Cancelling a workplace opening and operating license is not simply the loss of one document for a business. Stopping activity can affect employees, lease and supply contracts, reservations, the customer base and the continuity of the investment. On the other hand, a license does not guarantee the right to operate indefinitely under all conditions. The legal response must be built around the ground on which the cancellation rests, the authority that issued it, and whether the inspection procedure that applies to the business was followed.
Unless a special time limit is provided, an annulment action may be filed with the administrative court within 60 days from the day after written notice of the cancellation. Filing the action does not by itself prevent the suspension of activity; for that, a stay of execution is requested if its conditions are met. After a court decision, enforcement of the decision, correction of the license record and removal of the closure order must be followed up separately. Revival of a license and a new license application are not the same legal route. [1, Art. 2, 7, 27–28]
This guide examines the general administrative-court framework for workplace opening and operating licenses in Türkiye. Special permits and sanctions in fields such as pharmacies, private educational institutions, mining, energy, health facilities and tourism facilities are assessed separately. Because of the scope exceptions in Law No. 3572, it cannot be assumed that all businesses are subject to the same licensing regime. [2, Art. 2; 3, Art. 2–6]
The difference between license cancellation, refusal to grant a license and sealing
The first task is to identify correctly the act the business is facing. The heading the administration uses is not enough by itself; the legal and factual effect of the act on the business is also examined. If a license appears as "passive" in the system but prevents operations, it may not be treated as a simple record-keeping step. An inspection report is sometimes only a preparatory act and sometimes part of a directly enforceable measure. The action must be directed at the final act that has to be implemented. [1, Art. 14–15; 9] If no license was ever granted, the route to follow is explained in the article Refusal to Grant a Workplace Opening and Operating License.
| Act | Basic effect | Focus of legal review |
|---|---|---|
| Cancellation of an existing license | Removes the business's current operating permission. | Ground for cancellation, competence, inspection and the procedure for granting time to comply. |
| Rejection of an initial or new license application | The requested permission is not granted. | Application requirements, notice of missing documents, reasons for rejection. |
| Prohibition of activity or closure | Activity is blocked temporarily or permanently. | Specific legal basis, competent authority, scope and duration. |
| Sealing | Enforces a closure or suspension decision; in a given case it may also be subject to a separate action. | The decision relied on, the enforcement record, the area sealed and independent legal effects. |
| Construction stop record or demolition order | Produces separate consequences for the construction. | The procedure under the Zoning Law and how this act relates to the workplace license. |
The same file may contain a license cancellation, a closure, sealing, a zoning fine and the cancellation of a document by a ministry. Removing one of these does not automatically eliminate the others. The notice date, the time limit to sue and the competent court are determined separately for each act. For acts that are materially or legally linked, an action may be considered under the conditions of Article 5 of the Administrative Procedure Law No. 2577 (İYUK). For administrative fines, the special regulation and the jurisdictional rules, including Article 27(8) of the Misdemeanours Law No. 5326, must also be checked separately. [1, Art. 5; 7, Art. 32, 42; 8, Art. 27]
A "license cancellation" issued by the administration may technically have a retroactive effect of withdrawal or a prospective effect of revocation. A cancellation ruling by a court, however, is the outcome of judicial review. Distinguishing these concepts matters when assessing the earlier period of operation, any claim of acquired rights and the need for a new application.
Who is competent to cancel a license?
The competent administration is determined by the location of the workplace, the type of activity and its class. The municipality, the metropolitan municipality, the provincial special administration or the organized industrial zone may have competence. It is not correct to treat the district municipality as competent for all businesses. In addition, the power to grant a license must be distinguished from a temporary closure power derived from a special law. [3, Art. 4, 6, 39]
Under Article 6 of the Regulation, the license is signed by the highest officer of the competent administration or by a person that officer designates; a council or executive committee decision is not required for the license. The principle of parallelism of competence is also examined when a license is ended. This does not mean, however, that a municipal executive committee can never take a closure decision or that the license power can never be exercised by delegation. The delegation document of the signatory, the date of the act and the scope of the competence must be obtained for the file.
In a decision dated March 9, 2026, E.2026/1174, K.2026/1160, the Fourth Chamber of the Council of State (Danıştay 4. Daire) dealt with the making of licenses of an accommodation business in Antalya passive until it complied with fire legislation. The Chamber noted that the act suspending operations had the same effect as a license cancellation and examined competence. It did not regard the letter showing the municipal council's authorization and the division of duties among the departments as sufficient in place of the mayor's designation under Article 6 of the Regulation, and upheld the cancellation on the ground of lack of competence. In a dissenting opinion, it was argued that the deputy mayor who issued the license could also reverse the same act. [9]
This decision does not mean that all passivation acts are invalid for the same reason, or that fire deficiencies in a business are unimportant. The possibility of a new act being established after the defect in competence is cured remains open. Not every error of competence automatically creates a "non-existence"; instead of disregarding the act and continuing operations, judicial protection must be sought within the time limit.
