What Is a Tourist Residence Permit and What Right Does It Provide?
Article 31/1-e of Law No. 6458 on Foreigners and International Protection (YUKK) lists foreigners who will stay for tourism purposes among the persons to whom a short-term residence permit may be issued. The expressions used in everyday language, "tourist residence," "tourist stay" and "tourist residence permit," describe this ground of application. The law contains no independent, unlimited settlement status for tourism separate from the other permits. The permit issued enables a stay in Türkiye within the framework of the start and end dates in its document and its legal purpose. [1, m.19, 23, 31] [3]
The Difference Between a Visa, a Residence Permit and a Certificate of Residence
A visa or visa exemption is a stay opportunity tied to the person's nationality and entry conditions. A residence permit, on the other hand, is assessed for an appropriate purpose and period beyond a stay secured by a visa. The place-of-residence record (ikametgâh belgesi) obtained from e-Devlet shows the registered address; it does not replace the foreigner's permission to stay in Türkiye. A lease contract is likewise a document that proves accommodation. Because these documents serve different functions, a visa violation cannot be cured merely by registering an address. [1, m.11, 19–20] [2, m.22] [5] [6]
Does a Tourist Permit Give the Right to Work?
A tourist residence card is not a work permit. For an activity that requires working in Türkiye, a work permit or work permit exemption is needed, as the case may be. The validity of the residence card does not remove the legal consequences of unauthorized work. When a purpose of working emerges, the type of application and the employer's conditions must be assessed separately. [1, m.27] [5] [9, m.15]
Can Family Members Benefit from a Single Card?
A residence permit is issued separately for each foreigner. A spouse's or parent's holding tourist residence does not automatically give the other family members the same permit. If an application is made together, each person's passport, application form and documents suited to his or her situation are prepared; family ties are shown separately. If the conditions for a family residence permit are present, the suitability of that type of permit should be examined instead of the tourism ground. [1, m.23, 34–35] [5] [6]
Who Can Apply for a Tourist Residence Permit?
A foreigner who wishes to remain in Türkiye for tourism purposes beyond his or her existing lawful stay may request a short-term residence permit if personal circumstances, entry conditions and timing of the application allow. The center of the application is the explanation of why and for how long the person will stay in the country. Instead of merely saying "I like living in Türkiye," the relationship of the requested period to the travel program and to the means of subsistence should be shown. [1, m.31–32] [2, m.28/7]
The principal areas of assessment are information and documents supporting the tourism ground, the entry obstacles in Article 7 of the Law, suitable housing, a criminal record certificate when requested, and notification of the address at which the person will stay in Türkiye. Passport validity, health insurance and financial sufficiency also affect the file as a whole. The situation of a person who is subject to a valid entry ban or deportation decision cannot be handled like an ordinary first-application file. [1, m.7, 21, 32–33] [2, m.22]
What Information Should the Tourism Plan Contain?
The Regulation evaluates the foreigner's statement on where, when and for how long he or she will stay; information or documents supporting the travel plan and the tourism purpose may be requested. For this reason, the plan should not consist merely of the names of the cities to be visited. The requested dates, the main place of accommodation, the planned visits and how this program will be financed should explain one another. [2, m.28/7] [5] [6]
For example, if a hotel reservation for a few days is submitted and a residence of months is requested, the accommodation and expenses for the remaining period should be visible in the file. A person planning a long tourism program on a pension income can explain the continuity of this income together with the accommodation arrangement. These are examples of document preparation; every applicant's real plan is different. A reservation that will not be realized, or a ready-made travel text of someone else, must not be used in place of the person's own facts.
Does Making an Application Mean the Permit Will Be Granted?
No. Creating the electronic form, being given an appointment, paying the fee or having a document accepted does not replace a favorable decision. The administration's assessment must rest on concrete facts and the conditions in force; this power is subject to judicial review. The most useful preparation the applicant can make is to submit a consistent and verifiable file. There is no document package that guarantees the outcome, nor a general acceptance rate. [1, m.25, 31–33] [2, m.22] [13]
What Is Done If the Lawful Stay Period Has Been Exceeded?
The application plan should be made before the visa or the current permit expires. The Regulation contains provisions on accepting applications in certain cases of overstay and assessing special circumstances; these are not a new lawful stay period granted to everyone. The reason for the delay, its length, earlier permits and acts notified to the person are examined together. If a violation has occurred, it should not be assumed that opening a new form removes the violation automatically. [2, m.21/2–3] [1, m.54]
For How Many Years Is a Tourist Residence Permit Issued?
For a short-term residence permit for tourism purposes, the general statutory maximum is two years each time. The five-year exception that belongs to some other short-term grounds in the Law does not apply to an ordinary tourist application. The maximum does not mean that the applicant must be given two years. A shorter permit may also be issued, taking into account the request, the purpose of stay, the passport and insurance period and the other conditions of the file. [1, m.31/2, 5]
How Long Must the Passport Be Valid?
