence application based on ordinary home ownership are also separated. [K1: Art. 31/1-j, 31/2; K2]
TRNC citizens
For citizens of the Turkish Republic of Northern Cyprus (TRNC), there is a possibility of a short-term permit of up to five years each. Living in the TRNC, being a student there or having set up a company there does not take the place of the citizenship requirement. The citizenship and personal application conditions of each family member are checked. This permit does not remove the need to separately examine the legal authority required to actually work. [K1: Art. 31/1-k, 31/2; K2; K5]
How are the travel plan and financial sufficiency explained for a tourist residence?
The tourism purpose must be explained not by selecting a heading alone but by an actual plan of stay. Converting the program into a daily calendar of activities is not mandatory in every file; however, the geographic route, accommodation arrangement and costs of a request for a long stay in Türkiye must be understandable. The gap between a hotel reservation of a few days and a request for a long-term permit is explained when necessary. [K2–K4]
For example, in a genuinely planned trip there may be cultural and nature trips around Antalya, Kemer, Kaş and Demre in autumn; Istanbul, Bursa or Cappadocia in winter; Izmir, Ephesus, Bergama and Pamukkale in spring; and Aegean or Black Sea routes in summer. These are not trips taken in the applicant’s name or a mandatory program, but examples of how the plan can be made concrete. Trips that the person in question will not actually take, false reservations or documents that appear to have been created afterwards must not be used.
Income and expenses must be assessed over the same period. The continuity of pension payments, wages, rental income, savings and other legitimate sources, and their availability in Türkiye, matter. Money that enters the account at the last moment without explanation does not, by itself, prove a regular ability to support oneself. Leaving a reasonable margin for changes in exchange rates and living costs may be useful; this is not a statutory fixed ratio. [K4]
In a hypothetical budget in which monthly usable income is 90,000 Turkish lira (TL) and rent, living and insurance expenses are 70,000 TL, there is a difference of 20,000 TL. This example is not a minimum income or bank balance prescribed for a permit; it shows the logic by which a budget can be built. It should not be said that there is a single official bank amount applicable to everyone for short-term residence. The statutory income measure for family residence is stated separately below. [K4; K1: Art. 35]
Purchase of immovable property, the USD 200,000 debate and the residence permit
Owning a title deed and obtaining a residence permit are different procedures. Whether the dwelling may lawfully be acquired, the title deed and project status, suitability for actual residence, address restrictions and the value conditions relating to the permit application must be examined together. A seller’s or an intermediary’s statement that “a residence permit is certain with this house” does not take the place of an administrative permit. For a spouse and children who are not the owners of the dwelling, a family residence permit or another suitable status may be necessary; in co-ownership, each person’s share and family relationship are assessed separately. [K1–K2]
Article 31/6 of Law No. 6458, introduced by Law No. 7533 on November 30, 2024, provides that the nature and value of the immovable property forming the basis of a short-term residence permit are to be determined by the Ministry. The current debate therefore cannot be reduced to whether the Law contains a monetary figure. The authority provision in the Law, the Ministry’s concrete value criterion and the application of that criterion over time are separate layers. [K6]
For acquisitions after October 16, 2023, a threshold of USD 200,000 appears in accounts of the practice. However, it should not be accepted that this amount applies in the same way to all current applications, earlier acquisitions and different share-ownership situations. Because all thresholds and transitional details cannot be verified from publicly available official sources, the administrative criterion that will apply to the acquisition date and the application must be documented separately. For this reason, USD 200,000 should not be regarded as an unchanging and sufficient condition of acceptance, on its own, for all files. Before the purchase, the acquisition date in the title deed, the value and exchange rate to be taken into account, the share situation, previous permits and the current criterion relied on by the relevant administration should be clarified in writing. [K1: Art. 31/6; K6]
The USD 400,000 and three-year non-sale scheme announced for acquiring immovable property for citizenship is different. The Foreign Currency Purchase Document (Döviz Alım Belgesi), the valuation report, the citizenship eligibility certificate and the documents of the residence file do not take the place of one another. Meeting a particular investment amount does not, by itself, guarantee a citizenship or residence outcome. [K20]
Family residence permit: The situation of the sponsor, spouse and children
Who can benefit from family residence?
Family residence may be considered for the family members specified in the Law of Turkish citizens, of persons within the scope of Article 28 of Law No. 5901, of foreign nationals holding a suitable residence permit, and of refugees and holders of subsidiary protection status. The scope is the foreign spouse, the minor foreign child of the person or of the spouse, and the dependent foreign child. It cannot be assumed that a parent, a sibling or another relative is on this list. [K1: Art. 34; K2]
In the case of an adult child, “dependency” cannot be explained automatically merely by being unemployed or having no income. Health, care and other concrete conditions and the necessary documents are assessed. The assumption that spouses create two independent family permits that rely on one another by each presenting the other as sponsor is also incorrect; the suitable sponsor status must be determined first. [K2; K4]
In the case of a marriage to more than one spouse under the law of the country of nationality, family residence may be granted to only one spouse; the situation of children from the other spouses may be assessed separately. The consent of a parent who shares custody outside Türkiye matters in applications for children. Marriage, birth, custody and divorce documents must also be prepared with regard to the apostille, certification and translation. [K1: Art. 34; K2–K4]
The sponsor’s conditions and the period
The sponsor must have health coverage that includes all family members, suitable housing conditions and an address registration. That monthly income must not be less than the minimum wage in total and must not be less than one third of the minimum wage per family member are two separate elements of the statutory income regime. A certificate of no conviction for offenses against the family order in the last five years and, as a rule, a requirement of at least one year of residence are also assessed. [K1: Art. 35; K2]
There are exceptions to the one-year residence requirement; the special provision of the Law should be examined for those holding residence for scientific research purposes or a work permit, those within the scope of Article 28, and foreign nationals married to a Turkish citizen. It cannot be said that a work permit and one year of residence will in every case be required together. The Law also contains special provisions for sponsors with refugee or subsidiary protection status. [K1: Art. 35/2–4]
A family permit cannot exceed three years each time and cannot exceed the sponsor’s residence period. The genuineness of the marriage may be investigated when necessary. In the event of divorce, death or the child reaching the age of majority, it should not be assumed that the earlier ground for the permit continues; the transition provisions to a short-term permit above and other suitable types should be examined in time. [K1: Art. 34–37; K2]