What unlawfulness is raised in an annulment action?
Article 2 of the İYUK provides for review of an act in terms of competence, form, cause, subject matter and purpose. These five elements should not be listed in the petition as headings only; they must be linked to the documents of the case.
• Competence: Can the administration that took the decision, and the person who signed it, make an act on this activity? Is the designation valid on the date of the act?
• Form and procedure: Have the mandatory inspection, notice of deficiencies, grant of time and the check at the end of that time been completed? Was the process appropriate for the class of the business?
• Cause: Does the deficiency actually exist? Does the report relate to the correct independent unit, activity area and date? Has a deficiency reported as remedied been treated as if it continued on the basis of an old record?
• Subject matter: Does the legislation provide for license cancellation for this violation, or for a temporary prohibition or another sanction? Is the main activity separated from ancillary activities?
• Purpose: Was the competence used in line with the public interest and the purpose of the regulation? Are there concrete comparable data supporting an argument of equality or proportionality?
A neighbor's complaint may trigger an inspection; the existence of a complaint alone does not prove all the conditions of a sanction. On the other hand, the defense that "the complaint arises from personal hostility" does not, from a technical standpoint, remove a fire, noise or zoning violation that has been verified. That a similar business is licensed is not sufficient precedent unless the same use, structure, capacity and legal conditions are shown. The fact that an unlawful permit was granted to someone else does not by itself create a right to the same permit. [1, Art. 2, 20; 3, Art. 5–6]
Is the sanction applied after the first inspection the same as after later inspections?
This distinction is one of the most important points in license cancellation disputes. For sanitary workplaces, Article 13 of the Regulation sets a single 15-day period for the first inspection after licensing and for remedying the violations. For second- and third-class non-sanitary establishments, Article 23 applies; for first-class establishments, the relevant special provisions are assessed separately. Relying only on Article 13 without establishing when and at what stage the inspection was carried out may lead to an incomplete review. [3]
Supplementary Article 3 is a special provision on violations and deficiencies arising from the operator's faulty act after the first inspections mentioned in the article. Within this framework, a single 15-day period for remedy is provided; if the remedy is not made, an administrative fine under Law No. 1608 and, depending on the class of the business, consequences of prohibition of activity are foreseen.
| Inspection and business situation | Main provision to examine | Critical distinction |
|---|---|---|
| First inspection of a sanitary workplace after licensing | Article 13 of the Regulation | For a remediable deficiency, a 15-day procedure applies, followed by an assessment of license cancellation. |
| First inspection of a second- or third-class non-sanitary workplace | Article 23 of the Regulation | Its own licensing and first-inspection procedure applies. |
| Deficiency in a sanitary workplace under Supplementary Article 3 after the first inspection | Supplementary Article 3 of the Regulation | After the remedy period, an administrative fine and a prohibition of activity lasting no more than 15 days, as determined by the administration, are foreseen. |
| Deficiency in a non-sanitary workplace under Supplementary Article 3 after the first inspection | Supplementary Article 3 of the Regulation | The prohibition lasts until the violations and deficiencies are remedied; the 15-day upper limit does not apply in the same way here. |
| Recreation and entertainment venues open to the public | Supplementary Article 3 of the Regulation and special provisions | Articles 6 and 8 of Law No. 2559 are reserved. |
When a deficiency under Supplementary Article 3 is found to have been remedied, the prohibition decision is lifted immediately. The regulation, however, does not remove every ground for license cancellation. The first inspection, the operator's fault, the time the violation arose, the special law and the transitional provisions are examined together. Both "every deficiency leads to license cancellation" and "no license can ever be cancelled" are overgeneralizations.
The operator should submit the first inspection record, the file on the finality of the license, later changes and documents evidencing remedy. The administration should be able to explain the provision under which the sanction it relies on is foreseen and why that provision applies to the case. The fact that the license became final because no first inspection was carried out within a month does not give immunity against all future inspections. [2, Art. 5–6; 3, Art. 13, Supplementary Art. 3]
Must 15 days always be granted to remedy a deficiency?
Where legislation provides for a period to be granted, cancelling the license without clearly notifying a remediable deficiency, or before the period has expired, may constitute a significant violation of law. The notice must be clear enough for the operator to understand what must be done. A period given by the administration to another person, or for another act, does not replace the period that must be granted to the license holder in each case.
However, it is also not correct to make the duty to grant a period absolute. In its decision dated January 8, 2026, E.2025/2449, K.2026/56, the Plenary Assembly of Administrative Litigation Chambers of the Council of State (Danıştay İdari Dava Daireleri Kurulu) assessed, together, a finding of zoning violation for a structure containing a small sales point within a fuel station, the earlier period for remedy, a demolition order and the final rejection of the action against it. The Plenary concluded that, in the case concerned, there was no legal interest in granting a new 15-day period. The regional administrative court's view that a further period should be granted to the operator-tenant was not adopted by the majority; the dissenting opinions argued that the decision of the lower court should be upheld. [10]
The decision cannot be read as meaning that a license may be cancelled without granting a period for every zoning violation. Whether the violation can be remedied, the earlier act and the scope of the lawsuits, the difference between the operator and the owner of the building, and what a new period would change must be explained. Nor can it be said that this decision removes all conditions of application of Supplementary Article 3.
