Money arriving in a bank account does not, by itself, show that business income has been earned or that an income tax liability has arisen. For taxation, the real reason for the transfer, the type of income and the conditions of the relevant tax must be determined. Repayment of the principal of a loan, a transfer between a person’s own accounts and sales revenue cannot be treated in the same way. By contrast, a genuine gift, even if it falls outside income tax, may have consequences for inheritance and transfer tax.
This article deals with account activity within Türkiye. In responding to an examination, rather than relying only on the description on the transfer receipt, it is necessary to show with documents from whom the money came, for what relationship and on what date. The number and amount of transfers are important indicators; however, they do not replace legal characterization.
Why are bank transactions subject to a tax examination?
The tax administration may investigate inconsistencies between declared income and bank records. Frequently repeated customer payments, sales descriptions, online sales records or personal account use that is inconsistent with the scale of the activity may call for an examination. Having opened a personal account does not prove that the account is not used for commercial purposes; and not every incoming amount in a business account is sales income.
Under Article 3/B of the Tax Procedure Law (VUK), the real nature of the event giving rise to the tax is what matters. The administration must establish a link between the bank transaction and a taxable activity; and the taxpayer must explain the basis of the relationship that they claim to be out of the ordinary. Treating the entire amount as net income merely from the total of incoming amounts may overlook refunds and duplicate transfers.
Is a bank’s request for an explanation the same as a letter from the tax administration?
A bank’s request for documents within the scope of its transaction security or anti-financial-crime obligations does not in itself mean a tax assessment. A request for information from the tax office, a request to produce documents within an examination and an invitation to explain (izaha davet) under Article 370 of the VUK are also separate acts. The legal basis of the document, the period requested and the time limit for a response must be read as carefully as its heading.
There is no single general amount that automatically taxes every transfer, nor a safe harbor below that amount that prevents a tax examination. The tax liability arises according to the real nature of the transaction. Confusing banking reporting thresholds with the scope of income tax leads to wrong conclusions.
How are borrowed money and repayment of a loan explained?
In a genuine loan relationship, the money received is assessed together with the obligation to repay it. Recovery of the principal of a loan previously given, on the other hand, is not new income. However, a transfer described as “loan” may not prove the whole relationship on its own. The first outflow of money, the correspondence of the parties, the contract, the payment plan and the actual repayments are meaningful together.
For example, hypothetically, suppose a person sent 300,000 TL to a friend and received the same amount back six months later. If the first transfer and the later refund can be matched, a concrete answer can be given to the claim that the returned principal is a sales price. If there are documents showing that the first transfer was made for another purpose, similarity of amounts alone will not suffice.
Distinguishing interest, advances and reimbursement of expenses
If interest or another return is received in addition to the principal, the taxation of that additional amount is assessed separately. The expression “loan repayment” does not by itself take interest income out of tax. In an activity of continuous lending, the nature of the relationship may also change.
Reimbursement of a documented expense made on behalf of an employer, a refund of the price of a cancelled purchase, or the return of an advance for a transaction that did not take place must each be explained separately. The refunded amount is linked to the first payment and the cancellation document. Rather than a round-number explanation, it is shown which expense was repaid on the basis of which document.
Are family money transfers and gifts tax-free?
In transfers between mother, father, child, spouse or sibling, kinship does not remove the need to investigate the reason for the transaction. The transfer may be a loan, a contribution to shared expenses, performance of a duty of support, the price of goods sold or a gratuitous donation. It cannot be said that these produce the same tax result.
If there is a truly gratuitous transfer of assets, an assessment is made under Law No. 7338. The taxpayer is, as a rule, the person who obtains the gratuitous acquisition. For 2026, the general exemption for transfers without consideration is 66,935 TL; this figure should not be seen as an unlimited exemption for all family transfers or one that can be used again with every transfer. The integrity of the transfer, the relevant year and the statutory exemptions are examined separately.
Customary gifts and the filing period
The Law also provides a separate exemption for certain gifts that are customarily given according to tradition. It cannot be assumed that every high-value family support falls within this scope. The amount of the gift, the circumstances of the event and the scope of the exemption must be assessed together. The statutory distinction concerning real estate should also not be overlooked.
For transfers without consideration that give rise to a filing obligation, the general filing period is one month following the date on which the asset was legally acquired. This period should not be confused with the periods for transfers by inheritance. Therefore, when making the statement “this money was not business income, it was a gift,” the steps required for inheritance and transfer tax are also checked.
