Summary

Waiving alimony in an uncontested divorce, the child's right, annual increases and school costs. How the protocol can be changed later, with guidance on applying the 2026 decisions.

The alimony clause in an uncontested divorce protocol should state clearly who it is for, how much, from which date and how payment will be made. A spouse's free and voluntary waiver of poverty maintenance and a waiver of the child's future alimony right do not produce the same result. A record that existing alimony will not be increased later should also not be confused with a declaration giving up a first claim for poverty maintenance. [1–3]

A well-drafted protocol does not only make the divorce hearing easier; it also reduces later disputes over payments, increases and school costs. Broad phrases such as "the parties do not claim anything from each other" may leave unclear which right is being regulated. This guide focuses on setting up the alimony provisions and on how they should be assessed when circumstances change.

How do the conditions of an uncontested divorce affect the alimony clause?

Under Article 166/3 of the Turkish Civil Code (TMK), the marriage must have lasted at least one year, and the spouses must apply together or one must accept the other's application. The judge must hear the parties in person, be satisfied that their consent was freely given, and find the arrangement on the financial consequences of the divorce and on the children appropriate. A lawyers' agreement alone, or the submission of a signed text, does not replace these conditions. [1]

The judge may propose changes to the arrangement in the interests of the parties and the children. If the parties accept those changes, the court may decide on an uncontested divorce. In this way, the protocol does not create an ordinary and unlimited area of freedom of contract, particularly where the child's right to care is concerned.

Spousal alimony and child maintenance should be written separately

Poverty maintenance for a spouse and contribution alimony (iştirak nafakası) for a child concern different beneficiaries and conditions. Where there is more than one child, the amount and payment arrangement for each child should be understandable. A single figure described as "total for the mother and children" may cause enforcement problems when one child comes of age or when spousal alimony ends. [1]

Interim maintenance (tedbir nafakası) for living costs until the divorce becomes final should also be considered separately. No gap or overlap should be left between the start of the final alimony and the end of the temporary payment. The wording of the protocol is as decisive as what the court records in the operative part of the judgment.

Can a waiver of poverty maintenance be withdrawn later?

A spouse who has declared, freely and clearly, during the divorce that they will not seek poverty maintenance, and who later seeks poverty maintenance for the first time on the basis of the same divorce, faces a serious legal obstacle. A waiver is different from simply not claiming the next instalment or postponing collection of an existing receivable. The scope of the declaration should be determined by reading the protocol, the hearing record and the judgment together. [1, 2, 5]

The Court of Cassation's decision on the first request

In a decision of the Court of Cassation 3rd Civil Chamber (Yargıtay 3. Hukuk Dairesi), dated 26 February 2015, E.2015/1220, K.2015/3087, a woman had stated during an uncontested divorce that she would not seek poverty maintenance. Later, when child maintenance was increased, she also requested poverty maintenance for herself. The Chamber decided that this request should be rejected because of her free-will waiver. [2]

The review of that appeal concerned poverty maintenance established in the woman's favour. It is not correct to extend that result to the whole future of child maintenance. Two types of maintenance in the same file do not show that they are subject to the same waiver rules.

Is a waiver the same as reserving a claim?

No. Expressly giving up a right, not making a claim within that case, and accepting that a specific receivable has been paid are separate declarations. A phrase such as "I do not want it for now" cannot be treated, once taken out of context, as a safe way of preserving a right. In an uncontested divorce, the financial consequences must be made clear; a deliberately vague sentence may later increase the risk of litigation.

A claim that consent was defective is different from an ordinary change of mind. Article 311 of the Code of Civil Procedure (HMK) provides for seeking annulment of a waiver where there is a defect of intent. The legal nature, the evidence and the applicable time limits of a claim of pressure, deception or error are examined separately. The statement "I regretted it later" alone does not produce this result. [5]

What happens if the protocol states that no increase will be requested in future?