Where a previous deficiency has been remedied and the license has resumed operating, a new deficiency found later is assessed separately. In its decision dated January 15, 2025, E.2024/2123, K.2025/447, the Fourth Chamber of the Council of State (Danıştay 4. Daire) stressed the application of the new procedure to a deficiency found on a later date at a massage salon whose license had been revived after a previously remedied lack of a responsible manager. The Chamber upheld the cancellation on the reasoning of the first-instance court's grant of a period. This approach does not mean that a continuing identical violation will create an unlimited number of new periods at each inspection. Special rules on repeat violations also remain in force. The full text was reviewed through a secondary publication of the decision. [11]
Closure for a fire deficiency and the 2026 regulation
In fire safety violations, the scope of the report, the building and the type of use to which the finding relates, whether the deficiency can be remedied, and the specific provision that applies are decisive. An old fire brigade report does not in every case cover later alterations or a change in capacity. If a technical report is challenged, rather than only alleging economic hardship, a wrong measurement, a wrong classification or a completed measure should be shown with concrete documents.
Provisional Article 9, added on January 10, 2026, governs certain accommodation establishments that must obtain a fire brigade report and to which a period for procuring materials has been granted under Provisional Article 4 of the Fire Regulation. If the relevant report cannot be produced, the regulation provides for immediate prohibition of activity until May 31, 2026, use of that period only for works of manufacture and renovation that will remedy the deficiencies, and cancellation of the license and closure of the workplace if no report is submitted at the end of the period. This period is not a permit to operate; it also ended as of October 12, 2026. [3, Provisional Art. 9]
In addition, the change of December 11, 2025 broadened the definition of accommodation establishments and expressly set out, in Annex 1/A-11, the condition of an occupancy permit and a fire brigade report for those establishments. It therefore cannot be concluded from a note about the transitional period in 2025 that all hotels are exempt from license cancellation in 2026. Whether each accommodation business falls within Provisional Article 9 and the date on which the decision was taken must be determined separately. [3, Art. 4/r, Annex 1/A-11]
The operator's economic loss does not replace measures to protect life and safety. On the other hand, a public-safety justification does not by itself make an act based on an unauthorized or wrong type of sanction lawful. Judicial review of a license cancellation and the completion of necessary safety measures may proceed together.
Zoning violations, occupancy permits and the effect of a building registration certificate on the license
A building permit, an occupancy permit and a workplace opening and operating license are different acts. The existence of one does not show that all conditions of another are met. Article 5(c) of the Regulation sets out the condition of an occupancy permit for businesses that require a particular type of building; for accommodation establishments, the current Annex 1/A-11 is also taken into account. For other workplaces, zoning, the intended use and the operating conditions are also examined. Neither should a single document rule be set up for all buildings without exception, nor should a business outside Article 5(c) be treated as independent of zoning legislation. [3; 7]
Where the cancellation of the whole business is based on a violation affecting only part of it, the boundaries of the licensed area, the effect of the violation on the activity and whether a more limited measure is legally possible must be set out. However, a defense that "I did not build the non-conforming structure" or "it was already there when the license was granted" may not be enough on its own.
In a decision dated December 11, 2024, E.2024/1318, K.2024/3330, the Plenary Assembly of Administrative Litigation Chambers (İDDK) discussed an unlicensed closed structure on land licensed for storage of construction scaffolding in the open. The Chamber had leaned towards the operator, reasoning that no area had been gained and that it was not clear the operator had built the structure; the majority of the Plenary upheld the dismissal of the action, basing its decision on the failure to remedy the violation within the period given within the licensed area. A dissenting opinion found it unlawful to close the entire open area. The reasoning for the Chamber's reversal and the Plenary's final ruling of upholding must not be confused. The full text was reviewed through a secondary publication. [12]
A building registration certificate is also not, in itself, a workplace license. Whether it is valid is assessed together with the structure and activity it covers, later works and the specific license conditions. Filing an action against zoning acts does not by itself stop the time limit for challenging a license cancellation. If necessary, the relationship between the two disputes is explained to the court, and appropriate interim protection is requested for each act. For a separate review of the fine relating to the structure, the review of objections to and annulment routes against zoning fines may also be consulted.
How are acquired rights and legal certainty invoked?