Student residence permits and changes of status in education
Student residence is based on the primary and secondary education and higher education situations covered by the Law. In higher education, the admission document, the student registration, the type of program and the actual continuation of the education matter. In primary and secondary education, the undertaking of care and costs and the consent of the parent or legal representative are assessed separately; in this group, regulation in one-year periods may apply. There are situations in which a separate student residence permit is not required for children with family residence to attend primary and secondary education until the age of eighteen. [K1: Art. 34/4, 38–41; K2]
Open education, distance education, special student registration and an independent language course do not in every case provide student residence. The distinction between university preparation and an independent Turkish course should be made from the institution’s letter. The parents of a person holding student residence do not automatically obtain a permit; the family relationship dependent on the student is assessed as limited to the spouse and children. [K2; K4]
The possibility of requesting general health insurance within three months of the first registration date is important for a foreign student’s health coverage. If this possibility is not used in time, private insurance or another suitable coverage may be required. A change of school, a change of faculty, a freeze of registration, disenrollment or graduation may have consequences that must be notified to the administration. Uninterrupted education in the same province and a transfer to another province are not the same procedure; the relevant twenty-business-day notification and new application regime should be checked. [K2–K4]
The right to work of associate degree and bachelor’s students arises after the first year and on condition of a work permit. The existence of a different regulation for graduate students does not mean that the permit requirement falls away automatically. For those receiving specialty training under TUS, DUS and YDUS, the e-Residence portal announces that an application for a work permit exemption must be made separately. According to the statement of the Ministry of Labor and Social Security (Çalışma ve Sosyal Güvenlik Bakanlığı), exemption applications after September 17, 2026 are received through the new work permit portal, and earlier applications are followed through the old exemption system. The portal change does not mean that the student residence file and the work exemption merge into a single document. [K2; K5; K21]
Long-term residence: Eight years, calculation of the period and the limits of the rights
A long-term residence permit is provided for foreign nationals who have stayed in Türkiye with a residence permit uninterrupted for at least eight years or who meet the conditions set by the Ministry. The general conditions include not having received social assistance in the last three years, sufficient and regular income to support oneself and one’s family, if any, valid health insurance, and not posing a threat to public order or public security. A special assessment subject to conditions set by the Ministry cannot be interpreted as also removing the public order and security condition. [K1: Art. 42–43; K7]
In the eight-year calculation, half of the time spent under student residence and the whole of the periods under other suitable residence permits are taken into account. Interruptions in residence, stays outside the country and changes of permit type must be calculated separately. The effect of reasons such as health, education and compulsory public service on the calculation of interruption is documented. A general statement that tourist residence will in no case be counted cannot be substituted for the Law’s calculation of the period. [K1: Art. 28, 43; K2]
There is a special statutory exclusion for the transition to a long-term permit for refugees, conditional refugees, holders of subsidiary protection status, holders of humanitarian residence permits and persons granted temporary protection. It is not sufficient to add up the time spent under different statuses only on the calendar. An indefinite permit is not Turkish citizenship; differences from citizens continue in areas such as voting and standing for election, entering public service, military service and the import of exempt vehicles. [K1: Art. 42–44; K2]
Long-term residence does not automatically grant an indefinite work permit; it may provide a basis for being able to apply for that permit. Meeting the application condition does not mean that a work permit will necessarily be granted. A stay outside Türkiye of more than one uninterrupted year for reasons other than health, education and compulsory public service in one’s own country may bring about the cancellation of the long-term permit. The special procedure under which the eight-year residence requirement is not sought again in a new application by those whose permit has been cancelled should therefore be examined separately. [K1: Art. 45; K2; K5]
Humanitarian residence and residence for victims of human trafficking
Humanitarian residence is not a simplified copy of an ordinary application
The best interests of the child, the inability to enforce departure despite a deportation decision or entry ban or departure not being considered reasonable or possible, the grounds for not deporting under Article 55, recourse to judicial remedies against certain procedures, return procedures to the first country of asylum or a safe third country, urgent reasons and extraordinary circumstances fall within the assessment field of humanitarian residence. That the conditions sought for ordinary permits are not applied as they stand does not mean that the permit is automatic. [K1: Art. 46–47; K2]
Under the current regulation, the period is determined by the Ministry; the governorate and the approval process of the competent Presidency of Migration Management (Göç İdaresi) operate together. The wording “at most one year each time in every case” in older texts should not be repeated without taking into account the regulation amended by Law No. 7196. The obligation to register in the address registration system within twenty business days after humanitarian residence is granted is also important. If the conditions that gave rise to the permit cease to exist, cancellation or non-extension may come into play. [K1; K2; K7]
The existence of a child who is a Turkish citizen, a serious health condition or family unity can carry strong weight in the relevant assessment. However, with whom the child lives, the care relationship, health and education needs, the concrete effect of the separation and whether family life can be established in the other country must be documented. Rather than relying only on an abstract family tie, records of birth, custody, care, education, treatment and actual life are submitted together. [K1; K18–K19]
Special protection for victims of human trafficking
A permit of thirty days may be granted to foreign nationals for whom there is a strong suspicion that they are or may be victims of human trafficking, so that they can recover from the effects of what they have experienced and decide on cooperation with the authorities. If the victim’s safety, health or special situation requires it, this period may be extended in periods of up to six months each; the total period cannot exceed three years. The conditions of the other residence permits are not sought here in the same way. [K1: Art. 48–49; K2]
Safety and confidentiality are a priority in this process. Where a person is in danger, emergency help channels and the competent units should be used; sensitive information should not be written in public comment areas. The Foreigners Communication Center (YİMER) 157 is the official information and referral channel for foreign nationals; in immediate danger, 112 should be considered. Whether it is safe for the victim to make contact with the existing person or institution is also taken into account separately. [K22]
How are the first application, extension and transition made?