Are unexplained transfers treated as business income?
The absence of a description on the transfer receipt does not by itself create a presumption of business income. By contrast, regular receipt of money from many different senders, when combined with product deliveries, advertisements, order records and shipping documents, can strengthen an allegation of commercial activity. The continuity and organization of the transactions are important within the framework of Article 37 of the Income Tax Law (GVK).
A finding that there is no business income does not mean that other types of income are also excluded. Rent, wages, interest or, if its conditions are met, occasional income are subject to separate provisions. A transaction said to be one-off is also not exempt from all taxes merely for that reason.
| Account activity | Document prominent in the explanation | Distinction to watch |
|---|---|---|
| Transfer between own accounts | Statements of both accounts belonging to the same person | Not recording the same amount again as income |
| Repayment of loan principal | Initial payment, contract and repayment records | Separating interest or return |
| Gratuitous transfer from family | Purpose of the gift and the parties’ explanation | Possibility of inheritance and transfer tax |
| Collection from a customer | Invoice, order, delivery and refund records | Difference between gross receipts and net income |
Transfers between a company and a partner
For a payment from a company to a partner’s personal account, merely writing “loan” is not enough. It is investigated whether there are company records, a partners’ current account, wages, a profit distribution or another legal reason. Because the assets of a company and a natural person are separate, these transactions cannot be treated as equivalent to a transfer between a person’s own bank accounts.
It also cannot be automatically accepted that all money received in a joint account is the income of a single account holder. To whom the money economically belongs and how the account is used must be determined. Authority to dispose of the account and the real owner of the income are not the same matter.
Which documents should be prepared to respond to the examination?
First, complete account statements for the examination period are obtained; the response is not limited to a few selected transfer receipts. A worksheet may be prepared for each transaction containing the date, sender, amount, stated reason and supporting document number. Internal transfers, refunds and circulation of the same money are marked separately. Transactions for which there are no documents are also explained separately, without being hidden.
The consistency of contracts, invoices, delivery records and correspondence with the transaction dates is important. A one-sided statement prepared afterwards may not carry the same weight as records created at the time of the event. Preparing false or backdated documents is not a method of defense; it may give rise to new legal and criminal risks.
In responding to the administration’s allegation of commercial income, expenses are also shown with properly prepared documents. In income tax, gross receipts and earnings differ; VAT and other types of tax are examined according to their own rules on the event giving rise to tax and the tax base. The calculation method of one tax should not be carried directly over to another.
If an assessment is made, which act becomes the subject of the case?
An examination report or a request for information is not the same as a tax and penalty notice (ihbarname). Explanations can be prepared against the findings of the report; as a rule, the subject of a case is the assessment and penalty act that produces legal consequences. In the notice, the period, type of tax, difference in tax base and the basis of the calculation are each reviewed separately.
The general time limit for filing a case in the tax court, unless there is a special provision, is 30 days from the day following service of the notice. The date of electronic service and the date on which the document is actually opened are not always the same. Submitting an ordinary explanation or request for information petition to the tax office does not automatically stop this period. The options of a case, correction, voluntary disclosure (pişmanlık) or an invitation to explain should be assessed according to the nature of the document.

Conclusion
A strong explanation of a bank transaction shows the reason for the money with records created at the time of the transaction. It is necessary to separate loans, gifts and sale proceeds; to clear out duplicate transfers; and to assess other possible types of tax. The response to the examination letter and the calendar for a case against the notice should be tracked together. By examining the specific account activity and service records, it can be determined which transaction will be explained with which document.
Frequently Asked Questions
Is all money that arrives without a description subject to tax?
No. As explained in the section “Are unexplained transfers treated as business income?”, the real reason and other data on the activity are assessed together. The absence of a description is not enough on its own. Related explanation
Does tax arise on money from my family?
The distinction in the section “Are family money transfers and gifts tax-free?” applies. A loan and a gratuitous donation are not the same; in a genuine donation, inheritance and transfer tax is examined separately. Related explanation
Can I explain a loan repayment with the transfer receipt alone?
As in the section “How are borrowed money and repayment of a loan explained?”, the first transfer, the repayment and the other records of the relationship should be presented together. Whether the receipt is sufficient depends on the circumstances of the event. Related explanation
Does the time limit for a case wait after I respond to the examination?
As stated in the section “If an assessment is made, which act becomes the subject of the case?”, the time limit for a case concerning the notice is tracked independently. An ordinary explanation petition does not automatically stop the period. Related explanation