Long-standing licensed operation, the administration's earlier favorable inspections and the reliance placed on those acts when investing are important. Provisional Article 1 of the Regulation provides that workplaces lawfully licensed before its entry into force are not to be licensed again. This provision supports the protection of earlier licenses as regards time; it does not provide unlimited exemption against a danger that emerges later, a change in activity or new legal obligations. [3]
An acquired right that arose lawfully and the limitation of withdrawal of an unlawful act on grounds of legal certainty are separate matters. The nature of the license granted on the basis of a declaration, a false statement or fraud, a claim of manifest error, the administration's own failure to examine, the time that has elapsed, and the prospective effect of the intervention are assessed together. A general rule that "60 days have passed, so the administration can no longer act for any reason" cannot be established. [2, Art. 5–6; 12]
The operator's position is strong where the file shows that all information was correctly given in the initial application, that the activity and physical conditions have not changed, that the administration knew the situation, and that transitional provisions can be applied to the business. The administration's strong defense may be a new risk, a later defective change, a wrong declaration or a special provision. These counter-arguments must be answered; relying only on the phrase "vested right" is not enough.
Who files the action, against whom, and in which court?
The general competent court is the administrative court. Competence is determined by the general rule in Article 32 of the İYUK and, for acts connected with immovable property, special rules such as Article 34. It cannot be said that Ankara administrative courts are competent for all local licensing disputes. Where a regulatory act is itself challenged directly, competence and connection are examined separately. [1]
The claimant must be a person whose legitimate, personal and current interest has been infringed by the act. Where the license is held in the name of a company, the basic route is to file the action on the basis of the company's legal personality and its power of representation. Whether a partner, manager, lessor or owner of the property may file in his or her own name is assessed separately.
In a decision dated December 8, 2025, E.2025/3253, K.2025/3080, the Plenary Assembly of Administrative Litigation Chambers of the Council of State (İDDK) accepted that the representative of the company holding the license and a person holding 99 percent of the shares had a personal interest in the particular case. The Plenary overturned the rejection based on standing. Because there were dissenting opinions and because of the special structure of the case, the decision cannot be generalized to mean that every partner has an automatic right to sue for every company license. In addition, the decision does not determine that the cancellation was unlawful on its substance. [13]
The defendant is, as a rule, the administration that made the act; only the public officer who signed is not personally sued. The relationship between a municipal department letter, a mayoral approval or a ministry act is determined from the file. The existence of a procedure for the court to correct a wrong opposing party does not make defects in the claimant's standing or in the representation documents insignificant. [1, Art. 3, 14–15]
How are the time limit to sue and administrative applications calculated?
Where no special time limit applies, the time limit for an annulment action is 60 days; it begins on the day after the act is notified in writing. Notification papers, the electronic notification record and, where necessary, documents concerning the learning of an irregular notification must be preserved. The day on which an electronic message is opened and the day on which it is legally deemed notified may not be the same. The calculation of the period follows the rules of notification itself. [1, Art. 7–8]
Weekends and public holidays count toward the period; special rules apply where the last day falls on a holiday and on the suspension of work during the judicial recess. Waiting for the reasoning of the decision or for the complete administrative file does not by itself suspend a time limit that has already started running. A request for documents and a request to revoke the act are different applications.
Application against the existing cancellation act: Article 11 of the İYUK
Within the period to sue, the person concerned may apply to the superior authority or, if there is none, to the authority that made the act, requesting that the act be removed, withdrawn, amended or replaced by a new act. In the general regime this is not a mandatory preliminary objection. A duly made application under Article 11 suspends the time limit to sue; it does not suspend the implementation of the act. [1]
If the administration does not respond within 30 days, the request is deemed rejected. After an express or implied rejection, the period resumes from where it stopped, taking into account the days elapsed before the application. Hypothetically, if a valid Article 11 application is rejected after 20 days of the 60-day period have been used, the remaining 40 days apply, subject to other rules on time limits; a new 60 days does not begin. Repeated petitions do not revive a past time limit to sue. A CIMER record, a telephone call or a request for information is not treated as an Article 11 application unless its content and addressee are examined and it qualifies as one.
New license request and administrative silence: Article 10 of the İYUK
Where a new license decision is requested, Article 10 comes into play. If no answer is given to an application within 30 days, this constitutes an implied rejection for the purpose of bringing an action. The general time limit to sue is calculated after the end of that period. If a non-final answer is given in the first 30 days, a final answer may be awaited under the conditions of the law; the wait may not exceed four months from the date of the application. [1, Art. 10]
Article 10 also provides, under certain conditions, a new time limit to sue against an answer given later. This feature cannot be automatically transferred to Article 11. In addition, the processing periods for licensing in the regulation and the implied rejection period in the İYUK serve different functions. The administration's failure to respond does not give the operator a right to start operating without a license. [3, Art. 6]
| Act or application | General period | Start or important effect |
|---|---|---|
| Annulment action against license cancellation | 60 days | From the day after written notice; a special period applies if one exists. |
| Application under Article 11 of the İYUK | Within the period to sue | Suspends the existing period to sue; does not suspend implementation. |
| No response to an Article 11 application | 30 days | The remaining period to sue resumes after the implied rejection. |
| No response to a request for a new decision under Article 10 of the İYUK | 30 days | The general period to sue after the implied rejection; special responses are assessed separately. |
| Objection to a decision on a stay of execution | 7 days | Calculated from the day after notice of the decision; may be made once. |
| Appeal, or appeal on points of law where open | 30 days | Calculated from notice of the relevant decision in the manner provided by law. |
| Implementation of an annulment or stay of execution decision | Without delay, at most 30 days | Notice of the decision to the administration is the reference point. |
How is a stay of execution justified?