Lawful time to apply and the e-Residence system (e-İkamet)
In ordinary practice, the application is initiated after entry into Türkiye through the official e-Residence system and completed through the relevant Provincial Directorate of Migration Management (İl Göç İdaresi) or the designated delivery channel. The fact that the Law provides for a consulate application regime does not mean that all normal applications are today received from missions abroad. Special arrangements, such as re-obtaining a long-term permit, should be assessed separately from the general application flow. [K1: Art. 21–22; K2–K4]
In the first application, the correct procedure must be completed before the existing lawful period of stay ends. An extension application is made in the sixty-day period before the end of the permit and in any case before the permit expires. A transition application, on the other hand, is directed at the suitable new type upon a change in the reason for stay. Opening a draft in the system is not the same as a completed application and an appointment document. The period indicated for completing a record initiated by the system should not be read as an independent right that automatically extends the visa or the existing permit. [K3–K4]
Where an application has been completed in a timely and proper manner, the appointment being given for a later date is different from a person opening a record for the first time after the lawful period has ended. The relevant application and appointment document should be kept; it should not be forgotten that, apart from the stated excuses, failing to attend the appointment may result in the application being deemed not to have been made. In the event of a system failure, it is useful to keep a dated record of the error and an official support request; a screenshot alone does not make certain that the statutory time limit has been preserved. [K3–K4]
It cannot be said that everyone can apply unconditionally within ten or fifteen days after a visa or permit ends. A conditional entry undertaking, a change of status after graduation, an assessment based on an excuse and the obligation to leave after a refusal are different events. A special ten-day period is not a general additional period of lawful stay for all foreign nationals. [K1; K3–K4]
Follow-up through an attorney, a notary and a university
A residence application may be made by the foreign national or followed through an authorized legal representative or attorney. The administration may require the foreign national to be present for interviews, identity and biometric procedures it considers necessary. Granting a power of attorney does not, by itself, remove the need for entry into Türkiye, a status suited to the application or personal attendance. [K1: Art. 21; K4]
Since July 17, 2024, the practice of receiving residence application files through notaries has been extended nationwide. A notary is not the authority that decides on a residence permit; the file is forwarded to the relevant Presidency of Migration Management, and the assessment is made by the competent administration. This channel cannot replace the own procedures of international protection and temporary protection. The scope and costs of the notary procedure should not be confused with the free official appointment. [K9]
For higher education students, the arrangement of document delivery within the framework of cooperation between the university and the Presidency of Migration Management may also apply. The university’s current announcement, the student affairs delivery list and the e-Residence record should be checked together. Another university’s old courier or delivery period should not be applied automatically to all students. [K10–K11]
How should the application documents be prepared and compared?
The list of documents varies according to the permit type chosen. That the common documents are complete does not mean that the reason for the application has been proved. The form, passport, address, insurance and financial records must show the same person, the same period and the same life plan. The administration may request additional information or documents when necessary; the general list does not take the place of a person-specific request. [K3–K4; K8]
| Document group | Basic review | Frequently encountered dispute |
|---|---|---|
| Identity and passport | Validity, entry records, matching of the old and new passport | Differences in the spelling of the name, in the number or in the date of birth |
| Reason for stay | Title deed, education, institution, trade, treatment or family document | A housing document submitted in place of the reason for the permit |
| Address and accommodation | The actual independent unit, the owner or authorized person, actual use | Occupied address, closed area, house numbering or authority problem |
| Financial sufficiency | Source, regularity, usable amount and period | Unexplained money inflow or an unrealistic budget |
| Health coverage | Scope, start and end, special exception | Insurance gap or an unsuitable travel policy |
| Family and child | Birth, marriage, custody, consent, dependency | Missing parental consent or mutually contradictory records |
| Foreign documents | Apostille/certification, translation, validity and original document | Mistaking the apostille for proof of the accuracy of the content |
| Follow-up and payment | Application record, appointment, UETS, bank receipt (dekont), receipt of delivery | The notification not being seen, or payment made to the wrong item |
The passport or the document in its place must be valid for at least sixty days longer than the requested permit period. If there is a special exemption or an exception for the permit type, it is examined separately. The general application regime requiring four photographs taken within the last six months, on a white background and of suitable biometric quality should be observed. A photograph that has been artificially altered or does not reflect the person’s current appearance must not be used. [K1: Art. 21; K4]
For documents obtained from a foreign country, the apostille, consular certification, Turkish translation and notary procedures are determined according to the type of document and the relevant agreements. Just as not every document has to go through the same certification route, an apostille does not prove that all material information in the document is correct. For e-Devlet documents of a kind usable at official institutions as well, the type, currency and verifiability of the document are checked. [K4]
For children, the birth certificate, custody, the consent of the other parent and, where necessary, the documents of a guardian or trustee (kayyım) are assessed separately. The procedures of a foreign child born in Türkiye should be planned within the framework of the birth record and the temporary stay tied to the parents’ permit period; the arrangement of one hundred eighty days at the latest and the parents’ valid status are taken into account together. Birth taking place in Türkiye does not automatically grant the child Turkish citizenship. [K1; K4]
Address, lease, closed neighborhood and occupied address
The address review should be carried out before rent or the sale price is paid. The address in the contract, the actual independent unit, the house number, the title deed information and the address in the relevant records must point to the same place. Whether the lessor is the owner or an authorized person is investigated. A required notary procedure does not, by itself, correct an invalid power of representation or a false address declaration. [K3–K4; K8]
Forms of accommodation such as staying in one’s own home, tenancy, staying with a third party, a hotel, a student dormitory or a yacht are not explained with the same document. For a stay with a third party, a notarized undertaking and, where necessary, the spouse’s undertaking or consent; for a hotel and a dormitory, the institution’s record; and in cases concerning a yacht, berthing and stay documents may be requested. The list of documents suited to the application should be built on the relevant option. [K4; K8]
An “occupied address” may point to problems such as another person’s record existing or the records not matching the actual situation; the necessary confirmation or consent is investigated. A “closed neighborhood”, on the other hand, concerns an administrative practice in which certain foreign national registrations are restricted. These should not be used in place of one another. Without checking the date of the neighborhood decision, the permit type and its exception, it cannot be said that an entire district is permanently closed. [K4; K13]
Having a dwelling in Antalya, Istanbul, Izmir or Mugla/Bodrum does not, by itself, guarantee that a residence application can be made at that address. In tourist regions, summer house rentals, seasonal use, apart-hotels and independent unit records in particular should be compared. The criterion here is the registration and use status of the concrete address rather than the name of the city.
