Summary

Who can bring an action against a neighbor’s construction permit? The 60-day time limit, the date of learning, objection to the municipality and the conditions for a stay of execution.

A construction permit on a neighboring parcel may be made the subject of an annulment action before the administrative court if it violates your current and legitimate interest in your property and is unlawful. The general time limit for filing an action is 60 days; the fact that the neighbor was not served with notice does not mean that the period never began to run. A stay of execution decision is separately required for the construction to stop. The unlawfulness of the permit and the construction being carried out contrary to the permit give rise to different acts and different routes of application.

Which act is challenged in an action against a neighbor’s construction?

That a construction project causes disturbance in the surroundings does not show that the construction permit is unlawful of its own accord. The first review is an assessment, taken together, of the implementation zoning plan in force, the plan notes, the zoning status, the approved architectural project and the building as it stands on the site. If the subject of the action is not correctly determined, a technically justified objection may run into a problem of time limit or legal interest.

Separating the content of the permit from the contravention on site

If the permit and its annexes approve a project that exceeds the permitted height or the building setback line, the lawfulness of the permit is in question. If the project complies with the rules but the contractor has departed from the layout in the project, the first step is to request the identification of work contrary to the permit and action under Law No. 3194. The two problems may also be present together in the same file.

For example, the project may have preserved the side garden, while a room has been added to that area on site. In that case, bringing an action against the earlier permit alone may not be enough to have the later-built room reviewed. If a subsequent alteration permit has been issued, its date, scope and the information about learning of it must be examined separately. A new permit does not automatically create a new period for filing an action in respect of all earlier acts.

Should the zoning plan also be challenged?

If the source of the contravention is the plan decision on which the permit rests, the plan may also need to be reviewed. İYUK Art. 7/4 regulates the possibility of bringing an action, upon the application of a regulatory act, against the regulatory act, against the implementing act, or against both. However, saying that you learned of the existence of the plan later, or waiting for an expert report, does not in every case restart a period for filing an action that has already run.

It must be clear to which scale of plan and which plan note the objection is directed. The function of the implementation plan that determines the development of a parcel is not the same as that of a higher-scale plan. In the statement of claim, instead of requesting the annulment of all the plans in an undefined way, the decision giving rise to the dispute and its connection should be shown.

Who can bring an action against a neighbor’s construction permit?

In an annulment action, the criterion is a violation of interest caused by the act. For the owner of an adjoining parcel, effects on distance, light, ventilation, access, safety or use may show this relationship. Even so, it cannot be said that merely stating “I live in the same neighborhood” gives an unlimited right to sue against every permit.

The position of the owner, the unit owner and the tenant

The land registry record, the location of the independent unit, the lease and documents of actual use show the applicant’s connection to the act. The legal position of a tenant is not the same as that of the owner; the tenant must make concrete how he or she is directly affected by the act. If it is contemplated that the building management will bring the action, its authority of representation and the connection of the act to the management’s field of duty must be assessed separately.

The effect on view or on property value may be important as regards the relationship of interest. However, the violation of interest and the merits are separate matters. For the annulment of the permit, there must also be unlawfulness in respect of the plan, the legislation or the other elements of the act. Not every change of view eliminates the neighboring parcel’s right to build.

How does the 60-day period begin in an action to annul a construction permit?

Under İYUK Art. 7, the general time limit for filing an action in administrative courts is 60 days. For the person to whom the permit is notified, the date of notification is important. For third parties such as a neighbor, a discussion of actual learning arises. The date on which you saw the construction, a complaint petition you submitted earlier and correspondence concerning the permit may serve in the file as evidence of learning.

Is it safe to wait to obtain a copy of the permit?

Obtaining the official copy later does not in every case nullify an earlier learning. Knowledge of the construction site, existing correspondence and the stage of the construction are assessed together. For this reason, the dates of first noticing, first complaint, request for documents, reply and service should each be recorded separately. Commissioning a technical report does not of its own accord stop the period for filing an action.

In calculating the period, the starting day, holidays and any statutory extensions that may apply are also checked. A chronology reduces the risk of missing the period through the thought “I am waiting for a reply from the municipality.” Since objections about the time limit may be examined by the court before the merits, a legal calendar should be built first.

Does an objection to the municipality stop the period?

Under İYUK Art. 11, an application made within the period for filing an action to the superior authority, or, if there is none, to the authority that performed the act, for the act to be withdrawn, revoked or amended or for a new act to be made, may stop the period. If no reply is given within thirty days, the application is deemed rejected. After an express or implied rejection (zımni ret), the remaining period continues to run, taking into account the days that passed before the application.

A mere request for information, a general complaint or a CİMER record is not automatically regarded as an Art. 11 application. The content of the petition, the act to which it is directed, its addressee and its date are decisive. A request to revoke a permit after the period has expired also does not, as a rule, revive a lapsed right to sue. Art. 10, on requesting a new administrative act, and Art. 11, directed at an existing permit, should not be confused with each other.

How is the construction stopped through a stay of execution?

Filing an action does not stop the implementation of the permit of its own accord. Under İYUK Art. 27, the conditions that the act is clearly unlawful and that its implementation would cause damage that is difficult or impossible to remedy must be shown together. The progress of the construction cannot be accepted as sufficient on its own without making the unlawfulness concrete.