Filing an action does not by itself suspend a license cancellation, closure or sealing. Under Article 27 of the İYUK, a stay of execution requires both that the act is manifestly unlawful and that its implementation would cause harm that is difficult or impossible to remedy. The request may be made in the petition or, while the case is pending, by a separate petition. [1]
On the question of manifest unlawfulness, the following may be made concrete: absence of the authorization document, failure to give the mandatory period for a remediable deficiency, reliance on a report relating to another workplace, or application of a wrong sanction provision. On the question of harm difficult to remedy, the number of employees, cancelled contracts, reservations, stock that will spoil, loss of customers and difficulty of restarting the activity may be documented. A bare statement that "I will suffer commercial loss" is not enough.
The administration may argue that the harm can be compensated in money or that public safety requires the prohibition of activity. The file should therefore explain, on the one hand, the effect of the harm on the continuity of the business and, on the other hand, why the alleged technical danger was wrongly assessed or has been remedied. Economic loss does not take the place of the condition of manifest unlawfulness.
For acts whose effect will be exhausted by implementation, interim protection may be requested without waiting for the administration's defense, so that a new decision can be taken after the defense is received. Not every closure order can automatically be placed in this category. The reason why the act is not suitable for waiting must be shown for the specific file. Whether security is required is also assessed under Article 27; if no security is sought, the reason must be stated.
An objection to the decision on the stay request may be made once, within 7 days of notification, to the authority designated by the law. The same grounds may not be raised again; whether a new technical report, a new act or a changed legal situation constitutes a genuinely new ground must be explained. Interim protection does not mean that the case has been won; subsequent judicial decisions must be followed. [1, Art. 27]
Which documents should be in the case file?
In administrative proceedings the court has the power of its own investigation. Nevertheless, the operator should file the documents in its possession in an orderly way and state expressly which records it wants the administration to produce. In particular, the situation on the date of the act must be distinguished from conditions completed later. After a cancellation, remedying a deficiency does not automatically make the earlier act unlawful; it may nonetheless be effective for a new application or for lifting an interim prohibition. [1, Art. 20; 3, Supplementary Art. 3]
| Document group | What it shows | Practical note |
|---|---|---|
| License, its annexes and the earlier license file | Activity, area, persons and date | Ancillary activities and transfer records must be included. |
| Cancellation, closure, sealing and notice documents | Subject matter and time limit of the action | The date and number of each act must be recorded separately. |
| First and subsequent inspection records | The inspection regime to be applied | The chronology is important for assessing Supplementary Article 3. |
| Letter granting time to comply, delivery record, re-inspection | Whether the remedy procedure was applied | It must be shown to whom notice was given and which deficiency it covered. |
| Project, occupancy permit, fire brigade report and technical opinion | Material conditions and the basis of the challenge | The report must be checked for its fit with the activity, area and date. |
| Authorization and power of attorney documents | Signature and authority of the office | The valid document on the date of the act may need to be requested from the administration. |
| Registry and representation documents | Standing and representation | The distinction between company, partner and operator must be clear. |
| Contracts, payroll and financial records | Interim protection and loss | Turnover and net profit must not be confused. |
For technical disputes, a request for an on-site examination and expert review should be framed with the questions to be answered: Is the measurement in the report correct? In which area is the violation? Has the remedy been completed? Was the activity class correctly determined? The written procedure of administrative litigation, which requires the submission of documents, should not be replaced by the expectation that the witness-hearing procedure of civil courts applies in the same way.
If the court annuls the cancellation, does the license automatically return?
An annulment decision deprives the challenged administrative act of its legal basis; as a rule, it requires the legal position that existed before the act to be re-established. However, the court does not become the authority that issues the license in the administration's place. The operative part and reasoning of the decision determine which acts the administration must carry out. [1, Art. 2, 28]
If the act terminating the existing license has been annulled, the license record must be made valid again in accordance with the scope of the decision, and the activity barrier relying on it must be removed. If the act rejecting an application has been annulled, it cannot be said that a license that did not previously exist has come into being by itself; the administration must decide again within the legal framework set by the court.
Where the annulment rests only on a defect of competence or procedure, the administration may make a new act in line with the court's reasoning. It may not render ineffective, under an apparently new reason, a question that has been finally resolved on the merits. On the other hand, where a genuinely new technical danger or a different legal ground exists, the new act is separately subject to review of its lawfulness.
A court decision does not mean that the business will never be inspected again. When planning an investment or a reopening, the deficiency that the judicial gain removes and the material conditions that continue to exist should be assessed together.