The twenty-business-day notification regime for changes of address should be observed. The General Directorate of Population and Citizenship Affairs states, for 2026, an administrative fine of 814 TL for late notification and 17,051 TL for a false address declaration under Law No. 5490. These are not the penalty for all residence violations; the act, the responsible person, the competent authority and other sanctions are assessed separately. [K12]
Which distinctions matter in health insurance and financial documents?
Health coverage must be suited to the period requested. The options of a social security agreement document enabling use of health services in Türkiye, SGK provision (provizyon), general health insurance or suitable private health insurance are examined according to the person. Not every travel insurance is sufficient for a residence application. The practice under which uninterrupted coverage can be shown with one-year policies in two-year applications requires that the dates be set correctly. [K3–K4]
Different insurance provisions may exist for persons under eighteen or over sixty-five, students, those who come for treatment and those whose costs are borne by a public institution. It cannot be said that an age-related facilitation removes, in every case, the sponsor’s obligation in family residence to hold insurance covering the whole family. For which permit type and which person the exception is valid should be assessed with documents. [K1: Art. 35, 43; K2–K4]
In the financial file, not only the total amount of money but also the owner of the income, its source, its continuity, the size of the family and its availability throughout the application period are explained. Bank transactions, pension payments, salary, rental income, company or tax documents may be submitted together when necessary. A past-period or three-year tax document requested in a particular file should not be presented as an unchanging document obligation for all applications. [K4; K8]
That there are cases in which a financial declaration may be considered sufficient in the short term does not mean that the administration cannot request documents. By contrast, the numerical income condition in family residence differs from the regular and sufficient income and social assistance review in long-term residence. If the ground for refusal is financial insufficiency, rather than merely presenting a high balance, the income or expense contradiction on which the administration relied should be identified. [K1–K4]
Follow-up after the application: Missing documents, UETS and the assessment period
The period given for missing documents and the ninety-day review
The administration may grant a period of up to thirty days for missing documents to be completed. The start of the concrete period given, the form of the notification and the document requested are recorded separately; failure to complete them may lead to the file being removed from processing (işlemden kaldırma). It should not be assumed that a full thirty days will automatically be given for every deficiency, or that the same completion procedure will necessarily be carried out before every refusal. [K3–K4]
The rule that the application is to be concluded within ninety days at the latest is assessed from the complete submission of the information and documents to the competent authority. Additional review, correspondence and records of file completion are therefore important. The expiry of ninety days does not mean that the permit is granted automatically. The calculation of the time limits for judicial remedies against the administration’s silence is also not a mechanical copy of this assessment period; the type of application, Article 10 of the Administrative Procedure Law No. 2577 (İYUK) and the relevant special provisions are examined together. [K1; K3–K4; K14]
SMS, e-mail and legal notification
A change of phone line, a Turkish-language message not being understood, an e-mail landing in the spam folder or the UETS account not being checked may delay the procedure. Notifications by phone, e-mail, the e-Residence screen, UETS and physical mail at the registered address should be followed together. It is useful for each record to include the date of receipt, the action requested, the final day, the reply given and proof of delivery.
Since April 15, 2024, a document regime concerning UETS account information has applied to extension applications. In other cases, such as transition and student files with a previous foreign identification number, the relevant current delivery list is examined separately. For persons under eighteen, the arrangement made through the address of the parent or guardian is assessed. It should not be said, merely on the basis of an announcement about extensions, that the same condition exists in every first application. [K10–K11]
Under Law No. 7201, an electronic notification is deemed to have been made at the end of the fifth day following the date on which it reached the addressee’s electronic address. The document not being opened or the warning SMS not arriving does not, by itself, prevent this result. An SMS is often informational; the UETS evidence record, the notification of the decision and the calculation of the lawsuit time limit are linked but separate procedures. The decision, its attachments, and the records of receipt and statutory notification should be downloaded; it should not be assumed that the archive will remain online forever. [K15]
Travel with the application certificate and delivery of the residence card
While an application is pending, the online form alone is not sufficient for leaving the country. With an application certificate approved in the required manner and fee receipts, within the relevant validity period and on condition of returning within fifteen days each time, a possibility of exit and entry may exist. If fifteen days are exceeded, the visa provisions apply on re-entry. The passport, an entry ban, other border control and permit conditions also apply separately. [K3–K4]
The printing of a card does not show that it has been delivered to the right person. The address and contact details given in the application must be kept up to date; for a card that cannot be delivered, the process of PTT and then the Provincial Directorate of Migration Management should be followed. The delivery conditions may differ for the foreign national personally, the parent or guardian, and an authorized attorney-in-fact. For a lost or stolen card, renewal is carried out with the relevant record, address and photograph; in general practice, the full card fee and half of the residence fee may apply. Reprinting the card is not an automatic extension of the residence period. [K4]
The start of the permit is also not in every case the day the form was generated. In first permits, the end of the visa or exemption period or the requested start date; in an extension, the date on which the previous permit ended and the relevant practice are assessed together. What is essential is that the start and end of the permit in the issued document are consistent with the legal file. [K4]
Residence fee, card fee and other costs
According to the 2026 announcement of the Presidency of Migration Management, the residence permit document fee is 964 TL. This fee and the residence fee are different. The fee may vary according to citizenship, reciprocity, the permit period and applicable exemptions. In some files, a single-entry visa fee may also come into play. It should not be assumed that the total calculated for one country will be the same for a citizen of another country. [K16]
