Summary

The meaning of the green and red channel at the airport, undeclared goods, the Article 235/3 tax calculation, the distinction from smuggling, and objections to customs penalties.

Walking through the green channel at an airport is not just a choice of a faster exit; it is conduct that carries the legal consequence of stating that there are no goods subject to declaration. The red channel, by contrast, is used to notify customs of goods. The consequence of choosing the wrong channel varies with whether the goods fall within an exemption, their commercial character, whether they are prohibited or subject to a permit, and the way the event occurred.

This article addresses the two-channel system in passenger halls and the consequences of a breach of the declaration. The green or red control channels used in risk analysis for commercial declarations are a separate practice. The passenger green channel described here does not mean that no inspection will be carried out.

Why is walking through the green channel treated as a declaration?

A customs declaration is not made only by filling in a written form. Articles 175–178 of the Customs Regulation (Gümrük Yönetmeliği) provide for declaration by conduct in respect of certain goods. In the two-channel system, using the green channel is one of the ways in which the relevant goods are deemed declared. The fact that the passenger did not separately say “I have nothing to declare” does not remove the legal effect of the choice made. [1]

The green channel is the ordinary route for a passenger carrying goods that fall within the exemption. However, officers may inspect the baggage here too, and check whether the goods conform to the declaration. The fact that other passengers use the same channel, that the baggage has previously passed security screening, or that the product was bought in a duty-free shop does not replace customs inspection.

The legal literature likewise emphasizes that passing through the green channel is a form of declaration and that the nature of goods contrary to the declaration must be examined separately. This does not mean that every wrong choice automatically constitutes the same smuggling offense. [6]

What information should be given in the red channel?

A passenger carrying goods outside the exemption, or in doubt about special conditions, should approach the officer before completing the customs exit. The exact type, quantity and purchase value of the goods, their actual owner and the purpose of bringing them into Türkiye should be explained. A commercial sample, a company product or a device belonging to someone else should not be described merely as “personal effects.”

An invoice and payment record make the valuation review easier. Documents such as a prescription, a permit, a sample form, a company letter or a previous departure record may show which procedure the product is subject to. Following the officer’s assessment, taxation, normal import, placement in a warehouse, return shipment or a special-permit review may come into play. [2, 3]

Being in the red channel does not remove the consequences of an incomplete or untrue declaration. A product whose import is prohibited does not become free to enter because the red channel was chosen. Whether the declaration is correct and whether the product is eligible to enter Türkiye are two separate questions.

What distinction is made when goods contrary to the declaration are found?

Circular No. 2014/2 divides breaches of the passenger declaration according to the nature of the goods. The circular does not replace statutes; it is a source explaining how administrative practice is to be carried out. [3]

EventBasic assessmentPossible action

Exceeding the exemption limit is not the same as carrying commercial goods. For example, the value of certain products brought for family use may exceed the exemption, yet there may be no intention to sell. Conversely, a large number of identical low-priced products may be part of a sales operation. In either case, a conclusion should not be reached on price information alone.

How is the double amount in Article 235/3 of the Customs Law calculated?

For goods that fall outside personal effects and gifts and are found contrary to the declaration, or that belong to someone else but are presented by the passenger as their own, the article provides that customs duties are collected at double the amount and the goods are delivered to the owner. If payment is not made, the goods are deemed abandoned to customs. [2]

The measure here is not double the sale price or double the customs-cleared value of the goods. Nor can the provision be read as “two more times in addition to the normal tax” and converted automatically into a triple collection. Which taxes and financial obligations enter the calculation must be determined on the basis of the goods’ tariff and the applicable regime.

Under Circular No. 2014/2, the calculation under Article 235/3 uses the rates in the lists annexed to the Import Regime Decision, whatever the value of the goods. It is not correct to carry over directly into the calculation of the violation the single flat rate of 30% or 60% that applies to certain passenger goods properly declared. [3]

As a hypothetical example, if the total customs duties to be taken as the basis under this provision for a specific item have been correctly determined as TL 4,000, the double amount is TL 8,000. This is merely an example explaining the method of calculation; it cannot be applied to another product without examining the actual tariff, value, exchange rate and tax items.

Where payment is not made, the circular provides that abandonment procedures are carried out without applying the ordinary passenger warehouse period under Article 48/2 of the Customs Law. For this reason, the assumption that “my goods will wait three months in every case” is dangerous. The decision, the payment notice, the objection and, if any, the liquidation procedure must be examined together. [3]

When does a smuggling investigation come into play?