The difference between revival of a license and obtaining a new license
"Revival" (ihya), in this context, describes the restoration of the operative legal effect of a previous license. "Establishment" (ihdas) refers to the creation of a new act or regulation. What determines the outcome of a dispute is not which of these words is used in the application, but why the earlier license ended and what legal result is sought.
| Situation | Basic act that may be sought | Limit |
|---|---|---|
| The administrative act that cancelled the license has been annulled by a court or its enforcement has been stayed. | Implementation of the judicial decision and restoration of the earlier status to the extent of the decision. | Separate and valid other barriers to activity are examined separately. |
| The act granting the license has been annulled by a court as unlawful. | A new application may be assessed under the new legal and material conditions. | An annulled license cannot be revived merely by relying on its former existence. |
| The cancellation has become final; later the remediable deficiencies were completed. | A new license application, if special legislation permits. | A new application does not renew the time limit to sue that was missed against the earlier cancellation. |
| The reason for the temporary prohibition under Supplementary Article 3 has been remedied. | Lifting of the inspection and prohibition decision. | Ending the prohibition does not in every case mean the same act as a new license being issued. |
In a decision dated February 13, 2024, E.2023/8135, K.2024/862, the Fourth Chamber of the Council of State (Danıştay 4. Daire) upheld the rejection, as lawful, of a request to revive the license of a fuel station whose earlier license had been cancelled by a court decision, based on a building registration certificate obtained later. Since the earlier license had disappeared by reason of the court decision, the application under the new circumstances was distinguished from revival of the old license. The full text was reviewed through a secondary publication. [14]
This case is different from one in which the administrative act cancelling the business's license is annulled by a court. In the first, the legal basis of the license has disappeared; in the second, the intervention that ended the license has been removed. Approaching both situations with the same statement, "the court annulled the license", may lead to the wrong application and loss of time.
How is a seal removed after a court decision?
Under Article 28 of the İYUK, the administration must carry out the requirements of decisions annulling an act and staying its execution without delay. The 30 days in the law is the longest period, running from notice of the decision to the administration; it does not give the administration a freedom to wait 30 days in every file. An application by the person concerned asking for implementation is not a general precondition for this legal obligation to arise. Nevertheless, an application is useful for documenting the steps required and the actual implementation. [1, Art. 28]
The implementation application may specify the following matters:
- The court, the case number, the date of the decision and the information on notice to the administration.
- Correction of the license record in line with the decision and written notice of it.
- Lifting of the closure or prohibition falling within the scope of the decision.
- Removal of the seal by authorized personnel and the drawing up of a record.
- Notification to other institutions, and correction of notifications, arising from the act.
An appeal or an appeal on points of law by the administration does not by itself stop implementation of the decision. Whether the higher judicial authority has ordered a stay of execution is checked separately. In a license dispute, a general requirement of finality cannot be raised by relying on exceptions set out for other types of act. [1, Art. 28, 52]
The operator should not remove the seal itself and begin operating. Article 203 of the Turkish Penal Code No. 5237 (TCK) regulates the removal of a seal placed under the law or on the order of a competent authority, or acting contrary to the purpose for which it was placed. Not physically tearing the seal off does not in every case make continuing the activity lawful. For criminal liability relating to zoning violations, the review of the offense of causing zoning pollution is also relevant. In criminal liability, the legal basis of the seal, the scope of the judicial decision, the act and the intent are examined separately; for this reason, the judicial decision and the implementation by the competent administration should be documented together. [5, Art. 203]
Where there is more than one seal in the workplace, placed by different institutions or on different grounds, it must be determined which of them the decision covers. Where a permit is sought from the competent authority to remove perishable goods or to carry out a necessary technical operation, its scope must be specified; this differs from proceeding on the assumption that the prohibition of activity has ended.
What routes are followed if the administration does not implement the decision?
Non-implementation of a decision, incomplete implementation and a new act that renders the decision ineffective must be distinguished. First, notice of the decision to the administration, the steps needed for implementation and the existing factual situation are documented. If a new rejection or closure act has been made, it must be challenged separately and an application for a new stay of execution considered. The existence of an earlier action does not automatically preserve the time limit for the new act.
Article 28(3)–(4) of the İYUK provides for a route to compensation from the administration for losses arising from non-implementation of a court decision. Even where the fault of a public officer is alleged, the claim for compensation under this provision is directed at the administration. Disciplinary or criminal liability is considered on its own conditions; it cannot be said that every delay in implementation automatically results in a criminal conviction. [1; 4, Art. 138]
Payment of compensation by the administration is not an alternative to complying with an enforceable judicial decision. For the business, the priority is to secure the real result of the decision; the loss that has arisen may separately be claimed on a separate legal basis.
Can compensation and lost profit be claimed because of the closure?