In the official payment regime, the codes 9207 for the card fee, 9233 for the residence fee and 9234 for the single-entry visa fee are used. Payment should be made through the channels to which the official system directs; the item, the amount, the application information and the bank receipt (dekont) should be matched. Making an appointment is free. Translation, notary, insurance and agreed attorney’s fee costs, on the other hand, are items different from the administrative fee. [K4; K16]
Requests for payment to a private account, the use of an internet address resembling an official institution, or the promise of a certain permit in return for a fee should be examined carefully. Obtaining help with an application is not the same as acting as though one were authorized on behalf of the Presidency of Migration Management. The applicant’s passwords, original documents and financial records should be handled in a limited and secure manner for the purpose. [K3–K4]
The first review to carry out on a refusal, cancellation or non-extension decision
A refusal is the non-acceptance of a request for a new permit; a cancellation is the withdrawal of a permit that has been granted; and a non-extension is the non-continuation of a permit for a new period. First, the whole decision, the article of the Law applied, the concrete reasoning, the notification document and the application file should be obtained. A short result on the application screen does not take the place of the entire administrative reasoning. The request for missing documents, the interview, the address check and the statements in earlier files are compared. [K1: Art. 25, 33, 36, 40, 45, 47; K4]
A refusal of residence, a deportation decision, an entry ban and administrative detention are not the same procedure. They may be present together in one file; however, filing a lawsuit against one does not automatically remove the other. The person’s other valid basis of lawful stay, if any, the notified obligation to leave and the separate decisions should be examined on the same day. The shorter deportation lawsuit time limit should not be missed by waiting only for the outcome of the residence lawsuit. [K1; K17]
The statement of the Presidency of Migration Management states that after a refusal, no new application can be made within six months for the same purpose of stay; if lawful stay continues, an application with a different genuine purpose of stay may be assessed. Choosing a new heading does not cure the absence of a genuine purpose or of lawful stay. A repeated application also does not automatically restart the time limit for a lawsuit against the earlier refusal. [K4]
Annulment action and stay of execution against a residence decision
The general lawsuit time limit, jurisdiction and administrative application
For a refusal, cancellation or non-extension concerning a residence permit, where there is no special provision, the general time limit for an annulment action is sixty days from the day following written notification. To whom and by what method the notification was made, its legal validity, holidays and special time limit regulations are calculated separately. The competent administrative court is, as a rule, determined by the location of the administrative authority that took the action; the city in which the foreign national happens to be on that day is not the sole basis. [K14: Art. 7–8, 32]
An application under Article 11 of the Administrative Procedure Law is made within the lawsuit time limit to the superior authority, or, if there is none, to the authority that took the action, for the purpose of withdrawal, retraction or amendment of the action or the taking of a new action. A properly made application suspends the running of the lawsuit time limit. If no reply is given within thirty days, the request is deemed rejected; after an express or implied rejection, the remaining time continues to run. A new sixty-day period does not begin. Nor can it be said that every application made to the wrong authority will have the same effect. [K14; K23]
For example, solely to show the logic of the suspension of the period, if ten days are assumed to have passed before a valid application, the remaining time is fifty days. This example is not a calculation of a personal final day for application; the day, notification and holiday assessment are made from the file. An application for the taking of an action under Article 10 of the Administrative Procedure Law and an application under Article 11 against an existing action are also not the same procedure. [K14; K23]
The special procedure in short-term residence lawsuits
Under Article 31/7, added by Law No. 7533, in lawsuits filed against decisions refusing a short-term residence application or cancelling a short-term permit, the file is deemed ready for decision (tekemmül) upon the submission of the response or the expiry of the response period. Holding a hearing is at the court’s discretion. It is therefore especially important that the evidence, the application file and the substantive objections be presented in an orderly manner in the first petition. [K6]
Where notification cannot be made to the address indicated by the claimant, the period in Article 26/3 of the Administrative Procedure Law is applied as two months under this special regime. These two months are not the name of the general initial period for filing a lawsuit against a refusal of residence. Transitional Article 3 provides for the relevant procedural changes to apply to lawsuits filed after their entry into force. It should not be assumed that today’s procedure will automatically apply to a past file. [K6]
Stay of execution and proof
Filing an annulment action does not, as a rule, automatically stay the execution of the administrative action. In a stay of execution, the conditions that the action is clearly unlawful and that its implementation would cause damage difficult or impossible to remedy are assessed together. The request must make clear the effect of which action is sought to be stayed. It cannot be said that a decision obtained for a refusal of residence also removes a separate entry ban, deportation or other status obstacles. [K14: Art. 27]
Family life, the education and care of the child, ongoing treatment, settled life in Türkiye and the concreteness of the administration’s public order allegation may gain importance in this review. However, instead of an abstract statement such as “I will suffer harm”, birth and marriage records, custody documents, school and hospital letters, care needs, income, address and earlier permit records are submitted. A reply to any contradiction or negative record asserted by the administration and the supporting documents should also be prepared. [K18–K19]
The possibility of a one-time objection, within seven days from the day following notification, to the authority provided for by the Law against decisions given on a stay of execution is assessed separately. This period should not be confused with the sixty-day period of the main lawsuit or the special period of the deportation lawsuit. [K14: Art. 27]
Why are the deportation decision, administrative detention and legal remedies followed separately?
