Presenting a digital record as a screenshot may not by itself show its source, its integrity, who created it or whether it was obtained lawfully. The link between the technical data and the person must be established separately.

Special criminal laws may contain provisions that depart from the Turkish Penal Code and the Code of Criminal Procedure in respect of the elements of the offense, investigation permission, complaint, jurisdiction, legal remedy or security measures. The relevant special law and the general provisions must be examined together.

The Name of the Offense Alone Does Not Determine the Defense

The manner in which the act occurred, intent or negligence, the person’s contribution, aggravating circumstances and the evidence are examined together. A simple receivable or contract dispute is not fraud in every case. The presence of a bank account or a phone number in the file also does not, by itself, explain a person’s legal responsibility.

Criminal court of first instance or High Criminal Court?

The competent court is determined by the statutory rules of jurisdiction and the nature of the accusation. Not all of the offenses in this guide are heard by a High Criminal Court. In the defense, the elements of the offense, proof and procedural safeguards are worked on; in victim representation, clarifying the act, evidence requests and the exercise of rights are worked on separately.

Preparing for the Consultation and Next Step

Prepare the file number, the existing decision or summons, and the date of the approaching procedure. Note any missing documents; do not hold back a time-limited procedure while they are completed. After the review, the appropriate request, any additional documents needed and the scope of services to be undertaken are explained.