Losses caused by a license cancellation or closure may be claimed in a full remedy action. Article 12 of the İYUK provides for the options of a direct full remedy action for losses arising from an administrative act, filing together for annulment and full remedy, or filing a full remedy action after an annulment action under the conditions laid down in the law. The time limits and starting points for these must be determined according to the file. For administrative acts, the prior application and time regime in Article 13 do not apply in an identical way to every loss arising from a license cancellation. [1]
An annulment decision is not an automatic acceptance of every loss item claimed. The occurrence of the loss, its amount and a proper causal link with the act must be shown. The administration may argue that the business could not have operated for another reason, that the claim is hypothetical, or that the loss calculation did not deduct expenses.
- Loss of profit: Instead of expected turnover, the expenses saved and the net profit that could realistically have been earned are assessed, according to the nature of the activity. Past period records, seasonality and capacity matter.
- Continuing expenses: It must be shown that rent, staff and mandatory maintenance costs were actually paid and are not claimed a second time under other accounting items.
- Contract and stock losses: For cancelled orders, reservations, penalty clauses or spoiled goods, documents, payment and a direct link are required.
- Non-pecuniary loss: It does not follow automatically from the existence of a closure; the claimant's status and the concrete effects are assessed separately.
In its decision in the case of Çağdaş Petrol Ürünleri Pazarlama Otomotiv Tic. ve Tur. Ltd. Şti., application No. 2015/12306, dated November 28, 2018, the Constitutional Court examined the connection between economic value and the right to property in a dispute concerning a license and a new license application. The Court found that the failure to evaluate with sufficient reasoning the substantive claims of loss alleged to arise from the administration's acts was problematic in terms of the procedural guarantees of the right to property. The finding of a violation and the order for a retrial do not mean that a new license is granted directly to the applicant or that the entire loss claimed is accepted. The full text was reviewed through a secondary publication. [16]
New license applications, transfers and changed conditions
Where the cause of cancellation can be remedied and no obstacle exists in special legislation, a new license application may be made. The subject of the application must be stated clearly: is the implementation of a court decision sought, the lifting of a temporary prohibition, a new license, or a transfer? Combining these distinct requests in a single unclear petition complicates which act and which time limit apply. Where the business is operated on municipal property, the eviction from municipal property and Law No. 2886 article may be consulted for the eviction dispute.
Under Article 6 of the Regulation, a receipt is issued on application, and deficiencies identified in the preliminary review are shown there. Licensing periods begin on completion of the missing documents. The provisions of Article 12 for sanitary workplaces, Article 23 for second- and third-class non-sanitary workplaces and the relevant special procedures for places open to the public must not be confused. [3]
In its decision dated December 25, 2023, E.2023/7271, K.2023/7311, the Fourth Chamber of the Council of State (Danıştay 4. Daire) considered the application for a grocery shop and the requirement that the applicant complete the required forms and documents. The Chamber assessed the non-application of the procedure for determining which documents the applicant must complete. The decision does not mean that everyone who makes an incomplete application automatically obtains a license. The full text was reviewed through a secondary publication. [15]
On transfer, where the activity subject, area of activity and address remain unchanged, a license is issued in the name of the new operator on the basis of the existing file under Article 8 of the Regulation. The provision that a new license cannot be issued until legal violations arising from the operator's own fault are remedied is also taken into account. Use of an old file does not mean that changed physical conditions cannot be inspected. The transfer of the business does not make a cancelled license valid again by itself.
A joint entrance or exit, a change merely in the street name or number of the address, relocation of the business to another place, and succession through inheritance produce different results. In cases requiring renewal or conformity under Article 8 of the Regulation, a three-month application period applies; for heirs, a six-month application period applies, together with the 15-day completion procedure granted upon determination. A transfer of the business does not make a cancelled license valid again by itself.
In apartment buildings or residential complexes, Article 24 of the Condominium Law No. 634, the management plan and Article 5 of the Regulation are examined together. For some activities, unanimity is important; for some places open to the public, the management plan and majority voting conditions matter. The consent of the unit owners does not replace zoning or fire conditions; nor can it be said that a use prohibited by law is always liberalized by unanimity. [3; 6]
Legal remedies, costs and individual application
An appeal against a decision of the administrative court is made within 30 days of notice, subject to the finality provisions of the law. Review of an appeal against a decision of the regional administrative court is considered separately. Article 46(1)(e) of the İYUK provides for an appeal on points of law in actions concerning acts that prohibit a specific commercial activity indefinitely or for 30 days or longer. Article 46(2), amended in 2026, contains a separate appeal regime, with exceptions, for decisions given anew after a first-instance decision is quashed on appeal, in cases other than those under the first paragraph. For this reason, it cannot be said that "all license cases become final at two levels" or that "all of them necessarily go to the Council of State". [1, Art. 45–46]
Court fees, postal costs, expert fees, a possible security and the risk of an opposing party's attorney fee are assessed together. Current amounts depend on the type of claim and the date of the procedural act. Representation by a lawyer is generally not mandatory; the authorized representation of a legal entity and the lawyer's power of attorney are examined separately. Where legal aid is needed, its conditions and documents are submitted separately. For a foreign natural or legal person, the validity of the representation documents, translation and, where necessary, certification are also taken into account. [1, Art. 3, 6, 31]
An individual application to the Constitutional Court does not replace an ordinary license action. The application requires that effective administrative and judicial remedies for the alleged rights violation be exhausted, and that the general 30-day period under Article 47 of the Law No. 6216 be observed. Whether full remedy is an effective route where loss is alleged should also be assessed. It is not correct to assume that every license cancellation is an automatic violation of property rights, or that an individual application will directly result in a license being issued. [16; 17]
Conclusion
Effective legal protection against the cancellation of a workplace license does not consist only of filing an annulment action. First the act, the competence, the class of the business and the stage of inspection must be identified; the time limit to sue must be protected; and the application for a stay of execution must be built on evidence of unlawfulness and concrete harm. The difference between the first inspection, subsequent inspections and the provisions on special sectors directly changes which sanction may be applied.