A passport or a document replacing a passport valid for at least 60 days longer than the requested residence period is required. The residence permit is issued so as to be 60 days shorter than the passport's expiry date. Therefore it is not sufficient for the passport to be valid only on the day of application. When determining the application period, the expiry dates of the passport and the health coverage should be checked together. [1, m.21/2, 23/1]
| Procedure or condition | Basic period | Meaning in practice |
|---|---|---|
| Short-term permit for tourism purposes | At most two years each time | It is the statutory maximum; it is not a period granted automatically. |
| Passport validity | At least 60 days longer than the requested permit period | The passport's expiry limits the permit that can be issued. |
| Extension application | From when 60 days remain until expiry, before the permit ends | The 15 days after the permit ends are not a general right of extension. |
| Concluding the application | At most 90 days from complete submission of information and documents | Passing of the period is not deemed acceptance; information is given in case of extension. |
| Exit and return while the application is pending | Return within 15 days on each exit whose conditions are met | The approved application certificate, payment or exemption and the requested permit period are checked together. |
| Annulment action against a residence refusal | As a rule 60 days from the day following notification | It gives no permission to remain in Türkiye for another 60 days. |
| Suit against a separate deportation decision | Seven days from notification | It is a separate act from the residence refusal and a separate period calculation. |
The periods in the table belong to different legal acts. Public holidays, the form of notification, electronic notification and the effect of an administrative application made in due form are calculated separately. [1, m.21, 23–24, 31, 53] [2, m.21–22] [12, m.7–8, 11]
How Is a Tourist Residence Permit Application Made?
1. Determine the Purpose of Stay and the Last Day to Apply
First, the passport, the date of entry into Türkiye, the visa or exemption period, any existing residence card and any notified decisions are examined. Tourism, family, education, real estate or work grounds should not be chosen interchangeably at random. Filling in the wrong type of form does not solve the problem of documenting the real purpose of stay. [1, m.19, 30–31] [5]
2. Create the Correct Application in the Official e-Residence System
The first, extension or transition application is prepared by selecting the relevant transaction type in the e-Residence system of the Presidency of Migration Management. The name, passport number, contact details, address, insurance and requested dates must be the same as in the source documents. The opening of a draft record should not be regarded as sufficient; the application should be completed through all the stages the system indicates, and the resulting form should be kept. [4] [5] [6]
3. Follow the Appointment and Document Submission Instructions
The appointment, notifications and document submission instructions that arise from the application are followed. The documents requested are prepared according to the application type and the current operation of the provincial directorate. A postal or appointment method described in an old article must not be used in place of the current form. The application is as a rule made by the person; it can also be handled through a legal representative or an attorney holding a power of attorney. The administration may call the foreigner for an interview for the assessment. [2, m.21/4, 22/3] [4] [5] [6]
4. Complete the Payments and Keep the Submission Record
The necessary fee and document charges are paid on the assessment arising from the application; exemptions are assessed separately. The receipt, the application form, the appointment record and a copy of the documents submitted are kept. In this way it can later be explained which document was given and when, which file a notice of deficiency concerned, and when the periods began. Payment does not show that the application will be accepted. [5] [6] [8]
What Documents Are Required for a Tourist Residence Permit?
The document list is not the same for the first application and for an extension. The framework below is based on the official short-term application samples, GöçNet version 2026/04, accessed on 28 October 2026. The list that appears on the person's own application form and any additional document request addressed to the person must also be taken into account. The list for another type of permit or from an old internet article must not be used as it stands. [5] [6]
| Document group | Content to be prepared | Checkpoint |
|---|---|---|
| Application form | Signed residence permit application form | Signature of the applicant, legal representative or authorized attorney and the correct application type. |
| Passport and visa | Copies of the identity and photo page and, if any, the visa pages | The original document being present at the appointment and sufficient validity. |
| Photograph | Two biometric photographs taken within the last six months | White background and ICAO standard; checking the person's own current list. |
| Payments | Receipts for the residence fee, the document charge and, if needed, the single-entry visa fee | Distinguishing a fee exemption from the document charge. |
| Health coverage | Accepted insurance or social security document | Covering the requested period; documenting any exception. |
| Tourism purpose | Travel plan and information or documents on accommodation | Consistency among the period, places to be visited and accommodation information. |
| Means of subsistence | Documents showing sufficient and regular income | Source, amount and continuity of income; the ability to explain the last three months. |
| Accommodation in the first application | As the case may be, title deed and house numbering, notarized lease, accommodation or hosting documents | The real address, the right person and the requested period. |
| Address in an extension | Current certificate of residence and the specified bill or new subscription contract | The address record being current and consistent with the application information. |
| Electronic notification in an extension | Document showing the UETS address | The official list states that no document is required for persons under 18. |
| Child and family tie | When necessary, birth, marriage, custody, consent or death documents | Certification, translation and authority of representation for the document. |
The administration may request additional information and documents depending on the person's situation. Therefore a checklist does not replace the legal grounds of the file. Documents that depend on a request, such as a criminal record certificate, and the common documents required in every application should be assessed separately. [1, m.32] [2, m.22] [5] [6]
Consent, Custody and Foreign Documents for Children
If the child's parents cannot be understood from the passport or identity document, a birth certificate is required; in cases of divorce, joint custody, death or a single parent, appropriate documents may be required. The other parent's consent and the authority of the person who will represent the child in Türkiye are examined separately according to the nature of the case. A document that an adult can sign in his or her own name may not be sufficient on its own for a child. [5] [6]
For documents obtained from abroad, depending on the type of document and the country, an apostille or certification by the relevant authorities and a notarized Turkish translation may be required. The existence of an apostille does not itself remove the translation requirement, nor does a translation remove the need for certification. If the documents are prepared before travel, the risk of missing the appointment can be reduced. [5] [6]
What Is the Income Requirement and How Much Money Must Be in the Bank?
