Summary

The assessment committee decision and objection to the assessment in property tax. The 2026 value cap, filing period, comparable-sales documents and expert review.

In an objection to property tax value, the first question is which act is unlawful. The assessment committee’s decision on the unit value of land or plots and the municipality’s tax assessment for a particular property are different acts. The selection of the wrong value zone, an incorrectly taken surface area, or the failure to apply the cap specific to 2026 cannot be explained by the same ground either. The subject of the action, the time limit and the evidence must be built according to these distinctions.

The expression “municipal market value (rayiç bedel),” used in everyday speech, can be used to mean the unit value per square meter, the total tax value of the property or the sale value. Confusing these concepts leads both to a wrong calculation and to an application against the wrong act. This article examines disputes concerning the property tax base and the underlying value determination; the collection of the title deed fee on the actual sale price and the high-value residence tax are separate subjects.

What is the difference between the assessed unit value and the property tax value?

The minimum unit values per square meter for plots and land, determined under Article 49 bis of Tax Procedure Law No. 213, are used in calculating the tax value under Property Tax Law No. 1319. For plots, the neighborhood, avenue, street or zones that differ in value matter; for land, the relevant classifications matter.

The tax value of a building does not consist of the land value alone. The building class, use, construction cost values and related calculation elements are also taken into account. A single-line value certificate obtained from the municipality may not show that the whole calculation has been done correctly. In preparing for the lawsuit, the committee decision, the value schedule and the calculation breakdown applied to the property should be requested together.

Does the market sale price alone determine the tax value?

Market conditions matter in valuation; but the asking price in a sale listing is not an actual sale price. A bank appraisal may also have been prepared on a different date and for a different purpose. The location, zoning status, surface area, frontage and use characteristics of the comparable used in a dispute over tax value must be explained.

That a neighboring parcel has a lower value is a starting data point. If there are characteristics that justify a difference in value between two properties, mere adjacency is not enough. The administration, too, must support its general statement, “the zone was assessed,” with concrete valuation data and the reasoning of the decision.

How is the special value cap for 2026 applied?

Provisional Article 23 of the Property Tax Law, as amended by Law No. 7566, and General Communiqué Serial No. 89 introduce a special limitation in calculating the 2026 values. The law states that the 2026 building and land tax values within the relevant scope cannot exceed the 2025 tax values by more than two times (“iki kat fazlası”). Arithmetically, this describes three times the previous value; reporting it as “at most twice” is incorrect.

For example, under the same scope and calculation conditions, for a property whose 2025 tax value is TRY 1,000,000, the cap is TRY 3,000,000. If the new calculation is TRY 2,400,000, the value does not have to be raised to TRY 3,000,000 because of this limitation; the limitation creates a ceiling. If the new calculation is TRY 4,200,000, it is checked whether the ceiling was applied. This example is a comparison of values with the tax rate and other elements unchanged; it does not mean that the tax payable on all properties will automatically triple.

The provisional article has separate provisions for cases in which the tax liability must be established anew, for new buildings and for other reasons for change. For this reason, applying a simple multiplication to a property that did not exist in 2025 or whose nature has changed may not be correct. For the 2027–2029 periods too, the value basis determined by the law and the annual calculation rules must be followed.

That the cap has been applied does not prove that the assessed unit value is lawful on the merits. Conversely, an error in the committee decision and the municipality’s failure to apply the ceiling can be asserted as different grounds in the same action. It must be shown clearly which ground affects which act.

Against which act should the action be filed?

Saying only “I object to the market value” in the petition leaves unclear which administrative act is sought to be annulled. The date and number of the decision, the value zone, the details of the property, the taxation year and the scope of the annulment sought should be written. If there are multiple acts, the material and legal connection between them and the conditions for filing in the same petition are assessed separately.

Who can sue, and which court is applied to?

The standing of a person affected by the act because of ownership or a tax liability relationship must be shown concretely. The Constitutional Court’s annulment decision dated 31.05.2012, E.2011/38, K.2012/89, is important for taxpayers’ access to the courts against an assessment decision. Relying on the old provision, a general limitation that only the institutions listed in the law may sue cannot be established.

The competent court is the tax court. Territorial jurisdiction is determined according to the Administrative Procedure Law (İYUK) provisions relating to the administration that issued the act and the place where the tax was assessed or accrued. The defendant administration must be indicated according to the true owner of the act whose annulment is sought. The distinction between the committee decision and the municipal assessment also matters in establishing the proper defendant.

In co-ownership, it must be explained how the person’s own interest and tax liability are affected. It cannot be assumed that an action filed by a neighbor preserves the time limits of all owners or produces the same personal refund result for everyone. The effect of a decision on the same value zone is examined separately; one’s own assessment and payment records are still kept.

How is the filing period determined?