A request for an increase to alimony already established, on the basis of changed circumstances, is different from fully giving up the right to poverty maintenance during the divorce. Article 176 of the Turkish Civil Code allows alimony paid as periodic income (irat) to be increased or reduced where financial circumstances change or fairness requires it. Article 331 on child maintenance is also important. [1]

In its decision of 15 April 2026, E.2026/2058, K.2026/4169, the Court of Cassation 2nd Civil Chamber (Yargıtay 2. Hukuk Dairesi) did not accept that a statement that no future increase action will be brought is an absolute bar to assessing existing poverty and child maintenance in light of changed circumstances. The decision also emphasises that related disputes should be considered together. This decision does not answer the same question as the 2015 decision on waiving a first claim for poverty maintenance. [3]

Subject in the protocolLegal assessmentGeneralisation to avoid
Waiver of the first right to poverty maintenanceClarity, free will and the judgment are examinedSaying it can always be requested again
Recording that existing alimony will not be increasedChanged circumstances and the relevant type of alimony are assessedSaying it closes every future case completely
Waiver of the child's future maintenanceThe child's right to care and welfare are protectedAssuming the parents' agreement binds the entire future
Payment or release of a specific accrued instalmentThe period, the beneficiary and the scope of the declaration are examinedTreating it as the same as the future alimony right

What follows if no maintenance is requested for the child?

The child's future right to care and education cannot be entirely removed by a parental declaration such as "we have no claims against each other". The child's growth, changes in school needs or differences in financial circumstances may require a new assessment. A statement by the parent who obtains custody that they will bear all expenses during the divorce does not mean that the other parent's statutory duty of support has been permanently extinguished. [1, 3]

This approach also does not mean that all existing protocol provisions are unimportant. Payments already made, an arrangement built on a transfer of property, the parties' financial means and the child's current needs are assessed together. The same need should not be collected twice under different names.

It should also not be assumed that when the child comes of age, the former child maintenance provision automatically becomes education maintenance for an adult child. The need for care after majority, and the person who would claim it, are assessed separately. If the protocol contains an undertaking to fund education beyond majority, the scope and legal nature of that undertaking must be examined specifically. [1]

How should the payment and annual increase clause be written clearly?

An enforceable alimony provision identifies the payer and the beneficiary, and states the amount, the currency, the date of the first payment and the regular payment day. When the bank account changes, how notice is given is also important in practice. It should not be assumed that the alimony debt ends when account details change.

The measure and period of the annual increase

A phrase such as "it rises every year with inflation" may not show which index applies, and for which period. The Consumer Price Index (TÜFE) and the Domestic Producer Price Index (Yİ-ÜFE) are different indicators, and monthly change, annual change and change measured against twelve-month averages do not produce the same rate. The indicator chosen, the date of the first increase, the subsequent increase period and the calculation method should be specified.

There is no single annual increase rate that the law makes mandatory for all alimony. Where the court judgment sets an increase, practice follows that provision. The absence of an increase in the judgment does not mean that a person may unilaterally add any index to the debt; if the conditions exist, an increase claim is assessed. [1] For a detailed assessment, the article Interest and Annual Increase Calculation in Alimony can be consulted.

Before copying a sample clause

The table below shows which fields should be decided, rather than providing a contract text. An amount or rate should not be filled in without knowing the concrete financial situation. In particular, the date of the first increase should not be confused with the start date of the alimony.

Field to be regulatedQuestion to be clarified
BeneficiaryFor the spouse, or for which child?
StartFinality, another clear date, or how it relates to interim payment?
Amount and currencyAre the monthly debt and the method of payment specific?
Payment dayWhich day of each month, and into which account?
IncreaseWhich index, which period's data, from which date?
School and healthWhich expenses are included in the monthly amount?
Direct paymentWhich debt will a direct payment to the school be linked to?

How should private school and additional expenses be handled in the protocol?

The sentence "pays all education and health expenses" may look comprehensive at first glance. However, if details such as school type, transport, courses, clothing, discounts, insurance coverage and extraordinary treatment are not clear, they may increase later disputes. It is important that the expense can be identified and linked to the monthly alimony.

In a decision of the Court of Cassation 2nd Civil Chamber, dated 4 March 2026, E.2025/10739, K.2026/2494, it was explained that education costs regulated separately in a protocol should be included in child maintenance, so that a single obligation is created. Instead of an unclear additional debt, the expenses should be clarified and a workable alimony amount determined. The decision also contains a majority opinion and a dissent on increasing the alimony amount through amendment of the claim (ıslah). However, the objection concerning the start of the annual increase, which was not examined because the decision was quashed, should not be presented as if the chamber had resolved that question on the merits. [4]

When the protocol is prepared, consider which document will support the payments and how the expense will be notified to the other party. The child's urgent needs and optional high-cost choices may not be regulated in the same way. A clear text should reduce disputes without creating an unlimited waiver contrary to the child's best interests.

By what routes can the protocol later be changed?

