Summary

How are inherited gold, jewelry and a bank safe deposit box received? Opening, tax officer, proof of ownership, valuation and practice under a Court of Cassation decision.

With inherited gold, jewelry and the contents of a bank safe deposit box, the first problem is to whom the items belong as much as where they are. The death of the person who rented the box does not by itself prove that everything inside belongs to that person. What is involved may be jewelry kept at home, a spouse’s personal property, an item entrusted by a third party or an estate asset. Identification, ownership and delivery are separate stages. [1]

How Are the Items Protected and Identified?

After a death, the items that exist are, where possible, recorded in a lawful and impartial manner. Type, number, weight, purity, serial number, photograph and location are recorded. A vague statement such as “some gold” later leads to a dispute over value and quantity. The persons present at the opening or count and the person to whom the items are handed over should be shown in the record.

If there is a risk that the items will be removed or lost, the estate protection measures under Article 589 et seq. of the Turkish Civil Code (TMK), sealing, an inventory or appropriate interim protection are considered. It should be borne in mind that this application is not the same as the special procedure concerning the preparation of an official inventory and liability for debts. [1]

The Box Agreement Does Not Show Ownership of Everything Inside

The fact that a bank safe deposit box was rented in the name of the deceased does not make it certain that every piece of jewelry, document or sum of money inside belongs to the deceased. A spouse, a family member or a third party may claim that items were entrusted or are personal property. Likewise, joint authority to access the box does not by itself prove that the items belong half and half under co-ownership in shares. The box agreement shows the access relationship; ownership, on the other hand, calls for the ground on which the items were acquired and the evidence. [1] [4]

As for jewelry and valuables found at home, the place where they are found is likewise not decisive by itself. The facts of a wedding, gift, purchase, inheritance or entrustment are examined separately. Without reviewing current case law suited to the case, a general conclusion such as “all the jewelry belongs to the spouse” or “every item at home enters the estate” cannot be drawn. Invoices, payment records, photographs, correspondence and witness statements are assessed together with the legal ground of acquisition.

Special Tax Procedure for Opening the Box

Article 23 of the Inheritance and Transfer Tax Law (VİVK) provides that, on the death of one of the holders of a rented safe deposit box, except for an identification carried out by a civil judge of peace (sulh hâkimi), the box may not be opened unless an authorized officer of the tax office is present, and its contents may not be taken by the heirs, representatives or attorneys-in-fact before the contents have been identified. For this reason, the agreement of all the heirs or possession of the key does not require the bank to open the box by bypassing the procedure. [2]

The bank reviews the documents of heirship and representation and carries out the preparation of the procedure with the relevant tax unit. The date, the persons who will be present, the necessary documents and the way the contents will be identified should be clarified in advance. If the key is lost, the technical opening, the expenses and the record arrangements are determined separately. Operational details of this kind may vary according to the bank’s specific practice; a single bank procedure should not be presented as though it were a general statutory provision.

What Details Should the Identification Record Contain?

Type, Quantity and Distinguishing Feature

A statement such as “various gold items were found” is weak for later return or value calculation. The type of the item, its number, its visible purity or marking, the weighing information, its stones, its serial or document number and its condition should be recorded. Features that require technical valuation are left to expert examination; an exact purity or market value is not written down by judging with the eye. Photographs are matched with the numbers in the record.

If cash is found in different currencies, the amounts are shown separately. If a document, an instrument or a digital storage device is found, its legal nature is examined separately. The discovery in the box of an old document relating to an immovable does not prove that the immovable still belongs to the deceased; a registry search is needed. Likewise, the discovery of a hardware wallet requires a separate investigation of the crypto-asset it contains and of the authority of access.

Record of Delivery and Safekeeping

To whom, under what authority and for what purpose the identified items were handed over should be explained. Delivery to an heir for temporary safekeeping does not mean that those items are allocated to that heir in the partition. If packaging, sealing or a secure storage method has been used, it is shown in the record. The later duty of the recipient to account for and return the items should not be left unclear. [1]

An Ownership Objection Differs from a Partition Dispute

In an ownership objection, the question in dispute is whether the item forms part of the estate. In a partition, by contrast, the discussion concerns to which heir property accepted as belonging to the estate will be allotted. The value of a bangle that the spouse claims was given to them as a gift should not be divided as though it were the common property of all the heirs before that claim has been resolved. The evidence of the person making the claim and the statements of the other side are assessed together.

