Summary

Summons notice, the ten-day period, direct apprehension, preparing to surrender and enforcement applications for a final prison sentence; a guide with documents and a Court of Cassation decision.

When a prison sentence becomes final, the conviction becomes capable of enforcement. After that, the court’s judgment is sent to the Office of the Chief Public Prosecutor, and, depending on the nature and length of the sentence, a summons notice or an arrest warrant is issued. It is not mandatory in every final prison sentence for notice to be served first and for the person to be given a period in which to surrender. The correct procedure is determined by examining together the finality record, the nature of the offense, the judgment and any decisions affecting enforcement. [1]

For the convicted person and the family, the first need is not only to learn when the person will enter prison. It must also be made clear which decision has become final, to whom and when notice was served, whether the legal remedy that may be pursued stops enforcement, and how special conditions such as health are to be documented.

A conviction and finality are not the same thing

With which documents is the finality annotation checked?

Under Article 4 of Law No. 5275, convictions cannot be enforced unless they have become final. The court’s announcement of a prison sentence at the hearing does not mean that the sentence becomes final at that moment. The legal remedy to which the decision is subject, the filing period, the service of notices and the outcome of the appellate review are of importance. On the other hand, an order for pretrial detention made during the proceedings can be applied on a different legal basis. The existence of a non-final judgment does not by itself bring the detention to an end. [1][2]

In a finality review, the reasoned judgment, the operative part, the service records for the defendant and defense counsel, the decisions of the regional court of appeal (istinaf) and, if any, of the Court of Cassation, the finality annotation and the letter sending the file to enforcement should be read together. Where decisions have been made on more than one offense in particular, not all of the judgments may become final on the same date. The part sent to enforcement and the appellate review that is continuing must be kept apart.

If there is a defect in service, what procedure is requested?

If the decision is deemed final without having been properly served, the correction of the erroneous finality and the necessary appellate steps are assessed together. Defective service, the date of learning and restoration of the prior status (eski hâle getirme) are not concepts that can be used in place of one another. Which route applies depends on the nature of the act that started the period. For this reason, instead of simply saying “I did not see the decision”, the service receipt, address information and records showing the date of learning should be submitted.

The details of this distinction are explained in our article on defective service and restoration of the prior status in criminal proceedings. The fact that a petition has been filed does not show that an existing arrest warrant or enforcement steps are automatically suspended.

What does the enforcement prosecutor’s office do?

The enforcement of a final judgment is supervised and monitored by the public prosecutor. It is determined to which person, which provision and which part of the sentence the judgment relates, and an enforcement record is opened. The subsequent service and apprehension steps belong to a separate stage from the decisions made during the proceedings. [1, Arts. 5 and 20]

An error in the enforcement file does not always mean that the conviction is wrong. For example, although the judgment is correct, the period of pretrial detention may not have been carried over into the calculation. Conversely, it cannot be expected that the enforcement office will apply a new reduction or alternative sanction not found in the judgment. The step to which the request is directed determines the authority to which application is made.

The summons notice and the ten-day period to surrender

The period is tied to service of the summons notice

Article 19(1) of Law No. 5275 provides that the public prosecutor issues an arrest warrant against a convicted person who does not come forward within ten days of service of the summons notice sent for enforcement. Arousing suspicion of flight or of being about to flee is also assessed under the same provision. It is not correct to equate this period with the day the reasoned judgment was written, the date of the finality annotation or the day the summons papers were prepared. [1]

When the summons papers are received, the envelope, the service receipt and, if any, the electronic service record should be kept. Establishing the date from the document, rather than relaying it orally within the family, can prevent even a one-day miscalculation. In calculating the last day, the relevant service and period provisions must be assessed in the specific file; general calendars found on the internet do not take the place of official records.

A change of address must be notified

Article 20(3) of the Law regulates service of the summons notice at the address shown in the judgment and the convicted person’s obligation to notify the court or the Office of the Chief Public Prosecutor of a change of address. Otherwise, there is a special provision on the validity of service made to the address in the judgment. For this reason, merely having moved, or not living at the old address, does not show that service is automatically invalid. [1]

Living abroad also does not remove the enforcement of a final sentence. The foreign address, earlier notifications, the method of service and the enforcement steps that may be encountered on entering Türkiye are part of the legal preparation. An application by relatives can help in gathering information; however, authority to represent and to access the file must be arranged separately.

In which cases is an arrest warrant issued directly?

The thresholds for intentional and negligent offenses differ

Article 19(2) of Law No. 5275 provides for a direct arrest warrant for the enforcement of prison sentences of more than three years for intentional offenses and more than five years for negligent offenses. It is important that the limit is set as “more than”. However, falling below the limit does not mean that other legal grounds, such as flight or suspicion of flight, will be disregarded. [1]

Where there is more than one judgment, the assessment should not be made solely on the last decision that has reached the family. Without seeing the other sentences, the consolidation decision (toplama kararı) and the relevant records, it cannot be said that “a summons will certainly come”. In addition, for imprisonment converted from a judicial fine, the rule in Article 19(3) that a summons notice is sent first is assessed together with the special enforcement process in Article 106.

Apprehension must not be confused with pretrial detention

Apprehension for the enforcement of a final sentence is not the same act as pretrial detention ordered during an investigation because of suspicion of flight. For this reason, a general petition prepared to object to pretrial detention does not in every case resolve an error in an enforcement apprehension. The finality of the judgment, the enforceability of the sentence, the matching of the person and any stay decision should be examined directly.

If there is a claim of the wrong person or of a sentence that has already been enforced during the apprehension, the decision and official records showing this must be submitted without delay. The basis of the objection should be a deficiency in the legal conditions of the specific act, not the fact that the apprehension weighs heavily on the person.