An application against a deportation decision is made to the administrative court within seven days of the notification of the decision; the application is also notified to the authority that issued the decision. Unless the foreign national consents, there is special protection against being deported within the lawsuit time limit or until the proceedings are concluded. This result cannot be generalized in the same way to all residence refusal lawsuits. [K1: Art. 53; K6; K17]
The fifteen-day decision period in the current Article 53/3 is regulated from the file being ready for decision (tekemmül); where an interim decision or a hearing is necessary, from their completion. On the basis of older texts, it should not be said that every file will end fifteen days from the day of application. The finality of the administrative court’s judgment on the deportation decision is also a separate statutory provision. [K6]
Administrative detention is a separate decision concerning deprivation of liberty. An application is made to the criminal judge of peace (sulh ceza hâkimi) against it; the five-day period provided for the judge’s review does not mean that the foreign national must in every case apply within five days. In the event of a change in conditions, a renewed application and the alternative obligations to administrative detention are assessed separately. The end of administrative detention does not mean that a residence permit has been granted or that the deportation decision has been cancelled. [K1: Art. 57–57/A; K17]
In residence disputes, an appeal (istinaf) is, as a rule, examined within the framework of the thirty-day period in Article 45 of the Administrative Procedure Law and the nature of the decision. Article 46/2 of the Administrative Procedure Law, added by Law No. 7589 published on July 31, 2026, expressly sets lawsuits arising from the application of Law No. 6458 apart from the new possibility of appeal on points of law. A regional administrative court’s setting aside of a first-instance decision and giving a new judgment does not, for that reason alone, open the route to the Council of State (Danıştay) in every residence file. The special finality provisions and the scope of Article 46/1 should be examined separately. [K14; K24]
After finalization and the exhaustion of ordinary remedies, if the conditions are met, the thirty-day individual application period to the Constitutional Court (Anayasa Mahkemesi) or the four-month application period to the European Court of Human Rights may come into play. These are not an ordinary appeal route that re-examines all legal errors; the scope of the application, the domestic remedies and the start of the period are assessed separately. An application does not, by itself, stay all actions. [K25–K26]
In an individual application to the Constitutional Court, the learning of the final decision is also important. If the decision was learned earlier through UYAP or another route, the UETS notification calculation relating to the ordinary legal remedy should not automatically be accepted as the start of the individual application. The records of learning and notification should be preserved together; the application period should be calculated separately. [K25]
Constitutional Court decisions: A family tie matters, but the result is not automatic
Nodira Mustafayeva: A decision finding no violation in a humanitarian residence request
In the Nodira Mustafayeva decision of the Constitutional Court dated March 7, 2024, Application No. 2020/6545, the humanitarian residence request of an applicant with a spouse and child who are Turkish citizens was examined. The dispute centers on the required approval not being given because of the restriction code Ç-141 entered against the applicant. The Court found the allegation concerning family life admissible; however, it decided that there was no violation. [K18: §§29–37]
In the specific case, the absence of a deportation decision, the applicant’s continued life in Türkiye with the family, the failure to submit a document showing that a lawsuit had been filed against the restriction record, and the failure to substantiate any necessity of leaving the country were significant. This decision does not mean that the family tie is unimportant. The point it shows in practice is that each adverse procedure must be examined separately and the alleged hardship must be explained with concrete documents. The earlier humanitarian permit period reported in the historical decision should not be used in place of the current statutory provision. [K18; K7]
Demet Hussen Najem: Failure to discuss the situation of dependent family members
The Demet Hussen Najem decision of the Constitutional Court dated July 27, 2022, Application No. 2019/438, concerns not a direct residence refusal but a deportation procedure. The applicant’s living in Türkiye with an elderly mother and a severely disabled sibling, the care relationship and the appointment of the applicant as guardian of the sibling were assessed with regard to making family life concrete. [K19: §§31–38]
The Court determined that the necessary balancing was not carried out in a refusal decision issued by relying on an entry ban without discussing the effects on family life, and ruled for a violation of the right to respect for family life and a retrial. By contrast, the allegation of ill-treatment was found inadmissible because no concrete basis was shown. The decision is not a ruling that directly grants the applicant a residence permit. [K19: §§29–30, 49–55 and the judgment]
Taken together, the two decisions show the difference between saying “my family is in Türkiye” and documenting care and dependency, the child’s needs or the real effect of the separation. Positive and negative outcomes should be compared not only by their headings but by their facts, the actions subject to the lawsuit and the evidence submitted. The administration’s discretionary power in migration management and the protection of family life are assessed together in the same file. [K18–K19]
Implementation after the decision, costs and a new application
After a decision of annulment or stay of execution is given, notification and implementation are followed separately. Under Article 28 of the Administrative Procedure Law, the administration is obliged to take an action or act without delay in accordance with the requirements of the decision; the general maximum period is thirty days from the notification of the decision to the administration. An annulment on the ground of procedure or incomplete review does not always mean that a permit of a particular period will be issued directly. The reasoning of the judgment, the administration’s sphere of bound authority and the need for reassessment are examined together. [K14]
Where no action is taken despite a court decision, an unlawful action is taken again, or damage arises, the applicable remedies and compensation routes are assessed separately. Fees, postage, translation, attorney’s fee and other costs vary according to the type of file. The imposition of litigation costs on the other party and the fee agreement the client makes with the attorney are not the same relationship. If the conditions are met, legal aid is considered; special conditions are also taken into account for foreign nationals. [K14: Art. 31]
If a new application is to be made, how the earlier ground for refusal has been cured, whether the new reason actually exists and whether lawful stay continues should be explained. Instead of submitting the same file again with a newly dated lease, the changed facts and documents are shown. If there is an administrative lawsuit, a restriction procedure, a deportation or a work permit file, the effect between them is separately recorded. [K1; K4]
Time limit and procedure checklist
| Event or procedure | Period / start | Point to be kept apart |
|---|---|---|
| Extension application | May begin sixty days before the end of the permit; in any case before it ends | The sixty days are not additional stay after the permit ends. |
| Passport validity | At least sixty days longer than the requested residence period | It is not an application or lawsuit time limit. |
| Missing documents | A period of up to thirty days given by the administration | A full thirty days is not assumed automatically in every file. |
| Assessment of the application | At most ninety days from submission of the complete file to the competent authority | Expiry of the period is not an automatic permit. |
| Address and related changes | Twenty business days within the applicable regime | The same period does not apply to every change of status. |
| Return with the application certificate | Fifteen days on each exit, if the conditions are met | Visa, passport and entry obstacles are examined separately. |
| Short-term permit because of graduation | Within six months from graduation; once, for at most one year | The six months are not an automatic continuation of the student permit. |
| Residence refusal/cancellation/non-extension lawsuit | As a rule, sixty days from the day following written notification | Not to be confused with the deportation lawsuit. |
| Article 11 application under the Administrative Procedure Law | Within the lawsuit time limit; thirty-day implied rejection regime | The unused lawsuit time continues; a new sixty days does not arise. |
| Lawsuit against a deportation decision | Seven days from notification of the decision | There is a special suspensive protection and finality regime. |
| Objection to a stay of execution | Seven days from the day following notification | A procedural act separate from the main lawsuit. |
| Appeal (istinaf) | Thirty days from notification for decisions open to it | Not every decision is open to appeal or appeal on points of law. |
| Constitutional Court / European Court of Human Rights | Thirty days / four months, respectively, if the conditions are met | Domestic remedies and the triggering event are determined separately. |
This table does not determine a personal final day for application. The calendar day, business day, electronic notification, holidays, the suspension of the period by an application and special provisions must be calculated separately. In short-term and deportation proceedings, the special two-month period tied to the impossibility of notification at the address must not be used as the initial lawsuit period. [K1; K3–K4; K6; K14–K15; K23–K26]
Legal support and the role of the attorney in the residence permit process
The legal follow-up of a residence procedure does not consist only of filling in the e-Residence form. Within the scope of the legal and consultancy work it has carried out since 1999, Güneş & Güneş Law Firm adopts a preparation and follow-up approach that assesses the person’s purpose of stay, legal status, family and documents together. The scope of the work to be undertaken, the authority of representation, the fee and the stages to be followed are determined according to the specific engagement.