The identification procedure does not in every case amount to a definitive determination of ownership. Recording in the record that an item was found is different from resolving an ownership dispute. Selling the item while the dispute continues may make a request for return of the original item and the evidentiary position harder. If there is a concrete risk, an appropriate request for protection is considered; the right of a third person cannot be eliminated by the oral agreement of all the parties. [1] [3]

Valuation, Tax and Partition in Kind

The gram value of gold and the total value of a piece of jewelry are not the same calculation. Workmanship, the nature of the stone, the brand or a historical feature may affect the economic value. The tax valuation and the value the parties will accept in the partition serve different purposes. The date and method of valuation should be written down; an old expert appraisal does not make today’s sale value definitive. [2]

If, hypothetically, one of the pieces of jewelry left to three heirs is allotted to one person because it is a family heirloom, how the other shares will be balanced is clarified. The sentimental importance of a piece of jewelry does not by itself change the calculation of monetary value; if the parties make a different agreement, that intention and its scope are written down. Whether items found later are included in the agreement is determined separately.

If the Person Who Took the Items Does Not Hand Them Over

First, which items were taken, when, under what authority and where they are now located is made concrete. The conditions of a request for return, rendering of accounts, compensation or another claim relating to the inheritance differ. Filing a criminal complaint is not in every case a route that secures return in kind; criminal liability is examined separately in terms of its elements. Whether the legal claim rests on behalf of the estate or on a claim of personal ownership affects the alignment of the parties. [1] [4]

Where there is a danger that evidence will be lost, preservation of evidence and appropriate interim protection are considered. Documents such as camera footage, the box access log or the delivery record should be requested early. However, entering people’s private space without permission to take items or records is not a necessary result of the legal need for proof. Properly obtained documents and protective routes should be used.

At the end of the file, the delivery, sale, safekeeping or dispute status of each item on the identification list is shown. The emptying of the bank safe deposit box does not by itself show that all ownership and tax issues have been resolved.

How Does an Heir Abroad Organize the Opening of the Box?

In the first stage, it is determined at which branch of the bank, under which agreement and in whose names the box was rented. Even if no key is found, it is possible to investigate the box relationship; loss of the key may affect the technical method and the cost of the opening. The bank is asked for the box agreement, information on any joint lessee or authorized person, and preservation of the rent and visit records. It should not be assumed that an account inquiry alone shows all rented safe deposit boxes.

For a foreign heir, the death record, the identity link and a usable certificate of inheritance are prepared. Whether a power of attorney issued abroad covers box identification, signing the record, receiving the items and, where necessary, partition is examined separately. It should not be assumed that a person authorized for identification can personally receive the entire contents. If there are several heirs and a surviving joint lessee, the arrangement for attendance or representation is put in writing with the bank in advance.

If the decedent was a foreigner, the law applicable to the inheritance is also determined separately. Under Article 20 of the Law on Private International and Procedural Law (MÖHUK), the national law of the deceased and the rules of the place where the property is located on opening, acquisition and partition are assessed. It cannot be accepted that, just because the box is in Türkiye, all questions of entitlement will be resolved solely by Turkish inheritance shares. Tax and the bank’s opening procedure are also distinct from the examination of ownership. Law on Private International and Procedural Law, Art. 20

Opening in Terms of the Tax Officer and the Bank Agreement

Under Article 23 of the Inheritance and Transfer Tax Law, on the death of one of those renting the box, except for an identification carried out by the civil judge of peace, the box is opened in the presence of the authorized officer of the tax office; no delivery may be made to an heir or a representative before the contents have been identified. The provision also covers situations in which more than one person rented the box. For this reason, a statement that a surviving lessee has sole authority to open does not eliminate the special procedure that applies after a death. Inheritance and Transfer Tax Law, Art. 23

The bank’s agreement and appointment conditions are also checked. For example, Article 29 of VakıfBank’s publicly accessible safe deposit box agreement contains a provision on the presence of the heirs and the surviving lessees or their representatives, together with the tax official, at an opening following a death. This is the agreement sample of a single bank; it does not mean a condition that is unchanging in all banks or the undisputed validity of every provision. VakıfBank safe deposit box agreement

Before the date of the opening, the acceptance of the necessary documents, the persons who will attend, the status of the key, any need for an expert and the place of safekeeping are clarified. If an heir does not attend, a record cannot be drawn up as though that heir had consented. In a dispute over representation, protection or ownership that cannot be resolved through the bank’s routine procedure, the appropriate judicial route is considered. That the opening takes place does not mean that the partition will be completed at the same time.