It would be misleading to answer on this subject that "a fixed dollar balance is enough for everyone." The general regulatory framework and the current document expectation of e-Residence for the tourism application must be read together. The Regulation takes the declaration as the basis in assessing sufficient and regular financial means; for a declaration not found convincing, it provides for requesting concrete documents, for financial capacity to cover expenses, and for financial means not to rest solely on a third person's undertaking. [2, m.22/6]
The Tourism Criterion in the Current e-Residence Form
In the "Those who will stay for tourism purposes" section of the first and extension samples checked on 28 October 2026, an income of at least one and a half times the net minimum wage on the application date is stated for an individual application; for an application together with family members, an income of at least the minimum wage for each family member is stated. The same explanation requires documenting that sufficient income has been obtained for at least the last three months. This is the criterion in the current administrative document list; it should not be presented as an immutable bank balance written in the Law for everyone. [5, turizm bölümü] [6, turizm bölümü]
For example, if the monthly net minimum wage on the application date is taken as "A," the threshold in an individual application is 1.5 × A. For a family application, the official form separately gives an example of income at the level of four minimum wages for a family of four including the applicant. Because the family branch of the form does not separately state net or gross, the specific calculation should be confirmed with the administrative explanation on the day of application. Depositing money into a bank account immediately before the application may not, by itself, show the source and continuity of the income. [5] [6]
Which Income Documents Can Be Used?
The official samples list pension documents, account movements for the last three months, a company letter in due form, and documents showing deposit income or rental income. It is important that the source submitted truly belongs to the applicant, is available for use, and is consistent with the declared expenses. How income in foreign currency will be shown, and the certification and translation of a foreign document, should be checked in the specific file. [5] [6]
Does a Hosting Undertaking Replace an Income Document?
A notarized undertaking from the person with whom the applicant will stay may explain the accommodation. However, this document does not in every case prove the applicant's means of subsistence on its own. The Regulation contains the requirement that financial means not rest solely on the undertakings of third persons. It is therefore useful to prepare the accommodation file and the financial sufficiency file separately. [2, m.22/6-c] [5]
How Should Health Insurance Be Prepared?
The health coverage must cover the requested residence period. The official explanations list among the accepted options a document showing that health services in Türkiye are used under a bilateral social security agreement, an appropriate SGK provision, a document relating to an application for general health insurance, or valid private health insurance. The suitability of the document for the type of application and the persons it covers should be checked. [2, m.22/13] [4] [5] [6]
Is Every Travel Insurance Sufficient?
It is not sufficient that the policy merely has the word "travel" or "health" in its name. Its conformity with the coverage, period and policy conditions required in a residence application in Türkiye is examined. The start and end dates, passport information and the requested permit period must not conflict. If a longer permit is requested with one year of cover, how the whole period will be covered should be clarified before the application. [2, m.22/13] [4]
Special Situations in Social Security and Policy Renewal
Persons who can use health services in Türkiye under a bilateral social security agreement can benefit from the relevant provision by documenting this status. In addition, Article 22/14 of the Regulation provides that persons who are not covered by general health insurance or who have not applied to SGK, for residence requests of one year and over, submit a one-year private policy on condition that it is renewed at year end. This possibility does not mean that health coverage is unnecessary for the remaining period of the permit. The policy and the renewal calendar should be prepared together with the specific application period. [2, m.22/13–14]
How Is the Address and Accommodation Requirement Met?