Article 6/4 of Law No. 5607 refers to the provisions of Article 3 where goods found contrary to the declaration are commercial in nature or their import or export is prohibited. Even so, which type of offense the event fits, the intent, the nature of the goods and the source of the prohibition must be determined separately. A conviction cannot be inferred automatically from every excess of quantity. [4]

In one event, an administrative file and a criminal investigation may exist side by side. However, an administrative act does not mean that a criminal offense has been proven, and the opening of an investigation does not show that every administrative penalty is lawful. The statutory conditions of each sanction, and the rules on sanctions for the same act, are assessed separately.

In particular, the simple distinction “a false declaration is only a fine, a failure to declare at all is necessarily imprisonment” is misleading. Using the green channel can already count as a declaration by conduct; the outcome depends not only on the word used but on the whole act. Nor can it be said that an untrue statement made in the red channel will never give rise to criminal liability.

How are wrong direction or a language problem assessed?

A passenger’s not knowing Turkish or not noticing the signs is not, on its own, a rule that removes all consequences. However, facts such as which channel was actually used, what was said to the officer, how the officer directed the passenger and the passenger’s purpose of transit travel may matter. The claim should be substantiated as far as possible with camera footage, flight records, time information and consistent statements.

In its decision of November 15, 2024, E.2022/3792, K.2024/4697, the 7th Chamber of the Council of State (Danıştay 7. Daire) examined a dispute concerning a transit passenger carrying mobile phones. In the lower-court decision, the penalty was annulled by taking into account the camera recordings, the officers’ direction of the passenger to the green channel and a flight to Baku the next day. The Council of State upheld the regional court of appeal’s decision as lawful. [5]

The decision does not lead to the conclusion that “a foreign passenger does not receive a penalty” or that “a transit ticket exempts every product.” Its value lies in showing that the declaration process must be examined through the actual course of events, not only through the concluding sentence of the report. In a similar claim, a request to preserve the footage should not be delayed, given the possibility that recordings will be deleted.

What records should be obtained during and after the inspection?

The report should contain statements on the type, number, model, serial number and condition of use of the products and on whom they belong to. The point at which the passenger was stopped, whether a prior declaration was made and the documents presented may also form the basis of the dispute. An explanation should be requested about any text that is unreadable or not understood; incorrect information and objections should be entered in the report.

If the stage of being questioned as a suspect has been reached, the assistance of defense counsel and any necessary interpreter support are procedural safeguards separate from the ordinary exchange of information at customs. Instead of a ready-made account supplied by someone else, the actual course of events and the existing documents should be explained.

Against the taxes, penalties and administrative decisions under the Customs Law, Article 242 provides an administrative objection route within 15 days from notification. An application against a judicial seizure, on the other hand, is subject to the provisions of criminal procedure. It is not correct to use the same petition and the same time limit for both. Asking for camera footage, talking to the office or obtaining information by telephone does not stop these time limits by itself. [2, 7]

Conclusion

The choice between the green and red channel is part of the passenger’s declaration process. The right approach is to determine the type of the goods and their actual intended use in advance, to give information before exit if there is doubt about an exemption or permit, and to document the procedure carried out. When a dispute arises, the commercial character of the goods, the tax calculation, the actual direction given and the route of application should be examined separately.

Frequently Asked Questions

Does walking through the green channel mean making no declaration at all?

No. For the relevant passenger goods it is treated as a declaration by conduct and states that there are no goods subject to declaration.

Can my suitcase be searched in the green channel?

Yes. The green channel does not remove customs control. The legal conditions of search and inspection apply separately.

If I go through the red channel, will I necessarily pay a penalty?

No. On the basis of a correct declaration, an exemption, tax or another customs procedure may be applied. Making a declaration is not in itself a violation.

Does every item exceeding the exemption limit become the subject of a smuggling offense?

No. Commercial character, prohibited status and the other elements of the relevant offense are examined separately. An administrative consequence is also possible.

Is the Article 235/3 penalty double the product price?

No. The provision calls for customs duties to be collected at double the amount. The tax base and rates must be verified on the basis of the specific goods.

Is it enough to say I entered the green channel by mistake?

It may not be enough on its own. The direction given, the place and time of the event, the camera recordings and the consistency of the passenger’s statements matter.

Does a transit ticket prevent a penalty from being applied?

Not automatically. The purpose of transit, the intention to bring the goods into Türkiye and the actual manner of passage are examined together with the specific event.

If I pay the tax, does the criminal investigation close?

Not always. The conditions of an administrative tax payment and of a criminal investigation differ; effective repentance, where applicable, is also subject to separate provisions.

How long do I have to object to the penalty?

For an administrative objection under Article 242 of the Customs Law, 15 days from notification are provided. Judicial decisions and the later litigation stage involve separate time limits.

If the officer had me leave the goods, can I collect them after three months?

That conclusion cannot be reached until the type of procedure is determined. The ordinary passenger warehouse, abandonment under Article 235/3 and judicial seizure are subject to different rules.