After a final judgment, a material change in financial circumstances may become the subject of a claim to increase, reduce or terminate the relevant type of alimony. Article 176 applies to poverty maintenance and Article 331 to child maintenance. The binding force of the earlier agreement remains important; a mere new preference, or discomfort with an expected burden, is not in every case a reason for change. [1]

Are monthly alimony and a lump-sum payment under the same regime?

Article 176 regulates whether poverty maintenance is paid as a lump sum or, depending on the circumstances, as periodic income. The provision on changing alimony paid as periodic income is not a general authority that reopens every completed lump-sum payment in the same way. Lump-sum payments, transfers of property and mixed arrangements require a separate examination of the nature of the transaction and of any other legal grounds. [1]

Is it enough for the parties to sign a new text between themselves?

Making a new agreement does not automatically remove the existing judgment. Particularly where child rights and the amendment of an enforceable judgment are involved, its effect on the court decision should be assessed. A debtor should not stop payments simply by relying on a private text, and a creditor should not create a second calculation that disregards earlier payments.

Where there is uncertainty between the protocol and the judgment, the conditions for a clarification (tavzih) may be examined; where there is a clerical error (maddi hata), the conditions for a correction. These routes cannot be used to add a new alimony obligation that was never decided on the merits. A procedure before the judgment becomes final, through the appeal route, is different from a change action after finality. [5]

Does the Constitutional Court's 2026 decision end the protocol immediately?

The Constitutional Court (Anayasa Mahkemesi) decision of 4 June 2026, E.2025/156, K.2026/131, concerns the words "indefinitely" in Article 175(1) of the Turkish Civil Code. The decision was published in the Official Gazette (Resmî Gazete) on 30 September 2026, and the annulment was postponed for nine months. The date of entry into force is 30 June 2027. Therefore, it cannot be said that as of 13 October 2026 all existing alimony has been abolished, or that protocol payments may be stopped immediately. Nor does the decision automatically set a five-year period for everyone. On the date of publication or of a new protocol, entry into force and any possible new regulations must be reviewed again. [6]

Conclusion

The strength of the alimony clause in an uncontested divorce depends more on clarity, and on correctly separating the types of right, than on its length. A waiver of spousal alimony, child maintenance and a statement that no future increase will be sought each lead to different results. When the amount, period, increase measure and school costs are regulated together, the protocol is easier to implement; changed circumstances can be assessed separately in the appropriate lawsuit.

Frequently Asked Questions

After saying I do not want alimony, can poverty maintenance still be requested?

If the waiver was made freely and with clear intent, a later first claim for poverty maintenance based on the same divorce may be rejected. The protocol, the hearing record and the judgment should be read together. [2]

Is a waiver of child maintenance valid?

A child's future right to care cannot be entirely removed by the parents. A claim may be assessed on the basis of current needs and financial means. [1, 3]

If the protocol says no increase lawsuit will be filed, can no case be brought?

That statement is not an absolute bar in every case. The existing alimony, changed circumstances and the relevant type of right are assessed; it is not the same subject as a waiver of the first claim for poverty maintenance. [3]

Does alimony increase automatically each year in line with the CPI?

There is no common CPI rule that applies automatically to all alimony. The increase provision in the judgment is the basis; if there is none, a suitable increase claim is assessed. [1]

Can the judge change the alimony the parties have agreed to?

In an uncontested divorce, the judge must find the arrangement appropriate and may propose the necessary changes. Acceptance of the proposal by the parties is important for an uncontested divorce. [1]

Can a private school payment be written separately from monthly alimony?

The payment arrangement should be clear, determinable and in the child's interest. Duplication with existing alimony must be avoided, and current case law should be taken into account. [4]

Is the divorce complete once the protocol is signed?

No. The court process, the hearing of the parties in person, the judge's finding that the arrangement is appropriate and the judgment becoming final are also required. [1]

Can a lump-sum alimony payment later be increased like monthly alimony?

The rule on changing alimony paid as periodic income does not apply automatically to every lump-sum payment. The nature of the transaction and any other legal grounds must be examined. [1]

Can a waiver given under pressure never be disputed?

Article 311 of the Code of Civil Procedure (HMK) allows a request for annulment of a waiver where there is a defect of intent. Its conditions, proof and time limits require a specific assessment. [5]

Does a new private agreement cancel the earlier court decision?

It should not be assumed that it cancels the decision automatically. The effect of the new agreement on the existing judgment and on the child's rights should be clarified where necessary through a judicial change. [1, 5]