The address is not only the place where the card will be sent; it is information used in assessing the application. The declared residence or facility must actually be used, and the person and address information in the documents must coincide. The administration may check, where necessary, through the address registration system or an on-site inquiry. A contract prepared for an address at which the person does not actually stay creates a significant inconsistency rather than strengthening the file. [1, m.32/1-c, d] [2, m.22/7–8] [13]
Document Preparation by Type of Accommodation
Staying in a Rented Residence
The current first-application sample requires a notarized copy of the lease contract containing the landlord's details. The address, start date, parties and actual use in the contract should be checked. In an extension, the current certificate of residence and the specified bill or new subscription contract come to the fore. It should not be assumed that resubmitting only the old lease contract is sufficient. [5] [6]
Staying in a Hotel or Similar Facility
The first-application sample specifies, together with the document showing that the person stayed, a receipt showing that the accommodation for the requested residence period has been paid. The gap between a short reservation and a long residence request must be explained. A reservation that has been cancelled or will not actually be used must not be submitted as real proof of accommodation. [5]
Staying with a Relative or Third Person
The official list requires a notarized undertaking from the person with whom the applicant stays, and, if that person is married, the spouse's undertaking. A current electricity, water, natural gas or fixed-telephone bill in the name of the person giving the undertaking, or a new subscription contract, is also specified. This method does not itself meet the conditions of a family residence permit and does not remove the financial sufficiency examination. [5] [2, m.22/6]
Staying in One's Own Residence
In the first application, a copy of the title deed and a house numbering certificate may show the accommodation. However, an application on tourism grounds is different from a short-term application on the ground of owning real estate. The existence of a title deed does not show automatic acceptance of a tourist application or that all special conditions of a permit based on real estate are met. The real purpose and the appropriate ground for the permit must be selected separately. [1, m.31/1-b, e] [5]
Closed Neighborhoods and Change of Address
In some places, restrictions and exceptions may apply to foreigners' new address registration or residence procedures. The suitability of an address should be verified through the application type, the person's situation and current administrative practice. Before paying rent or a long-term accommodation payment, it is useful to confirm the specific address through the Provincial Directorate of Migration Management or YİMER. An old neighborhood list should not be accepted as giving a definite result for all of today's applications. [2, m.21/15] [7] [16]
Address registration and address change obligations should be performed on time. The Directorate's explanations contain periods of 20 business days for the relevant procedures. On moving to another province, it is not enough to change the address line only; the application and document arrangement for the new province should also be checked. The current address registration is also important in an extension and transition file. [2, m.22/12] [4] [6] [7]
What Are the Costs of a Tourist Residence Permit in 2026?
In calculating costs, the amounts collected by the State should be distinguished from insurance, notary and translation expenses. Creating an application and obtaining an appointment through the official e-Residence system is free of charge; even so, an obligation for fees and document charges tied to the application may exist. A private service fee must not be presented as the State's application or appointment fee. [7] [8]
- Residence permit document charge: In the Presidency of Migration Management's 2026 table, the document charge is stated as TRY 964. This is the tariff amount published for 2026; it is separate from the residence fee, and the current tariff on the date of the transaction should be checked. [8]
- Residence permit fee: It may vary according to nationality, period, reciprocity and exemption status. The tariff of one group of countries cannot be applied to all foreigners. [8]
- Single-entry visa fee, if required: It may arise separately depending on the applicant's entry and exemption status; the exceptions in the official list are checked. [5] [6]
- Other expenses: The cost of procedures such as a policy, notary, translation, apostille or certification varies with the person's documents. These are not the same item as the official charge for the residence card. [5] [6]
The most accurate calculation for a file is made on the assessment in the application form and the official tariff on that date. Exemption from the fee does not necessarily mean exemption from the card charge. Payment documents may be important both in submitting the file and, if the conditions are met, in travel while the application is pending. [2, m.21/9] [8]
When Is the Application Concluded and Can One Travel While Waiting?
How Is the 90-Day Evaluation Period Calculated?
The Law and the Regulation provide for the application to be concluded within at most 90 days; the Regulation ties the start to the complete submission of the necessary information and documents. Therefore the date of the electronic form and the date of complete submission may not be the same. If a missing document has been requested, what was completed, on which date and by which method should be recorded. If the period is extended, the foreigner must be informed; the passing of 90 days does not mean an automatic permit or card production. [1, m.21/5] [2, m.22/1–2] [4]
What Should Be Done If a Notice of Missing Documents Arrives?
The notice should be read carefully; the document name, method of submission and period should be recorded. Article 22/1 of the Regulation provides that if the missing or supplementary information and documents notified are not completed within 30 days of the notice, the application is struck off. A deficiency and a refusal on the merits of the application are not the same act. If there is a problem obtaining the document, instead of waiting for the last day, submitting an explanation and the available evidence to the administration in a recorded manner should be considered. [2, m.22/1]
Is the Application Certificate the Same as the Appointment Form?
The functions of the application record or appointment printout and of the residence permit application certificate (müracaat belgesi) approved by the directorate should not be confused. The Regulation provides that the application certificate given to a person who has completed a proper application provides the right to stay in Türkiye until the application is concluded. The person should confirm the nature of the document in hand and the stage at which it is valid, especially before travel. [2, m.21/8–9] [4]
Exit and Entry Within 15 Days While the Application Is Pending
According to the Presidency of Migration Management's explanation, a person may leave, with the application certificate approved by the directorate and the fee receipt, to return within 15 days. The Regulation separately provides that a fee exemption be stated on the document, that the exit be within the requested permit period, and that each return take place within 15 days. These conditions must be assessed together. Buying a ticket relying only on an online appointment printout is not appropriate. [2, m.21/9] [4]
If one stays abroad for more than 15 days, the general visa rules apply. The consequence of this situation for the course of the application and the person's re-entry should be checked separately. Passport, visa exemption, entry ban and other border checks also continue. The right to travel gives no assurance that the application will be concluded favorably. [1, m.7] [2, m.21/9] [4]
How Is a Tourist Residence Permit Extended?
An extension is not the automatic continuation of the current card's period. The foreigner's current purpose of stay and the permit conditions are assessed again. The application must be made from when 60 days remain until the permit expires and in every case before the permit ends. The existence of the old card does not mean that documents accepted the previous year will be sufficient unchanged. [1, m.24, 33] [2, m.21/5] [6]
What Is Updated in the Extension File?