A Real Court of Cassation Decision: The Right to Use a Box Is Not Proof of Ownership

In the decision of the 11th Civil Chamber of the Court of Cassation (Yargıtay 11. Hukuk Dairesi) dated April 29, 2024, E. 2022/7472, K. 2024/3366, the plaintiff, a joint lessee of the box, sought compensation from the bank because, after the death of the other lessee, the gold in the box was given to the heirs. The joint right in the use of the box was not enough to prove that the items belonged to the plaintiff. The dismissal given because the conditions of ownership and loss could not be proved was affirmed by the Court of Cassation. Full text of the decision

The practical conclusion to be drawn from this decision is that, in addition to the key or the rental agreement, evidence concerning the acquisition of the items should also be prepared. If an identification decision has determined only the right to use the box, it cannot be asserted as though it had resolved ownership of the entire contents with the force of res judicata. Nor should the decision’s assessments about the order of actions in that specific case be generalized to mean that, in every box dispute, an action must be brought first against the heir and only afterwards against the bank.

In an ownership inquiry, a definitive owner should not be determined from the appearance of the item. Invoices, payment records, the conditions of a gift, delivery documents, earlier photographs and consistent witness statements are assessed together. That a bangle is a woman’s piece of jewelry does not by itself show that it belongs to a particular person. In a claim against the bank, the breach of obligation, the loss and the connection between them are also made concrete.

Sample Work Plan for Identifying Valuable Items

Let us consider that a hypothetical box contains bangles, a ring with a stone, foreign currency and a sealed envelope. These should not be written on a single line as “some jewelry and money.” The bangles are recorded with their number, gross weight and distinguishing features; the ring with its stone and certificate information; the currency with its type and denominations. The opening of the sealed envelope and the recording of its contents are carried out within the framework of authority and the procedure to be applied. The private or personal nature of the document is also taken into account.

StepRecord entryCheck that reduces disputes
OpeningDate, box and status of those attendingConfirmation of representation and authority to open
InventoryA separate serial number for each itemMatching the photograph to the same number
MeasurementWeight, purity and measurement methodIndependent expert examination if necessary
ObjectionWhich item is claimed to belong to whomRecording the objection separately
SafekeepingPackage, seal and recipientTracking every later delivery

If an expert examination is needed, who will attend, where the items will be kept and how the cost will be met are determined. If a piece of jewelry has a workmanship cost, collectible character or a precious stone, a calculation based only on grams of gold may not show the true value. The purpose and date of the tax valuation and of the partition value among the heirs are also written separately.

Are Family Heirlooms, Household Goods and Jewelry the Same Category?

Under Articles 651–653 of the Turkish Civil Code, there are different rules for indivisible items, the family residence and household goods, and family documents and items of special sentimental value. Not every piece of gold or jewelry counts as a family heirloom. The surviving spouse’s claim concerning household goods should not be used as a rule of ownership that automatically covers all the jewelry in the box. The nature of the items to be divided and the specific family relationship are assessed. Turkish Civil Code, Arts. 651–653

The exemption for personal and family-related items in Article 4 of the Inheritance and Transfer Tax Law also cannot be extended to the effect that every valuable piece of jewelry is exempt from tax. The legal nature of the item, its belonging to the estate and its tax position are determined separately. If an exemption is claimed, the inventory should show for which item and under which provision it is asserted. Inheritance and Transfer Tax Law, Art. 4

Closing the File After Delivery

At the end of the partition, it is recorded which item was given to whom, together with the status of the recipient, any value equalization and the objections that remain open. The termination of the box rental relationship and the return of the keys to the bank are completed separately. That the items have been removed from the box does not necessarily show that the rental agreement has also been closed. The remaining fee or the status of the security deposit is confirmed with the bank.

For valuable items to be taken abroad, the customs rules and the notification rules of the country of arrival should be assessed separately. That an inheritance has been lawfully delivered in Türkiye does not by itself remove obligations at the border crossing. For this reason, the record, the certificate of inheritance and the ownership and valuation records are kept together; a single exemption or monetary threshold is not assumed for all countries.

Conclusion

In an estate of gold and a safe deposit box, a sound transfer rests on a verifiable count and an examination of ownership. The tax procedure, the partition and actual delivery should be documented separately; to whom and at what value the items were given should be shown clearly.

Frequently Asked Questions

I have the box key. Can I take what is inside?

The key alone does not give legal authority to take delivery; the inheritance and box-opening procedure must be followed.

Does everything in the box belong to the deceased?

No. Ownership claims of third persons and their evidence may be assessed.

Is it enough to divide the gold equally by grams?

Purity, workmanship, stones and collectible value may differ; entitlement and valuation are also needed.

Does the box opening record make ownership final?

It provides identification; it does not resolve disputed ownership with the force of res judicata in every case.
