Our practice areas

Legal services for the health sector

Practice areas determined by the nature of the institution, the scope of the activity and the needs of the file.
01

Establishment, Investment and Operations

Opening and operating permits for healthcare institutions

Legal planning for hospitals, medical centers, clinics and other healthcare institutions.

Depending on the type of institution, the legal framework for planning, licensing, operating permits, staff and physical conditions is assessed. Legal support is provided for application documents, correspondence with authorities, changes in activity and inspection processes. Not every healthcare institution is subject to the same permit regime.

Purchase and sale of healthcare facilities and companies

Transaction support from the first meeting through legal review, closing and post-transfer.

In a share or asset sale, licenses and permits, real estate rights, debts, contracts, staff relations and existing disputes are reviewed. Confidentiality agreements, letters of intent and sale agreements are addressed together with the required approvals, handover, transition period and post-closing responsibilities.

Preventive law and corporate counsel

Ongoing support in day-to-day operating decisions, contracts and corporate governance.

Powers of representation and signature, management decisions, partnership relations, contract standards and a legal follow-up calendar are organized. For investors abroad, transaction follow-up and reporting within the scope of authority can be provided. Representation on, or taking a role in, the board of directors is assessed separately in terms of liability and conflict of interest.

Patient complaints handled within the institution, keeping incident records, preserving evidence, notifying insurers and directing matters to legal review are organized. Rather than altering clinical or financial records after the fact in a manner inconsistent with the facts, record integrity is maintained.

Physician, staff and service contracts

Employment relations, outsourcing and organization of medical services.

Contracts of physicians and other healthcare professionals, pay and working arrangements, confidentiality, non-compete and termination provisions are reviewed. In outsourcing relationships such as laboratory, imaging, maintenance, software and other services, duties, authority and liabilities are clarified; the actual nature of the relationship is assessed rather than relying only on the name given to the contract.

02

Health Tourism and International Transactions

Health tourism authorization and compliance

Legal assessment of operating conditions for healthcare facilities and intermediary companies.

In international health tourism activities, the role of the institution, its authorization certificate and the obligations that apply are reviewed. Support is provided for applications, contracts, patient information, registration and inspection processes. The authority and responsibilities of a treating institution and of an intermediary company are addressed separately.

Foreign patient and intermediary company contracts

Scope of service, fees, cancellation, refunds and post-treatment follow-up terms.

The scope of treatment, information and translation, payment, transport and accommodation-related services are clarified in contracts. The parties’ obligations in complications, additional procedures, patient complaints and communication after return to the home country are assessed; no commitment is given as to the medical outcome.

Advertising, social media and digital communication

Limits of promotion specific to health services and legal review of content.

Websites, social media, patient reviews, use of images, campaign wording and promotion through third parties are assessed. Patient consent and the lawfulness of the promotion are reviewed separately. The rules that apply to activities aimed at domestic and international health tourism are also determined separately.

Cross-border disputes and representation

International legal coordination for healthcare services connected with Türkiye.

Applicable law, competent authority, service of documents, evidence and translation needs are assessed. Representation within the scope of authority is provided in legal proceedings in Türkiye; for matters involving foreign law or representation abroad, the need for coordination with authorized advisers in the relevant country is determined.

03

Health Data, Technology and Products

Personal health data and patient privacy

Legal compliance for processing, sharing and protecting health data.

Notices, appropriate legal grounds, explicit consent where required, access authorizations, retention and destruction, service provider agreements and data breach processes are assessed. Transfers abroad, remote access and cloud use are reviewed separately. It is not assumed that every data processing activity must rest solely on explicit consent.

Digital health, remote services and artificial intelligence

Permissions, data, contract and liability framework for health software.

Authorization, user information and the roles of service providers are reviewed in remote health services and platform models. Software licensing, access, data portability, exit from the system and cyber incident responsibilities are addressed. In AI-supported applications, human oversight and assessments where medical device status is at issue are also carried out separately.

Medical device, pharmaceutical and supply relations

Legal processes among manufacturers, importers, distributors and healthcare institutions.

Depending on the classification of the product, registration, permit, market placement, promotion and traceability obligations are reviewed from a legal standpoint. Supply, servicing, warranty, product safety, recalls and liability disputes are assessed. Technical conformity and quality testing require the work of competent specialists.

Clinical research and scientific collaborations

Research agreements, data use and the obligations of the parties.

Agreements between sponsors, researchers, institutions and other parties are reviewed with regard to the legal dimension of ethics and administrative permits, information provided to volunteer participants, data sharing, publication and intellectual property rights. Legal services do not replace scientific evaluation or ethics committee approval.

04

Patient Rights and Disputes

Patient rights and informed consent

Information, medical records, privacy and application processes.

Information and consent documents relating to medical intervention, access to records, patient complaints and rights in the course of care are assessed. The consent form is reviewed together with the specific procedure and the explanations given; it is not treated as a document that alone removes all responsibility.

Inspections, administrative sanctions and professional proceedings

Legal support in institutional decisions, operating restrictions and professional investigations.