The passport and current permit information, the new requested period, health coverage, income documents for the most recent period and the continuing tourism purpose are checked. The current official extension sample requires, together with the certificate of residence, the relevant bill or new subscription contract and, for applicants who have turned 18, a document showing the UETS address. Changes in the address or family status should be explained so as not to leave a conflict with the earlier file. [6]
Is Extension of Tourist Residence Completely Prohibited?
Tourism purpose continues to appear in the Law as a ground for a short-term application. Nevertheless, each extension request is assessed individually. From a historical administrative announcement, a "definite ban" or "definite extension" cannot be concluded for all countries, all provinces and all dates. The official explanations on the day of application, the person's earlier stays and the continuation of the tourism ground should be examined together. [1, m.31–33] [6] [14]
What Is Done If the Real Purpose of Stay Has Changed?
If the person will now stay for education, family unity, work or another legal reason, a transition to the appropriate type of permit should be considered instead of repeating the tourism ground. A transition requires separately meeting all the conditions of that type of permit. Preparing before the current permit expires prevents experiencing a missing document and a lost period at the same time. [1, m.29–30] [2, m.21] [5] [6]
Why Is a Tourist Residence Application Refused or a Permit Cancelled?
Refusal of a first application, cancellation of an existing permit and non-extension of a permit that has expired are separate acts. Article 33 of the Law provides as basic grounds the failure to meet, or the disappearance of, the required conditions, the determination that the permit has been used other than for its purpose, and a valid deportation or entry ban decision. The ground on which the decision rests determines the next legal step. [1, m.32–33]
The Inconsistencies That Most Often Cause Problems in the File
Inability to link the purpose of stay with the period requested, an address that does not reflect reality, inability to explain the source of income, insufficient passport or insurance period and failure to complete the requested documents may affect the assessment negatively. Use of a forged or misleading document may additionally have serious legal consequences. On the other hand, it is not a correct generalization that every missing document is treated on the same day as a refusal on the merits, or that every address check automatically ends in refusal. [1, m.32–33] [2, m.22] [5] [13]
How Should the Expressions "Six Months" and "120 Days" Be Understood?
Article 19/1 of the Law provides that a residence permit loses its validity if its use is not begun within six months. This should not be read as "anyone who obtained a card has the permit cancelled on the same ground if he or she stays abroad for six months." Which permit issued on which date was not used, and the person's entry status, must be examined. [1, m.19/1]
As to a stay abroad, the former sub-paragraph in Article 33/1-c of the Law was repealed in 2016, while the second paragraph of the same article leaves the procedures and principles of cancellation to the regulation. The current Article 29/1-c of the Regulation continues to provide for staying abroad for more than 120 days in total within the last year, except for compulsory public service, duty, education or health reasons. Therefore it should be said neither that the 120-day criterion has disappeared altogether, nor that the same result arises in every file without examining the stated exceptions. Entry-exit records and documents showing the reason for being abroad should be assessed together. The calculation of uninterrupted period for long-term residence is made separately. [1, m.28, 33] [2, m.29/1-c, 40]
Can the Same Application Be Made Again After a Refusal?
The Regulation requires a person whose application has been refused or whose permit has been cancelled to present a new ground for the request when reapplying within six months. Re-uploading the same file with different sentences is not a solution in every case. That the new ground is genuine, that the person meets the conditions of that type, and the lawful stay status at the time of reapplication should be checked separately. [2, m.21/10]
What Legal Remedies Can Be Used Against a Refusal or Cancellation Decision?
First, the Decision and the Notification Should Be Examined
The full text of the act, its reasoning, the date of notification, the statement of the route of appeal and, if any, the document concerning departure should be obtained together. An email, an SMS, a portal result and a notification in due form may not be the same thing. In particular for acts notified through UETS, the statutory date of notification must be determined separately. Tying the calculation of the period solely to the expiry of the card or to the day a result is seen on the screen may cause loss of rights. [1, m.25] [6] [12, m.7–8]
Application to the Administration and the Annulment Action
Against a tourist residence refusal, cancellation or non-extension, where no special period is provided, the general 60-day period for an annulment action before the administrative court applies. The period is calculated from the day following the written notification. The competent court and the correct defendant are determined through the authority that made the act. A separate application to the administration is not a precondition for the suit in every case. [12, m.7–8, 32]
Within the scope of Article 11 of the Administrative Procedure Law (İYUK), a request for revocation, withdrawal, amendment or a new act may be submitted, within the suit period, to the superior authority or, if there is none, to the authority that made the act. A proper application suspends the suit period; if no reply is given within 30 days, the request is deemed refused and the remaining period continues to run. The days that passed beforehand are counted. Because not every email or freedom-of-information request is an application with this effect, the nature of the petition and the delivery record are important. [12, m.11]
Special Procedure in Short-Term Residence Cases
Article 31/7 of the YUKK provides that, in cases concerning refusal of a short-term application or cancellation of a short-term permit, the file is deemed complete upon the submission of the administration's defense or the lapse of the defense period. If notification cannot be made to the address the plaintiff has given, the period in İYUK Article 26/3 applies as two months; holding a hearing is at the court's discretion. This special regulation makes it especially important that the first-instance file be prepared completely with regard to reasoning and evidence and that the address for the proceedings be kept current. [1, m.31/7]
Does Filing a Suit Automatically Secure Remaining in Türkiye?