Review of status, address and documents before the application
Entry and exit dates, existing permits, previous refusals, restriction records and the situations of family members are collected in the same chronology. The suitable permit type is determined on the basis of the genuine reason for stay. Before a lease or the acquisition of immovable property, an address and use review; and afterwards, a check of the consistency between the passport, family, education, income, health and foreign documents may be carried out. The deficiencies, the points that can be completed and the risks on which a decision must be made before the procedure are explained to the client.
Recorded follow-up from the application to the notification of the decision
A person-specific list of documents and the genuine life plan are prepared; delivery through the application, the appointment, a notary or the university and, when necessary, personal attendance are organized. A copy of the application file and the payment and delivery records are preserved. Requests for missing documents, SMS, e-mail, UETS, interviews and physical notifications are placed in the follow-up plan. The responsible person and the frequency of checks are determined according to the nature of the work; in critical periods, daily checks and prompt notification of important developments may be necessary.
Legal protection in refusals, cancellations and related procedures
The reasoning of the adverse decision, its supporting records and its notification are reviewed. The administrative application, the annulment action and the stay of execution are assessed without confusing them with the separate deportation, entry ban or administrative detention procedures. Evidence suited to the file is identified for the allegations concerning family and children, health, education, actual life in Türkiye and public order. After the decision, implementation, a new assessment and, if the conditions are met, subsequent routes of application are followed.
Clear communication, multilingual work and confidentiality
Within the scope of the legal services of our Antalya-based firm across Türkiye, communication can be conducted in Turkish, English, German and Russian with persons in Türkiye or abroad. The language and method of the meeting are determined in advance; whether a sworn translation or an official interpreter is needed for the relevant document is assessed separately. Legal options and risks are explained; the granting of a permit, the outcome of a lawsuit or the conclusion of a procedure within a fixed period is not promised.
The information and documents shared are handled for the purpose of legal assessment and carrying out the service undertaken, with regard to attorney professional secrecy and the principles of personal data protection. In the first stage, only necessary information should be shared; sensitive documents should be sent by the method communicated by our firm. For the first meeting, it is useful to prepare entry and exit dates, the current permit status, any refusal decision and notification, and the questions to be answered first.
Conclusion
The right approach for a residence permit in Türkiye is to match the person’s genuine purpose of stay with the suitable legal status and to explain that status with consistent documents. None of a lease, a title deed, a bank account, a marriage or an education record is, on its own, an assurance that takes the place of all the application conditions. As much as the length of the permit, the notification and document-completion obligations after the application are also important.
In an adverse decision, the first question is not only “can I apply again?” but which action was taken, how it was notified, what the current lawful stay is and which time limit is running. When the residence lawsuit, the deportation decision, the restriction code and administrative detention are handled separately, both the preparation of the application and legal protection can be built more accurately. Preserving the documents from the beginning and notifying changed circumstances in time help prevent disputes that are difficult to remedy later.

Frequently Asked Questions
Can everyone wait ninety days before getting a residence permit?
No. Depending on citizenship, the visa and entry history, the period of lawful stay may be shorter. The need to apply is determined according to the end of the current status; ninety days is not additional time for everyone. [K1; K3]
Does a domicile certificate (ikametgâh belgesi) take the place of a residence permit?
No. The address registration, the permit status and the place of residence within the meaning of civil law are different. The application form is also not a granted residence permit. [K1; K4; K12]
Can I make a normal residence application for Türkiye while abroad?
The general current practice proceeds through e-Residence and the relevant administration after entry into Türkiye. The consulate regime in the Law and the general process actually applied should be distinguished; special re-application or special status routes should be examined separately. [K2–K4]
When should I apply for an extension?
The application should be made in the period beginning sixty days before the end of the permit and in any case before the permit ends. After the period has passed, there is no automatic additional right of application for everyone. [K3–K4]
What happens if my appointment is given for a date after my visa period?
An application completed in a timely and proper manner differs from a record started late or left as a draft. The application and appointment document should be kept and the stated conditions fulfilled; the effect of failing to attend the appointment should be examined separately. [K3–K4]
Is making an appointment subject to a fee?
The official appointment is free. Fees, card, translation, notary, insurance and agreed legal service costs are different items. [K4; K16]
Can an attorney carry out all procedures without my coming?
Within the scope of authority, the attorney can follow the application and the file; however, conditions such as the foreign national’s presence in the country or the administration’s request for personal attendance, an interview and biometric procedures may continue. [K1; K4]
Does a notary grant a residence permit?
No. In the practice under which files can be submitted through a notary, the assessment and decision rest with the competent Presidency of Migration Management. [K9]
Is renting a home or depositing money in a bank sufficient?
No. These can explain housing and the financial situation; they do not take the place of the statutory purpose of stay. [K1–K4]
Does buying a home automatically provide residence or citizenship?