Inspection reports, requests for a defense statement, sanction decisions and notification dates are reviewed. Administrative applications, litigation and interim legal protection options are assessed. The conditions of criminal and disciplinary proceedings and the required permit procedures are addressed based on the file.

Fees, SGK, insurance and litigation

Collection, reimbursement, service fees and disputes arising from contracts.

Documents relating to patient fees, refund requests, private health insurance, Social Security Institution (SGK) contracts and deductions are reviewed. The competent authority, route of application, mediation requirement and time limits are determined. Depending on the circumstances of the specific case, support is also provided for violence against healthcare workers and other criminal law applications.

Violence and threats against healthcare workers

Application, evidence and representation processes in incidents of violence, threats and insults.

Incident reports, camera footage, witnesses and medical documents are reviewed. Complaints, criminal investigations, lawsuits and protective measures suited to the specific incident are followed. The respective functions of internal reporting and judicial applications are determined separately.

Physicians and healthcare professionals

Employment relations, professional liability, defense and insurance applications; the parties’ positions and relevant records are reviewed together.

Medical Malpractice Claims and Disputes Arising from Medical Practice

We assess alleged medical errors in diagnosis, treatment, surgical intervention and follow-up processes through patient records, informed consent, expert opinions and court-appointed expert reports. In patients’ and relatives’ rights claims, and in the defense needs of physicians and healthcare institutions, we provide legal support and representation after a conflict-of-interest check.

Allegations of diagnosis, treatment and follow-up errors

Review of every stage of the intervention through medical records.

Allegations of delayed or incorrect diagnosis, drug administration, surgical intervention, referral and post-operative follow-up are addressed. Medical standards, fault, damage and causal link are reviewed, where needed with the assessment of specialists from the relevant field.

Distinguishing complications from faulty practice

Assessment of how the risk was explained, recognized and managed.

Calling an outcome a complication does not by itself end the assessment of liability. Foreseeable risks, the information given to the patient, precautions, timely intervention and the follow-up process are reviewed together. Not every adverse outcome is automatically considered malpractice.

Informed consent, records and evidence

Procedure-specific information, retrieval of records and preservation of evidence.

Consent documents, discharge summaries (epikriz), operative and anesthesia records, nursing observations, tests, images and correspondence are assessed to the extent relevant to the event. Gaps in records, inconsistencies and, where necessary, the need for evidence preservation are determined. The content of the signed form and the explanations actually given are reviewed together.

Objections to expert and specialist reports

Review of reports against medical records and the specific claims.

The field of expertise of the report, the records it relies on, its method, its reasoning and its adequacy in answering the questions are reviewed. Deficiencies and inconsistencies are made specific; where necessary, a supplementary report, a new expert examination or a specialist opinion is assessed.

Liability of hospitals, physicians and insurers

Separate review of medical practice, organization and insurance relationships.

The physician’s intervention and the hospital’s staff, equipment, organization and service processes are assessed separately. The period, scope and notice requirements of the professional liability policy, its exclusions, and disputes with the insurer are addressed. Possible claims are determined according to the parties’ concrete legal position.

Compensation, defense and routes of application

Heads of loss, competent authority and time limits determined for each file.

Treatment and additional treatment expenses, loss of income and earning capacity, care needs, claims of relatives in the event of death, and non-pecuniary damage are reviewed according to documents and circumstances. Depending on the nature of the public or private health institution, the status of the parties and the claim, administrative, legal, criminal and professional processes, as well as any required application or permit procedures, are determined separately.

Aesthetic procedures, dental treatment and health tourism

Scope of service, statements, additional procedures and post-treatment follow-up.

The promised service, the contract, information, consent, the need for additional procedures and follow-up after return to the home country are assessed together. Fee and refund disputes and claims of medical liability are addressed separately; the same legal characterization is not assumed for every procedure.

Invoices, supplementary charges and refund requests

Private Hospital Fees and Objections to Healthcare Costs

We review amounts in invoices of private hospitals, clinics and other healthcare providers that are alleged to be high, undisclosed or unlawful, and provide legal support in objection, complaint, refund and litigation processes.

Objections to private hospital invoices and high charges

Comparison of the price disclosed in advance with the amount collected.

The detailed invoice and service breakdown, price quote, package scope, fee information, payment records and whether the service was actually provided are reviewed. The unlawfulness of an amount alleged to be high or excessive is assessed based on SGK and insurance coverage, the contract, the applicable fee rules and the specific service. A high amount alone is not presented as an automatic right to a refund.

Supplementary charges, duplicate collection and charges outside the package

Review of undisclosed, re-collected or legally questionable charges.

The SGK contract status, the patient’s coverage, the type of procedure and the regulations in force on the date of the procedure are determined. Services and persons for which no supplementary charge may be collected, the applicable limits and information requirements are reviewed. The distinction between an emergency department visit and services within the scope of an emergency condition is taken into account; it is not assumed that every emergency department visit falls under the same fee regime.

Objection, complaint, refund and litigation follow-up

Determination of the appropriate route to have the charge explained, corrected or refunded.