No. Filing a suit against a residence act does not, by itself, stay the execution of the act. A stay of execution is a request that the court assesses separately. Article 27 of the İYUK requires together the manifest unlawfulness of the act and that its implementation would cause damage that is difficult or impossible to remedy. The suit period, the obligation to depart and the existing right of stay must be calculated separately from one another. [12, m.27]
Article 22/11 of the Regulation mentions a document that, if a permit that has expired is not extended or the request is refused, allows a stay in Türkiye of only up to ten days. The scope of the document notified to the person, whether the person has another valid permit, and whether there is also a separate deportation decision are assessed. The conclusion "I have 60 days to file a suit, so I can remain in Türkiye for the whole of this period" should not be reached. [2, m.22/11] [12, m.7, 27]
In assessing a refusal, non-extension or cancellation, family ties in Türkiye, the length of residence, the situation in the country of origin and the best interests of the child are also taken into account. The Regulation provides for a one-month stay document where the execution of the decision is postponed and for a possibility of reassessment if the conditions continue. This document does not arise automatically from filing a suit; the specific administrative assessment and the scope of the document issued are the basis. [1, m.25] [2, m.22/18]
If a Separate Deportation Decision Has Also Been Issued
A residence refusal and a deportation decision are not the same act. If a separate deportation decision has been notified, the seven-day suit period and the special procedure in YUKK Article 53 apply. The suit that must be filed for this act is not covered automatically by a suit filed only against the residence refusal. If there is administrative detention or an entry ban, the routes of appeal for these are also assessed separately. [1, m.9, 53, 57]
Appeal (İstinaf) and Appeal on Points of Law (Temyiz) After the Court's Decision
The legal remedy after the first-instance decision must be determined separately. In 2026, by İYUK Article 46/2, suits arising from Law No. 6458 were also listed among the exceptions to the additional possibility of appeal on points of law introduced for some suits in which the regional administrative court sets aside a first-instance decision and decides anew. This does not mean that appeal (istinaf) has been abolished in all residence suits. The nature of the decision, the notice of the legal remedy and the transitional provisions must be checked in the specific file; the statement of legal remedy at the end of an old decision should not be applied as it stands to every present file. [12, m.45–46/2-d]
Which Documents Should Be in the File for Legal Assessment?
The refusal or cancellation decision and the notification record; the application form and all its attachments; previous cards; the passport and entry-exit information; address and income documents; correspondence on deficiencies; and, if any, documents concerning a family, health or security assessment should be prepared together. In the petition, instead of merely saying "unjust refusal," the relationship between the specific reasoning of the decision and the evidence in the file is explained. The effect of a court decision is also applied according to the scope of the judgment; an annulment decision does not in every case mean that a card is directly issued. [12, m.2–3, 20, 28] [13] [14]
What Do Court Decisions Show About Tourist Residence?
Adequacy of the Address Inquiry: Council of State 10th Chamber
In its decision dated 25.11.2020, E.2016/12017, K.2020/5407, the 10th Chamber of the Council of State (Danıştay 10. Daire) affirmed the first-instance decision that annulled a tourist residence refusal given, without adequate inquiry and assessment of the other conditions, concerning an applicant who had notified his or her address in due form. The detailed assessment lies in the first-instance reasoning set out in the decision. The different conclusion reached by the dissenting opinion must not be confused with the majority's judgment. [13]
The contribution of this decision to application preparation is in dealing with the address and the administrative inquiry through concrete evidence. The decision does not say that address checking is unnecessary or that a permit must be granted to everyone who could not be found at the address. The consistency among the lease, the actual accommodation and the address notification therefore retains its importance. [13]
Family Life in an Extension: The Constitutional Court's Louven Decision
In the application of Hans Jürgen Peter Louven, the Constitutional Court (Anayasa Mahkemesi, AYM) examined the refusal of a tourism-purpose extension within the framework of security grounds and the applicant's family ties. In the decision dated 24.10.2024, B. No: 2020/21147, it concluded that the right to respect for family life had not been violated. This is not an annulment or permit decision in favor of the applicant. [14, §§11–21]
The decision shows that earlier permits, family ties in Türkiye or real estate do not by themselves create a guarantee of renewal. However, it also cannot be concluded from this event in a security context that all tourist extension applications may be refused. Personal circumstances, the reasoning of the act and constitutional guarantees are assessed together. [14]
A Distinction Emphasized in Doctrine: Right to Sue and Lawful Stay
The study by Öztürk, Kuşcu and Tufan discusses the documenting of the purpose of stay and the difference between being able to bring suit against a refusal and the status of remaining in the country. The study's proposal on issuing a stay document while the suit is pending is not an automatic right in force. An academic criticism or reform proposal must not be applied as if it were a current application requirement. This distinction explains that, in planning a legal route, notification and stay status must be examined together. [15, s.708, 715–716]
Consequences for Work, Long-Term Residence and Citizenship
Applying for a Work Permit from Tourist Residence
A residence card does not give the right to work; by contrast, the residence requirement that can be used in a work permit application made from within the country is a separate subject. The current Article 15/4 of the Regulation on the Implementation of the International Labor Force Law requires, except for exceptions, a valid residence permit of at least six months. The criterion here should not be interpreted, in every case, as having lived in Türkiye for six months or as the card having six months left until expiry. [9, m.15] [10]
Nor can it be said that, because tourist residence exists, every domestic work application is categorically impossible. The application channel, the person's situation, the field of activity, the employer and the current assessment criteria are examined together. In some fields there is an obligation to apply from abroad or other special conditions. Actually starting work is separately related to obtaining the appropriate permit or exemption. [9, m.15/3–6] [10]
Does Time Spent on Tourist Residence Count Toward Long-Term Residence?