Technical documents supporting the request

A conflict between the approved site plan and field measurements, an exceeded permitted elevation, or a layout contrary to the plan note may explain the allegation of unlawfulness. A shadow study, the safety of the neighbor’s foundation, the closing of access and dated images of rapidly advancing work may make the scale of the damage concrete. It should be stated where, when and in which direction a photograph was taken.

In an urgent situation, the court may issue a provisional decision without waiting for the defense, within the statutory conditions concerning acts whose effect would be exhausted by implementation. This is not an automatic result in every construction file. On security, İYUK Art. 27 applies; the same procedure as an interim injunction in a civil court or a stay of enforcement is not involved. The seven-day objection period for stay of execution decisions is followed separately.

Where, against whom and with which documents is the action filed?

In a zoning dispute concerning an immovable, under İYUK Art. 34 the administrative court of the place where the immovable is located is taken as the basis. The defendant is the administration that issued the permit. The permit holder or the contractor is not named in place of the defendant administration in an action to annul the permit merely because he or she carried out the construction; joining the case, depending on his or her interest, is a different matter.

The following documents are useful in the initial file:

  • The land registry, lease and location documents showing the plaintiff’s connection to the immovable.
  • The permit and, if any, the alteration permit; the approved architectural project and site plan.
  • The zoning status, the plan sheet, the plan notes and the relevant plan amendments.
  • Records showing the dates of first learning, complaint, application and reply.
  • Dated photographs, existing measurements and a technical opinion.

Not having been able to obtain the documents does not justify behaving as if the period were not running. By sufficiently identifying the subject of the action, it may be requested that the administration’s file be obtained. In the statement of claim, instead of merely saying “it is contrary to the zoning legislation,” it should be explained between which document and which rule there is a conflict.

What is investigated in an on-site examination and expert review?

The review begins with the plan and the legislation that had to be applied on the date the permit was issued. The plan notes, the calculation of the floor area ratio (emsal), the building order (yapı nizamı), the setback line, the elevation and the height are addressed together. Whether a rule that changed later can be applied directly to an earlier act requires a separate legal assessment.

Instead of asking the expert only whether the building is “suitable or not,” verifiable questions should be put: Which plan sheet was used? On which boundary is the measurement based? How was the basement floor calculated? In what respect did the alteration project change the earlier project? The reasoning of the technical report, its supporting documents and its method of measurement should be open to objection. The task of making the legal decision belongs to the court.

A Council of State decision: Does an expert report start a new period for filing an action?

In the decision of the 6th Chamber of the Council of State (Danıştay) dated April 3, 2023, E.2020/6232, K.2023/3217, the date of learning arising from earlier applications concerning the neighbor’s development was important. In upholding the conclusion that the action brought against the underlying plan after the expert report in the permit case was time-barred, the Chamber did not accept the approach that obtaining a technical assessment later is a new starting point.

The practical counterpart of the decision is that the chronology of learning should be examined without waiting for a technical report. The opinion of the judge rapporteur (tetkik hâkimi) in the decision differs from the operative part of the court; the conclusion relied on in this article is the affirmance. The administrative application provisions of the period reflected in the text of the decision should not be used in place of the thirty-day implied-rejection period valid today. Is the building demolished immediately after the permit is annulled?

An annulment gives rise to an obligation on the administration to implement the decision. Under İYUK Art. 28, an act or action must be taken in accordance with the requirements of the decision without delay and at the latest within thirty days of service on the administration. The implementation of a permit annulment decision within this scope is not postponed of its own accord merely because an appeal has been filed; stay decisions that have been separately issued are assessed.

However, the annulment of the permit and the actual demolition of the building are not the same act. The present state of the building, the ground for annulment, the possibility of a new lawful permit and the proceedings under Law No. 3194 are examined. No guarantee of outcome can be given in the form “the permit is annulled, so the building will certainly be demolished the next day.” Compensation for the neighbor’s damage is also addressed separately in the appropriate court route.

Conclusion

An effective application against a neighbor’s permit rests on preserving the date of learning and on showing which concrete rule the permit contravenes. Annulment of the permit, review of unauthorized work and remedy of neighborly damage are not the same request. In the first stage, a chronology of acts and time limits should be prepared; in a construction that is ongoing, a request for a stay of execution should be assessed with technical evidence.

Frequently Asked Questions

Can I automatically bring an action because I am a neighbor?

Being a neighbor is an important connection; even so, the effect of the act on your current and legitimate interest must be explained. Standing to sue and the unlawfulness of the permit are examined separately.

I complained to the municipality; do the sixty days start again?

Not every complaint stops the period. If the conditions of İYUK Art. 11 are met, the period that was stopped continues with the part remaining after the rejection; a fresh sixty days is not given from the beginning.

Once a permit action is filed, must the contractor stop work?

The filing of the action is not sufficient on its own. A legal basis is required, such as a stay of execution decision or a stop-work act by the competent administration.

Is a permit annulled just because my view has been blocked?

The effect on the view may support the relationship of interest in a specific case. For annulment, unlawfulness in respect of the legislation, the plan or the other elements of the act must also be shown.

Is mediation mandatory before a permit action?

An action to annul a permit in administrative justice is not within the scope of the mandatory mediation that applies to private-law actions concerning neighbor law.