A written application to the hospital, a request for documents and an account explanation are assessed. Depending on the conditions, complaint routes to the SGK or to the Provincial Health Directorate (İl Sağlık Müdürlüğü) and consumer application routes are evaluated. The route — Consumer Arbitration Committee (Tüketici Hakem Heyeti), mediation or litigation — is determined by the nature of the dispute and current monetary thresholds. An administrative complaint does not replace a refund request and does not in any case suspend litigation time limits.

Private insurance, pre-authorization, advance payment and cancellation disputes

Clarifying payment responsibility before and after treatment.

Refusal of pre-authorization or payment, policy exclusions, the difference requested from the patient, advance payments, deposits and refunds for canceled procedures are reviewed. The responsibilities of the hospital and the insurer are assessed separately. Where no payment document has been issued, no service breakdown has been provided, or pressure to collect payment is alleged, the appropriate legal route and evidence needs are determined.

Preparing for a consultation

  • Brief summary of the request, the parties and key dates

Before your consultation

Frequently asked questions about the health sector

Whom do you provide legal support to?

We assess applications from healthcare institutions, physicians, healthcare professionals, investors, health tourism companies, and technology and product suppliers. Applications concerning patient rights are also reviewed. Joint representation of opposing parties in the same dispute is not accepted.

Which matters are reviewed when opening a healthcare institution?

The type of institution, the scope of activity, planning and permit conditions, location and use rights, and the staff and contract structure are assessed together. The required documents and the competent authority are determined according to the specific activity.

When buying a healthcare facility, is the license also transferred automatically?

A share transfer, a business transfer, a real estate sale, and a license or operating permit do not have the same legal consequences. Without reviewing the required approvals and amendment procedures, one should not proceed on the assumption of an automatic transfer.

In health tourism, are the facility and the intermediary company subject to the same obligations?

No. Providing treatment and intermediation are different roles. The institution’s scope of activity, authorization, patient contracts and responsibility within the organization are assessed separately.

Does obtaining consent for a patient photo always make sharing lawful?

Consent is one of the elements to be assessed. In healthcare promotion, the advertising rules, privacy, personal data and the content of the sharing should be reviewed together.

Can health data be held on software located abroad?

The nature of the data, the reason for processing, the transfer mechanism, the role of the service provider and the security conditions should be reviewed. Access from abroad is included in the assessment as well as the server location.

Is every adverse treatment outcome malpractice?

No. Medical standards, information, the intervention and follow-up process, the management of complications, and damage and causal link are assessed together. A medical expert review may be needed for a legal assessment.

What documents should I prepare for the first consultation?

A summary of the matter, the parties, key dates and directly relevant documents provide an adequate starting point. For corporate matters, permits and contracts; for patient disputes, the relevant medical records and correspondence help the assessment. The method of sharing documents is determined separately.

Can I consult online from abroad?

Yes. Zoom or WhatsApp video calls can be arranged. Please state your country and city in the application; when the appointment is confirmed, the local time in that city and the time in Türkiye are clarified together. In-person consultation at our office in Antalya is also possible.

Does corporate counsel cover technical or medical audit?

Legal advice is not a medical decision, a technical conformity assessment, a scientific evaluation or an independent financial audit. Where needed, coordination with the relevant specialists is provided; the scope of the service is determined separately.

Does sending documents or holding a consultation mean that the matter has been accepted?

A consultation, correspondence or document sharing alone does not constitute acceptance of the matter. Acceptance is confirmed once the scope, fee, contract, required authorizations and documents, and the obligations agreed upon have been clarified. The legal consequences of a relationship that has actually been established are reserved.

When will I receive a response to my request, and how is the fee communicated?

We will respond to your request within 48 hours. The scope of the consultation and, where applicable, its fee are communicated before your appointment is confirmed. For urgent or time-limited legal matters, call our main line directly; please state any specific time needs in your application.

Does the occurrence of a complication completely remove liability?

It cannot be said that it alone removes liability. The disclosure of the risk, the necessary precautions, the timely recognition of the complication and its appropriate management are also assessed.

If the consent form has been signed, can a claim still be pursued?

A signature does not by itself prevent an application. The scope of the information, its specificity to the procedure, the patient’s circumstances and medical practice are assessed together.

How is a high invoice from a private hospital reviewed?

First, the service breakdown, price information, contract, payment documents and the scope of SGK or private insurance coverage are compared. For fees that are undisclosed, duplicated or contrary to applicable rules, the appropriate objection and refund route is determined.

Is every fee collected in an emergency department unlawful?

Not every emergency department visit falls within the same scope. The nature of the emergency condition, the procedures provided, the records, the insurance status and the applicable rules are reviewed. SGK statements and application routes concerning services provided within the scope of an emergency condition are also assessed separately.

Does complaining about the hospital secure a refund of the fee?

A complaint may lead to an inspection or sanction review; a refund may not occur automatically. To obtain a refund, an appropriate consumer application or judicial route suited to the claim must be pursued separately.

Does payment having been made prevent an objection to the invoice?

Payment alone does not eliminate every objection. The basis of the amount, the documents, any settlement or release texts, and the time limits are assessed together.