In tax disputes, where there is no special provision, the general filing period is 30 days. However, case law on the taxpayer’s learning of the assessment committee decision, its announcement, the year of application and filing together with the assessment must be related to the specific case. The same calendar day cannot be announced as the deadline for every property.

A municipal application, a reply, a value certificate or an electronic query record showing the date on which the decision was learned matters. The day on which the unit value was learned and the day on which the assessment for a given year was learned may be different. The claim regarding notification and the date of learning must be consistent with the documents in the file. For a decision stated in earlier correspondence to have been known, a later date should not be asserted without reasons as the first learning.

What does the Constitutional Court’s assessment of access to the courts mean?

In the Constitutional Court’s (AYM) official announcement concerning the application of Gemak Gemi İnşaat Sanayi ve Ticaret A.Ş., it was explained that in the decision dated 29.02.2024, B. No: 2020/11509, the interpretation of the time limit had made access to the courts difficult in an unforeseeable manner in the specific case. This assessment shows that, in the relationship between the assessment decision and the tax assessment, the interpretation of the time limit may be reviewed from the standpoint of the right to seek legal remedies. It cannot be concluded that an unlimited right to sue has been recognized or that every assessment restarts all past periods.

The safest practice is to obtain the relevant documents without delay when a value increase is learned and to determine the litigation route. General assumptions such as “one can wait until the end of the year” or “a new period will certainly begin with the first installment” should not be used without examining the specific file.

Does objecting to the municipality stop the filing period?

A request for information and documents, a request to correct a clerical error and an application under İYUK Article 11 to withdraw or amend the act are different. Merely requesting a value breakdown does not in every case stop the filing period. The date, content and addressee of the application and the special provisions must be assessed together.

The correction–complaint route may come into play for tax errors that are open. By contrast, disputes such as the choice of comparables, the valuation method or the legal conformity of the unit value are not always regarded as tax errors within the meaning of the Tax Procedure Law (VUK). A correction application made after the ordinary filing period has passed does not automatically reopen a dispute that essentially requires legal interpretation.

With what evidence is the unlawfulness of the value shown?

An objection resting only on the percentage of increase may not be sufficient. A value set low in the previous period and a value that does not reflect actual conditions in the new period are different matters. The examination should be directed at the valuation date and the specific characteristics of the property.

In particular, it is investigated whether there are zoning rights, building restrictions, heritage or protection status, frontage on a road, infrastructure, slope, transport, commercial activity and different value areas within the same zone. Comparable sales are compared in terms of date and quality. Listings may be used as supporting data; they should not be presented as equivalent to a completed sale.

If expert review is requested, the questions to be answered must be written. For example, are the zoning rights of the comparable parcel and the property in dispute the same; do all sections of the avenue have the same economic value; is the selected sale date consistent with the assessment period? An expert’s reference merely to the general market increase may not make the calculation method verifiable.

How does filing an action affect payment and collection?

The scope of the rule on suspension of collection specific to tax cases in İYUK Article 27 is determined according to the act that is the subject of the action. It cannot be said that an action filed only against the assessment committee decision automatically eliminates the municipal debts for all years. An action against the assessment, a reservation of rights (ihtirazi kayıt), the collection procedure and a separate request for stay of execution should be assessed separately.

Payment of the tax does not as a rule mean waiver of the right to sue; however, there is a possibility that payment may show awareness of the act. When the action is won, it is determined which year and which amount the decision affects. The refund and interest claim is followed on the basis of the scope of the judgment and the applicable statutory provisions. If no correction was made in the municipal account, the implementation of the decision should be followed up separately.

Conclusion

An effective objection to property tax value requires preparation that separates the unit value decision from the personal assessment and uses the appropriate time limit and evidence for each. The special cap for 2026 must in any event be brought into the calculation check; however, this limit should not be substituted for judicial review of the underlying valuation. When the committee decision, the municipal calculation breakdown and the actual characteristics of the property are examined together, the subject of the action and the need for proof become clear.

Frequently Asked Questions

Can the 2026 property tax value rise to at most twice the previous value?

The wording in the law is “twice in excess”; for the value within the relevant scope, this means three times the 2025 value. The special calculation rules for new tax liabilities and cases of change apply separately. Related explanation

Does the action filed by my neighbor also protect my time limit?

No such general conclusion can be drawn. Even if the effect of the decision on values in the same zone is examined separately, one’s own assessment, payment and filing periods must be protected. Related explanation

I submitted a petition to the municipality; can I wait before filing the lawsuit?

It depends on whether the petition is a request for information, a correction or a withdrawal of the act. It should not be assumed that every petition stops the period. Related explanation

Do sale listings alone prove that the property tax value is wrong?

Generally they are not sufficient. The listing price, the completed sale and the legal tax value are different. The date, location, zoning and physical characteristics of the comparables must be compared. Related explanation