The residence calculation for long-term residence and for Turkish citizenship is not the same. YUKK Article 28/2 provides for counting half of the period in student residence and the whole in other residence permits. Within this framework, valid tourist short-term permit periods can, as a rule, be taken into account in the period calculation for long-term residence. However, the condition of at least eight uninterrupted years, periods abroad, income, health coverage and other conditions are examined separately; the total of eight years of cards is not sufficient on its own. [1, m.28, 42–43] [2, m.40]
Does Tourist Residence Count Toward Turkish Citizenship?
In a general-route citizenship application, periods spent for tourism purposes are not treated the same way in the valid residence calculation. The Regulation on the Implementation of the Turkish Citizenship Law lists tourist stay among the reasons that do not show an intention to settle. A later transition to another status likewise does not make earlier tourist periods automatically added to the calculation. Therefore the conclusion "if I have had a tourist card for five years, I have a right to citizenship" cannot be reached. [11, m.16/2-c, 71/1-ç, d]
The availability of marriage or another citizenship route depends on separate conditions. If the person's long-term plan is also assessed while preparing a residence application, accumulating years under the wrong type of permit can be avoided. This assessment does not replace meeting today's permit conditions. [1, m.30–31] [11]
Points to Check Before the Application and After the Decision
In reading the application file one last time, the following questions should be answerable with documents:
- Is the real reason for being in Türkiye tourism; is the requested period consistent with this plan?
- Was the application completed before the lawful stay ended; is the extra 60 days required in the passport present?
- Can the source of income and its continuity over the last three months be explained in line with the current tourism list?
- Are the accommodation document, the address record and the place of actual stay the same?
- Does the health coverage cover the requested period; if there is an exception, has it been documented?
- For children, family ties and foreign documents, are representation, certification and translation complete?
- In an extension, are the current certificate of residence, the bill or subscription and the required UETS document ready?
- Are the application and deficiency notices followed regularly, and are the submission records kept?
- If travel is planned, have the nature of the document in hand and the conditions of return been confirmed?
- If there is an unfavorable decision, have notification, the suit period, stay status and other administrative acts been examined separately?
This check can be used not to multiply documents but to see whether the basic facts in the application agree with one another. How a deficiency is cured varies with the stage the file is at. In particular, repeating the same application after a refusal and resorting to a legal route against the decision are different options. [1] [2] [5] [6] [12]
Conclusion
The foundation of a tourist residence application is a real and documentable tourism purpose. The travel plan, income, health coverage and accommodation must be assessed together. The two-year statutory maximum is not an automatic permit period; nor does the earlier card guarantee an extension. The application and extension calendar should be set up before the lawful stay ends. [1, m.24, 31–33] [2, m.28/7]
After the application is completed, document and notification follow-up should be continued; the conditions of the application certificate should be checked for travel. In case of a refusal or cancellation, one should proceed from the reasoning of the decision and the date of notification, and the right to sue and the status of remaining in the country should be assessed separately. This preparation ensures both that the application is understandable and that, when necessary, a legal objection rests on concrete evidence. [2, m.21–22] [12, m.7, 11, 27]
Frequently Asked Questions
What is the maximum period for which a tourist residence permit is issued?
The general maximum is two years each time. This does not mean two years will be given in every application; the purpose of stay, the passport, health coverage and other conditions are assessed. [1, m.31]
Must one wait for the visa period to end for the first application?
No. The application must be made before the lawful stay period ends. The special assessment provisions on overstay are not a general additional period that justifies waiting. [2, m.21]
When is an extension application made?
It is completed from when 60 days remain until the current permit expires and in any event before the permit ends. The information that an unconditional extension can be made within 15 days after the permit ends is not correct. [1, m.24/2] [4]
How much longer than the residence period must the passport be valid?
It must be valid for at least 60 days longer than the requested residence period. The permit is issued 60 days shorter than the passport's expiry. [1, m.21/2, 23/1]
How many biometric photographs are required?
The official first-application and extension samples checked on 28 October 2026 specify two photographs. The photographs must have been taken in the last six months, have a white background and conform to the biometric standard; the person's own application list should also be checked. [5] [6]
How much money must be in the bank for tourist residence?
There is no fixed dollar balance valid for everyone. The current tourism form requires documenting income of at least 1.5 times the net minimum wage in an individual application, and at least the minimum wage per person in an application with family, together with its regularity over the last three months. The family calculation should be confirmed with the administrative explanation on the day of application. The bank balance is assessed together with the source of income and continuity. [5] [6]
Is a notarized lease contract sufficient to obtain a permit?