Where a court decision has been obtained, the goal is to implement the real legal result of the decision. Revival of the license, a new license application and removal of the seal are separate procedural needs. The business should not return to operation without examining the legal basis of the earlier license, the reasoning of the decision and any continuing independent obstacles. A documented and correctly sequenced process protects both the business's rights and the lawful restoration of operating conditions.
Frequently Asked Questions
Can a workplace keep operating after filing an action against a license cancellation?
Filing an action alone does not give permission to operate. A stay of execution decision is required to suspend the effect of the cancellation or closure, if its conditions are met. Other valid obstacles to activity are also examined separately. Details: Stay of execution.
Is an objection to the municipality first mandatory?
An application under Article 11 of the İYUK is not mandatory in general. Whether a separate preliminary procedure exists under special legislation is checked. A duly made application suspends the time limit to sue, but does not stop the closure. Details: Time limits and applications.
If I apply to the municipality, do I gain a new 60 days?
In an Article 11 application to remove the existing act, as a rule no new 60 days arises. The days used before the application are taken into account, and the remaining period runs after the rejection. The answer possibilities under Article 10 for a request for a new decision are different.
Must 15 days be given before every license cancellation?
No. The applicable rule is determined by whether the violation can be remedied and by the special regulation. There are special situations in which the administration is accepted as having no legal interest in granting a period; this exception cannot be generalized to every zoning or safety violation. Details: Period for remedy.
Does Supplementary Article 3 allow closure for at most 15 days at all workplaces?
No. The 15-day upper limit in the provision relates to sanitary establishments. For non-sanitary establishments, the prohibition lasts until the violations and deficiencies are remedied. Places open to the public and special provisions are also assessed separately.
Does having been licensed for years prevent cancellation?
An earlier license is important for legal certainty and transitional provisions; however, it does not give absolute protection against a new danger, a wrong declaration or violations arising later. The conditions at the dates the license was granted and cancelled are compared.
For a company license, can a company partner file an action in his or her own name?
The basic route is for the company to sue through its authorized representative or lawyer. A partner's own standing to sue is assessed according to a personal and current interest; it cannot be accepted automatically for every partner.
If the court annuls the decision, is a new application required?
Where the act that removed the existing license has been annulled, implementation of the decision and restoration of the former status arise. Where the rejection of the first license application has been annulled, the administration decides again. Annulment by a judicial decision of the act granting the license is different. Details: Revival and a new license.
Can the administration wait for the court decision to become final before implementing it?
In a license dispute, it generally cannot wait. An appeal or appeal on points of law does not by itself stop implementation; whether the higher judicial authority has ordered a stay of execution is checked. The obligation to implement arises on notice of the decision to the administration.
Can I remove the seal myself?
A seal should not be removed on your own because you believe a court decision or a remedy document exists. The implementation by the competent administration and its record must be obtained; it must also be determined whether there is another seal or a prohibition of activity. The legal and factual conditions under Article 203 of the TCK are also especially important.
Does a building registration certificate revive a cancelled workplace license?
Not by itself. The reason why the earlier license ceased, the scope of the building registration certificate and the conditions of the new application are examined. A building registration certificate does not replace all activity permits.
Can the whole turnover for the closure period be claimed as compensation?
Turnover is not directly the same as net profit lost. Expenses saved, actual activity capacity, seasonality, other reasons for closure and the risk of double counting are assessed. Each loss item must be explained with documents and a causal link.
How long does a license cancellation action take?
There is no reliable single duration for all files. Service, defense, technical examination, on-site inspection and the stages of appeal affect the outcome. A stay of execution is a separate interim protection assessment; it cannot be promised that a positive decision will be given on a particular day.
Can the fire deficiency period granted up to May 31, 2026 still be used?
The date in Provisional Article 9 has passed. In addition, the period under that provision was granted not to continue operating, but to remedy the deficiencies in the accommodation establishments specified. The date of the event, the scope conditions and subsequent administrative acts are assessed together.