No. The dwelling, value, acquisition date, address and personal application conditions are examined. The investment and other conditions of citizenship are assessed separately. [K1–K2; K6; K20]
Does the USD 200,000 figure apply in the same way to all older title deeds?
Such a generalization cannot be made. The current administrative criterion, the acquisition date, the transitional regime, the share and the previous permit status must be determined. This guide does not present as an unconditional condition of acceptance a monetary threshold whose official text, for all current implementation details, could not be accessed. [K6]
If the home is in my spouse’s name, can I make the same application?
Your own ownership share and your family residence conditions are examined separately. A single title deed does not automatically provide property-based residence for the whole family. [K1–K2]
Can a false reservation be used in a tourist application?
No. Travel and accommodation documents must be genuine and consistent with the person’s plan and financial situation. A false document or statement also gives rise to legal risk. [K3–K4]
Is there a single amount that must be in the bank for a short-term permit?
A single official balance that applies in the same way to everyone should not be assumed. The source, continuity, family expenses and the requested period are assessed; the statutory income measure for family residence is different. [K1: Art. 35; K4]
Is there automatic residence specifically for retirees?
A pension can be useful for financial sufficiency; but the person must separately have tourism, home ownership or another genuine statutory reason for stay. [K1–K2]

Which period matters in a change of address?
Twenty business days is observed in an applicable address notification. Moving to another province or a change in the permit type may separately require a new procedure. [K4; K12]
How long must my passport be valid?
As a rule, it must be valid for at least sixty days longer than the requested residence period. Special exemptions or different conditions of the permit type are assessed separately. [K1; K4]

Suitable and uninterrupted coverage must be shown for the whole of the requested period. The arrangement in which consecutive one-year policies are used requires that the second period and the consistency of the dates also be prepared. [K3–K4]
Does open education or TÖMER registration provide student residence?
Open or distance education does not automatically provide student residence. As to TÖMER, an independent course is distinguished from preparatory education tied to a university program. [K2; K4]
Can I stay with my student card for six months after graduation?
The six-month period is a special condition of the short-term application because of graduation; it is not an automatic six-month continuation of the student permit. The Presidency of Migration Management explains that an application suited to the new purpose of stay is to be made within ten days after graduation. The two separate periods must be observed together. [K1–K2; K4]
Is long-term residence an indefinite work permit?
No. It can be a basis for applying for an indefinite work permit; separate conditions and a decision are needed for authorization to work. [K5]
Does divorce or the sponsor’s death affect family residence?
Yes. The ground for the permit and the conditions for transition to a short-term permit are reassessed. In divorce, the three-year family permit and the exception for violence, and in the sponsor’s death, the transition without a required period, are different. [K1: Art. 34]
Does a foreign child born in Türkiye automatically become a citizen?
No. The birth, the passport, the parents’ status and the child’s suitable residence procedures are assessed separately. The one-hundred-eighty-day arrangement is handled together with the parents’ valid stay. A birth certificate alone does not grant a right of entry into or exit from Türkiye. [K1; K4]
Is humanitarian residence granted for one year in every case?
No. The current regime provides for the periods to be determined by the Ministry. The old one-year wording should not be used without taking the amendment into account. [K7]
Is thirty days always given for a missing document?
A period of up to thirty days may be given; the period in the concrete notification and the document requested are what count. Failure to complete has an effect on the file being removed from processing (işlemden kaldırma). [K4]
If the application is not concluded within ninety days, is the permit deemed granted?
No. The review period, the completion of the file and the legal remedy against the administration’s silence are assessed separately; exceeding the period does not by itself create a permit. [K3–K4; K14]
If I do not open the UETS message, does the lawsuit time limit not begin?
That is not correct. An electronic notification being deemed made by law is not dependent on the message being opened. The records of receipt, statutory notification and the start of the lawsuit should be checked. [K15]
Can I stay abroad as long as I like with the application certificate?
No. Besides the approval, validity and payment documents, the condition of returning within fifteen days on each exit is important. In a longer stay, the visa provisions and other entry conditions apply. [K3–K4]
Are the 2026 card fee and the residence fee the same?
No. The 2026 document fee is 964 TL. The fee and, if any, the visa fee are calculated according to separate conditions. [K16]
Does a residence refusal mean a deportation decision?
No. The decisions may be separate; however, they may be present together in the same file. For each, the authority, the time limit and the request for protection are examined separately. [K1; K17]
If I file a residence lawsuit, can I automatically stay in Türkiye?
As a rule, a lawsuit does not, by itself, stay the execution of the action. The current lawful stay, the stay of execution and any separate deportation decision are assessed together. [K14; K17]
If I object to the administration, do I get sixty days again?
An application in accordance with Article 11 of the Administrative Procedure Law suspends the remaining part of the period. After an express or implied rejection, the remaining time continues; a new sixty days does not begin. [K14; K23]
Is there also sixty days in a deportation lawsuit?
No. The special lawsuit time limit against a deportation decision is seven days. It should not be confused with the general period for a residence procedure. [K6; K17]
Can every residence lawsuit be taken to the Council of State?
No. There are special finality provisions and conditions for legal remedies. The new route of appeal on points of law added by Law No. 7589 leaves lawsuits arising from Law No. 6458 outside its scope; the specific nature of the decision is also examined. [K24]
Does having a Turkish citizen spouse or child mean the lawsuit will certainly be won?
No. Genuine family life, the best interests of the child, the care relationship and the effect of the interference are made concrete. The Constitutional Court’s decisions finding a violation and finding no violation show that each case must be assessed with its own evidence. [K18–K19]
After a refusal, can I apply again immediately by choosing another category?
A different genuine purpose of stay and continuing lawful stay are also required. A new form should not be opened without examining the six-month application restriction for the same purpose and the earlier ground for refusal. [K4]
Which documents should I keep from the beginning?
The application form and its attachments, appointment and delivery records, payment receipts (dekont), documents of purpose and address, insurance, correspondence, requests for missing documents, UETS evidence records and complete copies of decisions should be preserved in the same file. This allows what was submitted, and when, to be shown more reliably later. [K3–K4; K15]