What preparation should be made before surrender?

The legal file and the personal needs file should be kept separate

The legal file should contain the final judgment, the summons notice, earlier dates of custody and pretrial detention, other judgments, existing applications and any decisions staying enforcement. The personal needs file may contain identification, medications in use, current health reports, accessibility needs and the contact details of a relative to be notified. The institution’s current practice on items and medications that will be accepted should be learned separately.

The existence of a health report does not by itself mean that the obligation to surrender is lifted. Continuing treatment in the institution, referral to hospital, postponement of enforcement and enforcement at home are assessed differently. If necessary, a reasoned application is made before surrender and the outcome of the decision given on it is followed.

Where to surrender should be confirmed from the papers and the enforcement unit

The place of application shown in the summons notice and the Office of the Chief Public Prosecutor conducting the enforcement should be taken as the basis. A convicted person going, on his or her own assessment, to any open penal institution does not create an acquired right as to the choice of institution. Confirmation of the procedure and of the direction given should be obtained from the relevant enforcement unit.

At this stage, legal support serves to manage the period, the competent unit and the preparation of documents together. Making arrangements for family and working life is an understandable need; but these do not of themselves provide an additional period for surrender. For postponement, the conditions in the law must be shown with concrete documents.

Direct entry to an open prison and the “in and out” expectation

Assignment to an open institution is a separate legal review

Issuing a summons notice and enforcing the sentence directly in an open institution are not the same decision. The type of offense, the amount of the sentence, recidivism, special exceptions and the relevant regulations are assessed separately. Surrendering within the time limit does not by itself guarantee admission to an open institution. For this reason, the conditions for transfer to an open prison require an independent review.

Records and decision processes are completed for supervised release

The colloquial phrase “in and out” is not an independent enforcement right defined by law for everyone. The applicability of supervised release depends, besides the relevant periods, on the status of the institution, good conduct, a request and the competent decision process. In particular, the minimum period condition in the institution added by Law No. 7550, and the transitional provision tying that condition to the date of the offense, must be checked separately. [5]

For this reason, it cannot be said that two people who receive the same sentence will be released on the same day. Earlier pretrial detention, different judgments, provisional provisions and decision processes can change the result. The conditions for supervised release should be assessed together with the official sentence calculation sheet.

Making an application does not of itself stop enforcement

Article 98 of Law No. 5275 assigns the court that gave the judgment to questions about the interpretation of the judgment or the application of a later law under TCK 7, and the enforcement judgeship (infaz hâkimliği) to doubts about the calculation of the sentence and about whether the sentence can be carried out. Applications within this scope do not postpone enforcement automatically. The court or the enforcement judgeship may, according to the particulars of the case, decide on postponement or a stay. [1]

For this reason, the petition should give reasons not only for the underlying unlawfulness but, where necessary, also for the need for interim protection. For example, if the release date calculated is already past because of a deficiency in set-off, the missing days and supporting records must be shown, and the effect of the delay on liberty explained. An objection to the sentence calculation sheet and an extraordinary application directed at the judgment are not the same file procedure.

Court of Cassation decision: For which issue is the effect of service examined?

Criminal General Assembly, 20.11.2024, E.2021/222, K.2024/360

The Criminal General Assembly of the Court of Cassation (Yargıtay Ceza Genel Kurulu) examined whether service by public announcement made at the enforcement stage interrupts the limitation period of the sentence. The majority did not accept service by public announcement in the specific case as an act interrupting limitation under TCK 71, and decided to quash the decision concerned and that the sentences were not to be enforced. Four members dissented, taking the view that service by public announcement interrupts limitation. [4]

The importance of the decision for this article is that it shows that the preparation of the summons papers, their service, the issuing of an arrest warrant and the person’s actual apprehension are different acts. The decision cannot be read to mean that all summons notices are invalid unless handed over in person, or that failure to comply with a summons will have no consequence. The dispute concerns the nature of the act that interrupts limitation. Moreover, since provisions from the period of the former criminal code were also involved in the case, the result cannot be carried over, with the same period, to every file today.

Conclusion

In a final prison sentence, the first thing to do is to verify the enforcement papers and the dates. The period in the summons notice, the conditions for direct apprehension, the status of the institution and any application for postponement should be examined separately. The difference between making an application and stopping enforcement must be kept in mind; the plan for surrender and release should rest on decisions and records, not on oral information.

Frequently Asked Questions

My prison sentence has become final; will a summons notice necessarily come to my home?

No. The provisions applicable to the file are examined, above all the conditions for direct apprehension in Article 19(2) of Law No. 5275. It should not be assumed that a ten-day summons will be issued first in every judgment.

Do the ten days in the summons notice start from the date of finality?

The ten-day period in Article 19(1) is tied to service of the summons notice. The date on which service legally took effect is determined from the relevant documents.

Does consulting a lawyer stop the time to surrender?

No. Holding a meeting, issuing a power of attorney or filing a petition does not of itself provide a stay. A competent decision affecting enforcement must exist separately.

If I have a health report, may I not go to prison?

The existence of a report is not sufficient on its own. The nature of the illness and the statutory procedure are assessed, and the competent authority must decide. The existing obligation to surrender is checked separately in light of this.

Is the time I spent in pretrial detention taken into account in the surrender process?

If the conditions for set-off exist, earlier restrictions on liberty affect the enforcement calculation. The start and end dates must be documented, and whether they have been correctly carried into the official calculation must be examined.

Are service of the summons and service of the judgment the same act?

No. Service of the judgment matters for appellate remedies and finality; service of the summons notice matters for the call to enforcement. An error in one is not deemed cured by the existence of the other.