No. A lease contract shows accommodation; it does not replace the tourism purpose, financial sufficiency, health coverage and the other conditions. The address must be consistent with actual use and records. [1, m.32] [5]
Can an application be made while staying in a hotel?
The address of the accommodation facility can be used. The current first-application sample specifies the accommodation document and the receipt for payment for the requested period. The difference between a short reservation and a request for a long permit should be explained. [2, m.22/8] [5]
Is it possible to stay with a friend?
In the current list, hosting can be documented by a notarized undertaking; the undertaking of the spouse of a married person giving the undertaking and the specified address supporting documents are also required. This does not remove the financial sufficiency examination. [5] [2, m.22/6]
Does buying a home guarantee a tourist permit?
No. A title deed may be important for accommodation or for a separate ground of application based on real estate. The tourism and real estate grounds are assessed separately; the conditions of each are examined. [1, m.31–32] [5]
Is a separate application needed for a child?
A residence permit is issued separately for each person. The child's passport, representation, birth, custody or consent documents are prepared according to the specific family situation. A parent's card does not automatically give the child a permit. [1, m.23] [5] [6]
Is health insurance from abroad sufficient?
Not every foreign policy is automatically sufficient. The insurance or social security document accepted for the application in Türkiye, the period it covers and the required coverage are checked. Bilateral social security agreements may provide a separate possibility. [2, m.22/13] [4]
What happens if the application was made with a missing document?
The notice of missing or supplementary documents must be followed. The Regulation provides for striking off the application because of information and documents not completed within 30 days of the notice. This act differs from a refusal on the merits. [2, m.22/1]
Is a residence application concluded in one month?
There is no one-month guarantee of an outcome for every file. The 90-day evaluation period in the legislation starts from the complete submission of information and documents. Delay does not mean automatic acceptance. [1, m.21/5] [2, m.22/2]
Can one go abroad while the application is pending?
One may leave after checking together the approved application certificate, fee payment or documented exemption, the requested permit period and the condition of return within 15 days. One should not rely only on the appointment printout. [2, m.21/9] [4]
What happens if the 15 days abroad are exceeded?
The general visa rules apply. The conditions of re-entry and the status of the application are assessed separately; this period is not an unconditional right of travel or return for everyone. [2, m.21/9] [4]
Is UETS required in an extension application?
The official extension sample checked on 28 October 2026 requires a document showing the UETS address and states that it is not required for persons under 18. UETS notifications should be followed regularly. [6]
What is the cost of a residence card in 2026?
In the official table, the 2026 residence permit document charge is TRY 964. The residence fee, the visa fee if required and other expenses are separate from it; the total cost is not the same for everyone. [8]
Is an e-Residence appointment paid?
Making an application and an appointment through the official system is free of charge. The fee tied to the application, the document charge, or the fee for a private legal service obtained are separate items. [7] [8]
What is the time limit for suit against a tourist residence refusal?
For residence acts with no special period, the general annulment action period is 60 days and is calculated from the day following notification. The effect on the period of an administrative application made in due form is assessed separately. [12, m.7–8, 11]
Does filing a suit automatically extend the stay in Türkiye?
No. A suit against a residence act does not by itself stay execution. The existing right of stay, the departure document and any stay-of-execution decision are examined separately. [2, m.22/11] [12, m.27]
Are a residence refusal and a deportation decision the same?
No. If there is a separate deportation decision, the special seven-day suit period for it must not be overlooked. Filing a suit only against the residence refusal does not automatically cover the separate deportation act. [1, m.53]
Can one reapply immediately after a refusal?
The Regulation requires a new ground for the request when reapplying within six months after a refusal or cancellation. The genuine ground, the conditions of that type and the person's lawful stay are examined separately. [2, m.21/10]
Can one work with a tourist residence permit?
A residence card does not give the right to work; an appropriate work permit or exemption is required. The condition of a valid residence permit of at least six months in a domestic work permit application is assessed separately from the right to work itself. [9, m.15] [10]
Do tourist residence periods count toward the eight-year long-term calculation?
Valid tourist short-term periods can, as a rule, be taken into account in this calculation. Interruptions, stays abroad and the other conditions of the long-term permit are examined separately; adding up the card periods is not sufficient by itself. [1, m.28, 42–43] [2, m.40]
Does five years of tourist residence give Turkish citizenship?
No. In the general citizenship route, tourist periods are subject to a different rule in the valid residence calculation and do not create an automatic right to citizenship. A later transition to another status does not automatically take earlier tourist years into account. [11, m.16, 71]
What should be done when the address changes?
The address record must be updated and the relevant notification period observed. On moving to another province, the application arrangement for the new province is checked separately. The current certificate of residence is important in an extension file. [4] [6] [7]
Can the application be made through an attorney?
The Regulation allows an application through a legal representative or an attorney holding a power of attorney. The administration may interview the foreigner when necessary. Representation does not remove the obligation of document accuracy and of meeting the permit conditions. [2, m.21/4, 22/3] [5]
